WHO WE ARE: We are a non-profit organization of motor-

cycle enthusiasts from all walks of life. We

lobby and educate the government and the

general public to promote motorcycling in

a safe and positive image. We endeavor to

enlist the cooperation and participation of

all organizations and individuals that

share a similar interest in preserving our

American tradition of FREEDOM. We pro-

mote motorcycle safety, training, and po-

litical awareness. We ARE NOT A CLUB

OR GANG. We fund our work through toy

runs, poker runs, campouts, and other mo-

torcycle activities. We are your neighbors

and friends who work, pay taxes, and get

involved with our community. We serve

and support our country and believe in

freedom. We use all legal means to protect

our rights without infringing on the rights

of others.

OUR GOALS To become a powerful and viable politi-

cal force in legislative matters concern-

ing the motorcyclist. To promote the safe riding habits with-

out infringing on individual freedoms. To motivate the bikers to write letters

to their legislators before, during, and

after the legislative session. To furnish our members with a news-

letter to keep all bikers informed in

regards to upcoming legislation.

Hi Everyone!

Well, here we are entering October. This month is going

to be very busy with Avon Park and Hallowheels going on all in

one weekend. The weekend following these 2 events is our first

Bike Night in Cape Coral and the State Meeting in Hillsborough

County. I know I sound like a broken record here, but we could

really use the volunteers. Remember that this is an organization

and everyone who can get involved only makes our group better.

Our goal is to spread the word about Motorcycle safety and these

events are a great way to market ourselves and also to get some

new blood to sign up. I'm only asking for the help when you can,

it's always nice to get a break when doing these booths, plus get-

ting to know new people is always fun.

Also, I want to point out that this is the time of season

that the snow birds do start making their way south. With this, I

just want to say: Watch out for the extra traffic, be on guard, and

be safe out there.

Hello Southwest Chapter!

We attended the local Meeting of the Minds September meet-

ing on 9/13 and came away very optimistic about support for our Veter-

ans Christmas Ride. If you’re unaware, the MOM is an informal gather-

ing of local riding clubs where we talk about each others’ events and try

to eliminate schedule conflicts. We also ask the other groups to support

our events. Strong support was voiced for our Veterans Ride. Now, we

need to show similar support to the other groups. We will keep you in-

formed as to when the Lost Riders, LAMAs, Rebel Riders, Women in

the Wind, etc. are having their events and we need to show up and con-

tribute to their efforts.

The MOM is held at Fritz’s Motorcycle Garage in Fort Myers.

Fritz is generously donating time and space at his shop for our meetings.

For those who haven’t heard- Fritz offers the use of motorcycle lifts,

tools, parts washers, etc. to those who want to work on their own bikes

but lack the facilities. Check out Fritz’s Facebook page for more info.

Just an observation-I’ve noticed that many of our members

don’t wear Chapter T-shirts or sweatshirts when they’re out and about.

Now, anyone who knows me will tell you that I am the LAST person

who would suggest that we wear “uniforms”- however, I would ask that

each of us at least consider wearing our gear. It’s a way to make our

presence known and to possibly start a conversation with someone who

may then join the Chapter. We have a limited number of Chapter shirts

so if you need one, please see me.

Finally- please come to our next meeting Sunday, October 18

and try to bring a visitor. We need to be constantly recruiting members

to keep this organization alive and vital.

Dear Fellow Abate Members… The TRUE Believer!

We have known someone for many years of whom we would say is a true

Biker. All the years we’ve known him, he’s never owned a cage. All of his

transportation to anywhere was by motorcycle. Even, his grocery shopping… All his

social activities revolved around motorcycling. Not only does he ride motorcycles-

but, he believes in them. Motorcycles are a part of his “fabric.” It’s the make-up of his lifestyle.

There are others that we have known, throughout the years who acknowledge motorcycles. They know

motorcycles exist, and even have ridden them, from time-to-time. Are they true believers, when it comes to mo-

torcycles? It may not be for us to judge. We do not know their hearts as we would probably know the motorcy-

cling heart of the biker mentioned in the beginning of this letter.

Many of us know who God is. We have somewhat acknowledged Him, to a certain extent. Some of us

know who Jesus is. Most believe that He existed or still exists. Some of us believe that He is not only the Son

of God but, He is God that became a man for a time upon the earth. However, the question is, “Do you actually

believe in Him? Do you believe in Him who sent Jesus?” The basis of the Christian faith is that God became

man in the person of Jesus Christ.

Jesus said, “Most assuredly, I say to you, he who hears My word and believes in Him who sent Me has ever-

lasting life, and shall not come into judgment, but has passed from death into life.” John 5:24 NKJV

And, the scriptures near the beginning of the Chapter says, “But as many as received Him, to them He gave the

right to become children of God, to those who believe in His name.” John 1:12 NKJV “Therefore, if anyone is in Christ, he is a new creation; old things have passed away; behold, all things have

become new.” 2 Corinthians 5:17 NKJV

It is not enough just to know who God and who his son Jesus is. It is not enough to know about Him.

