    administrators, and others to learn about the educational rights of children who hadisabilities and receive special education and related services. It has been revised incorporate the changes made to the Individuals with Disabilities Education ImprovemeAct of 2004 and the Illinois special education rules and regulations which became effecti

    June 28, 2007.

    Special education laws and procedures are complicated and can be hard understand. This guide will clarify some of the procedures of special educatiohowever, it is not a complete explanation of all the special education laws. The guidoes contain information about many of the most common things readers may want

    know.If you are a parent reading this guide, your child may have been identied as havina disability or may be experiencing difculties in school. All students possedifferences, learn differently and demonstrate varied abilities. This is what makus unique. Special education is more about ability than disability. What your chican do is far more important than any perceived or actual limitations he or she may bexperiencing. Because you know your child better than anyone else, your involvemein the education process is critical. Your school district wants and needs yoinvolvement in your childs education.     Introduction: How to Use This Guide

    This guide is written for parents of children who receive or are suspected of needing speceducation and related services, teachers, education administrators and professiona

    and service providers. Special education and related services are supports and servicprovided to children with disabilities. Certain procedures must be followed to determiif a child is eligible to receive special education services. Those procedures are written federal and state laws. Special education laws and procedures can be complicated. Thguide explains the requirements in a way that relates to all groupsparents, schoprofessionals, and others.

    The Guide contains a wide variety of information about special education. Sominformation may be relevant to you now; other information might be helpful in thfuture. Whenever you refer to the guide, we hope youll nd it of value in expandin

    your knowledge of special education. As your knowledge expands, we hope your abilito make decisions that improve your childs academic outcomes increases.

    Overview

    Overview

    Child Find is an ongoing process through which all chil-dren, from birth through 21 (i.e., through the day beforethe students 22nd birthday), or who may be eligible forearly intervention, or who may be in need of special educa-

    tion services are identied, located and evaluated.

    Each school district is responsible for actively locating,identifying and evaluating all children who live within thedistrict boundaries who may qualify to receive special ed-ucation and/or related services. All school districts musthave written procedures for child nd activities for allschool children, including those attending private, char-ter, and/or religiously afliated schools. These procedures

    must describe activities for: annual screening of children under the age of ve to

    identify those who may need early intervention orspecial education services;

    ongoing review of all children in general educationclasses;

    ongoing coordination with early intervention pro-grams like Child and Family Connections, Head

    Start, local preschools and daycare facilities;

    coordination and consultation with nonpublicschools located within the district; and

    referrals of children who might require evaluationfor special education from parents, school staff, andrepresentatives from community agencies.

    ScreeningScreening is the process of reviewing all children in a giv-en group with a set of criteria for the purpose of identify-ing certain individuals for evaluations who may be in needof special education. One purpose of screening is to locatechildren, birth through age 21, (i.e., through the day beforethe students 22ndbirthday) who may benet from specialeducation services to maintain satisfactory educational

    Chapter 1: Child Find

    performance. No child can be determined eligible to re-ceive early intervention/special education and related ser-vices based only on the results of a screening procedure.

    Screening is different from evaluation. Screening gener-ally means reviewing all children in a given group (all kin-

    dergartners, all students who are new to the school dis-trict, all 3-year-old children in the community, etc.). It isnot specic to an individual child except where it is used

    by a school district to determine whether a child that hasbeen referred for evaluation is in need of evaluation. Allchildren in the group must be screened with the same as-sessment process. Screening does not involve administra-tion of assessment instruments which would be used inan evaluation. The district must inform the public of the

    process for conducting group screenings through schoolhandbooks, newsletters, child nd activities, letters, orsimilar methods. Written parent/guardian permission isnot required for this type of screening. Screening resultsshould be shared with the parents/guardians. Screeningsare done to determine which students are in need of evalu-ation. Screening may also occur when a particular childis referred for evaluation for special education in order forthe school district to determine if evaluation is necessary.

    Special education instruction and related services are avail-able for children with special needs from birth to age 21 (i.e.,through the day before the students 22ndbirthday).

    What is RtI?

    What is RtI?

    Response to Intervention (RtI) is an approach for redesign-ing and establishing teaching and learning environmentsthat are effective, efcient, relevant and durable for all stu-dents, families and educators. RtI is a general education

    initiative.

