Why Drug Test Students?

• To insure the health and safety of all students who represent the district in any competitive after school extracurricular activities.

• To serve as a deterrent to the use of illegal drugs and the abuse of prescription and over the counter medications or alcohol among the student body.

• To offer students a credible means to resist peer pressure as it relates to the use of illegal drugs and/or alcohol.

• To provide a ready resource for support and assistance to any student who may be using illegal drugs, performance enhancing drugs, prescription drugs and/or alcohol.

Who Will Be Tested? The MISD program allows schools to

randomly test studentsfor illegal drugs if they are:

• involved in extra-curricular activities.

• Parents can voluntarily ask for their children to be included in the group.

• If students in extra-curricular shows “reasonable suspicion” of drug use.

Random Selection Procedures

• A computer generated, random selection process will be utilized to select a number of students per campus per week for testing.

• In a true random program each student has an equal chance of being selected each time testing is done.

• Certified male and female collectors will conduct random testing at each campus.

• Selected students will be notified the day of the test.

What Can Students Expect?

Drug testing is a four step process:

1. Collection

2. Screening

3. Confirmation

4. Review

Collection Procedure

• A school staff member will escort students chosen from the testing pool to the designated collection area at each campus.

• Students will be required to show their MISD student ID to positively identify themselves.

• The collector will complete the chain-of-custody form, which keeps track of where the specimen has been and who has handled it throughout the process.

• Blue dye has been placed in the toilets and water to the sink has been shut off or the faucets taped shut to lesson the risk of adulteration.

• Students will be given a collection kit, asked to go into the stall, close the door, and provide 30ml. of urine.

• Upon completion, the temperature is read and recorded on the chain-of-custody form. Student is asked to initial security seal and place the specimen in tamper proof bag.

INABILITY TO TEST

If the student is unable to give a sample, the student will be allowed to drink water or other beverages. The student will return to class but will be called back to the collection site within a 2 hour time period so that he/she can give a sample.

If the student returns and is unable to give a sample, the student will receive the same consequences and interventions as if he/she had tested positive.

Refusal to Test

A refusal on the part of any student to participate in a scheduled or random

drug test shall be considered ashaving tested positive.

Medical Review Officer

If the confirmation test also comes up positive, a qualified “MedicalReview Officer (MRO)” should determine whether the positive readingwas caused by illicit drugs or by proper prescription medication.

A MRO is a licensed physician who is also an expert in drug and alcoholtesting.

It is the job of the MRO to ensure the integrity of the drug test.

If a test is positive, the MRO will confer with a parent or guardian to determine if there is a medical explanation.

If the MRO determines that the positive test was not the result of illegaldrug use, the test is reported as a negative.

Utilizing an MRO helps protect the rights of the students and can have the added benefit of strengthening the school’s position if the test results areever challenged.

Test Results

• Student privacy will be protected in accordance with all applicable laws.

• Test results will be kept confidential and provided only to parents/guardians, and designated administrators.

• For those who worry about the “Big Brother” dimension of drug testing it is worth pointingout that test results are generally required by law to remain confidential, and in no case are turned over to the police.

Retest of Sample

Students who test positive may request asecond test. A request for a retest must be

made to the MRO within 48 hours from the time the parent or guardian was first notified ofthe positive test result. The specimen must be

sent to a second test laboratory on the certified SAMHSA approved list. The

parent/guardian will bear any expense for the requested test.

Frequently Asked Questions

What if the student is unable to provide at least 30ml. of urine?The collector will discard the specimen and the student will be given accessTo bottled water or other fluids to help produce enough urine within the allottedTime frame set by MISD.

Will over-the-counter medications cause a positive result?Over-the-counter medications if taken as instructed on the packaging will not appearas a positive test result.

What if the student is at a party and marijuana is being smoked? Will the smokeresult in a positive drug test?

Limited exposure to marijuana smoke does not cause a positive test result.

What if the student is on her menstrual cycle…will that affect her test result?No.

Will eating poppy seeds cause a positive test result?No.

Will drug testing drive students out of extracurricular programs, or deter themfrom joining in the first place?A well-implemented testing program is created to assist students, not to punish them.It provides students with a “built-in” excuse to refuse drugs and offers them an opportunity for counseling and drug treatment.

Consequences of Positive Testing

Consequences of a FIRST confirmed positive test result shall be as follows:1. Required conference with parent/guardian and student.

2. Referral to an MISD approved counseling program for an assessment which will determine the length of counseling needed for the student. The student must fulfill the recommendation of the counseling program, and provide documentation confirming completion of the program.

3. A minimum 20 school day suspension from all extracurricular activities.

4. Prior to rejoining any extracurricular activity, a negative test result must be obtained at thestudent’s/parent’s/guardian’s expense.

5. After regaining eligibility retesting once a month for 4 months.

Consequences of a SECOND confirmed positive test result shall be as follows:1. Required conference with parent/guardian and student.

2. Referral to an MISD approved counseling program for an assessment which will determine the length of counseling needed for the student. The student must fulfill the recommendation of the counseling program, and provide documentation confirming completion of the program.

3. A minimum 60 school day suspension from all extracurricular activities.

4. Prior to rejoining any extracurricular activity, a negative test result must be obtained at thestudent’s/parent’s/guardian’s expense.

5. After regaining eligibility retesting once a month for 4 months.

Consequences of a THIRD confirmed positive test result shall be as follows:1. Required conference with parent/guardian and student.2. Referral to an MISD approved counseling program for an assessment which will determine the length of counseling needed for the student. The student must fulfill the recommendation of the counseling program, and provide documentation confirming completion of the program. 3. A minimum of one full calendar year suspension from all extracurricular activities.4. Prior to rejoining any extracurricular activity, a negative test result must be obtained at the student’s/parent’s/guardian’s expense. 5. After regaining eligibility retesting once a month for one year.

Consequences of a FOURTH confirmed positive test result shall be as follows:1. Required conference with parent/guardian and student.2. The student will be removed from all participation in extracurricular activities for as long as the student is enrolled in McKinney ISD.

A positive test that results in a suspension in excess of the number of days remaining in the school year will continue on the first day of school of the next school year.

Refusal to participate in a drug test after signing the consent form shall count as a positive test.
