PART 1—PRELIMINARY

Division 1—Introduction

1 ObjectivesThe main objectives of these Regulations are—

(a) to define the meaning of plumbing work, and tospecify classes of plumbing work and specialisedplumbing work, for the purposes of Part 12A of theBuilding Act 1993; and

(b) to specify the qualifications and experiencerequired for a person to be eligible to be registeredor licensed to carry out plumbing work; and

(c) to incorporate the Plumbing Code of Australia andto prescribe other standards that relate to plumbingwork; and

(d) to specify fees for the purposes of Part 12A of theBuilding Act 1993;

(e) and to provide for any other matters authorised tobe prescribed for the purposes of Part 12A of theBuilding Act 1993.

2 Authorising provisionsThese Regulations are made under sections 221ZZZVand 262 of the Building Act 1993.

3 CommencementThese Regulations come into operation on 24 November2008.

4 RevocationsThe Regulations listed in Schedule 1 are revoked.

5 DefinitionsIn these Regulations—

apprenticeship means a training contract between aperson and an employer entered into under Part5.5 of the Education and Training Reform Act2006;

approved competency units means competency unitsthat are approved by the Commission underregulation 42;

AS/NZS 3500.2 means AS/NZS 3500.2 Plumbing anddrainage Part 2: Sanitary plumbing and drainage,as issued, published or remade from time to time;

AS/NZS 3500.4 means AS/NZS 3500.4 Plumbing anddrainage Part 4: Heated water services, as issued,published or remade from time to time;

AS/NZS 4234 means AS/NZS 4234 Heated watersystems—Calculation of energy consumption, asissued, published or remade from time to time;".

backflow prevention work has the same meaning asset out in regulation 36;

blackwater means wastewater from a toilet or urinal;

caravan means a structure, other than a vessel,designed or adapted to be moved from place toplace, intended for human habitation or use as aworkplace including a self-propelled recreationalvehicle or mobile home and any attached oradjoining annex or the like;

Certificate II course means a Certificate II courseaccredited under Part 4.4 of the Education andTraining Reform Act 2006;

Certificate III course means a Certificate III courseaccredited under Part 4.4 of the Education andTraining Reform Act 2006;

Certificate IV course means a Certificate IV courseaccredited under Part 4.4 of the Education andTraining Reform Act 2006;

Commission means the Plumbing Industry Commissionestablished under Part 12A of the Act;

cooling tower means a device for lowering—

(a) the temperature of recirculated water bybringing the water into contact with fan-forced, or fan-induced, atmospheric air; or

(b) the temperature of water, a refrigerant orother fluid in a pipe or other container bybringing recirculated water and fan-forced, orfan-induced, atmospheric air into contact withthe pipe or container;

cooling tower drift eliminator is a device used tocontrol water loss from a cooling tower through theexhaust air;

drain means a pipe or conduit laid above or below theground surface, including all associated fittings andequipment, for the conveyance of sewage, tradewaste, greywater or stormwater;

drainage work has the meaning set out in regulation 15;

drinking water has the same meaning as in the SafeDrinking Water Act 2003;

evaporative cooler means a non-refrigerated waterfiltered airflow ducted cooling system installedabove and through a roof or outside and through awall;

fire protection work has the meaning set out inregulation 17;

gas except in regulation 26, has the same meaning as ithas under the Gas Safety Act 1997;

gas company has the same meaning as it has under theGas Safety Act 1997;

gas isolating valve means a valve for the purpose ofisolating part of a gas installation from theremainder of the gas installation;

gas storage container means a tank, cylinder or similarcontainer from which gas is supplied;

gasfitting work has the meaning set out in regulation20;

greywater means all household wastewater excludingblackwater;

irrigation (non-agricultural) work has the meaning setout in regulation 25;

mechanical services work has the meaning set out inregulation 26;

PCA means the Plumbing Code of Australia;

rainwater means water collected directly from roof run-off;

rainwater tank means a tank or a number of connectingtanks designed to collect rainwater from roofcatchments;

refrigerated air-conditioning work has the meaning setout in regulation 28;

refrigerated package appliance means a refrigeratedair-conditioning appliance that does not requirepipework to be installed for its operation;