    Response to Intervention (RtI) is a process designed to helpschools focus on and provide high-quality instruction andinterventions to students who may be struggling withlearning. An intervention is a specic type of instructionthat is used to help with a specic type of problem. Inter-ventions are matched to student needs. Student progressis monitored often to check the effectiveness of the instruc-

    tion and interventions. The data collected on a studentsprogress are used to shape instruction and make educa-tional decisions. Use of an RtI process can help avoid await to fail situation because students get help promptlywithin the general education environment.

    RtI has three important parts: 1) using a three tier modelof school supports, 2) using a problem-solving method fordecision-making, and 3) using data to inform instruction.

    Part 1: Three-Tier Model of School Supports:

    In an RtI framework, resources are determined by a stu-dents needs. This framework is usually shown as a three-tier model (see Figure 1) that uses more and more intenseinstruction and interventions. The level of intensity of in-struction and interventions is determined by how a stu-dent responds to the instruction.

    As the diagram on page 10 shows, Tier 1 is the founda-tion. This is the instruction that all students receive in thegeneral education classroom with their general educationteacher. It is called Tier 1 instruction or the core instruc-tion. Schools need to make sure that the materials and in-structional practices they use are of high quality and have

    been shown by research to be effective (research-based). Re-search based interventions are teaching strategies or meth-ods that have been proven to be effective in helping children

    Chapter 2: Response to Intervention (RtI)

    learn. Another important issue related to high quality in-struction and interventions is the delity of using the ma-terials for their intended purpose. Instructional materialsare designed and developed for a specic reason and it isimportant that the materials are used as they are intended.

    Schools use a universal or school-wide screening to iden-tify students that are at risk for learning problems withthe core instruction and materials. When a screening testshows that a student is at risk for a learning problem, thestudent may receive extra help in the general educationclassroom with the general education teacher. The school

    begins a step-by-step teaching process and uses frequentassessments to determine if the teaching techniques arehelping the students. If after a brief period of time, thestudent does not show enough progress, the teacher willconsult with other staff members at the school. Togetherthe team might decide that the best way to help a studentwho has not progressed in the core instruction, even withextra help, may require Tier 2 interventions.

    Tier 2 interventions are provided with an increased levelof intensity in addition to core instruction for small groups ofstudents who show some risk of not meeting grade level

    standards. With fewer students in a group, an individualstudent has more opportunities to respond, and the teach-er has more opportunities to give immediate and appro-priate feedback to each student. The teacher can more eas-ily guide a student along the right course. Tier 2 interven-tions usually involve additional practice and skill build-ing. There are many different kinds of interventions andinstruction that can happen in the classroom, outside theclassroom or in small groups.

    Tier 3 interventions are an even higher level of intensityfrom Tier 2 interventions and are also provided in additionto core instruction. Tier 3 interventions are typically pro-vided to an individual student or perhaps two to three stu-dents at one time by a staff member. Interventions are tai-lored specically to meet the needs of each student. Stu-dents may move uidly from tier to tier as a result of their

    The steps of problem solving

    Dene the problem: Determine the gap or differ-ence between what the student is expected to do andwhat the student is actually doing.

    Analyze the problem: Use information collectedfrom a variety of sources, such as school work, tests,parents input, etc. to determine why the studentmay be having problems with learning or behavior.

    Develop and implement a plan: Set a goal that describes the expected improve-

    ment in the students learning;

    Choose the intervention(s) specic to the problem;

    Identify how the students progress will be moni-tored; and

    What is RtI?

    Carry out the interventions and check to makesure they are being done correctly.

    Monitor Progress: Collect and use student data todetermine if the intervention plan is working or ifchanges are needed.

    Part 3: Using Data to Inform Instruction

    In an RtI model, as interventions get more intensive, stu-dent progress is monitored more often. Knowing if a stu-dents performance is improving helps the team membersplan for the students learning. A small group of educatorsfamiliar with the student and the learning and behavioralexpectations and the parent(s) of the student are membersof the group that participate in the development and ongo-

    ing decision-making of the students learning plan.

    At Tier 1, data are collected and used for screening andbenchmarking of all students in important areas such asreading, math, writing and behavior. This means thatschools use the information to measure where all studentsare performing and how much progress they are mak-ing. The data also helps schools determine if their coreinstructional practices are effective for most students. AtTier 2, data are collected to determine whether the ex-tra instruction is making a difference. At Tier 3, data arecollected for the same reasons as Tier 2, but are collectedmore often so that decisions and changes to the studentsinstruction can be made sooner.

