INTRODUCTIONInaccordancewiththeHigherEducationActof1965,§485(f)(20U.S.C.1092(f)),the"JeanneCleryDisclosureofCampusSecurityPolicyandCampusCrimeStatisticsAct”thisdocumentprovidesthepoliciesandproceduresthatSinteGleskaUniversityhasimplementedforthesafetyandsecurityofthecampuscommunity.Thisdisclosureisacombinedannualcampuscrimeawareness/securityreportforthepastthreeyears.
OnOctober1stofeveryyear,eachmemberofthecampuscommunityissentanoticeofavailabilityofinstitutionalinformation,reports,andfinancialaidbyelectronicmailalongwithabriefdescriptionofitscontentsasfollows:
“IncompliancewithCodeofFederalRegulations668.46andthefederalHigherEducationActof1965,asamendedbytheHigherEducationOpportunityActof2008(HEOA),SinteGleskaUniversityisprovidingtherequireddisclosuresforthe2015-2016academicyear.ThefollowingreportscontainbothgeneralandspecificinformationrelatedtoattendingSinteGleskaUniversityaswellasdrug/alcoholpolicies,campuscrimeandViolenceAgainstWomenReauthorizationActof2013(VAWA)whichcontainstatisticsforthepreviousthreeyearsconcerningreportedcrimesthatoccurredon-campus;incertainoff-campusbuildingsorpropertyownedorcontrolledbySinteGleskaUniversity;andonpublicpropertywithin,orimmediatelyadjacenttoandaccessiblefrom,thecampus.Additionally,thereportscontaininstitutionalpoliciesconcerningcampussecurity,suchaspoliciesconcerningsexualassault,drug/alcoholviolations,conduct,andothermatters.

SinteGleskaUniversityencouragesaccurateandpromptreportingofallcrimestocampussecurityandappropriatepoliceagencies,whenthevictimofsuchcrimeelectsorisunabletomakesuchareport.Victims,witnessesoranyothermembersofthecampuscommunityhaveadutytoreportincidentsimmediatelytocampussecurityofficers.
CriminalactionsorotheremergenciesshouldbeimmediatelyreportedtoRosebudSiouxTribalPolicebydialing605-747-2266orreportinginpersontoalawenforcementofficer.AllcriminalreportsareinvestigatedbytheRosebudSiouxTribalPoliceDepartment.Thereisnovoluntaryconfidentialreportingsystemavailable,andnoreportisheldinconfidence.ToreportcriminalactionsoremergenciestotheappropriateSinteGleskaUniversityadministratorcall605856-8100,ortheSGUSecurityat605856-8122forassistanceorinformation.
EmployeesshallcontacttheirimmediateornearestrankingsupervisortoreportanyincidentandwillalsoreportanycriminalactiontoRosebudSiouxTribalPolice.EmployeesmustalsonotifyLeoMcCauley605319-1700orSGUSecurity605-856-8122ofthesituation;describetheperson(s)involvedandthelocation.LeoMcCauleyorSGUSecuritywillnotifytheappropriateindividualswithrespecttonecessaryaction.
LogskeptpursuanttothesepoliciesarekeptforpublicinspectioninLeoMcCauley’soffice(SGUAdministrationBuilding;AntelopeLakeCampus;Mission,SouthDakota).Aprintedcopywillbemadeavailableuponoralorwrittenrequest.Newinformationaboutanentryintoalogthatbecomesavailabletosecurityshallberecordedinthelognotlaterthantwo(2)businessdaysaftertheinformationbecomesavailable.Ifthereisclearandconvincingevidencethatthereleaseofsuchinformationwouldjeopardizeanongoingcriminalinvestigationorthesafetyofanindividual,causea