Restricted electrical worker's licence (Class 2) hasthe same meaning as it has in the Electricity Safety(Registration and Licensing) Regulations 2010 andincludes a disconnect/reconnect licence that istreated as a Restricted electrical worker's licence(Class 2) under regulation 42 of those Regulations;

retention tank means any storage receptacle used forthe storage and detainment of stormwater;

roofing (stormwater) work has the meaning set out inregulation 30;

sanitary work has the meaning set out in regulation 32;

sewage has the same meaning that it has under theWater Act 1989;

specialised gasfitting work means any of the followingclasses of specialised plumbing work—(a) type A appliance conversion work;(b) type A appliance servicing work;(c) type B gasfitting work;(d) type B gasfitting advanced work;

split system means a refrigerated air-conditioningappliance with separate indoor and outdoorcomponents that requires pipework to be installedfor its operation in a building;

subsoil drain means a trench filled with filter material orenhanced by using slotted pipes for the purpose ofconveying subsoil water;

surface water drainage system means any stormwaterdrains, retention tanks, pump installations andrising mains for the collection and conveyance ofsurface water, from paved and unpaved areas anddischarges from downpipes, but does not includesubsoil drains;

the Act means the Building Act 1993;

trade waste has the same meaning that it has under theWater Act 1989;

trade waste agreement has the same meaning that ithas under Part 9 of the Water Act 1989;

type A appliance has the same meaning as Type Aappliance has in section 3(1) of the Gas SafetyAct 1997;

type A appliance conversion work has the meaningset out in regulation 22;

type A appliance servicing work has the meaning setout in regulation 21;

type B gasfitting advanced work has the meaning setout in regulation 24;

type B gasfitting work has the meaning set out inregulation 23;

vessel means any houseboat, yacht or marine craft usedfor recreation and includes a vessel that is used—(a) for hire and reward; or(b) as a restaurant or for public entertainment;

wastewater means spent or used water, includinggreywater and blackwater, which containsdissolved or suspended matter;

water supply work has the meaning set out inregulation 34.

6 Interpretation(1) If a provision of any document applied, adopted or

incorporated by, or referred to in, these Regulations isinconsistent with any provision in these Regulations, theprovision of these Regulations prevails.

(2) Subject to the Act and to these Regulations, words andexpressions used in these Regulations have the samemeaning as they have in the PCA.

(3) A reference to plumbing work in these Regulations,except in Part 12, includes a reference to specialisedplumbing work unless a contrary intention expresslyappears or the context otherwise requires.

(4) Any reference in a document incorporated by theseRegulations to a requirement to comply with a direction,instruction, specification or requirement of amanufacturer when carrying out plumbing work is to beread as if the reference were to a requirement to complywith relevant best practice when carrying out thatplumbing work.

(5) In these Regulations—

(a) a reference to the installation, replacement, repairor alteration of a thing; or

(b) a reference to any one or more of the activitiesreferred to in paragraph (a) in relation to a thing—

includes the extension, renewal, relocation, connection,disconnection or removal of the thing.

(6) In these Regulations a reference to the commissioning ofa thing, unless a contrary intention expressly appears orthe context otherwise requires, includes therecommissioning or decommissioning of the thing.

(7) In these Regulations a reference to the construction,installation, replacement, repair, alteration, maintenance,testing or commissioning of a thing includes any workthat is incidental to, or associated with—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof that thing; or

(b) any extended meaning of an activity described inparagraph (a) referred to in subregulation (5) or (6)in relation to that thing.

Division 2—Plumbing Code of Australia

7 Plumbing Code of Australia forms part of theseRegulations

Subject to regulation 8, the PCA is adopted by and formspart of these Regulations, as modified by theseRegulations.

8 Provisions of the PCA not adoptedThe following Parts of the PCA are not adopted by, anddo not form part of, these Regulations—

(a) Part D2, to the extent that it relates to the followingwork—

(i) the construction, installation, replacement,repair, alteration, maintenance, testing orcommissioning of a subsoil drain;

(ii) the construction or replacement ofstormwater pits, below-ground storage orretention tanks;

(iii) any design work that is incidental to orassociated with any work described insubparagraph (i) or (ii);

(b) Parts F1 and F2.

9 Modifications to the PCA(1) The PCA is to be read as if—

(a) a reference to a plumbing or drainage installationwere a reference to a plumbing or drainagesystem;

(b) a reference to a plumbing and drainage installationwere a reference to a plumbing and drainagesystem;

(c) a reference to a plumbing installation were areference to a plumbing or drainage system.

(2) The PCA is to be read as if in paragraph (a) of clauseA1.3, "relevant document listed in Table A3.1 as thatdocument is issued, published or remade from time totime" were substituted for "edition or issue, together withany amendment listed in Table A3.1".

(3) The PCA is to be read as if paragraph (d) of clause A1.3were omitted.

PART 2—PLUMBING WORK

Division 1—Plumbing work regulated by Part 12A ofthe Act

10 Meaning of plumbing work(1) For the purposes of section 221C of the Act the following

plumbing work is plumbing work to which Part 12A of theAct applies—

(a) backflow prevention work;

(b) drainage work;

(c) fire protection work;

(d) gasfitting work;

(e) irrigation (non-agricultural) work;

(f) mechanical services work;

(g) refrigerated air-conditioning work;

(h) roofing (stormwater) work;

(i) sanitary work;

(j) type A appliance conversion work;

(k) type A appliance servicing work;

(l) type B gasfitting work;

(m) type B gasfitting advanced work; and

(n) water supply work.