    In an RtI model, test materials or other tools used to collectdata for screening should be in line with the districts in-structional materials and practices. Progress monitoringtests should be similar across all three tiers. Additionally

    all of the screening and progress monitoring tools should be scientically, research-based. The information collect-ed from the screening and progress monitoring materialsare used to help the team answer the following questionsabout the students learning:

    Is the student making progress?

    Are the current interventions helping the student

    Te Role o Parents in an RtI Process

    Parents are important partners in all aspects of their childseducation. In an RtI process, school teams should involveparents from the beginning. Concerns about a student ex-

    periencing academic and/or behavioral difculties are pre-sented by the childs teacher to a building-level team. The building team consists of school staff who review avail-able student information and collect additional informa-tion from the parents to gain a better understanding of thestudents needs. As the process continues, parents should

    be active members of the team and participate in the prob-lem-solving process.

    If your child is identied as being at risk for learning or

    behavioral difculties, to be involved you can:

    Attend team meetings. Remember, you are the ex-pert regarding your child!

    Ask what interventions are being used for academicand/or behavioral problems.

    When possible, use the same strategies or interven-tions at home.

    Ask the school what formal guidelines they are us-ing for progress monitoring.

    Ask your school to provide you with regular prog-ress monitoring reports.

    Praise your child for any progress or general im-provement in the area(s) of concern.

    Denitions

    A referralin the context of special education services isa process asking the school district to evaluate a student todecide if the student qualies to receive special educationservices. A referral can be made either by the school dis-

    trict (through a teacher or other school personnel involvedin the students education) or by a parent or guardian. Thereferral is a required rst step before an evaluation cantake place.

    The date of referralis the date of written parental consentfor an evaluation. Screening procedures shall not be consid-ered an evaluation.

    Within 14 school days after receiving the written request,

    the district will decide whether to evaluate the child ornot. If the district determines an evaluation is warranted,then the district must provide the parents with the paper-work to provide formal written consent.

    If the district determines that the evaluation is not neces-sary, it must notify the parent in writing of the decision notto evaluate and the reasons for the decision.

    The district must advise the parents of their right to re-

    quest a due process hearing to challenge its decision.

    Parents need to submit a request for evaluation to havetheir child considered to be eligible for special educationservices. It is best to put your request in writing.

    Not all referrals result in an evaluation being conducted.

    To be eligible to receive special education services, the childmust have a disability that impacts educational perfor-

    mance. Please see Chapter 5, Eligibility Categories for fur-ther information.

    Requests for evaluation may be made by a parent of achild, an employee of a State educational agency, anotherState agency, a local school district, or a community ser-vice agency.

    Tips for Parents

    Dont forget to write a let-ter to request an evalua-tion. Asking for one is notenough!

    Keep a copy of the letter. Ifpossible, it is best to havesomeone at the school signand date that the school re-ceived the letter, or to send itcertified mail, return receiptrequested.

    Initial Eligibility: Step by Step

    Step 1: Request for Evaluation

    A request for an evaluation is made by the parent to determine thechilds eligibility for special education.

    Step 2: Decision to Proceed

    At this stage, the district meets withthe parent to determine whetheran evaluation should proceed.If yes, the district needs to determine whatdomains will be evaluated and will

    request the parents consent to do the evaluation.

    Step 3: Consent to Evaluate

    e evaluation cannot proceed until the parent has provided informed written consent for the district to begin theevaluation. Timelines for completing the evaluation do not start until consent has been given by the parent.

    Step 5: Eligibility Conference & IEP

    By the end of the 60th school day, the evaluation team must meet with the parent to decide if the child is eligiblefor special education. If yes, an IEP team must then meet with the parent to develop the IEP for the student.

    Step 6: Consent for Placement

    Before the special education services can begin, the parent must provide written informed consent to allowthe district to proceed with the placement. Placement may begin no sooner than 10 days aer theparent consents,

    unless the parent gives permission for it to start sooner.

    Step 4: Evaluation

    During a period of up to 60 school days,district personnel can take the steps needed

    to complete the evaluation. If any part of theevaluation has been written in nal form,

    it may be shared with the parent.

