Highlights

2011 Quarter 3 Quarterly Environmental Enforcement Summary

The Quarterly Environmental Enforcement Summary for Q3 2011 outlines 6 orders 28 Administrative Sanctions, 420 Tickets, and 9 Court Convictions for a combined total of over $100,000 in penalties.

Notable Highlights this Quarter: A Port McNeil company was ordered to pay $4,000 by Victoria provincial court after pleading guilty to a charge resulting from illegally burning tires. LeMare Lake Logging Ltd. was charged under the Environmental Management Act after witnesses observed flames that reached higher than an adjacent mature forest stand. Investigators estimated that up to 300 tires were burned, including logging truck tires that are considerably larger than a standard pickup truck tire. The judge fined the company $2,000 for the infraction and ordered it to pay an additional $2,000 to the Habitat Conservation Trust Foundation for habitat restoration projects in the North Island area. In 2011, government launched a new online database making it faster and easier for British Columbians to keep track of the people, businesses and industries running afoul of B.C.’s environmental rules. In addition to the Quarterly Environmental Compliance and Enforcement Summaries, published in PDF format, the new database allows information to be searched by violator names, locations, dates or types of violation, dating back to 2006 when the Ministry of Environment began public reporting of violations. The public plays an important role in keeping our province safe, clean and beautiful. The Report All Poachers and Polluters (RAPP) program is a toll free tip-line and web-based service for reporting known or suspected violations of fisheries, wildlife, or environmental protection laws. Calling the RAPP line ensures the crime can be reported anonymously and without risk of confronting the offender. Available 24/7, RAPP is simple, safe and effective. With accurate reporting, RAPP Call Centre staff relay the information to the Conservation Officer Service. Pollution Abatement Order issued to the company following reports of sandblasting contaminants affecting the surrounding area. The Order required the company immediately cease all outdoor sandblasting operations until an emissions collection and containment plan is prepared by a Qualified Professional and approved by the Ministry.

Engineer's Order issued to cease the drilling of geotechnical wells at a site because of the potential to disturb an aquifer. Drilling was ceased until the Ministry's regional hydrogeologist received notificationof and accepted confirmation of direct supervision by a qualified well driller at the drilling site.

Engineer's Order issued after inspections determined that measures must be taken to correct unauthorized work along an unnamed stream. The Order required: (1) immediate measures to stop the entry of soil caused by the work into the stream; and, (2) preparation of a plan to restore the stream channel. If new works are pursued by the landowner, the following conditions apply: (a) the plan be prepared by a Qualified Professional and be submitted by October 15, 2011; (b) the recommendations in the plan be completed under the direction of a Qualified Professional; and, (c) a report prepared by a Qualified Professional be provided to the Ministry documenting the mitigation and restoration activities undertaken.

Engineer's Order issued after onsite inspections determined that a dam was unsafe. The Order required the following: (1) removal of the dam as per the design provided by a third party consultant; and, (2) complete all removal works by December 31, 2011.

Engineer's Order issued in response to unauthorized works constructed along the shore of Dragon Lake. The Order required the following: (1) development of a plan for restoration and re-vegetation of the disturbed shoreline; (2) removal of all introduced material along the shoreline; and, (3) all rehabilitation of the site must be conducted or supervised by a Qualified Professional experienced in lakeshore rehabilitation.

Engineer's Order issued after onsite inspections determined that diversion of water from an unnamed stream must cease. The Order required the following: (1) immediately cease the diversion of water from the unnamed stream; and, (2) prepare a plan for the removal of a metal tank and gravel access ramp from the stream.

35(1) Harmful Alteration of Fish HabitatCommunity Environmental Justice Forum: A Forum was held in Midway, B.C. in response to a July 2009 disturbance of soils and vegetation within the riparian zone of the Kettle River during a clean-up by the company. As a result of the Forum, which brought together representatives from the company and the community to identify appropriate restitution for the incident, the company made a public apology and paid $10,000 to the Granby Wilderness Society to aid in river restoration.