(2) For the purpose of section 221C of the Act, the followingwork is not plumbing work to which Part 12A of the Actapplies—

(a) any work carried out in relation to a supply ordischarge reticulation system or a treatment plantor any equipment, appliance, fixture or systemassociated with that system or plant (other than anyequipment, appliance, fixture or system usedmainly for administrative or ablution purposes)owned by, or exclusively vested in—

(i) a gas company; or

(ii) the holder of a water licence or a water andsewerage licence under the Water IndustryAct 1994; or

(iii) an Authority that has a water district or asewerage district under the Water Act 1989;or

(iv) a council when the work is for stormwaterdrainage system purposes;

(b) the internal design, construction, installation,replacement, repair, alteration, maintenance,testing or commissioning of any integral part of anon-site wastewater management system device oran on-site liquid trade waste management systemdevice;

(c) the opening or closing of inspection opening capsand covers in sewage, stormwater and wastepipes;

(d) the clearing of blockages, or closed circuittelevision inspection of sewage, stormwater andwaste pipes, using existing inspection openings orremovable grates;

(e) the connection for water use of hoses fromappliances such as dishwashers and clotheswashing machines to taps;

(f) the connection of hoses to taps for the purposes ofactivities that use water including cleaning orwatering a garden;

(g) the connection of irrigation systems or devices tohose taps for the purposes of watering a garden orirrigation;

(h) the installation of a refrigerated package appliance;

(i) design work where that design work is carried outby a person in their capacity as—

(i) a building practitioner; or

(ii) an architect; or

(iii) a draftsperson; or

(iv) an engineer; or

(v) a landscape architect; or

(vi) a designer—

unless the design work is incidental to, orassociated with, plumbing work (that is not designwork) that is or will be carried out by that person.

11 Plumbing work that may be carried out byunlicensed or unregistered persons(1) For the purposes of section 221D(2)(b) of the Act, the

change over of a 3 star shower head in a dwelling isplumbing work that may be carried out by a person whois not a licensed or registered plumber.

(2) For the purposes of section 221D(2)(b) of the Act, therepair or replacement of tap washers and other minor taprepairs in a dwelling is plumbing work that may be carriedout by a person who is not a licensed or registeredplumber.

Note

Under section 221D(2)(a) of the Act, a person is excepted fromhaving to be licensed or registered as a plumber whenrepairing a tap in a dwelling that the person owns andoccupies. The above regulation extends this exception to non-owners or non-occupiers of a dwelling.

(3) In this regulation—

3 star shower head means a shower head with a waterefficiency rating of 3 stars determined inaccordance with AS/NZS 6400 Water efficientproducts—Rating and labelling as issued,published or remade from time to time;

minor tap repairs do not include the repair of anythermostatic mixing valve, tempering valve orbackflow prevention device.

Division 2—Classes of plumbing work

12 Classes of plumbing work other thanspecialised plumbing work

For the purposes of the definition of class of plumbingwork in section 221B(1) of the Act, the following classesof plumbing work are specified—

(a) drainage work;

(b) fire protection work;

(c) gasfitting work;

(d) irrigation (non-agricultural) work;

(e) mechanical services work;

(f) roofing (stormwater) work;

(g) sanitary work; and

(h) water supply work.

13 Classes of specialised plumbing workFor the purposes of the definition of class ofspecialised plumbing work in section 221B(1) of theAct, the following classes of specialised plumbing workare specified—

(a) backflow prevention work;

(b) refrigerated air-conditioning work;

(c) type A appliance conversion work;

(d) type A appliance servicing work;

(e) type B gasfitting advanced work; and

(f) type B gasfitting work.__________

PART 3—STANDARD OF PLUMBING WORK

14 Standard of plumbing workAny registered plumber, licensed plumber or otherperson authorised to carry out plumbing work under theAct must carry out plumbing work in a good andworkmanlike manner.

PART 4—DRAINAGE

15 Drainage work defined(1) Drainage work is—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof any part of a below-ground sanitary drainagesystem or a below-ground stormwater drainagesystem from the above-ground sewage,stormwater or waste pipes to the connection withthe disposal system; and

(b) any design work that is incidental to, or associatedwith, any work described in paragraph (a).

(2) Drainage work does not include—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof—

(i) a subsoil drain for the sole purpose of subsoilwater collection; or

(ii) stormwater pits, channels that are grated orbelow-ground storage or retention tanks; or

(b) any design work that is incidental to, or associatedwith, the work described in paragraph (a).

PART 5—FIRE PROTECTION

17 Fire protection work defined(1) Fire protection work is—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof any part of a water service used for fire fighting,from the point of connection of the service to thewater supply to any firefighting device or equipmentforming part of that service, including the followingequipment—

(i) a fire hydrant or hose reel;

(ii) a residential or domestic fire sprinklersystem;

(iii) a commercial or industrial fire sprinklersystem;

(iv) a fire system pump set other than thecommissioning of a fire system pump set;and

(b) any design work that is incidental to, or associatedwith, any work described in paragraph (a).