suspecttofleeorevadedetection,orresultinthedestructionofevidence,suchinformationmaybewithhelduntilthatdamageisnolongerlikelytooccurfromthereleaseofsuchinformation.
TIMELYWARNINGSIntheeventthatasituationarises,eitheronoroffcampus,that,inthejudgmentoflawenforcementorthecollege,constitutesanongoingorcontinuingthreatand/oraCleryActreportablecrime,acampuswide“timelywarning”willbeissued.Suchreportsshallbeprovidedtostudentsandemployeesinamannerthatistimely,thatwithholdsthenamesofvictimsasconfidential,andthatwillaidinthepreventionofsimilaroccurrences.Thewarningwillbeissuedthroughthestudentinformationsystemtostudents,faculty,andstaffemails;“knockandtalk”notificationtoclassrooms.
Printedcopiesofthenoticemayalsobepostedatconspicuouslocationsthroughthecampusasthesituationpermits.ThisprocesswillbeusedfornotifyingthecampuscommunityofbothCleryActreportablecrimesandotheremergenciesasdescribedinthe“EmergencyNotification”sectionofthisAnnualReport.
SAFETYOFANDACCESSTOCAMPUSFACILITIESDuringbusinesshours,theUniversitywillbeopentostudents,parents,employees,andthegeneralpublic.Duringnon-businesshours,thecampusisclosedandaccessisrestrictedtoallUniversityfacilities.Inthecaseofperiodsofextendedclosing,theUniversitywilladmitonlythosewithpriorapprovaltoallfacilities.Somefacilitiesmayhaveindividualhours,whichmayvaryatdifferenttimesoftheyear.Inthesecases,thefacilitieswillbesecuredaccordingtoschedulesdevelopedbythedepartmentresponsibleforthefacility.Emergenciesmaynecessitatechangesoralterationstoanypostedschedules.Allrearandsideaccessdoorsleadingtothecampusareclosedandlockedduringeveninghoursstartingat5:00pm.Whentheschoolclosesforthenight,SinteGleskaUniversitySecuritywillinspectthebuildingtoseethatitisemptyandthensetthealarmsandthenlockdownthecampus.Otherindividualspresentoninstitutionalpropertyatanytimewithouttheexpresspermissionoftheappropriateadministratorshallbeviewedastrespassingandmayassuchbesubjecttoafineand/orarrest.
CONFIDENTIALREPORTINGOFCRIMESTOCOUNSELORSSinteGleskaUniversitydoeshavementalhealthcounselorsonitscampus.Therearenoproceduresthatencourageprofessionalmentalhealthcounselorstoreferpersonstheyarecounselingtoreportcrimesonavoluntary,confidentialbasisforinclusionintheannualcrimestatistics,aseachreportisinvestigatedbylawenforcementofficials.Additionally,SinteGleskaUniversitydoesnothaveproceduresthatencouragepastoralcounselorsandprofessionalcounselorstoinformpersonstheyarecounselingaboutproceduresforconfidentialcrimereporting.

