Perhaps, like me, you have seen the latest twist on the apparently perennial property television-show format. Home-owners are presented with the dilemma of whether to spend money improving their current home instead of moving up the property ladder.

To most, this is hardly a new idea, but for once the concept has merit. Together, the two largest single costs associated with a house move (stamp duty and estate agent’s commission) will total thousands of pounds. Could this money be better spent funding extensions or home improvements?

You will need to do your homework on the following practicalities before embarking on drawing up plans for major home improvements.

The legal stu� The land upon which all our homes are built has been the subject of terms in previous deeds created over many years. It is not uncommon for these to include covenants such as building, height, view-line or usage restrictions. There may be rights of way owed to neighbours or legislation (e.g. the drainage law) which gives a neighbour or a local authority the power to prevent you from doing what you want to. You may need to seek permission from your neighbours before building close to your boundaries. If they don’t give their permission it defaults to common law rules, dealing with (amongst other things) proximity of buildings and windows to boundaries. It would be disastrous to embark on an expensive construction project only for it to be halted for a legal battle. Before you spend any money on architects or planning applications (neither of which will take account of these legal issues) it is very simple to draw on a digital photo of your home to

illustrate a very outline proposal, email this to your property lawyer or conveyancer who will quickly and inexpensively provide you with a summary of potential di� culties to take into account or overcome.

Your mortgage lenderYour mortgage will contain a standard term requiring you to seek the written consent of your lender before undertaking any material change to your property. This includes change of use. Works which add value are unlikely to be problematic with your lender, providing you can demonstrate that you have the funds to complete the project.

Avoid over-investmentYou should consider your home improvements with your business hat on. There is no point spending on an extension or improvement unless it will increase the sale price of your property. Kindly estate agents will tender an informed opinion on what works will best improve property value as well as those which will not, so pick up the phone.

Don’t detract from current selling pointsIf your proposals involve the loss of private parking or natural light to your existing home then works might detract from its appeal. Your cherished man-cave may be the next man’s garden shed, so try to be objective.

ConservatoriesPlanning exemptions may not apply for a large conservatory, listed properties or if you are building it close to your boundaries. Double check.

Pre-planning adviceThe planning department o� ers a very quick, helpful and free service, so make use of this.

Moving house may involve less personal e� ort and a shorter period of disruption, but if you like where you live, there is defi nitely a case for considering what scope there is to improve your current home before looking to move on.

Most people know that Jersey has separate pensions legislation and options to the UK.

However, for some it can come as a surprise to fi nd that despite having never lived or worked in the UK they hold funds in a UK-based scheme and as such can only access them as UK legislation allows.

This is often because a current or former employer o� ered a company pension that was UK- based, rather than setting up a Jersey-based one for their local sta� .

This can bring a host of issues when trying to access or transfer the funds to a Jersey scheme.

Whilst most schemes will allow the individual to draw the funds under their standard UK terms, for some there can be better options that provide a larger initial lump sum, annual income and ultimately death benefi ts payable, should they be moved to a Jersey-based scheme instead.

Trying to do this yourself can be very complicated and time consuming. For those clients we have helped to date, the end result has more often than not been positive.

It is also worth pointing out that while many people will choose to draw their funds on the normal retirement date specifi ed, for many the option the draw the funds earlier, or later, can prove a better option.

Pension FundsTrapped In The UK?

Property Demand and the HPIThe latest House Price Index (HPI) fi gures suggest that there has been a slight decrease in Jersey property values for one and two bedroom fl ats and smaller houses. Interesting statistics, as this is the very area where the highest demand is – a demand created by First Time Buyers, who tell us that there is insu� cient supply of new property coming on to the market at this level.

The statistics are just that – providing an indication of trends, although they can sometimes be misleading.

I’m not quite certain where to start with my review of the Hill House in Gorey.  Simply calling it a house is perhaps the best place to start, as it’s a quite a considerable understatement.  This owner designed home is something really rather remarkable and rarely seen here in Jersey.  It’s a development  you’d expect to see unfolding under the watchful gaze of Kevin McCloud and the Channel four team of Grand Designs.  From the very paint on the walls to the layout of the rooms it really is an absolutely fantastic property.

Whilst viewing The Hill House from outside, you will be forgiven for presuming that what lies inside is an soulless uber modern new build, the current owners only fi nished and moved in to the property four years ago. What instead you’ll fi nd is a clever blend of all you’d expect of a high end modern house, but with thoughtful fi nishing touches that make it an absolutely beautiful home.

