POLITICS IN ISLAM

• Discussing broadly some of the rulings with regards to the “sultaan” or “wali ul-amr” (those placed in authority over us)

• This is a very complex and complicated subject

• Much controversy and one of the most intensively discussed matter today

• Requires extensive study and deep understanding

POLITICS IN ISLAM

• Much blood shed as a result of this area:

• We ask Allah for guidance

– The two great fitnahs

– What we see happening in Syria, Egypt, Somalia, Iraq etc

LEGITIMACY OF AN AUTHORITY

O you who believe! obey Allah and obey the Messenger and those in authority from among you; then if you quarrel about anything, refer it to Allah

and the Messenger, if you believe in Allah and the last day; this is better and very good in the end

Surah An Nisa 4:59

OBEDIENCE TO THOSE IN AUTHORITY

`Ubadah bin As-Samit said,

"We gave our pledge to Allah's Messenger to hear and obey (our leaders), while active and otherwise, in

times of ease and times of difficulty, even if we were deprived of our due shares, and to not dispute this

matter (leadership) with its rightful people.”

(Two Sahihs)

Even if a slave was appointed over you, and he rules you with Allah's Book, then listen to him

and obey him

(Muslim)

`Umm Al-Husayn said that she heard the Messenger of Allah giving a speech during the Farewell Hajj, in which he said;

There will be leaders who will not be led by my guidance and who will not adopt my ways? There will

be among them men who will have the hearts of devils in the bodies of human beings. I said: What

should I do. Messenger of Allah, if I (happen) to live in that time? He replied: You will listen to the Amir and carry out his orders; even if your back is flogged and your wealth is snatched, you should listen and obey.

OBEYING A KAAFIR GOVERNMENT ?

Sayyiduna Abd Allah ibn Umar (Allah be pleased with him) narrates that the Messenger of Allah (Allah bless him & give him

peace) said:

“It is necessary upon a Muslim to listen to and obey the ruler, as long as one is not ordered to carry out a sin. If he is commanded to commit a sin, then there is

no adherence and obedience.”

HADITH

(Sahih al-Bukhari, no. 2796 & Sunan Tirmidhi)

Not all non-muslim governments are the

same

NOT ALL NON -MUSLIM GOVERNMENTS ARE THE SAME

Where muslims are at war or oppressed by the government.

No freedom to practice Islam.

In such place hijrah may be required

Category 1 : Dar harb/khawf

NOT ALL NON -MUSLIM GOVERNMENTS ARE THE SAME

Muslims are secure and free to practice their religion.

No hostility between Muslims and non-muslims, eg Muslims in Abyssinia

South Africa falls into this category

HIJRAH OR REMAIN IN A NON -MUSLIM LAND?

Maalik ibn al-Huwayrith (may Allaah be pleased with him) and his companions came to the Prophet SAWS (peace and blessings of Allaah be upon him) and stayed with him, when the Prophet SAWS (peace and blessings of Allaah be upon him) noticed that they were missing their families, he told

them to go back and to teach their people, and he said:

“Go back to your families and teach them.”

Narrated by al-Bukhaari, 6008; Muslim, 674.

HIJRAH OR REMAIN IN A NON -MUSLIM LAND?

If he is able to practice his religion openly, and he is safe from fitnah (tribulation, temptation), and he can call people to Allaah and teach the Muslims about their religion, then he may stay

and not migrate, because his staying there serves an interest

kaafiroon.”

“. . . And whoever does not judge by that which Allaah has revealed, such are the

zaalimoon (polytheists and wrongdoers)”

Surah Al Ma’idah 5:44-45

“. . . And whoever does not judge by what Allaah has revealed (then) such (people) are the faasiqoon (rebellious or disobedient).”

Surah Al Ma’idah 5:47

• The are those who have not only said it is haram to vote but that it is an act of major Kufr as one supports and approves of laws which contradict the law of Allah

• Halaal to kill the rulers an all those who support them or voted for them

• This is the path of the Khawrij of old and modern day “terrorism”

The Islamic Fiqh Council in its nineteenth session, which was held in the headquarters of the Muslim

World League in Makkah al-Mukarramah between 22 and 27 Shawwaal 1428 AH (3 to 8 November 2007 CE)

has examined the issue of

“Participation of Muslims in elections with non-Muslims in non-Muslim countries.”

This is one of the topics on which discussion was deferred in the sixteenth conference which was held

between 21 and 26 Shawwaal 1422 AH in order that it may be examined more thoroughly.

“it is permissible for a Muslim who enjoys the rights of citizenship in a non-Muslim country to take part in elections and the like because it is

more likely that his participation will bring benefits such as presenting a true picture of

Islam, defending Muslim issues in that country, supporting the rights of religious and other

minorities, strengthening their role in circles of influence, and cooperating with reasonable, fair-minded people on a basis of truth and

justice”

CAN WE VOTE?

Some scholars like Sh Salih ibn Uthaymeen (R) said it is compulsory for Muslims to

participate in politics and vote if they can bring about positive change

Choosing the ruler

FRAME WORK TO SELECTING A MUSLIM RULER

1. Must be a Muslim

2. Must be of moral character not faasiq

3. Most qualified and able

Determined in the light of weighing up the pros and cons and choosing

the lesser of two evils

• Intend thereby to serve the interests of the Muslims and ward off evil and harm from them

• Participation will have positive effects that will benefit the Muslims in that country

• Voice concerns of the Muslim and encourage the authority to make the correct choices

• Must be an informed decision

• We need to ask which party will be best for us as muslims in RSA, as well as Muslims all over the world

• Who is most able to fulfill the obligations of leadership

• Muslim party vs greater impact ?

• Which parties policies are best?

• Who has the competency and will?

• If no suitable alternative then our duty to come up with suitable alternatives next 5 years.

Beyond the elections

BEYOND MAY THE 8TH

Give shukr for the blessings we live in

"and if you count the Blessings of Allah, never will you be able to count them.”

[Surah Ibrahim, 14: 34]

1. GIVE SHUKR FOR THE BLESSINGS WE LIVE IN

• We live in peace and security

• In spite of our tiny minority we have total freedom to practice our deen as we choose

• We have rights which very few in the world enjoy

• With this great ni’mah comes a great responsibility

• Allah can easily change this favorable state of affairs if we are ungrateful

• From our sports clubs, masjid committees, ulema bodies we as Muslims fail to unite and provide solutions to our problems

• We should be the best and most able leaders

• In times of Sahaba non-muslims supported them

We need to fix our own house

• All of us guilty of this at times

• At times we only concerned with our own well being in spite of the greater good

• Mindset of the companions was to prefer the well being of their brothers over themselves.

A mindset of demanding your rights

• We demand things around us to change but we refuse to change

• If we all look to our duties, everyone’s rights will be fulfilled

• We are all leaders and all responsible

• We are one body: what harms one of us must trouble all of us.

• The plight of society should concern us

• Changing that which is in our power to change

• At the very least do not be part of the problem