ENFORCEMENTAUTHORITYOFROSEBUDSIOUXTRIBALPOLICEANDCAMPUSPERSONNELSinteGleskaUniversityhastheirowncampussecuritydepartmenttoenforcecampuspolicies,protectUniversitystudents,staff,facultyandfacilities,andinformlawenforcementofcriminalviolations.SinteGleskaUniversitysecurityofficersarenotarmedandnotcertified.Theyarevestedwiththeauthoritytoinvestigate,detainandapprehendpersonsbelievedtobeinviolationofthelaw.SinteGleskaUniversitysecurityofficershavenoauthoritytoarresthowever;securitymayapprehendanddetainindividualswhileconductinganinvestigationofanyviolationoncampus.
SinteGleskaUniversityutilizestheRosebudSiouxTribalPoliceasitslawenforcementagency,whichhasauthoritytoarrestperpetratorsandinvestigatecriminalactivity.EachTribalpoliceofficerisdulyswornandcommissionedinaccordancewiththeRosebudSiouxTribeLawEnforcementCodeandpeaceofficertrainingstandardsandmayenforceTheRosebudSiouxTribeLawandOrderCode,criminallawsandtherulesandregulationsofSinteGleskaUniversity.Additionally,allTribalpoliceofficershavepowersofarrestoverRosebudSiouxtribalmembersthroughoutallofToddCountyandanyotherplaceinwhichtheCollegeowns,leases,controlsorotherwiseholdsproperty.
SinteGleskaUniversityadministratorsarerequiredintheeventofacrimeoremergencytocallRosebudSiouxTribePolice605747-2266.TheCitizensArrestLawwillbeinvokedonlyasalastresort,andafterallotherpossibilitieshavebeenexplored.
INFORMATIONANDPROGRAMSATSINTEGLESKAUNIVERSITYSinteGleskaUniversitydoessponsorcrimeawarenessandpreventioninformationthroughouttheacademicyearwithscheduledeventstostudentsandstaff.Studentsareencouragedtoexercisepropercareinseeingtotheirpersonalsafetyandthesafetyofothers.Thefollowingaresomecrimepreventiontipsforeachindividualtoprotectthemselvesandothers:
• Donotleavepersonalpropertyinclassrooms.
• Reporttoyourinstructororsecurity,anysuspiciouspersons.
• Alwaystrytowalkingroupsoutsidetheschoolpremises.
• Ifyouarewaitingforaride,waitwithinsightofotherpeople.
• Employees(staffandfaculty)willcloseandlockalldoors,windowsandblindsandturnofflightswhenleavingaroom.
• BeawareofthesecurityoftheSinteGleskaUniversityCampusbyreadingthe“CrimeAwarenessandCampusSecurityReport”whichisavailableuponrequesttostudents,employees(staffandfaculty)andprospectivestudentsandispublishedontheSGUWebsiteat:sintegleska.edu

• Informationregardinganycrimescommittedonthecampusorleased/attachedproperties(parkinglot)willbeavailableandpostedinaconspicuousplacewithintwo(2)businessdaysafterthereportingofthecrimeandbeavailableforsixty(60)businessdaysduringnormalbusinesshours,unlessthedisclosureisprohibitedbylaw,wouldjeopardizetheconfidentialityofthevictimoranongoingcriminalinvestigation,thesafetyofanindividual,causeasuspecttoflee/evadedetection,orresultinthedestructionofevidence.Oncethereasonforthelackofdisclosureisnolongerinforce,theinstitutionmustdisclosetheinformation.Ifthereisarequestforinformationthatisolderthansixty60days,thatinformationmustbemadeavailablewithintwo(2)businessdaysoftherequest.IncidentsshallberecordedwithLeoMcCauleyat605319-1700.
TofileanincidentreportcontactSinteGleskaUniversityCampusSecurityat605856-8122orLeoMcCauleyat605319-1700.Incidentreportswillincludethedate,time,location,incidentreported,anddispositionofincidentandthenameofthepersonwhotookthereport.IncidentReportformsareavailablefromtheSecurityDepartmentontheMainCampus,thePersonnelOfficeandfromLeoMcCauleyontheAntelopeLakeCampusormaybeobtainedandcompletedontheSGUWebsiteat:sintegleska.edu.
Exceptwheredisclosureofsuchinformationisprohibitedbylaworsuchdisclosurewouldjeopardizetheconfidentialityofthevictim,reportsareopentopublicinspectionwithintwobusinessdaysoftheinitialreportbeingmadetoacampussecurityauthority.
STUDENTORGANIZATIONSOFF-CAMPUSSinteGleskaUniversitydoesnothavestudentorganizationswithoff-campuslocations,thereforethereisnopolicyregardingmonitoringandrecordingthroughlocalpolicecriminalactivityinwhichstudentsengagedatoff-campuslocationsofstudentorganizations.
ALCOHOLANDDRUGPOLICYSinteGleskaUniversitydoesnotpermitalcoholoncampus,andnoalcoholispermittedonthegroundsoratanyactivitysponsoredorrecognizedbytheUniversity.Alllawsrelatedtothesale,possession,andconsumptionofalcoholicbeveragesbyminorsarestrictlyenforcedandaggressivelyprosecutedforthesafetyofourstudents.SinteGleskaUniversityisadrug-freecampus,andnoillegalsubstancesarepermittedonthegroundsoratanyactivitysponsoredorrecognizedbytheUniversity.Alllawsrelatedtothesale,possession,andconsumptionofillegaldrugsorassociatedparaphernaliaarestrictlyenforcedandaggressivelyprosecutedforthesafetyofourstudents.
DRUGORALCOHOL-ABUSEEDUCATIONPROGRAMSSinteGleskaUniversityHumanServicesDepartmenthostsalcoholabuseeducationprogramsatthebeginningofeachsemestertoinformstudentsaboutthedangersrelatedtoalcoholconsumption/abuse.Additional,thereareongoingworkshopseveryweekduringtheschoolyearwhichmayincludealcoholand/ordrugabuseeducationandpreventionstrategiessponsoredbytheSGUAlliedHealthDepartment.

