The CREEKSIDE CONNECTION

Keep it or Dump it?

When your Board of Directors were sworn in

to serve the Pismo Creek R.V. Resort, Inc., a decision

was made to assure that the membership was kept

informed on a monthly basis of everything going on

in the Park. It was important to provide a financial

update monthly, an update of the action minutes, and

the criticality of what was happening in the Park

concerning upcoming activities and Park rule changes.

The Board also found how pleased members were

with the photographs of the Park.

Thus, the Creekside Connection was launched.

The Board of Directors appointed Inger Hudson to

serve as the Editor of the newsletter. So far the

newsletter has lived up to its goals. It has been

published monthly, and has kept the membership

informed of all financial commitments, the

maintenance upgrades to the buildings and grounds of

the Park, calendars, activities, minutes, photographs,

and several other articles.

Recently, some members have been attending

the Board Meetings and making statements that the

membership does not need the publication at all.

Others have opined that it comes too often and should

be cut back. Some members have offered that it be

published only on a quarterly basis.

It should be noted that since a very small

percentage of the total membership attends the Board

meetings, your Board felt it necessary to send out this

notification. Your Board needs to hear from

you.....the members who enjoy the newsletter and

wish to have it continue. Please call, write, or email

the Park office and voice your opinion.

Remember....if you do not act, your newsletter will be

canceled or greatly reduced in publication dates.

Thank you.

Procedure Adopted for Termination of ―Not-In-Good-Standing‖ Memberships

On May 21, 2011, the Board of Directors of Pismo

Creek R.V. Resort, Inc. adopted a procedure as per

Article III. Section 8 and 9 of the By-Laws

concerning Certificate Holders (Members) who are

delinquent on their membership dues. As you are

aware, membership dues are due on January 1st and

delinquent on January 31st.

If any membership has not been paid on the first

day following January 31st, of any year when the

Certificate Holder (membership) has failed to pay

dues and/or assessments and/or fees required, a letter

will be sent from the Board of Directors suspending

all voting privileges and all use of the Park until all

funds in arrears are brought current. The letter will

contain an additional $60.00 penalty for Failure to

pay timely. It will also include interest accruing from

February 1st, at the rate of 10% per annum.

On March 1st of that same year, if the Certificate

Holder (membership) is still a Failure to Pay, a

certified letter with a

return signature will be

sent advising the

Certificate Holder that

his/her membership will

be terminated on the

30th day following

March 1st. The letter

will include notice that

the Certificate Holder

has thirty (30) calendar

days to respond in

writing and sent by certified mail to the Board of

Directors. The letter must request a Due Process

Hearing and should include any mitigating

circumstances for the failure to pay timely. The letter

must be accompanied by all the funds that are in

arrearage as a (0300A) deposit that will be retained by

the Park.

The Certificate Holder will be notified of the time and

date for his/her Due Process Hearing. Reasonable

requests for date accommodation will be considered,

but must not exceed one (1) month beyond the

originally scheduled date for the hearing. The

decision of the Board of Directors will be final

following a Due Process Hearing. Failure to appear

for a Due Process Hearing will be deemed a voluntary

termination of the membership by the Certificate

Holder. The Certificate Holder will be notified by

certified mail of the decision of the Board of Directors

and will be postmarked within seven (7) days

following the Due Process Hearing date.

On April 1st of that

same year, if the

Certificate Holder has

failed to respond in

writing by certified

mail, the membership

will be deemed null

and void.

The 4th of July fun just kept happening…

it was great to be together...at the beach.