    Both state and federal laws and regulations governing the administration of educationalprograms for students with disabilities have recognized the important role of parentsin the special education process. Parents and school personnel should establish a posi-

    tive relationship with shared goals and a common understanding of the childs needs athome, at school, and in the community. It is essential that parents and schools work co-operatively together to improve student performance. Below you will nd some tips tohelp you with parent involvement.

    Be an active participant in your childs education:

    Inform yourself about what help is available in or through your childs school.

    Talk to other parents, teachers, doctors, and community providers.

    Find resources like the ISTAC Parents, Parent Mentors, ISBE, Parent Training, Infor-mation Centers (PTIs) and Equip for Equalitys Special Education Clinic.

    Be able to talk about your childs strengths and needs.

    Learn about your childs legal rights.

    Participate in the meetings that look at information to decide if your child is eligibleto receive special education services.

    Attend and be prepared to participate in the Individualized Education Program

    (IEP) meetings. Parents are key decision makers and an equal member of the IEPteam.

    Ask questions if you do not understand terms, language, or other things that hap-pen during your childs meeting(s).

    Call, email, or request a meeting if you are worried about how your child is doingat school.

    In addition:

    Share letters, reports, or other materials that can help the school understand yourchild and provide appropriate services to your child. This information could befrom teachers, doctors, or community agencies. Be sure to keep a copy of theseitems for your records.

    Start a le or log in which you write important dates and milestones of your childslearning. This will also be a good place to record the results of important conversa-tions and meetings you have had with teachers and others regarding your childs

    Develop an ongoing working relationship with those persons who are responsibfor providing services to your child. Get to know the names and responsibilitiesall those working with your child.

    Evaluation and Reevaluation

    Evaluation is dened regulations as procedures used todetermine whether a child has a disability and the natureand extent of the special education and related servicesthat the child needs.

    The school district must assess the child in all areas of sus-pected disability including:

    academic performance

    health

    vision

    hearing

    social & emotional status

    communication

    motor abilities

    general intelligence

    functional performance

    other areas as needed.

    Public agencies are prohibited from using a measure orassessment for purposes different from the purpose forwhich the measure was designed.

    Assessments are provided and administered in the childsnative language or mode of communication to get accurateinformation on what the child knows and can do.

    The school district must use a variety of assessments, tools,and strategies to conduct the evaluation.

    When conducting an initial evaluation, a child must betested in all areas of suspected disability.

    Data gathered from evaluations are used to assist in thedevelopment of the IEP.

    Assessments should be valid and reliable for their de-signed purposes.

    Assessments must be administered by personnel who aretrained to do so.

    Assessments and other evaluation materials used shouldbe administered:

    so as not to be discriminatory on a racial or culturalbasis, and

    in the childs native language or other mode of commu-nication.

    Parent written informed consent must be obtained beforethe evaluation can be conducted.

    Information from parents should be included as part of theevaluation.

    Information should be collected through a variety of ap-proaches (observations, interviews, tests, curriculum-

    based assessment, and so on) and from a variety of sources(parents, teachers, specialists, peers, and the child).

    Parents should be given a copy of the conference reportand recommendations.

    Parents should be informed of their right to obtain an in-

    dependent educational evaluation (IEE) at district expenseif they disagree with the evaluation ndings.

    The evaluation should yield information on what the childknows and can do academically, developmentally, andfunctionally.

    This applies when evaluating all children including those:

    for whom English is not the native language;

    who communicate by signing; who use alternative augmentative communication; and

    who use other means to communicate.

    Independent Educational Evaluation (IEE)

    one test, measure, or assessment procedure. A varietyof tools must be used.

    As a parent, you can agree or disagree to any or all ofthe testing.

    Think about what the child knows and can do. Exam-ine how the child learns and demonstrates knowledge.

    It is not enough to conduct a thorough examination ofwhat a child cannot do when making decisions abouteducational programming.

    Independent Educational Evaluation (IEE)

    Sometimes parents may have a reason to believe that theevaluation does not provide an accurate picture of theirchilds abilities/areas of needs. In those cases, parents canrequest in writing that a new evaluation be completed byan outside person or agency (someone not employed by thedistrict). The district is free to agree to the evaluation orto deny the request. The district must provide its answerwithin ve (5) calendar days of the parents request. If thedistrict denies the request, it is required to initiate a due

    process hearing in order to allow a due process hearing of-cer to decide whether the evaluation should occur. (SeeSection 11 for more information on due process hearings.)

