Arbitration clauses appear in all kinds of documents. If you read a commercial lease (for a warehouse or shop for example) then it is likely to include an arbitration clause. Broadly it will say that, in the event of a dispute between the landlord and the tenant, the dispute will be referred to an arbitrator for determination. Similar clauses appear in other kinds of contracts. What does this mean? Who is an arbitrator and what will he do?

Arbitration is part of a process called alternative dispute resolution – a method to resolve a dispute without reference to the court. It is a private judicial dispute resolution determined by an independent third party.

Its advantages include:

· Speed – it is usually less formal than court proceedings and therefore faster and often cheaper.

· Confi dentiality – court proceedings are public; decisions by an arbitrator are issued to the parties involved but are not necessarily public.

· Expertise – depending on the subject matter of the dispute, the arbitrator appointed by the parties may have a qualifi cation in that fi eld e.g. an architect in the matter of a building dispute which can speed things up.

The disadvantages can be:

· Arbitration is often expressed in the agreement to be mandatory and binding.

· There are few avenues for appeal.

Arbitration and the court - power station leaseIn narrow circumstances the decision of an arbitrator can be appealed. It is usually in

circumstances where the decision he reached is obviously wrong or based on fl awed information or reasoning. The Royal Court has dealt with more than one such appeal this year but the fi rst was Public v JEC. This was an appeal against the decision of an arbitrator deciding on the rent to be levied for the land at La Collette upon which the power station is sited.

The public owns this land and the JEC lease it from the public. It was originally leased for a sum of £1,000 per annum in 1967. Subject to arbitration in the event of dispute, the lease

contained a rent review clause at various trigger dates. The clause went further and said that the decision of the arbitrator was fi nal and without appeal.

The arbitrator decided that the new revised rent was £1,000 per annum and equal to the rent charged in 1967. When examining the arbitrator’s decision the court then ruled that the arbitrator had started at the wrong starting point in law. His decision was based

on false assumptions and the revised rental should not be as it was nearly 50 years ago. As a consequence, leave was granted to appeal against his decision.

SummaryThe aim of arbitration is to provide a swift dispatch to a dispute. On public policy grounds it is desirable to conclude disputes speedily - for better or for worse. It may be di� cult to challenge an arbitrator’s decision therefore make sure that the proceedings before the arbitrator are carefully prepared and presented.

The best advice however, is to avoid the dispute in the fi rst place. Disputes are often evidence of a break down in communication. If it can be maintained then parties will often negotiate a solution. Keep talking and avoid a row. By adding a fi re pit to your garden, the days can carry on into the early hours, huddled around a crackling fi re, you’ll never want to head inside. When fi nding a location for your fi re pit, make sure you are at least 10 to 20 feet away from any trees, bushes or grass areas that could catch alight by spitting fl ames.  Also consider seating space around the fi re pit, making sure that everyone can fi t comfortably with enough space to move about. To make the wall of your fi re pit you will need to use a limestone retaining wall block. Once you have measured where your fi re pit will be built, you will need to dig out roughly 4-6 inches of dirt from the inside of the pit circle which will then be fi lled with decomposed granite or gravel.

Once the fi rst layer of wall block has been built and the granite has been added, continue to add another three layers to add height to your fi re pit. With this done, all that’s left is to fi nd some comfortable seating for you to relax in.

While this requirement has all but disappeared, the importance of the cover has not. We strongly recommend that everyone with a mortgage or other liabilities has cover in place.

Relying on an employer’s death in service benefi t is not ideal, given it is not guaranteed to remain in place for the duration of the loan and would result in the lump sum payment being used to repay a mortgage provider, rather than payable to family, for which it is designed.

JEAA Members

The Jersey Estate Agents’ Association has once again teamed up with The National Association of Estate Agents to hold their second Channel Island conference to be held at the Pomme D’Or Hotel on July 26th at 5.30pm – 8.00pm.

John Quemard, President of the JEAA, said “ Last year was such an overwhelming success that we have decided to hold a similar joint venture and look forward to welcoming existing members and non members within the industry to our second conference”.

The National Association of Estate Agents has recently appointed Shelagh Marett as Regional Executive for the Channel Islands who takes over from Andy Truscott who has since left the industry.

Over the last 12 months, The JEAA has worked very hard to strengthen relationships with its members and the National Association of Estate Agents.

Estate Agents in Jersey are not obligated to join any such memberships but for those that choose to do so, it sends out a strong message that members of the JEAA are professional, work to a code of conduct and are accountable for their actions.

A high percentage of our members have now also become members of the NAEA and The Property Ombudsman.

At a recent Annual General Meeting, the JEAA decided that all members will be required to belong to The Property Ombudsman from January 2017.

This compliments our working relationship with the NAEA and adopts the same practices that they require form their members.

This will add further confi dence in the market and o� er the customer a great deal

of comfort knowing that they are dealing with a Company that is a� liated with such memberships.

The JEAA continues to grow with more members signing up all the time.

We would also like to invite other professionals within the property industry to become associate menbers of the JEAA and benefi t from the seminars and networking events that we organize on a regular basis.
