2009 Quarter 3 Quarterly Environmental Enforcement Summary

The Quarterly Environmental Enforcement Summary for Q3 2009 outlines 3 orders 53 Administrative Sanctions, 796 Tickets, and 8 Court Convictions and for a combined total of over $146,000 in penalties.

Notable Highlights this Quarter: Ministry of Environment compliance staff issued 52 violation tickets under the Wildfire Act to address contraventions during summer campfire bans, and 48 violation tickets under the Liquor Control Act for possessing open liquor in a vehicle. These are important public safety issues related to the protection of our natural resources and road safety in the back country. These types of infractions are encountered during the ordinary course of duty for Conservation Officers and exemplify an efficient use of government law enforcement resources working in the public interest. The Ministry of Environment held two administrative hearings to deal with allegations of misconduct by Guide Outfitting operations. Under section 61 of the Wildlife Act, a Regional Manager may hold a quasi-judicial hearing to consider licensing actions in response to the conduct of a Guide Outfitter, Guide Angler or Trapper. Through their licence, Guide Outfitters are representatives of the Crown in British Columbia. As such, they need to be held to a high standard of conduct and must always operate within the law. Guide Outfitters must also be aware of and monitor the actions of their employees and clients to ensure that they are also operating within the law. See page 6 for the results of these administrative hearings. The public plays an important role in keeping our province safe, clean and beautiful. The Report All Poachers and Polluters (RAPP) program is a toll free tip-line and web-based service for reporting known or suspected violations of fisheries, wildlife, or environmental protection laws. Park Act Order issued to a property owner adjacent to the South Okanagan Grasslands Protected Area to stop active vineyard operations within the park. The activities were in contravention of the Park Act and involved a boundary trespass.

Engineer's Order issued to a property owner for undertaking work on Cluculz Lake and an adjacent stream without authorization. The property owner was ordered to perform restoration and remediationto the lake shoreline by completing the following: (1) plant vegetation and apply mulch (hay) to stabilize the lakeside slope area; (2) pump out the sediment in the streambed caused by the unauthorized work; and, (3) re-establish the stream/lake beach interface with rock to convey water across the beach and into Cluculz Lake.

Engineer's Order issued to this mining operation for undertaking work in a tributary of the Murray Riverwithout authorization, causing a volume of sedimentation which could negatively impact a high value fish-bearing system. The Order required the operation to: (1) cease and discontinue any further works that may cause or allow further erosion into the tributary; (2) submit to the Ministry a Site Remediation Plan prepared by a Qualified Environmental Professional or Professional Engineer; (3) upon Ministry approval of the plan, immediately commence the remediation works; and, (4) advise theMinistry upon completion of the plan and submit a Final Project Report.

An administrative hearing was called by the Regional Manager based on a number of illegal activities that took place at the Triple H Outfitters. In rendering his decision, the Regional Manager considered that Mr. Horvath had been charged with 17 counts of failing to submit guide declaration reports, 5 counts of failing to pay guide royalties, 1 count of angling without a licence. Two assistant guides at Triple H Outfitters were also charged for failing to report the killing of a5 point elk and illegally harvesting a bighorn sheep ram with less than full curl.

Based on allegations currently before the Courts, an administrative hearing was called by the Regional Manager to consider Marika Ramousch's guiding activities. The allegations before the Courts concerned the shooting of two mountain goats within her guiding area and some subsequent related illegal activities. Most of the offences were a direct result of the actions taken by Mrs. Ramousch's Assistant Guides and clients, however that does not excuse the Guide Outfitter as she has a responsibility to ensure her employees and clients are operating within the law.