    Disability Category Denitions

    IDEA lists different disability categories under whichchildren may be eligible for services. For a child to beeligible for services, the disability must affect the childseducational performance. Students may qualify forservices under one or more categories. These categories

    do not tell the whole story of the student. Categories alonedo not identify where the student will go to school ordetermine what kind of services they need.

    A child may not be identied as a child with a disabilityjust because he or she speaks a language other than Englishand does not speak or understand English well. A childmay not be identied as having a disability just because heor she has not had enough instruction in math or reading.

    Disability Category Denitions

    Unless otherwise stated in the denitions below, thefollowing 14 special education eligibility categories arefound at 34 CFR 300.8.

    Autism

    Autism means a developmental disability signicantly

    affecting verbal and nonverbal communication andsocial interaction, generally evident before age three,that adversely affects a childs educational performance.Other characteristics often associated with autism areengagement in repetitive activities and stereotypedmovements, resistance to environmental change or changein daily routines, and unusual responses to sensoryexperiences. Autism does not apply if a childs educationalperformance is adversely affected primarily because the

    child has an emotional disability. In addition, autismshall include, but not be limited to, any Autism SpectrumDisorder that adversely affects a childs educationalperformance.

    Cognitive Disability

    Cognitive disability means signicantly below averagegeneral intellectual functioning, existing concurrentlywith decits in adaptive behavior and manifested during

    the developmental period that adversely affects a childseducational performance.

    Deaf-Blindness

    Deaf-blindness means concomitant hearing and visualimpairments, the combination of which causes such severecommunication and other developmental and educationalneeds that they cannot be accommodated in special

    education programs solely for children with deafness orchildren with blindness.

    Deafness

    Deafness means a hearing impairment that is so severe thatthe child is impaired in processing linguistic informationthrough hearing, with or without amplication thatadversely affects a childs educational performance.

    Developmental Delay

    A delay in physical development, cognitive development,communication development, social or emotionaldevelopment, or adaptive development (may includechildren from three through nine years of age). (23 IAC226.75)

    Emotional Disability

    An emotional disability means a condition exhibiting oneor more of the following characteristics over a long periodof time and to a marked degree that adversely affects achilds educational performance:

    Emotional disability includes schizophrenia.

    Hearing Impairment

    A hearing impairment is one that is either permanent oructuating and that adversely affects a childs educationalperformance, but that is not included under the denitionof deafness.

    Multiple Disabilities

    Multiple disabilities means a combination of variousimpairments that cause such severe educational needsthat they cannot be accommodated in special educationprograms solely for one of the impairments. Multipledisabilities does not include deaf-blindness.

    Orthopedic Impairment

    An orthopedic impairment means a severe orthopedicimpairment that adversely affects a childs educationalperformance. The term includes impairments caused bya congenital anomaly, impairments caused by disease(e.g., poliomyelitis, bone tuberculosis), and impairmentsfrom other causes (e.g., cerebral palsy, amputations, andfractures or burns that cause contractures).

    Other Health Impaired

    Other health impairment means having limited strength,vitality, or alertness, including a heightened alertness toenvironmental stimuli, that result in limited alertness with

    asthma, attention decit disorder or attention decithyperactivity disorder, diabetes, epilepsy, a heartcondition, hemophilia, lead poisoning, leukemia,nephritis, rheumatic fever, sickle cell anemia, andTourette syndrome; and

    Adversely affects a childs educational performance.

    Specic Learning Disability

    Specic learning disabilitySpecic learning disabilitymeans a disorder in one or more of the basic psychologicalprocesses involved in understanding or in using language,spoken or written, that may manifest itself in the imperfectability to listen, think, speak, read, write, spell, or to domathematical calculations, including conditions such

    as perceptual disabilities, brain injury, minimal braindysfunction, dyslexia, and developmental aphasia.

    Speech or Language Impairment

    Speech or language impairment means a communicationdisorder, such as stuttering, impaired articulation, alanguage impairment, or a voice impairment, that adverselyaffects a childs educational performance.

