As per the Ex-Servicemen (Re-deploymentin Goa General Services & Posts) Rules, 1997,Ex-servicemen are eligible for appointment inGovernment service. The Ex-servicemeninclude retired person from Army, Navy andAir Force. However, the said rules weremodified, vide Notification No. 01/49/95-PERdated 30-5-2013 whereby following CentralArmed Police Force namely, Central ReservePolice Force (CRPF), Border Security Force(BSF), Central Industrial Security Force (CISF),Indo-Tibetan Border Police (ITBP) and Sahastra

Seema Bal (SSB) were included asEx-servicemen for the purpose of reservationin Government job.

In view of the above, all the GovernmentDepartments are required to advertise andconsider the filling of posts, reserved for Ex--servicemen from the Army, Navy and AirForce, including Central Armed Police Force.

However, it has been observed that some ofthe Departments do not consider applicationsfrom the Central Armed Police Force for thevacancies reserved for Ex-servicemen.

In this regard, it is once again reiterated thatvacancies reserved for Ex-servicemen shouldalso include personnel of Central Armed PoliceForce such as CRPF, BSF, CISF, ITBP and SSB,which should clearly mention in theadvertisement while calling for applications.

This shall be applicable from the date ofNotification dated 30-5-2013.

This is for strict compliance by allconcerned.

The Government of Goa, in supersession toall previous Notifications published in theOfficial Gazette in this behalf, hereby makesthe following rules namely:—

1. Short title and commencement.— TheseRules may be called the Goa MediaRepresentatives Accreditation Rules, 2014.

2. They shall come into force from the dateof their publication in the Official Gazette.

3. Definition.— In these rules, unless thecontext otherwise requires:—

(a) “Government” means the Governmentof Goa;

(b) “Member Secretary” means theDirector of Information & Publicity of theGovernment;

(c) “Newspaper” means any publication,printed and distributed at fixed intervals,which contains news and comments ofpublic interest as defined in the Press andRegistration of Books Act (25 of 1867) butnot a publication containing information ofsectional interest such as house journals;

(d) “State” means the State of Goa;

(e) “Working Journalist” means aworking journalist as defined in the WorkingJournalist and other Newspaper employees(conditions of Service) and MiscellaneousProvisions Act, 1955 (45 of 1955), asamended from time to time;

4. Amendment to rules.— These rules maybe amended/altered/modified/added to, onthe recommendation of the Committee, if aproposal to this effect is made to theCommittee, by at least three of its members orthe Member Secretary.

5. Application of rules.— These rules shallapply to the accreditation of mediarepresentatives to the Government.

(i) Accreditation: Recognition granted tore p o r t e r s / c o r re s p o n d e n t s / e d i t o r s //cameramen of media organizations (asdefined in sub clause 4) to have access tonews materials, written and pictorial; tooffices and officers of the Government at theHeadquarters and other centre forgathering news; access for laws, rules,notifications, press releases, backgroundpapers, etc., of the activities of theGovernment; for invitations and admissionwithout any hindrance to functions, pressconferences, statutory events and otheractivities of the Government; facilities interms of travel, research, documentationetc. relating to news gathering. Theaccreditation should be availablethroughout the State, as decided by theCommittee.

(ii) Correspondent/Reporter/MediaRepresentative: A Working Journalistemployed by a newspaper, magazine, newsagency, television channel, radioorganization or news portal, together andfile news items regularly for the newspaper,magazine, television channel, radioorganization or news portal, as defined inclause 2 (iv) of these rules. The definition ofWorking Journalist for print media,including newspapers, magazines andnews agencies, shall be generally the sameas the definition in the Working JournalistAct.

(iii) Cameramen: Still and televisioncameramen employed by mediaorganizations for taking picture orvideograph news events.

(iv) Editor: Editor of a Newspaper,magazine, television channel, radioorganization, news portal, who is in chargeof news selection and editorial policy ofthe organization, including Chief Editor,Editor-in-Chief, Managing Editor, ExecutiveEditor, Resident Editor.

(v) Media Organization: Newspaper,magazine, television channel, radioorganization, news portal, recognized byGovernment of Goa under relevant laws andrules like PRB Act, up linking Guidelines forTelevision Channels, Prasar Bharati Act,DFP, PIB, Department of Information &Publicity etc.

(vi) News Media: shall includenewspapers, wire service and non wireservice, news agencies, news featureagencies, electronic media agencies, newsportals containing news and comments onpublic news.

(vii) Newspaper/Magazine: shall have thesame definition as given in the Press andRegistration of Books Act, 1867. A Dailynewspaper shall be published on not lessthan five days in a week; A Weekly orFortnightly newspaper shall have not lessthan 42 or 22 issues in a year respectively.A monthly shall not have less than 10 issuesin a year. Magazines shall have 100 percentnews content.