(2) In this regulation water service includes a service that isconnected to a reticulated water supply, a rainwatersupply or any other water supply.

18 Requirements for fire protection workIn addition to any other requirements of theseRegulations, fire protection work must comply with therequirements set out in Part 2 of Schedule 2.

PART 6—GASFITTING

19 Terms used in this PartWords and expressions used in this Part that are notdefined in these Regulations or the PCA have the samemeaning that they have in the following standards—

(a) AS 4575 Gas appliances—Quality of servicing, asissued, published or remade from time to time;

(b) AS 3814 Industrial and commercial gas-firedappliances, as issued, published or remade fromtime to time;

(c) AS 5601 Gas installations, as issued, published orremade from time to time.

20 Gasfitting work defined(1) Gasfitting work is the construction, installation,

replacement, repair, alteration, maintenance, testing orcommissioning of any pipe, appliance, flue, fitting,apparatus, control or other item that is involved with thesupply or use of gas and that is fitted downstream of theoutlet of a customer billing meter or a consumer's gasstorage container and includes—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof—

(i) any gas appliance in, or on, a caravan or avessel; and

(ii) any roof sheeting and flashing that isnecessary for the purpose of any workdescribed in this subregulation; and

(b) any design work that is incidental to, or associatedwith, any work described in this subregulation.

(2) Gasfitting work does not include—

(a) any specialised gasfitting work; or

(b) any cleaning, painting or preparation work inrelation to gas pipes or gas pipe joints that doesnot involve the connection, disconnection oralteration of those pipes or joints; or

(c) the connection or disconnection of a gas storagecontainer for the purpose of filling or refilling thecontainer; or

(d) any work in relation to an item that is involved withthe supply or use of gas that relates to thepropulsion system, or any system that is poweredby the propulsion system, of any motor vehicle orvessel.

21 Type A appliance servicing workType A appliance servicing work is the internal cleaning,maintenance and adjusting of a type A appliance andincludes the adjustment, repair or replacement ofcomponents.

22 Type A appliance conversion workType A appliance conversion work is the adjusting oraltering of a type A appliance to operate on a differentgas from—

(a) the gas that the appliance was originallymanufactured to use; or

(b) the gas that the appliance had been previouslyconverted to use.

23 Type B gasfitting work(1) Type B gasfitting work is the construction, installation,

servicing and maintenance of a type B appliancebetween the gas isolating valve adjacent to the applianceand any flue connection and includes—

(a) repair and replacement of gas components; and

(b) the commissioning of gas components; and

(c) the commissioning of the gas burner system.

(2) For the purposes of subregulation (1), type B appliancemeans any of the following single appliances of inputgreater than 10 MJ/h and less than 5000 MJ/h that formspart of an integrated industrial process—

(a) a water heater;

(b) a space heater;

(c) a vat or tank heater;

(d) a dryer or oven not associated with volatile solventsor hazardous atmospheres;

(e) a batch kiln with flame supervision and safeguards;

(f) any catering equipment.

(3) In addition to the work described under subregulation (1),type B gasfitting work also includes the construction,installation, servicing and maintenance of a steam boileror thermal fluid heater of input less than 10 000 MJ/h thatforms part of an integrated industrial process betweenthe gas isolating valve adjacent to the appliance and anyflue connection, including the repair and replacement ofgas components in that appliance.

(4) In this regulation—

batch kiln means a single industrial appliance for firingor drying a product in one discrete campaign oroperating cycle that is not part of a continuousoperation;

thermal fluid heater means an appliance that uses anoil or hydrocarbon based heat transfer medium inthe liquid phase.

24 Type B gasfitting advanced work(1) Type B gasfitting advanced work is the construction,

installation, servicing and maintenance of a type Bappliance, including the gas supply componentry of theappliance, between the gas isolating valve adjacent tothe appliance and any flue connection and includes—

(a) the repair, replacement, alteration or modificationof the burner and associated safety system; and

(b) the commissioning of a new, existing or modifiedgas burner system; and

(c) any design work that is incidental to, or associatedwith, any work described in this subregulation.

(2) In this regulation type B appliance means—

(a) any appliance referred to in regulation 23(2) or23(3); and

(b) any of the following appliances of input greater than10MJ/h—

(i) a furnace;

PART 7—IRRIGATION (NON-AGRICULTURAL)

25 Irrigation (non-agricultural) work defined(1) Irrigation (non-agricultural) work is the construction,

installation, replacement, repair, alteration, maintenance,testing or commissioning of any part of an irrigationsystem on a property from the connection point to anywater supply in the system to the last valve or control toany pressurised zone in the system and includes anydesign work that is incidental to, or associated with, anywork described in this subregulation.