    Traumatic Brain Injury

    Traumatic brain injury means an acquired injury to the brain caused by an external physical force, resultingin total or partial functional disability or psychosocialimpairment, or both, that adversely affects a childseducational performance. Traumatic brain injury applies

    Overview

    IDEA 2004 expanded the specic learning disability deter-mination to require States to adopt criteria that

    does not require the use of a severe discrepancy be-

    tween intellectual ability and achievement in deter-mining whether a child has a specic learning dis-ability;

    must permit school districts to use an educationalprocess based on the childs response to scientic,research-based instructional interventions; and

    may permit the use of other alternative research- based procedures for determining whether a child

    has a specic learning disability.Schools in Illinois shall, no later than the beginning of the2010-2011 school year, implement the use of a process thatdetermines how the child responds to scientic-research-

    based interventions as part of the evaluation procedure.

    Special Education Eligibility Considerations

    Within a scientic, research-based intervention process,such as RtI, school teams are able to use student prog-ress data collected at each tier to document a students re-sponse to scientic, research-based interventions as part

    of the special education evaluation process. Evaluation todetermine special education eligibility may occur at anytier, although it typically occurs within Tier 3 when a stu-dent either:

    Does not respond to the most intensive interventionsor

    Responds to the interventions but is not able to main-tain his/her performance if the intensity level is de-

    creased or the interventions are faded.

    It is also important to note that a parent may request a spe-cial education evaluation at any point during the interven-tion process. The use of the RtI process cannot delay theevaluation, if needed. The district must fully consider theparents request and decide whether or not to conduct theevaluation. The district must then notify the parents in

    State special education regulations require that by the 2010-2011 school year, school districts must use an RtI processas part of the special education evaluation process when aspecic learning disability (SLD) is suspected. After using

    an RtI process for this purpose, a district may also, but isnot required to, use a severe discrepancy between intel-lectual ability and achievement as part of the evaluationprocess for determining whether a child has a SLD. How-ever, they will not be able use severe discrepancy alone todetermine eligibility.

    ISBE recognizes that some districts are currently furtheralong in the implementation of RtI and may implement

    What is an IEP?

    What is an IEP?

    Once it is determined that a student meets the criteria toreceive special education and related services, an Individ-ualized Education Program (IEP) will be developed. AnIEP is a written statement of the educational program de-

    signed to meet the students needs and is developed by ateam. The IEP includes a detailed description of what will

    be done to give the student the extra help needed. The IEPwill change based on the students needsit is like a roadmap showing where the student is and where he or she isgoing.

    Who is on the IEP team?

    The following individuals are required to attend all IEPmeetings:

    Parent(s) - Parents are equal participants.

    Student The student may attend and participate ifthe parent(s) decide he/she should be present.

    General Education Teacher - The IEP team must in-clude a general education teacher who has knowledgeof the curriculum and may be responsible for imple-menting the IEP, if the child is, or may be, participatingin the general education environment.

    Special Education Teacher - There must be a specialeducation teacher on the IEP team who is responsiblefor implementing the IEP.

    School Administrator - This person must know aboutthe general education curriculum and be able to ensurethat the IEP is implemented and has the authority tocommit resources.

    Evaluation Personnel - This person must be someonewho can explain evaluation and/or test results.

    Others with knowledge or special expertise aboutthe student - The parents or the school may bring oth-

    Annual goals

    A goal is something that can be obtained within a school

    year. Data should form the basis for instruction and thegoals should be written to allow access to the general cur-riculum and other activities during or after school. Goalsmust be measurable, identify who will be responsible forworking on them, and identify how progress will be re-ported to parents.

    Benchmarks or short-term objectives

    Short-term objectives are the steps toward meeting thegoals. A short term objective is something that can be at-tained within a reporting or grading period. Each bench-mark or short-term objective should list the steps neces-sary to achieve the goal by the end of the school year.

    Progress toward goals

    The IEP should include information about how the school

    will measure the students progress and when reports tothe parents will be issued. The measurement should beclear enough so that parents can understand whether theirchild is being successful or not.

    Special education and related services

    These services and supports assist the student to advancetoward the annual goals, progress in the general curricu-

    lum, participate in extracurricular and nonacademic activ-ities, be educated and participate with all children. TheIEP should include any additional training or supportneeded by the parents, educators, and paraprofessionals.

    Statewide assessment

    All children with disabilities must be part of state and dis-trictwide assessments with appropriate accommodations,including English language prociency, where appropri-ate. The IEP team decides whether the student should begiven state and/or district assessments, with or without ac-

    commodations; or if the student should take the alternateassessment.