DefinitionofaControlledSubstance:AnydrugsinconflictwiththeIndianReligiousFreedomActareexemptfromthispolicy.Adrugwhichhasbeendeclaredbyfederalorstatelawtobeillegalforsaleoruse,butmaybedispensedunderaphysician'sprescriptionisexemptifthestudent/staffhasavalidprescription.Thebasisforcontrolandregulationisthedangerofaddiction,abuse,physicalandmentalharm(includingdeath),thetraffickingbyillegalmeans,andthedangersfromactionsofthosewhohaveusedthesubstances.www.legaldictionary.com

SEXUALMISCONDUCT:DISCRIMINATION,HARASSMENT,ANDASSAULTPOLICYIntroduction
SinteGleskaUniversityseekstocreateapositiveeducationalenvironmentonandoffcampusthroughouracademicprograms,services,activities,policiesandproceduresaimedatprovidingprotectionagainstsexualmisconductwithjurisdictionoverTitleIXcomplaints.TothatendSinteGleskaUniversitycondemnsdiscriminationinitseducationprogramsandactivitiesbasedonsexorgender,sexualharassment,sexualassault,sexualorientationdiscrimination,discriminationbasedongenderidentityorexpression,andsexualmisconduct.SinteGleskaUniversitywilladdressanysexualmisconductasdefinedthroughoutthispolicycommittedbyamemberoftheUniversitycommunitywhichmayincludeSinteGleskaUniversitysanctionsaswellascivilandcriminalpenaltiestopreventdomesticviolence,datingviolence,sexualassault,andstalking.

Thispolicyisapplicabletoallstudents,administrators,faculty,staffandvisitorsofSinteGleskaUniversitybothmaleandfemalestudentsregardlessofnationalorigin,immigrationstatus,orcitizenshipstatusareprotectedfromsexualharassmentengagedinbyaschool’semployees,otherstudents,orthirdparties.Thirdparties,whoarenotthemselvesemployeesorstudentsattheschool(e.g.,avisitingspeakerormembersofavisitingathleticteam)areincludedinthispolicyandSinteGleskaUniversitywilltakenecessaryactiontopreventfurtherinstancesandremediatethesituation.