We must believe IN Jesus and what He did on the cross for us. We must believe IN His father. We must re-

ceive Him. The start is the new birth that Jesus describes. “There was a man of the Pharisees named Nicode-

mus, a ruler of the Jews. This man came to Jesus by night and said to Him, “Rabbi, we know that You are a

teacher come from God; for no one can do these signs that You do unless God is with him.” Jesus answered and

said to him, “Most assuredly, I say to you, unless one is born again, he cannot see the kingdom of God.” Nico-

demus said to Him, “How can a man be born when he is old? Can he enter a second time into his mother’s

womb and be born?” Jesus answered, “Most assuredly, I say to you, unless one is born of water and the Spirit,

he cannot enter the kingdom of God. That which is born of the flesh is flesh, and that which is born of the Spirit

is spirit. Do not marvel that I said to you, ‘You must be born again.’ The wind blows where it wishes, and you

hear the sound of it, but cannot tell where it comes from and where it goes. So is everyone who is born of the

Spirit.” John 3:1-9 NKJV

Just allow Him to enter fully into your life with the following prayer: "Dear God, the God of Abra-

ham, Isaac, and Jacob, the God of Jesus, my heavenly Father, I confess that I am a sinner and have been

separated from You. I ask forgiveness of my sins. I repent and accept this gift of repentance. I confess

with my mouth that your son Jesus is my savior and died for me. I believe in my heart that You raised

Him from the dead. I receive Jesus into my heart and ask Him to become the center of my life. I ask, in

the Name of Jesus. Amen." If you prayed that prayer for the first time and you really have accepted Him into your heart, please let us know.

PRESIDENT’S REPORT: SHAYNE HANLEY 1. Avon Park is coming up. The secretary and I will be

going Saturday. We will be doing the Bike Show

from 10am to 2pm. The best three bikes will get a

trophy. We could really use some help so if you aren’t

doing anything come help out.

2. Hallowheels is the same weekend as Avon Park. We

are setting up a booth there on Saturday. Come and

help out. Moe and Heidi are setting up. Laurie and I

will be joining them when we get back from Avon

Park. We will be taking down our booth. It’s going to

be a long day for us so any help will be appreciated.

3. The following weekend is our first Bike Night in

Cape Coral. That is always great fun.

4. Also that same weekend is the State Meeting up at

Hillsborough County. It is their 35th annual fund-

raiser, Spook ‘N Scoots. Anyone interested can check

out the flier in the newsletter.

5. I can’t stress it enough that we need volunteers. The

same few people can’t do it all. Even if all you can do

is an hour or two, it would help a lot.

6. I want to announce that Charlie will be taking over as

Membership Trustee. Thank you Charlie.

7. I want to also say that we have 3 new members.

Marge, Charlie’s better half has just become a mem-

ber and will be helping Charlie with membership.

Everyone welcome Michele who is also a new mem-

ber and she has agreed to do Products. Our last new

member is Tara and she will be taking over the news-

letter. Our board is finally complete.

8. One more thing, Carl has agreed to be one of our per-

manent delegates along with Victor.

VICE PRESIDENT: MOE MOSER

1. Everything about our Veterans Ride should be final-

ized by our next meeting. Outside groups have given

us a lot of support which helps. I’m still reaching out

to organizations for contributions. Anyone who

knows somebody affiliated with the VFW let me

know. Also I’m thinking of joining HOGS so maybe

we can get some help from them as well.

2. SPIVEY law firm has generously contributed to our

Ride. I’m still waiting on some of the others that I’ve

contacted.

PROPOSAL WOULD ALLOW OPEN CARRYING OF FIREARMS

A House Republican on Monday filed a proposal that would allow people with concealed-weapons li-

censes to openly carry firearms. The bill (HB 163), filed by Rep. Matt Gaetz, R-Fort Walton Beach,

will be considered by lawmakers during the 2016 legislative session, which starts in January. The bill

also would make other changes in gun-related laws, including giving direction for judges to use "strict

scrutiny" when reviewing laws dealing with the right to bear arms or self defense. "The right to bear

arms is a fundamental and individual right that exists in any place that a person has the right to be, sub-

ject only to exceptionally and narrowly tailored restrictions that employ the least possible restriction on

the right in order to achieve a compelling government interest,'' the bill says.

