Highlights

2014 Quarter 1 Quarterly Environmental Enforcement Summary

The Quarterly Environmental Enforcement Summary for Q1 2014 outlines 8 Orders, 44 Administrative Sanctions, 295 Tickets, and 12 Court Convictions for a combined total of over $72,000 in penalties.

Notable Highlights this Quarter: Ministry staff undertook inspections of agricultural operations across the province, resulting in the issuance of three Pollution Prevention Orders under the Agricultural Waste Control Regulation of the Environmental Management Act. The orders required that measures be taken to better manage run-off from manure stored on agricultural properties, in order to protect the environment. A lakeside resort adjacent to Bowron Lake Provincial Park was issued a Park Act Order for constructing a wooden retaining wall that encroached beyond the park boundary. Becker’s Lodge was ordered to remove the structure, as well as the backfill material, and return the lakefront area to its natural state. In keeping with the ministry’s efforts to improve the payment of environmental fines, one individual must pay his fines in full before having his seized hunting rifle returned. In 2013, the Ministry of Environment partnered with the Ministry of Justice and the Ministry of Finance to reign in outstanding court fines. So far, over $106,000 has been collected, with more coming through payment plans and Canada Revenue agency seizures. A Pollution Prevention Order was issued to amend an existing order, updating deadlines to submit information outlining requirements for the closure of a landfill site which include: (1) hiring a QP; (2) updating legal surveys; and (3) submitting a final closure report. If the work is not completed, the party is required to provide proof of financial security in the amount of $9 million.

A Pollution Prevention Order was issued after inspection of the property determined that contamination from manure and several deceased cattle could be present in a creek. The order requires the property owner to retain a QP to supervise the removal of the manure and deceased cattle from the creek and the remediation of the site.

A Pollution Prevention Order was issued after inspection of the property determined that agricultural waste was being discharged into a watercourse in violation of the Code of Agricultural Practice for Waste Management. The order requires the property owner to retain a QP to create a surface drainage control plan, undertaking the following steps; (1) intercept manure contaminated runoff and prevent further escape from the property boundary; (2) scrape and pile manure for storage a minimumof 30m from any watercourse or source of water used for domestic purposes; and (3) construct bermsor other works if necessary to preven the escape of agricultural waste beyond the property boundary.

A Pollution Prevention Order was issued after inspection of the property determined that effluent containing agriculutral waste was discharging from the property to a watercourse. Contamination of neighbouring shallow drinking wells suspected and high E. Coli discharge rates confirmed through sitesamples. The order requires the property owner to retain a QP to create a surface drainage control plan, undertaking the following steps: (1) intercept manure contaminated runoff and prevent further escape from the property boundary; (2) scrape and pile manure for storage a minimum of 30m from any watercourse or source of water used for domestic purposes; and (3) construct berms or other works if necessary to prevent the escape of agricultural waste beyond the property boundary.

A Park Act Order was issued after an unauthorized structure was discovered inside a provincially protected area. The structure consisted of a wooden retaining wall and backfill materials. The order requires the following: (1) removal of the retaining wall and all added rocks and fill within the park boundary; and (2) remediation of the lake foreshore area below the present natural boundary by returning the park to its natural state.

A Water Act Order was issued in response to unauthorized works constructed in a creek. The order requires the following: (1) take immediate measures to prevent soil from entering the watercourse; (2) submit a report written by a QP to indentify habitat losses and recommendations for remediation of losses; and (3) complete the remediation measures as directed by the ministry.

A Water Act Order was issued in response to a fisheries officer inspection that revealed unauthorized changes in a tributary to the Salmon River. The order requires that a QP be retained to prepare a new Erosion and Sediment Control Plan and an Environmental Assessment Report. The work to be conducted under this order is to prevent and manage the potential for further release of silt, sediment or sediment-laden water, or any deleterious substances into any of the streams, and maintain or restore the direction of streamflow.