IndividualsareresponsibleforimmediatelyreportinganyknowledgeorinformationconcerningmisconducttotheSinteGleskaUniversityTitleIXofficialidentifiedinthispolicywhichcoversunwelcomeconductofasexualorgender-basednature,whethercommittedon-campus,oroff-campuswhereSinteGleskaUniversityhascontrolovertheperpetratororthecontextoftheharassment.
TheUniversityencouragesvictimsofsexualviolencetotalktosomebodyaboutwhathappenedsovictimscangetthesupporttheyneed,andsotheUniversitycanrespondappropriately.DifferentemployeeswithinthescopeofSinteGleskaUniversity’sresourceshavedifferentabilitiestomaintainavictim’sconfidentiality.
• Somearerequiredtomaintainnearcompleteconfidentiality;talkingtothemissometimescalleda“privilegedcommunication.”
• Otheremployeesmaytalktoavictiminconfidence,andgenerallyonlyreporttotheUniversitythatanincidentoccurredwithoutrevealinganypersonallyidentifyinginformation.DisclosurestotheseemployeeswillnottriggeraUniversityinvestigationintoanincidentagainstthevictim’swishes.
• Thirdly,someemployeesarerequiredtoreportallthedetailsofanincident(includingtheidentitiesofboththevictimandallegedperpetrator)totheTitleIXcoordinator.Areporttotheseemployees(called“responsibleemployees”)constitutesareporttotheUniversity–andgenerallyobligatestheUniversitytoinvestigatetheincidentandtakeappropriatestepstoaddressthesituation.PrivilegedandConfidentialCommunications
• ProfessionalandPastoralCounselors.Professional,licensedcounselorsandpastoralcounselorswhoprovidemental-healthcounselingtomembersoftheschoolcommunity(andincludingthosewhoactinthatroleunderthesupervisionofalicensedcounselor)arenotrequiredtoreportanyinformationaboutanincidenttotheTitleIXcoordinatorwithoutavictim’spermission.
• Non-professionalCounselorsandAdvocates.Individualswhoworkorvolunteeratasexualassaultcenter,victimadvocacyoffice,women’scenter,healthcenterincludingfrontdeskstaffandstudents,cangenerallytalktoavictimwithoutrevealinganypersonallyidentifyinginformationaboutanincidenttotheUniversity.

Retaliationisanyattempttopenalizeortakeanadverseemployment,educationalorinstitutionalbenefitaction,includingbutnotlimitedtomakingthreats,intimidation,reprisalsorotheradverseaction,againstapersonbecauseofparticipationinacomplaintortheinvestigationofdiscrimination,sexualharassmentorsexualmisconduct.
D. SexualViolencereferstophysicalsexualactsperpetratedagainstaperson’swillorwhereapersonisincapableofgivingconsent(e.g.,duetothestudent’sageoruseofdrugsoralcohol,orbecauseanintellectualorotherdisabilitypreventsthestudentfromhavingthecapacitytogiveconsent).Anumberofdifferentactsfallintothecategoryofsexualviolence,includingrape,sexualassault,sexualbattery,sexualabuse,andsexualcoercion.Sexualviolencecanbecarriedoutbyschoolemployees,otherstudents,orthirdparties.

E. Datingviolenceisviolencebetweenindividualsinthefollowingcircumstances:Thepartyisorhasbeeninasocialrelationshipofaromanticorintimatenaturewiththevictim;and

G. SexualExploitationoccurswhenapersontakesnon-consensual,unjustorabusivesexualadvantageofanotherforhis/herownadvantageorbenefit,ortobenefitoradvantageanyoneotherthantheonebeingexploited,andthatbehaviormaynototherwiseconstituteoneoftheothersexualmisconductoffenses.
H. Discrimination,definedasactionsthatdepriveothermembersofthecommunityofeducationaloremploymentaccess,benefitsoropportunitiesonthebasisofgender;
I. Gender-basedintimidation,definedasimpliedthreatsoractsthatcauseanunreasonablefearofharminanother;

A. Consentisinformed,knowingandvoluntary.Consentisactive,notpassive.Silence,inandofitself,cannotbeinterpretedasconsent.Consentcanbegivenbywordsoractions,aslongasthosewordsoractionscreatemutuallyunderstandablepermissionregardingtheconditionsofsexualactivity.
B. Consenttooneformofsexualactivitycannotimplyconsenttootherformsofsexualactivity.
C. Previousrelationshipsorconsentdoesnotimplyconsenttofuturesexualacts.
D. Consentcannotbeprocuredbyuseofphysicalforce,compellingthreats,intimidatingbehavior,orcoercion.Coercionisunreasonablepressureforsexualactivity.
E. Inordertogiveeffectiveconsent,onemustbeoflegalageandhavethecapacitytoconsent.Incapacitymayresultfrommentaldisability,intellectualdisability,unconsciousness/sleep,age,oruseofalcohol,drugs,medication,and/orothersubstances.

