SAFETY AND COMPLIANCE At ABC Supply, we work hard to be leaders in safety and compliance. With that goal in mind, we want to share with you how we are addressing a recently enacted OSHA regulation regarding boom and crane safety. As required by OSHA regulation, 29 CFR § 1926.1427, all of ABC’s operators of cranes, knuckle booms and drywall booms are certified by the National Commission for the Certification of Crane Operators (“NCCCO”). Although this certification is not required in all situations (e.g., ground drops), it is required for most types of enhanced deliveries. For example, when a crane operator is slinging or offloading a suspended load held in place for unloading, OSHA has ruled that the NCCCO certification is required. ABC believes that we would best serve our customers and associates by requiring the NCCCO certification of all of our operators of these types of equipment. OSHA’s multi-employer citation doctrine provides that citations and penalties can be issued to both the delivery service and to customers who offload the suspended load, if the crane, knuckle boom or drywall boom operator is not NCCCO certified as required by the OSHA regulation. Potential OSHA citation penalties are currently up to $12,934 for each serious violation, and $129,336 for delivery services and customers that willfully fail to comply with the OSHA certification regulation.