Set over three fl oors this is an upside down house, with the reception rooms being on the top, situated to make the very best of that

absolutely stunning view.  With Gorey castle so close it almost feels like you could touch it and the whole bay of Grouville stretching before you, this really is an enviable position on the hill side, a spot no one else will be able to occupy now, thanks to the change in building development regulations.  The development of the property saw 3,600 cubic metres of rock and rubble excavated so that the house could be built right in to hillside, which serves to make the very best use of the space and also enables the property to blend in to the landscape.

As you walk in to the large hallway you will begin to discover the clever practicalities that have been incorporated into the property, making it clear this was built by someone who was going to live in this house, rather than just develop and run.  There is a large storage cupboard for your coats, shoes, etc.  A large cloakroom, which also has a shower installed, which will perfectly service the two rooms on this fl oor, currently one is a used as a bedroom, whilst the other is a phenomenal home o� ce.  Cleverly this room does already have the plumbing in situ, to be able to turn what is currently used as a large storage room at the back of the bedroom, in to a large ensuite for this room, if the new owners would rather use it as a fi fth bedroom.  Each of these rooms also benefi ts from fl oor to ceiling glass doors, which open up the whole house to the outside and the balcony which runs the length of the house.

Throughout the house you’ll also find engineered oak flooring and all of the paints used are from Little Green Eco paint, carrying on the environmental considerations where possible.

Moving downstairs to the bedrooms, you’ll perhaps be surprised to realise you’re underground, as the rooms remain bright and light, and in fact you can still see the sea through the bedroom windows. There are three bedrooms down here, with access to the courtyard garden area outside the front of the house, from the sliding doors in all of them. They’re all really good sized rooms, even the smallest of the three is a large double. Further practicalities have been catered for here, thanks to an additional shower room, for the bedroom that isn’t an ensuite and also a large linen cupboard, provides excellent storage. The master suite is just that, a suite of four rooms in total, including a dressing room which would make most grown women weep with joy, whilst dreaming of all of the extra clothes they’ll be able to store, a ‘his’ dressing room, and a bathroom which is similar to that you’ll find in high end hotels, it truly is a sanctuary waiting to be enjoyed.

The sociable kitchen extends outside, thanks to the clever outdoor fi replace, which can be cooked on and there’s even an outside bathroom, meaning you don’t need to go downstairs once you’re up here.  The large terraced space leads on to a further garden area, complete with olive trees and plenty of space to have your own kitchen garden.  The top of the house has a natural living garden on top of it too, meaning it blends in to the outside space brilliantly.

All of this and you are mere minutes away from some excellent restaurants, bars, shops, one of the best bus routes in the island and of course town and schools are all within a very easy and convenient commute. The details of this property are really too lengthy to cover, you really do need to see this one to appreciate just how special it is.  I can’t imagine that Hill House will be on the market for long, I only hope that I know the new owners, as I really want to go back and sit on the swing chair in the garden with a gin and tonic and enjoy!

JEAA Members

Next month sees the JEAA and the NAEA join forces once again to host their second conference to be held at The Pomme D’Or Hotel in Jersey for all registered estate agents and associated professionals throughout the Channel Islands.The conference will invite guest speakers, both local and from the UK, to talk on a range of subjects concerning the property market here in the Channel Islands, to include talks from representatives of the NAEA and The Jersey Financial Services Commission.

President of The JEAA, John Quemard, said: “We are pleased to co-host our second major event with the NAEA which promises to be bigger and better than last year”.

Personal invitations are currently being sent out to all estate agents (including non-members and associated professionals in Jersey, Guernsey and Alderney), all of which are invited to attend this exciting venue which will take place at The Pomme D’Or Hotel on July 26th 2016 from 5.30pm onwards.

The JEAA are working hard with other local professionals to organise regular seminars throughout the year which are both informative and constructive for its members to keep up to date with current legislation.

As it stands, the JEAA now represent almost half of the islands estate agents with enquiries on the increase and new members signing up.

At some point, over the years, the majority of estate agents have been involved with the JEAA in one way or another.

“The JEAA is now a di� erent ship and one that is focused on working more closely with all estate agents in the island.

We would very much like to reach out to all estate agents and re-connect with previous members and invite them to join us once again”:, said John Quemard.