Note,thatindicationsofconsentareirrelevantiftheinitiatorknowsorshouldreasonablyhaveknownoftheincapacityoftheotherperson.Examplesofwhenapersonshouldknowtheotherisincapacitatedinclude,butarenotlimitedto:
• Theamountofalcohol,medicationordrugsconsumed,or• Imbalanceorstumbling,or
• slurredspeech,or

ReportingtothePolice.SinteGleskaUniversitystronglyencouragesyoutoreportsexualviolenceandanyothercriminaloffensestothepolice.Thisdoesnotcommityoutoprosecutebutwillallowthegatheringofinformationandevidence.Theinformationandevidencepreservefutureoptionsregardingcriminalprosecution,Universitydisciplinaryactionsand/orcivilactionsagainsttheperpetrator.

WhenthecomplaintdoesnotinvolvesexualviolenceasdefinedintheSexualMisconductPolicy.Becausetheoutcomesofvoluntaryresolutionconversationsaremutuallydevelopedandagreeduponbypartiesinvolved,anappealoftheprocessanditsresultisnotpermitted.Ifthepartiesareunabletoagreeonavoluntaryresolution,thematterwillbereferredbytheTitleIXOfficertotheVicePresidentofStudentServices.TheproceduresoutlinedintheStudentHandbookNostatementsmadeduringthevoluntaryresolutionprocessmaybeintroducedbeforetheHearing.Confidentialitymaystillbemaintainedthroughoutthemediationprocess.

OutcomeWhenitisdeterminedthatsexualmisconductismorelikelythannottohaveoccurred,theoutcomecanincludeseparationfromSinteGleskaUniversity.Thevictimhastherighttobeinformedoftheoutcome.Bothpartieswillbenotifiedwithinfivebusinessdaysafterthehearingatthesametimethroughadesigneddeliverysystem.
Studentshavetherighttoappealthedecisionreachedthroughthehearingproceedingswithintwodaysafterreceivingthehearingdetermination.PossiblesanctionsSinteGleskaUniversitymayimposefollowingtheresultsofanyinstitutionaldisciplinaryproceedingsforanallegationofdatingviolence,domesticviolence,sexualassault,orstalking.SinteGleskaUniversitywillimplementprotectivemeasuresfollowinganallegationofdatingviolence,domesticviolence,sexualassault,orstalking;
AppealProcedures:Anappealisnotanewhearing,butisareviewoftherecordoftheoriginalhearing.Itservesasaproceduralsafeguardforthestudent.TheburdenofproofshiftsfromtheUniversitytothe

• Robbery:Thetaking,orattemptingtotake,anythingofvalueunderconfrontationalcircumstancesfromthecontrol,custody,orcareofanotherperson,orpersons,byforceorthreatofforceorviolenceand/orputtingthevictiminfearofimmediateharm.
• AggravatedAssault:Anunlawfulattackbyonepersonuponanotherwhereintheoffenderusesaweaponordisplaysitinathreateningmanner,orthevictimsuffersobvioussevereoraggravatedbodilyinjuryinvolvingapparentbrokenbones,lossofteeth,possibleinternalinjury,severelaceration,orlossofconsciousness.
• Burglary:Theunlawfulentryintoabuildingorotherstructurewithintenttocommitafelonyortheft.• Arson:Tounlawfullyandintentionallydamage,orattempttodamage,anyrealorpersonalpropertybyfireorincendiarydevice.
• MotorVehicleTheft:Thetakingorattemptingtotakeamotorvehicle.Amotorvehicleisaself-propelledvehiclethatrunsonthesurfaceoflandandnotonrails.
• Hatecrime:acrimereportedtolocalpoliceagenciesortoacampussecurityauthoritythatmanifestsevidencethatthevictimwasintentionallyselectedbecauseoftheperpetrator’sbiasagainstthevictim.
• LiquorLawViolations:Theviolationsoflawsorordinancesprohibitingthemanufacture,sale,purchase,transportation,possession,oruseofalcoholicbeverages.
• DrugLawViolations:Theunlawfulcultivation,manufacture,distribution,sale,purchase,use,possession,transportation,importationofanycontrolleddrugornarcoticsubstance.
• WeaponLawViolations:Theviolationoflawsorordinancesprohibitingthemanufacture,sale,purchase,possession,transportation,concealment,oruseoffirearms,cuttinginstruments,explosives,incendiarydevicesorotherdeadlyweapons.
• HierarchyRule:therequirementintheFBI’sUCRprogramthat,forpurposesofreportingcrimesinthatsystem,whenmorethanonecriminaloffenseiscommittedduringasingleincident,onlythemostseriousoffenseistobeincludedintheinstitution’sCleryActstatistics.
Larceny-theft,simpleassault,intimidation,anddestruction,damage,orvandalismofproperty,andofothercrimesinvolvingbodilyinjurytoanyperson,inwhichthevictimisintentionallyselectedbecauseoftheactualorperceivedrace,gender,religion,nationalorigin,sexualorientation,genderidentity,ethnicity,ordisabilityofthevictimthatarereportedtocampussecurityauthoritiesorlocalpoliceagencies,whichdatashallbecollectedandreportedaccordingtocategoryofprejudice(HateCrime).