(2) Irrigation (non-agricultural) work does not include thedesign, construction, installation, replacement, repair,alteration, maintenance, testing or commissioning of anirrigation system used for the purposes of agriculture.

(3) In this regulation connection point means—

(a) the outlet side of the meter assembly in the system;or

(b) if no meter assembly is installed on the property,the principal control valve nearest to the propertyboundary.

PART 8—MECHANICAL SERVICES

26 Mechanical services work defined(1) Mechanical services work is the construction, installation,

replacement, repair, alteration, maintenance, testing orcommissioning of a mechanical heating, cooling orventilation system in a building, which is associated withthe heating, cooling or ventilation of that building andincludes—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof—

(i) any valve, regulator, register, pipe, duct, flue,tank, heating or cooling pipe or surface,boiler, burner, solid fuel heater, coil or otheritem that is used in the system; and

(ii) any single head split system; and

(iii) in relation to a cooling tower, any water pipe,valve, pump, automated dosing device orautomated bleeding device or any othermechanical component that affects thecooling tower's cooling water flow rate orwastewater disposal; and

(iv) any fixed component used in a reticulationsystem for the supply or removal of medicalgases from the gas source to a wall outlet;and

(v) roof sheeting and flashing that is necessaryfor the purpose of any work described in thissubregulation; and

(b) any design work that is incidental to, or associatedwith, any work described in this subregulation.

(2) Mechanical services work does not include—

(a) gasfitting work; or

(b) any work on a cooling tower drift eliminator; or

(c) any treatment of cooling water; or

(d) the connection or disconnection of a systemreferred to in subregulation (1) from a water supplyother than disconnection of the system from a

water supply at an isolating valve adjacent to amechanical component of that system.

(3) In this regulation—

automated bleeding device means an automaticdevice used for the purposes of draining orbleeding or removing a fluid or gas;

medical gases means any gas or mixture of gases orother substance or process used for hospital ormedical use that is supplied to, removed from orconducted at, a hospital or other place wheremedical procedures are carried out, by way of apipeline reticulation system and includes oxygen,helium, nitrous oxide, nitrogen, medical air, surgicaltool gas, carbon dioxide and common mixtures ofthose gases as well as anaesthesia waste.

27 Requirements for mechanical services workIn addition to any other requirements of theseRegulations, mechanical services work must comply withPart 3 of Schedule 2.

28 Refrigerated air-conditioning work defined(1) Refrigerated air-conditioning work is the construction,

installation, replacement, repair, alteration, maintenance,testing or commissioning of refrigerated air-conditioningequipment, including—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof—

(i) flexible ductwork, associated with the heatingand cooling of a building; and

(ii) roof sheeting and flashing that is necessaryfor the purpose of any work described in thissubregulation; and

(b) any design work that is incidental to, or associatedwith, any work described in this subregulation.

(2) Refrigerated air-conditioning work does not include—

(a) the connection or disconnection of refrigerated air-conditioning equipment from a water supply otherthan the disconnection of that equipment from awater supply at an isolating valve adjacent to amechanical component of that equipment; or

PART 9—ROOFING (STORMWATER)

30 Roofing (stormwater) work defined(1) Roofing (stormwater) work is the construction,

installation, replacement, repair, alteration, maintenance,testing or commissioning of any roof covering or roofflashing and any part of a roof drainage system involvedin the collection or disposal of stormwater, whichconnects to ground level and includes—

(a) the connection of any stormwater piping to—

(i) a below-ground stormwater drain; or

(ii) an on-site retention or storage tank; and

(b) any design work that is incidental to, or associatedwith, any work described in this subregulation.

(2) Roofing (stormwater) work does not include—

(a) any cleaning, painting or preparation work inrelation to any item, device or equipment involvedin the collection or disposal of stormwater otherthan the connection, disconnection or alteration ofthat item, device or equipment; or

(b) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof any roof covering consisting of non-metallic tiles,slate or flat membrane sheeting or any design workthat is incidental to, or associated with, that work.

31 Requirements for roofing (stormwater) workIn addition to any other requirements of theseRegulations, roofing (stormwater) work must comply withPart 5 of Schedule 2.

PART 10—SANITARY

32 Sanitary work defined(1) Sanitary work is the construction, installation,

replacement, repair, alteration, maintenance, testing orcommissioning of any part of an above-ground sanitaryplumbing system to connect sanitary fixtures andappliances to a disposal system or below-ground sanitarydrainage system and includes—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof—

(i) any fixture in, or on, a caravan or vessel thatis connected to a disposal system orbelow-ground sanitary drainage system; and

(ii) any roof sheeting and flashing that isnecessary for the purpose of any workdescribed in this sub-regulation; and

(b) any design work that is incidental to, or associatedwith, any work described in this subregulation.

(2) Sanitary work does not include—

(a) water supply work; or

(b) drainage work.