    If the IEP team decides that the child should take the Illi-nois Alternate Assessment (IAA), the IEP must include:

    An explanation of why the child cannot take the regu-lar test

    The participation criteria has been met by a Yes re-sponse to the two (2) statements in the IAA Participa-

    tion Guidelines (see Appendix D)

    A statement explaining how the student will be as-sessed

    Frequency, location, and duration of services

    This is the what, when, where, and for how long: part ofthe IEP. Each of the services the student needs should be

    written into the IEP and indicate: 1) how long or how ofteneach session will last (the number of minutes); 2) wherethe services will be provided (i.e., general education class-room, a resource room, or another setting such as the com-munity); and 3) when the services will begin and end.

    Transition

    For students who will reach the age of 14 during theschool year, the IEP must document a statement of transi-tion service needs that focuses on the students course of

    study and goals to address those needs. Transition servicesare a coordinated set of activities that focuses on improv-ing academic and skill achievement to prepare for life afterschool. The goals should include the needs for: training,education, employment, and independent living, whereappropriate. Transition services may include academic in-struction, related services, postsecondary education, vo-cational training, supported employment, community ex-periences, daily living skills, and work evaluation. Tran-

    sition plans must include the students strengths, prefer-ences, and interests. The student must be invited to theIEP meeting.

    In preparing for the meeting, parents should:

    Think about what the child needs to learn to help thembe successful after graduation

    Help students explore work and career options whilestill in high school

    Decide what skills the young person needs to live andwork in the community after high school

    Make connections with education and training pro-grams, colleges, agencies, and support services

    Assist in the selection of classes and services that mighthelp the child be successful in his/her adult life

    Learn what agencies provide services to adults with

    disabilities in the community and invite them to theIEP meeting.

The district must inform the parentsand student of the students right to delegate decision-mak-ing to another adult individual. At least one year beforeturning 18, the parents and the student will receive notices

    in writing from the school about the change. The districtmust document that the parents and the student received thenotice and were told about the transfer of rights. The schoolmust provide the student with a Delegation of Rights form(see ISBE form 34-57k located at www.isbe.net/spec-ed/pdfs/nc_deleg_34-57k.pdf). The school must use the ISBE form or onethat is substantively the same.

    The Delegation of Rights:

    May be terminated by the student at any time Will remain in effect for one year

    Must be signed by the student and the designee

    Can be renewed each year

    Extended school year services (ESY)

    These are special education and related services that 1)

    are provided to a student with an IEP beyond the normalschool day/year, 2) are stated in the students IEP, and 3)are provided at no cost to the parents of the student. Thedecision about what services will be provided should beindividually based on the needs of the student. Loss ofknowledge/skills or an extraordinarily long time in re-learning skills (regression/recoupment) can be part of, butnot the only reason for determining ESY. No single factorcan determine ESY, and ESY services may not be limited

    to particular categories of disability. ESY services may notbe the same as services provided during the regular schoolyear. The IEP team determines what services are provid-ed during the ESY term. ESY services can be provided inschool, at home, or in the community.

    Other IEP Considerations

    In addition to the required parts of the IEP described inthe previous section, the following components can also

    be part of the IEP. The decision to add one or more of thefollowing pieces will depend on the nature of the childs

    disability and how it impacts the childs performance inschool.

    Behavior

    If a childs behavior gets in the way of his/her learning orthe learning of other students, then the IEP team should con-sider the use of positive behavioral interventions and sup-ports. (See also Chapter 9: Behavioral Intervention Plans.)

    The IEP of a student who requires a behavioral interven-tion plan (BIP) shall:

    summarize the ndings of the functional behavioralassessment;

    summarize prior interventions implemented;

    describe any behavioral interventions to be used, in-cluding those aimed at developing or strengthening al-

    ternative or more appropriate behaviors;

    identify the measurable behavioral changes expectedand methods of evaluation;

    identify a schedule for a review of the interventionseffectiveness; and

    identify provisions for communicating with the par-ents about their childs behavior and coordinating

    school-based and home-based interventions.

    Limited English Prociency (LEP)

    The language needs of a student who has difculty un-derstanding and speaking English must be considered bythe IEP team. The IEP must include a statement as to thelanguages or modes of communication in which special

    education and related services will be provided, if otherthan or in addition to English. The IEP should also noteany English language learning services the student mayrequire, along with necessary support services.