Domesticviolence,datingviolence,andstalkingincidentsthatwerereportedtocampussecurityauthoritiesorlocalpoliceagencies,whichdatashallbecollectedandreportedaccordingtocategoryofViolenceAgainstWomenAct.SinteGleskaUniversitywillrecordreportsofstalkingbycomplainantreports.Stalkingactivitiesinmorethanonecalendaryearorinmorethanonelocationwithintheinstitution’sCleryAct-reportableareaswillberecordedasseparateoccurrences.
TheChiefofsecuritywilldeterminewhentoreportanewcrimeofstalkinginvolvingthesamevictimandperpetrator.SituationsinwhichanindividualisavictimofasexoffenseandamurderduringthesameincidentwillbeincludedinbothcategoriesunderSinteGleskaUniversitypolicy.
Forpurposesofreportingthestatisticswiththecrimesdescribedbelow,aninstitutionofhighereducationshalldistinguish,bymeansofseparatecategories,anycriminaloffensesthatoccur.
1. Theterms"datingviolence","domesticviolence",and"stalking"havethemeaninggivensuchtermsinsection40002(a)oftheViolenceAgainstWomenActof1994(42U.S.C.13925(a)).
2. Theterm‘‘campus’’means:(I)anybuildingorpropertyownedorcontrolledbyaninstitutionofhighereducationwithinthesamereasonablycontiguousgeographicareaoftheinstitutionandusedbytheinstitutionindirectsupportof,orinamannerrelatedto,theinstitution’seducationalpurposes,includingresidencehalls;and(II)propertywithinthesamereasonablycontiguousgeographicareaoftheinstitutionthatisownedbytheinstitutionbutcontrolledbyanotherperson,isusedbystudents,andsupportsinstitutionalpurposes(suchasafoodorotherretailvendor).
3. Theterm‘‘non-campusbuildingorproperty’’means:(I)anybuildingorpropertyownedorcontrolledbyastudentorganizationrecognizedbytheinstitution;and(II)anybuildingorproperty(otherthanabranchcampus)ownedorcontrolledbyaninstitutionofhighereducationthatisusedindirectsupportof,orinrelationto,theinstitution’seducationalpurposes,isusedbystudents,andisnotwithinthesamereasonablycontiguousgeographicareaoftheinstitution.
4. Theterm‘‘publicproperty’’meansallpublicpropertythatiswithinthesamereasonablycontiguousgeographicareaoftheinstitution,suchasasidewalk,astreet,otherthoroughfare,orparkingfacility,andisadjacenttoafacilityownedorcontrolledbytheinstitutionifthefacilityisusedbytheinstitutionindirectsupportof,orinamannerrelatedtotheinstitution’seducationalpurposes.
5. Theterm“sexualassault”meansanoffenseclassifiedasaforcibleornon-forciblesexoffenseundertheuniformcrimereportingsystemoftheFederalBureauofInvestigation.