(viii) News Agency: shall be wire and nonwire organizations which supply news ona minute to minute or daily basis to a numberof media organizations, both print andelectronic. It should be registered underShops and Establishment Act, CompaniesAct etc. at the time of commencement andits standing should be more than 3 years inthe State of Goa.

Agency shall have minimum 3 payingsubscribers from among accreditednewspapers and media units in the State.

(ix) News Feature Agencies: shall beagencies which supply news and featuresbased on current affairs to newspaperorganization on a weekly or fortnightlybasis. It should be registered under Shopsand Establishment Act, Companies Act etc.at the time of commencement and itsstanding should be more than 3 years in theState of Goa.

— Agency shall have minimum 3 payingsubscribers from among accreditednewspapers and media units in the State.

— The applicant shall submit clippingsof the articles by concerned news featureagency published in different newspapers//magazines of the State for a period of 3months prior to the date of application foraccreditation.

(x) Radio Organization: means any mediaorganization which broadcast newsbulletins and carries current affairsprogrammes, including All India Radiowhich operates under the Prasar BharatiAct.

(xi) Television Channel: (a) Include TVservice providers operating in Goa andhaving news telecast of minimum 3 hoursper day. (b) Shall have the same meaningas News and Current Affairs Channelspermitted under Guidelines of the Ministryof Information and Broadcasting. Thisincludes the news channels of Doordarshan

operating under the Prasar Bharati Act. (c)Include TV service providers operating inGoa and having news telecast of maximum3 hours per day. The organization runningthe channel should be registered as a mediahouse with the Government either underCompanies Act, Shops and EstablishmentsAct or any other recognized authorityformed by the Government for this purpose.Its standing should be more than 3 years inthe State of Goa.

— Having news telecast of minimum 3hours per day. Its standing should be morethan 3 years in the State of Goa.

(xii) Television and Radio News Agency:shall be media organizations which providesnews clips and feeds to television channelsand radio stations.

— It should be registered under Shopsand Establishment Act, Companies Act etc.at the time of commencement and itsstanding should be more than 3 years in theState of Goa.

(xiii) News portals/news serviceproviders: are news and current websiteswhich provide continuous news coverageand current affairs features for minimumperiod of 02 years.

— Only news portals run by entities dulyregistered under Companies Act, Shops andEstablishment Act as a media house shallbe considered for the accreditation. Newsportals/news service providers Hall have100 per cent news content.

— Its articles should be on current social,political, economic and other matter ofpublic interest.

6. Accreditation Card.— The Director ofDepartment of Information & Publicity,Government of Goa who also function asMember Secretary shall issue a photo identitycard to all reporters/correspondents/news//cameramen/videographers and editors to

whom the accreditation is granted by theCommittee, and whenever necessary, the cardshould have authorization to enter all premisesof the Central and State Governments, withoutany requirement of obtaining visitor pass.

7. Committee.— Committee formed by theGovernment for considering and sanctioningof accreditation, and to recommend stepsfor facilities for news gathering byaccredited correspondents and newsorganizations.

8. The Press Accreditation Committee.—Shall be a permanent organization, whosemembership will change every two years.There shall be no discontinuity in thefunctioning of the Committee and it shall bethe responsibility of the Government to ensurethat the nomination of fresh members isnotified before the term of the earlier teamexpires. In case the Government is unable tonominate the new members, the oldCommittee will continue until the newCommittee is constituted.

9. (a) The Press Accreditation Committeeshall consist of not less than 10 members,representing various recognized mainstreammedia organizations.

(b) The Accreditation Committee formed bythe State Government shall have 03representatives of the Editors Guild, 08representatives of Goa Union of Journalists//out of which 04 shall be from print media, 01shall be news photographer, 02 from electronicmedia, (one cameraman and one newsgatherer) and 01 sports reporter preferablyrecommended by the respective organization.

(c) No member shall continue for more thantwo consecutive terms.

10. The Director of Information & Publicityshall be Member Secretary. The MemberSecretary shall be responsible for conveningthe meetings of the Committee, scheduling theagenda and for implementing the decisions ofthe Committee. The Joint Director of

Information and Publicity shall assist theMember Secretary. Both shall have no rightto vote.

11. The Chairman of the Committee shall bea senior journalist, who shall be elected by theCommittee through a majority vote. TheChairman shall have minimum 10 yearsexperience as Working Journalist (preferablyaccredited) and shall be ineligible for a secondconsecutive term.

12. The Committee shall meet once in amonth, last Friday, if not feasible 1st Friday offollowing month or more frequently, ifconsidered necessary. The quorum shall be50 percent of the total membership.

