Agricultureisincreasinglycri*cizedforitsimpactontheenvironment.Thiscourseexaminesthetensionsbetweentheneedtoproducefoodandfiberefficientlyandconcernforsustainabilityandtheprotec*onofnaturalresources.OpentoJDCandidateswithpermission.Studyofinsolvencylaw,withpar*cularemphasisonfederalbankruptcylawStudyoftherulesofevidenceunderwhichtrialsareconducted;themethodsbywhichitemsofevidenceandadmiQedorexcluded;relevancy,realevidence,tes*monialproof,andhearsayanditsexcep*ons.Thecourseexploresthebusiness-humanrightsnexuswithapar*cularfocusonthefoodandagriculturalsectorandoncasestudiesfromaroundtheworld.Thecourseintroducesstudentstothelinkagesbetweenbusinessandhumanrightsfromavarietyof(legal,regulatory,andpolicy)perspec*ves.

Thisclasswilldealwiththeclashofaparent’srighttoraisetheirchildrenastheyseefitandtheState’sdutytoprotectthewelfareofchildren.Theclasswillconsistoftradi*onalsessionsontheapplicablelawfollowedbysimula*onsapplyingthatlawtoscenariosbasedonover45yearsofprac*cingfamilylaw.Studentswillbeaskedtopreparepleadings,conductnego*a*ons,andrepresentparents,thestateandchildrenatsimulatedhearingsStudyoftheprocessofcivilli*ga*onfrompreliminarymaQerssuchascourtselec*onandjurisdic*on,throughjoinderofpar*esanddiscoverytechniques,todisposi*onofcasesandfinalityofjudgments.SomeaQemptismadetocovertheantecedentsofmodernprocedure;whereappropriate,sugges*onsforreformaredevelopedinclassdiscussion.EmphasisisontheFederalRulesofCivilProcedure.

StudentsenrolledintheHumanTraffickingClinicwilldevelopandcompleteadvocacyprojectsfortheirclients–agenciesandorganiza*onsseekingtoconfrontandpreventhumantrafficking.Studentswillmeetwiththeirorganiza*onalclientsatleasttwiceduringthesemester.ThroughtheirworkintheHumanTraffickingClinic,studentswilldevelophighlytransferablelawyeringskills,includingfactinves*ga*onandlegalresearch,wriQenandoralcommunica*on,andcri*calandstrategicthinking.IntheHumanTraffickingClinic’sweeklyseminar,studentswillexaminethescopeofthehumantraffickingproblem.Theywilllearnaboutfederalandstatean*-traffickinglaws,includinghowtobringcivilclaimsandseekimmigra*onrelieffortraffickingsurvivors.Studentswillalsostudyvariedan*-traffickingstrategiesandassesstheireffec*veness.Inaddi*ontointerviewingandcounselingskills,studentswillalsolearnhowtoworkeffec*velywithsurvivorsoftraumaandacrossculturalandlanguagedifference.

Dealswiththeques*onsofwhatconductsocietypunishesthroughacriminalcodeandoftheappropriatepunishmentfortheforbiddenconduct.Inthiscontextthecourseincludesananalysisofthetheoriesofpunishment,thedefini*onsofvariouscrimes,thedefensesavailabletoonechargedwithcriminalconduct,andthelimita*onsplacedbytheCons*tu*onongovernmentalpowerinthecriminallawarea.Throughoutthecourse,specialemphasisisplacedonthelegislature'sroleincrea*ngstatutesalongsidethejudiciary'scorrespondingroleininterpre*ngthosestatutes.

Concernedwiththelegalstepsthroughwhichacriminalproceedingpasses,commencingwiththeini*alinves*ga*onofacrimeandconcludingwiththereleaseofthedefendant.Doesnotdealexclusivelywithcons*tu*onalproblems,althoughconsiderable*meisspentonthem.RecentSupremeCourtdecisionsreceivespecialemphasis.CriminalProceduredoesnotdealwithcriminaltac*csorwithmanyofthespecialproblemsrela*ngtotheintroduc*onofevidenceatthetrial.

ThiscoursewillintroducestudentstokeyissuesinU.S.sentencinglaw,theory,andpolicy.Thecoursewillcoverthebasicelementsofthefederalsentencingguidelinesandtheirprac*calapplica*on,aswellasthestatutorysentencingfactorsthatalljudgesarerequiredtoconsider.Sentencingstrategiesandbestprac*ceswillbeaddressed,aswillthetopicsofcapitalcases,sentencingop*ons,thepresentenceinves*ga*onprocess,aggrava*ngandmi*ga*ngsentencingfactors,theuseofexpertwitnesses,preservingissuesforappeal,andmandatoryminimumsentences.