PART 11—WATER SUPPLY

34 Water supply work defined(1) Water supply work is—

(a) the construction, installation, replacement, repair,alteration, maintenance, testing or commissioningof the following—(i) any part of a heated or cold water service that

is connected to a drinking water supply fromthe point of connection to the water supply tothe points of discharge of the service;

(ii) any part of a non-drinking heated or coldwater service or rainwater service, from thepoint of connection to the water supply to thepoints of discharge of the service;

(iii) any heated water service in or on a caravanor vessel; and

(b) any design work that is incidental to, or associatedwith, any work described in this subregulation.

(2) Water supply work does not include work described insubregulation (1) carried out in connection with thesupply of piped non-drinking water for agriculturalpurposes unless the water is supplied by a network utilityoperator or other water provider.

35 Requirements for water supply workIn addition to any other requirements of theseRegulations, water supply work must comply with Part 7of Schedule 2.

36 Backflow prevention work definedBackflow prevention work is the repair, alteration,maintenance, testing or commissioning of a backflowprevention device, which is capable of being tested andis listed in Column 1 of Table 4.1 of AS/NZS 3500.1Plumbing and drainage Part 1—Water services, asissued, published or remade from time to time.

37 Requirements for backflow prevention workIn addition to any other requirements of theseRegulations, backflow prevention work must comply withPart 8 of Schedule 2.

PART 12—ELIGIBILITY REQUIREMENTS FORLICENCE OR REGISTRATION

37A Prescribed class or classes of plumbing work orspecialised plumbing work required to carry outspecialised plumbing work(1) For the purposes of section 221OA(1)(a) of the Act, the

prescribed class or classes of plumbing work orspecialised plumbing work required for registration in theclass of specialised plumbing work set out in Column 2 ofthe Table in Schedule 2A is the class or classes ofplumbing work or specialised plumbing work set out inColumn 3 of that Table corresponding to that class ofspecialised plumbing work.

(2) For the purposes of section 221N(1)(a) of the Act, theprescribed class or classes of plumbing work orspecialised plumbing work required for a licence in theclass of specialised plumbing work set out in Column 2 ofthe Table in Schedule 2A is the class or classes ofplumbing work or specialised plumbing work set out inColumn 4 of that Table corresponding to that class ofspecialised plumbing work.

38 Qualifications and experience required forclasses of plumbing work other than specialisedplumbing work(1) The qualifications and experience required for a person

to be able to be registered under section 221O of the Actto carry out a class of plumbing work set out in Column 2of the Table in Part 1 of Schedule 3 are the qualificationsand experience set out in Column 3 of that Tablecorresponding to that class of plumbing work.

(2) The qualifications and experience required for a personto be able to be licensed under section 221M of the Actto carry out a class of plumbing work set out in Column 2of the Table in Part 1 of Schedule 3 are the qualificationsand experience set out in Column 4 of the Tablecorresponding to that class of plumbing work.

39 Qualifications and experience required forclasses of specialised plumbing work(1) The qualifications and experience required for a person

to be able to be registered under section 221OA of the

Act to carry out a class of specialised plumbing work setout in Column 2 of the Table in Part 2 of Schedule 3 arethe qualifications and experience set out in Column 3 ofthat Table corresponding to that class of specialisedplumbing work.

(2) The qualifications and experience required for a personto be able to be licensed under section 221N of the Act tocarry out a class of specialised plumbing work set out inColumn 2 of the Table in Part 2 of Schedule 3 are thequalifications and experience set out in Column 4 of thatTable corresponding to that class of specialisedplumbing work.

40 Experience requirementsDespite regulation 38, in the case of a person licensed orregistered to carry out a particular class of plumbingwork who applies to be licensed or registered to carry outanother class of plumbing work, employment for not lessthan 1 year in work of that other class is sufficient for thatperson to meet the experience requirements to belicensed or registered to carry out that other class ofplumbing work.

41 Experience may be obtained over separateperiods and with different employers

For the purposes of this Part, the experience required fora person to be eligible to be registered or licensed as aplumber under the Act with respect to a class ofplumbing work or specialised plumbing work may beobtained over more than one period and with more thanone employer.

42 Commission may approve competency units(1) For the purposes of this Part, the Commission may from

time to time approve one or more competency units to becontained in a Certificate II course or a higher courserelating to a class of plumbing work or specialisedplumbing work.

(2) The Commission may from time to time amend thecompetency units approved under subregulation (1) withrespect to a class of plumbing work or specialisedplumbing work.

(3) The Commission must publish in the GovernmentGazette an up-to-date list of the competency units

43 FeesFor the purposes of Part 12A of the Act, the fee for amatter set out in Column 2 of the Table in Schedule 4 isthe amount set out in Column 3 of that Tablecorresponding to that matter.

