REASONS FOR NOT PROVIDING INFORMATION An exemption applies, subject to the public interest test Section 29(1)(a) – formulation or development of government policy An exemption under section 29(1)(a) of FOISA (formulation or development of government policy) applies to some of the information requested because it relates to the development of the Scottish Government’s policy on the minimum income guarantee. This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is a public interest in disclosing information regarding the minimum income guarantee as part of open, transparent and accountable government, and to inform public debate. However, there is a greater public interest in high quality policy and decision-making, and in the properly considered implementation and development of policies and decisions. This means that Ministers and officials need to be able to consider all available options and to debate those rigorously, to fully understand their possible implications. Their candour in doing so will be affected by their assessment of whether the discussions on the development of the minimum income guarantee will be disclosed in the near future, when it may undermine or constrain the Government’s view on that policy while it is still under discussion and development. It is essential for officials to be able to communicate, often in confidence, with external stakeholders on a range of issues, including some discussions undertaken within the Minimum Income Guarantee Steering Group. Disclosing the content of these communications, particularly without the consent of the stakeholder, is likely to undermine their trust in the Scottish Government and will substantially inhibit communications on this type of issue in the future. These stakeholders will be reluctant to provide their views fully and frankly if they believe that their views are likely to be made public, particularly while these discussions are still ongoing and decisions have not yet been taken. This would significantly harm the Government’s ability to carry out many aspects of its work, and could adversely affect its ability to gather all of the evidence it needs to make fully informed decisions. This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. Premature disclosure is likely to undermine the full and frank discussion of issues between the Scottish Government and these stakeholders, which in turn will undermine the quality of the policy-making process, which would not be in the public interest. An exemption applies Section 38(1)(b) – applicant has asked for personal data of a third party An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, i.e. the names and contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

to seek initial ideas against key questions, using online vehicles, and then move to a discussion and consultation on the ideas that had been generated, and this further engagement, including with the public and experts by experience would be overseen by the Steering Group.

4. Officials have considered a number of options in discussion with colleagues across the Scottish Government, including those from Digital Engagement, Open Government and Communities Analytical Division (CAD). This included:

- roundtable stakeholder events and workshops; - a formal consultation; - the Scottish Government’s Dialogue Platform; and - a questionnaire distributed by mail shot.

5. Having considered the pros and cons of each of these, officials favour use of the Scottish Government’s Dialogue Platform1 to invite views on how a MIG should be delivered in Scotland.

What were the key actions taken to complete this commitment?

On 17 August the Cabinet Secretary for Social Justice, Housing and Local Government co-chaired the first meeting of a new Minimum Income Guarantee (MIG) steering group that will drive forward this ambitious policy, with the aim of reducing poverty, inequality and

insecurity. The other co-chair is Russell Gunson, Director of IPPR Scotland. The steering group includes both expert and cross-party representation

and will consider how a Minimum Income Guarantee should be designed and delivered in Scotland. On the same day, the Scottish Government also launched a discussion

space on the Dialogue Platform to gather views and ideas on how establishing a Minimum Income Guarantee should work for Scotland.

Statistics or key facts:

The Minimum Income Guarantee Steering Group held its first meeting on 17 August, and will run for at least two years.

The primary purpose of the MIG Steering Group is to define a MIG for Scotland and to identify and prioritise action for further development and testing. The Group will operate during the course of this

Parliament to support the delivery of a MIG within current devolved powers. The MIG Steering Group may also consider what further powers may be sought in order to build on that action in the longer term.

The Dialogue Platform soliciting views for on a Minimum Income Guarantee will close on 16 September, and its findings will be used by the Steering Group to inform their future work.

Are there any

issues/sensitivities?

The policy of a MIG is often confused with that of a Universal Basic

If this point is raised during the debate, it should be noted that a MIG is a new policy, distinct from a basic income, and that no costings have been attached to the policy yet and that the Steering Group will consider this in due course.

ISSUE 17 August: As part of a first 100 days commitment The Scottish Government

established a new steering group, including expert and cross-party representation, to commence work on a Minimum Income Guarantee for Scotland.

Scotland is taking its first steps towards establishing a Minimum Income

Guarantee, helping ensure everyone in Scotland can live healthy, financially secure and fulfilling lives

On 17 August Social Justice Secretary Shona Robison co-chaired the first meeting of a new steering group that will drive forward this ambitious policy, with the aim of reducing poverty, inequality and insecurity. The other co-chair is Russell Gunson,

Director of IPPR Scotland.

The steering group includes both expert and cross-party representation and will consider how a Minimum Income Guarantee should be designed and delivered in Scotland.

The Scottish Government has also launched a discussion space on the Dialogue Platform to gather views and ideas on how establishing a Minimum Income Guarantee should work for Scotland.