GAETZ JOINS SON IN FILING OPEN-CARRY BILL

Sen. Don Gaetz on Wednesday joined his son, Rep. Matt Gaetz, in seeking to allow people with con-

cealed-weapons licenses to openly carry firearms. The elder Gaetz, R-Niceville, filed a bill (SB 300)

that is identical to a measure (HB 163), filed Monday by Matt Gaetz, R-Fort Walton Beach. The pro-

posals, which will be considered during the 2016 legislative session, also would make other gun-related

changes, including giving direction for judges to use "strict scrutiny" when reviewing laws dealing with

the right to bear arms or self defense.

CAMPUS GUN BILLS ADVANCE IN HOUSE AND SENATE

A proposal that would allow people with concealed-weapons licenses to pack heat while hitting the

books on college and university campuses notched it first two successes Wednesday. The legislation

(SB 68 and HB 4001), which won support from criminal-justice committees in the House and Senate,

is widely opposed by academic leaders. Proponents argued that the proposal would make colleges

safer, while opponents questioned the need to allow weapons into an already stress-filled atmosphere.

"I don't feel like your constitutional rights should stop at a line in the sand," said Senate Criminal Jus-

tice Chairman Greg Evers, a Baker Republican who is sponsoring the Senate bill. The Senate commit-

tee voted 3-2 along party lines to support the proposal, which is filed for the 2016 legislative session.

The Senate proposal must still get through three additional committees, including the Judiciary Com-

mittee, which did not take up the issue during the 2015 legislative session. The House Criminal Justice

Subcommittee voted 8-5, with Rep. Ray Pilon, R-Sarasota, joining four Democrats in opposing the

measure. Pilon, saying he is a National Rifle Association member, noted a desire for additional training

for campus law enforcement. House bill sponsor Greg Steube, R-Sarasota, indicated the measure could

make schools safer since concealed-carry permit holders must be 21. Also, he said current law prohibits

military veterans who have returned to school on the "GI Bill" from carrying weapons. "Most of those

people have more training than our law-enforcement officers do," Steube said. "I was an infantry offi-

cer. We trained for years on how to execute different scenarios, and so have all these different military

members."

BURDEN OF PROOF WOULD SHIFT IN SELF-DEFENSE CASES

A key supporter of Florida's controversial "stand your ground" law filed a bill Tuesday that would shift

a burden of proof to the state in cases in which people argue they used force in self-defense. The bill

(HB 169), filed by Rep. Dennis Baxley, R-Ocala, came about two months after the Florida Supreme

Court ruled that people who use "stand your ground" defenses have the burden of showing they should

be shielded from prosecution. In such cases, pre-trial evidentiary hearings are held to determine

whether defendants are immune from prosecution under the law. But Baxley's bill, which will be con-

sidered during the 2016 legislative session, would place the burden of proof on prosecutors in the evi-

dentiary hearings. The bill said it is "intended to correct misinterpretations of legislative intent made by

the courts" and would apply retroactively to pending cases. "The Legislature finds that imposing the

burden of proof on a person who uses or threatens to use defensive force as permitted by general law at

a pretrial evidentiary hearing substantially curtails the benefit of the immunity from trial provided by

this section (of law),'' the bill says. "The Legislature intends to make it explicit that the state shall bear

the burden of proof in establishing beyond a reasonable doubt whether a defendant is entitled to immu-

nity at a pretrial evidentiary hearing in order to disprove a prima facie claim of self-defense immunity.

The Legislature has never intended that a person who acts in defense of self, others, or property be de-

nied immunity and subjected to trial when that person would be entitled to acquittal at trial."

On Sept. 10, two motorcycling-related amendments were approved by the Subcommittee on Research

and Technology of the U.S. House Science, Space and Technology Committee as part of the “Surface

Transportation Research and Development Act of 2015.” The bill – as part of the broader surface trans-

portation authorization bill – prioritizes research and development activities within the U.S. Dept. of

Transportation. It passed by voice vote.

The two motorcycle-related amendments were introduced by U.S. Rep. Randy Hultgren on behalf of

U.S. Rep. Jim Sensenbrenner.

Amendment No. 036 would require the DOT engage the National Academy of Sciences to conduct a

study on the most effective means of preventing motorcycle crashes. While this study is being con-

ducted, no federal funding would be provided to states to conduct motorcycle-only checkpoints. The

Senate version does include language to prohibit federal funding for motorcycle-only checkpoints. The

federal dollars from this program should be used exclusively for proven highway safety strategies and

not sporadic, discriminatory checkpoints.

The amendment was approved by voice vote.

Amendment No. 037 would prohibit the DOT from lobbying for any activity on any pending federal,

state or local legislation. This is commonly known as the “NHTSA Lobby Ban.” Sensenbrenner in-

cluded similar language in the Surface Transportation Research and Development Act of 1997.

It was approved by a vote of 7 – 6.

The American Motorcyclist Association applauds these amendments and will work to include them in

the next highway bill. On Sept. 17, the U.S. House Transportation and Infrastructure Committee is ten-

tatively scheduled to consider the highway bill.