44 Value of plumbing workFor the purposes of section 221ZH(1)(a) of the Act, theamount fixed is $750.

45 Price of compliance certificate formFor the purposes of section 221ZN(5) of the Act, themaximum amount that may be charged for the sale of acompliance certificate form is $31.25.

46 Exemption from feesThe Commission may wholly or partially exempt a personfrom having to pay a fee prescribed in this Part if, in itsopinion, there are special circumstances.

PART 14—TRANSITIONAL PROVISIONS

47 DefinitionsIn this Part—

commencement date means the date that theseRegulations come into operation;

former class of plumbing work means a class ofplumbing work prescribed under the oldRegulations;

old Regulations means the Plumbing Regulations 1998.

48 Former classes of plumbing work taken to beclasses and types of plumbing work under theseRegulations

A former class of plumbing work that is set out in Column2 of the Table in Schedule 5, is taken to be the class orclasses of plumbing work, and, if applicable, the type ortypes of plumbing work falling within a class of plumbingwork, prescribed under these Regulations set out inColumn 3 of that Table corresponding to that formerclass of plumbing work.

49 Persons licensed or registered to carry outformer class of plumbing work may continue tocarry out that work(1) A person who immediately before the commencement

date was licensed under section 221M or 221N of the Actto carry out a former class of plumbing work set out inColumn 2 of the Table in Schedule 5—

(a) is taken to be licensed under section 221M or 221Nof the Act (as the case requires) to carry out theclass or classes of plumbing work prescribed underthese Regulations set out in Column 3 of the Tablecorresponding to that former class of plumbingwork; and

(b) if applicable, is taken to be licensed under section221Q of the Act to carry out the type or types ofplumbing work falling within a class of plumbingwork prescribed under these Regulations set out inColumn 3 of the Table corresponding to that formerclass of plumbing work.

(2) A person who immediately before the commencementdate was registered under section 221O or 221OA of theAct to carry out a former class of plumbing work set outin Column 2 of the Table in Schedule 5—

(a) is taken to be registered under section 221O or221OA of the Act (as the case requires) to carryout the class or classes of plumbing workprescribed under these Regulations set out inColumn 3 of the Table corresponding to that formerclass of plumbing work; and

(b) if applicable, is taken to be registered under section221R of the Act to carry out the type or types ofplumbing work falling within a class of plumbingwork prescribed under these Regulations set out inColumn 3 of the Table corresponding to that formerclass of plumbing work.

(3) A person who is taken to be licensed or registered tocarry out a class or classes and, if applicable, a type ortypes of plumbing work under subregulation (1) or (2) istaken to be so licensed or registered until the date theperson's licence or registration to carry out the formerclass of plumbing work would have expired had the oldRegulations not been revoked.

(4) Subregulation (3) ceases to apply if a person's licence orregistration is suspended or cancelled under the Act.

(5) As soon as is practicable after the commencement date,the Registrar must—

(a) seek the return of each licence or certificate ofregistration issued under Part 12A of the Act tocarry out each former class of plumbing work setout in Column 2 of the Table in Schedule 5; and

(b) issue a replacement licence or certificate ofregistration under the relevant section of Part 12Aof the Act in respect of the class or classes ofplumbing work, and if applicable, the type or typesof plumbing work, set out in Column 3 of the Tablein Schedule 5 corresponding to that former class ofplumbing work set out in Column 2 of that Table.

(6) No fee is payable for the issue of a replacement licenceor certificate of registration under subregulation (5).

50 Persons eligible to be licensed or registered tocarry out former class of plumbing work stilleligible(1) A person who immediately before the commencement

date was eligible to be licensed under section 221M or221N of the Act to carry out a former class of plumbingwork set out in Column 2 of the Table in Schedule 5 istaken to be eligible to be licensed under section 221M or221N of the Act (as the case requires) to carry out theclass or classes of plumbing work prescribed underthese Regulations set out in Column 3 of the Tablecorresponding to that former class of plumbing work.

(2) A person who immediately before the commencementdate was eligible to be registered under section 221O or221OA of the Act to carry out a former class of plumbingwork set out in Column 2 of the Table in Schedule 5 istaken to be eligible to be registered under section 221Oor 221OA of the Act (as the case requires) to carry outthe class or classes of plumbing work prescribed underthese Regulations set out in Column 3 of the Tablecorresponding to that former class of plumbing work.

51 Exemption from section 221D(1) of the Act forcertain persons carrying out fire protection work

A person, who immediately before the commencementdate carried out any type of work described in regulation17 that was not plumbing work under the old Regulationsbut is a type of fire protection work under theseRegulations, is exempted from section 221D of the Act inrelation to the carrying out of work of that type for theperiod ending one year after the commencement date.