13. The Committee shall admit newspapers,news agencies, magazines, TV channels, radioorganizations, news portals provided theyfulfill the basic criteria of providingcontemporaneous news to their readers,subscribed, viewers, listeners as the case maybe. They should carry at least 100 per cent ofits contents as news/comments of generalpublic interest. The decision of the Committeeon whether the applicants carry 100 per centof content as news is final. These organizationsmust have been officially registered underrelevant Act and rules and functioning asnews organization for a period of at least sixmonths before they are eligible foraccreditation as an organization. However, ifa publication changes the periodicity ofpublication but continues to carry minimum100 per cent of contents as news, currentaffairs comments of general public interest,then its admission shall continue.

— The nature of the content published//telecast shall be responsible, impartial andnon-communal in nature.

14. However, if the Committee isunanimously satisfied that news organizationneeds temporary accreditation from the dayit starts the operations, then the Committeemay grant few accreditation to the applicantorganization.

15. (a) The newspapers registered, printedand published in Goa are entitled for 03reporters, 01 sports repor ter, 01 newsphotographer based at headquarter at Panajiand 01 reporter, 01 news photographer and01 sports reporter in South.

(b) TV service providers operating in Goashall be entitled for Press accreditation to tworeporters and two cameramen each.

(c) Periodicals like monthlies, fortnightliesand weeklies are entitled for Pressaccreditation to one reporter and one newsphotographer.

(d) Media organizations like PIB, DDK(News), AIR (News) shall be entitled fortwo repor ters and one photographer//cameraperson while the DIP, StateGovernment Media agency is entitled for 2reporters (media officials), 01—photographer;1 videographer and in addition 02—reporters(media officials) in the South.

16. Effect of accreditation.— (1)Accreditation does not confer any officialstatus on the media representatives but shallrecognize and identif y him/her as aprofessional journalist dealing with news ofpublic interest. He/she shall not have letterheads, visiting cards and display boards withthe words “Accredited to the Government ofGoa” or any words to similar effect.

(2) Accreditation shall be used forjournalistic purpose and for no other purpose.

17. Accreditation is Personal.— Accredi-tation is personal and not transferable.

18. A minimum of three years experienceat a stretch in prominent news organization,is required to consider the application of ane d i t o r / r e p o r t e r / c o r r e s p o n d e n t //photographer/TV cameraman-reporter//media official for accreditation to theGovernment of Goa. The journalist seekingaccreditation shall furnish the prescribedapplication form duly filled authenticated by

the editor/publisher along with the companyletterhead signed by the editor and encloseappointment /contract letter/latest salary slip//proof of birth. Appointment should be of fulltime journalist. In case of TV service providersin Goa, the applications should be routedthrough Electronic Media JournalistsAssociation (EMJA) and should have beenapproved at their General Body meetingbefore forwarding to the PAC. Educationalqualifications in case of electronic media localnews channel journalists should be atleastSSC with course in journalism.

19. For the purpose of accreditation, editorshould be considered as being engaged inthe news gathering and should be givenaccreditation. The Committee shall satisfy itselfthat the applicant is fully employed in the newsorganization by asking for the news clippings,video clips, radio clips etc. apart fromemployment certificate, a certificate from thepublisher that the applicant is engaged in thenews reporting. The accreditation of editorshall be recommended by the publisher. TheCommittee shall not give accreditation toadvertising or sales persons who put in a claimthat they are also correspondents.

20. On satisfaction that the applicant meetsthe criterion to be an accreditedcorrespondent, the Committee shall permitgrant of accreditation, subject to theavailability of the quota of the newsorganization.

21. The Member Secretary shall issue theaccreditation card for journalist within afortnight of the date of approval by theCommittee. The fee of Rs. 150 perAccreditation Card shall be paid by thejournalist, subject to revision. In case ofduplicate/renewal of accreditation card thejournalist will have to pay additional fee ofRs. 150/-.

22. In case the Committee rejects theapplication of a media, organization, or ajournalist on behalf of a media organization foraccreditation, then the applicant organization/

/individual shall be informed the reasons forrejection in writing within a fortnight. Theapplicant organization/individual can makeamends or place other relevant facts beforethe Committee for reconsideration withina month’s time on receipt of letter fromMember Secretary. However, the Committee’sdecision, after such reconsideration, shall befinal.

23. The Committee can grant accreditationto senior journalists, who are freelancing,provided they have been continuously workingfor news organization for last 25 years,provided they show evidence that their mainvocation is of journalism and that they areearning their livelihood through journalism.

24. The Committee may grant specialaccreditation to journalists on application inprescribed form, self authenticated who havedone a long and distinguished service asaccredited correspondents provided they areabove 58 years of age and were accreditedfor minimum period of 15 years; and areactively pursuing journalism at the time ofrecognition of their services. The accreditationissued in this category is only a recognitionand shall not accrue any benefit as extendedto regular accredited journalist.