    Braille

    For a student who is blind or visually impaired, the schoolshall provide for instruction in Braille and the use of Brailleunless the IEP team determines, after an evaluation of thechilds reading and writing skills, needs, and appropriatereading and writing media (including an evaluation of thechilds future needs for instruction in Braille or the use ofBraille), that instruction in Braille or the use of Braille is not

    appropriate for the child. For a child who is functionallyblind or visually impaired to the extent that Braille instruc-tion is determined necessary, the IEP team must considerthe students reading and writing skills, the students com-munication needs, the students use of reading and writingmedia, and the students future needs for instruction inBraille or the use of Braille

    Communication needs

    The communication needs of the student must be consideredby the IEP team. An IEP shall be considered linguistical-ly and culturally appropriate if it addresses the languageand communication needs of a student as a foundation forlearning, as well as any cultural factors that may affect thestudents education. For students who are deaf or hard ofhearing, the IEP team must consider the students languageand communication needs and opportunities for direct com-

    munications with peers and professional personnel. Theneeds must address the students language and communi-cation mode. The IEP team must consider the students aca-demic level and full range of needs, including opportunitiesfor direct instruction in the childs language and communi-cation mode.

    Assistive technology

    The term assistive technology encompasses a broadrange of devices from low tech (e.g., pencil grips, splints,paper stabilizers) to high tech (e.g., computers, voice syn-

    thesizers, Braille readers). These devices include the entirerange of supportive tools and equipment from adaptedspoons to wheelchairs and computer systems for environ-mental control. Assistive Technology is technology used

    by individuals with disabilities in order to perform func-tions that might otherwise be difcult or impossible. Con-sideration should be given to the needs of the student forassistive technology devices and services. The IEP teammust decide if the student needs assistive technology devices

    and services in order to receive a Free, Appropriate, PublicEducation (FAPE).

    Additional Requirements or Students Who Have aDisability on the Autism Spectrum

    Recent changes to the Illinois School Code now require IEPteams to consider additional factors for students who havea disability that falls within the Autism Spectrum. If the

    student has a disability on the autism spectrum (which in-cludes autistic disorder, Aspergers disorder, pervasive de-velopmental disorder not otherwise specied, childhooddisintegrative disorder, and Rett syndrome, as dened inthe Diagnostic and Statistical Manual of Mental Disorders,fourth edition [DSM-IV, 2000]), the IEP team shall considerall of the following factors:

    The verbal and nonverbal communication needs of thechild.

    The need to develop social interaction skills and pro-ciencies.

    The needs resulting from the childs unusual respons-es to sensory experiences.

    The needs resulting from resistance to environmentalchange or change in daily routines.

    Changes to IDEA in 2004 now make it possible for membersof the IEP team to be excused from an IEP meeting. Theimportant thing to remember is that excusal can only oc-cur if the parent and the district agree to excuse the teammember from the meeting.

    Changes to the IEP Without a Meeting

    must ask parents to sign a form that states that they un-derstand that the IEP has been changed. The school mustmake sure that the IEP team knows about the changes andmust give an updated copy to the parent. 34 CRF 300.324(a)(4)(ii).

    Prior Written Notice

    There are certain times when the school must put in writ-ing its decisions about the childs education and state thereasons for those decisions. This written communicationis called prior written notice. Parents have the right to re-ceive prior written notice whenever the school wants to dosomething or refuses to do something such as:

    Evaluate the child

    Change the childs disability category

    Change the childs educational placement,

    Change the way in which the child is provided a free,appropriate public education (FAPE), or

    Terminate special education and related service in re-sponse to a parents revocation of consent for specialeducation placement.

    Sometimes the school tells parents about its decision overthe telephone, in a meeting, through an email, or in a con-versation. However, even if the school informs the parentin one of these ways, the school still must provide the par-ents with prior written notice before it can proceed.

    Revocation o Consent

    If the parent agrees to allow the school district to make the

    student eligible for special education and related services,the parent has the right at any time to revoke consent forspecial education services. However, it is very importantfor the parent to understand that if consent for special edu-cation is revoked, the school district must terminate allspecial education services. As a result, the student will

    be considered a general education student and will no lon-ger receive any services set forth in the students IEP.

    In order to revoke your consent for special education, Il-linois law permits the parent to do so either in writingor orally (Federal law only allows you to revoke in writ-ing). But to ensure that the revocation is received by thedistrict, it is highly recommended that the parent provide

    the revocation in writing, or follow up the oral revocationwith a short letter conrming that the parent has revokedconsent for special education.