PART 7—REQUIREMENTS FOR WATER SUPPLY WORK

10 Definitions

In this Part—automatic or manual interchange device means a device that

by way of manual or automatic means can alternatebetween varying water sources;

Class 1 building has the same meaning as it has in the buildingregulations;

heat pump water heater means a water heater using vapourcompression cycle and incorporating a compressor, anevaporator and a condenser, which delivers heat to thewater either directly or indirectly;

solar pre-heater means a solar water heater without a boosterheating unit;

solar water heater means a system for heating water consistingof—(a) a solar collector and a container (that may be

integral, close coupled or remote) that heats waterby means of radiant energy from the sun andincludes—(i) a single container solar water heater with

electric or gas boosting; or(ii) 2 or more solar pre-heat containers connected

to each other and to an electric booster or agas booster; or

(iii) a solar pre-heater coupled with a conventionalstorage water heater; or

(iv) any other solar powered heater configurationthat incorporates a heater referred to insubparagraph (i) and a component referred toin subparagraph (ii); or

(b) a heat pump water heater.

14 Requirements where rainwater used for sanitary flushing

(1) If a reticulated water supply from a network utility operator isconnected, or proposed to be connected to a building where arainwater tank is installed for the purpose of sanitary flushing, anautomatic or manual interchange device that allows alternate useof water from the rainwater tank or the reticulated water supplymust be installed to ensure that there is a continual supply ofwater for sanitary flushing.

(2) A rainwater tank installed in a new Class 1 building in order tocomply with the requirements of the building regulations must—(a) be installed in such a way that it receives the rainfall from a

minimum catchment area of 50 square metres; and(b) have a minimum capacity of 2000 litres; and(c) be connected to all toilets in the building for the purpose of

sanitary flushing in accordance with subclause (1).NoteThe Victorian variation to the energy efficiency provisions of theBuilding Code of Australia (as incorporated by the buildingregulations) provides that the energy efficiency performancerequirement for a new Class 1 building is satisfied if either arainwater tank is connected to all sanitary flushing systems or asolar water heater is installed in accordance with theseRegulations.

15 Requirements relating to solar water heaters—all buildings

(1) The solar collectors contained in a solar water heater installed ina building must—(a) be oriented to face between 30 degrees east and 60

degrees west of magnetic north; and(b) have an inclination of 35 degrees plus or minus 20 degrees

to the horizontal.NoteFor additional requirements relating to a solar water heaterinstalled in a Class 1 building, see clauses 15A and 15B.

(2) Subclause (1) does not apply to a new Class 1 building if—(a) a solar water heater is installed in the building in order to

comply with the building regulations; and(b) the solar water heater installed is evaluated and performs

to the standard required under clause 15B(1); and(c) it is not practicable to comply with subclause (1).

15A Requirements relating to solar water heaters—Class 1 buildings

(1) The annual energy performance of a solar water heater installedin a Class 1 building, if evaluated in accordance with AS/NZS4234, must be evaluated in accordance with that standard asmodified by subclause (2).

(2) For the purposes of subclause (1), AS/NZS 4234 is to be read asif—(a) the following clause were inserted after clause 1.4.17—

"1.4.17A Solar water heaterA system for heating water consisting of—

(a) a solar collector and a container (that may beintegral, close coupled or remote) that heatswater by means of radiant energy from the sunand includes—(i) a single container solar water heater

with electric or gas boosting; or(ii) 2 or more solar pre-heat containers

connected to each other and to anelectric booster or gas booster; or

SOLAR WATER HEATERS IN CLASS 1BUILDINGSDespite Clause 3.3, the following load andenvironmental conditions in Appendix A must beadopted for evaluating the annual energy use of asolar water heater installed in a Class 1 building—(a) climate zone 4 for all simulation model inputs;

and(b) for a building with less than 3 bedrooms—the

small system peak daily thermal energy load,as set out in Table A3; and

(c) for a building with 3 or more bedrooms—themedium system peak daily thermal energyload, as set out in Table A3; and

(d) the collector inclination and azimuth modelledto the North orientation, as set out in TableA1.".

15B Requirements relating to solar water heaters—new Class 1buildings

(1) A solar water heater installed in a new Class 1 building, inorder to comply with the requirements of the buildingregulations, must—

(b) perform to a standard under which the energysavings, relative to a conventional water heater, are60% or more when so evaluated.

(2) A solar water heater installed in a new Class 1 buildingmust have attached to the heater's water heater storagecontainer a legible label that is in the following form andcontains the information required to complete the label—

"This solar water heater installation complies with thePlumbing Regulations 2008 (Victoria) when installedwith the following collectors

".(3) Subclause (2) does not apply to a heat pump water heater.(4) If a reticulated gas supply from a gas company is available

for connection to a new Class 1 building, a solar waterheater installed in that building must be—(a) if it incorporates booster heating and is not a heat

pump water heater—a gas boosted solar waterheater; and

(b) if it is a heat pump water heater—installed so that nopart of the heater that is capable of heating watercan be connected to the mains electricity supply inorder for that part of the heater to operate.