25. The accreditation cards issued toe d i t o r s / r e p o r t e r s / c o r r e s p o n d e n t s //cartoonists/news photographers/TVcameramen, etc. shall be valid for a period oftwo years. Under the general directions of theCommittee, the Member Secretary shallrenew the accreditation of all accreditedjournalists once in two years, ensuring thatthe accredited journalist is not deprived of thefacility even for a single day. The Committeeshall consider/treat as cancelled theaccreditation card of accredited journalist whofails to renew the same within period of 30days.

26. In case a correspondent/repor terwho work for more than one organization,and requests for additional accreditation,the Committee may not entertain suchapplications to grant additional accreditation.

27. All Government Ministries, Departments,undertakings and other wings shall provideaccess and information to accreditedjournalists, and they shall not discriminateamongst accredited journalist fordissemination of news.

28. The Committee shall withdraw theaccreditation, provided:—

— The editor informs the Committee thatthe journalist has reassigned within theorganization.

— The editor informs the Committee thatthe news organization has closed down/or isno longer carrying 50 per cent content asnews.

— The journalist is no longer an employeeof the news organization.

— If a journalist has been censured at leasttwice by the Press Council of India forprofessional misconduct.

— If the Committee were to come to theconclusion that the journalist has made grossmisuse of the accreditation facility, then heshall be given an opportunity to answer thecharges, and the Committee shall record itsreasons for withdrawal of accreditation.

29. Provision.— As journalists enjoy theprotection of the Constitution, theAccreditation Committee shall ensure that theaccreditation is not cancelled for any malafideor frivolous reason by the State Governmentor any politician or official who have a grudgeagainst journalists publication news whichmay be unpalatable. No media organizationor journalist shall be deprived of accreditationmerely on the ground that he had publishedwhat was claimed to be an official secret, orthat he has published reports which areunfavourable to the Government or itsMinisters or Officials.

by news organization and journalists, theCommittee shall discuss and recommendmeasures for providing additional facilitiesto news organizations and journalists toimprove the quality of news dissemination.

(b) Editor/journalists deputed by editorsof newspapers, magazines, news agencies,television and radio organization, newsportals who are accredited by a StateAccreditation Committee shall beconsidered eligible for accreditation to theGovernment of India as its headquarters inNew Delhi and offices in State capital/s, eventhough they may not be residing in theNational Capital Region, with a view toensure that the news relating toGovernment of India is disseminated in allregions and editors/accredited journalistsfrom all over India have access toGovernment of India’s offices.

30. Government media organization viz. theDepartment of Information & Publicity, PressInformation Bureau of Government of India,News Services Division of All India Radio, theNews unit of Doordarshan, the Photo Divisionof Government of India may be deemed asequivalent to experience the work in a newsmedia organization for the purpose ofaccreditation. Those officers havingexperience of Journalistic Work in Media Unitof the Information and Publicity Departmentof the State Government other than thosereferred to above, may also be considered forthe purpose of accreditation, if the Committeewould be satisfied about their journalisticexperience.

31. Accreditation card for pressrepresentatives.— (1) Accreditation cardbearing a passport size photograph of themedia representatives will be issued to anaccredited media representative by theMember Secretary.

(2) The accreditation card will normally beutilized for attending press conferenceconvened by the Government, or anyauthorized Government officer and for entryinto Government Offices.

(3) The accreditation card shall not beadmissible for attending special functions orconferences, where entry is covered byspecial invitation cards and security passes.

(4) The accreditation card will entitle theholder to receive the facilities provided to him//her by the Government from time to time inrespect of medical, transport, housing,Government accommodation in the State ofGoa.

32. Power of Government to take actiondeemed fit.— Notwithstanding anythingcontained in these rules, the Government shallbe free to take any action warranted bycircumstances in matters relating toaccreditation and disaccreditation and ingiving press facilities and in all these cases,the Government decision shall be final.

2. Amendment of rule 1.— In rule 1 ofthe Goa, Daman and Diu Inland VesselsRegistration Rules, 1965 (hereinafter referredto as the “principal Rules”), the expression“Daman and Diu” shall be omitted.

3. Amendment of rule 2.— In rule 2 of theprincipal Rules, in clause (c), the expression“Daman and Diu” shall be omitted.

4. Amendment of rule 10.— In rule 10 of theprincipal Rules, for sub-rule (1) the followingsub-rule shall be substituted, namely:—

“(1) If a vessel has been destroyed orrendered permanently unfit for service, theowner thereof shall, within one month,report the fact to the Registering Authority

in Form VII and shall also forward to thatauthority the Certificate of Registration ofthe vessel accompanied with a challan forhaving credited into a GovernmentTreasury a sum of Rs. 2,000/-. TheRegistering Authority shall then have theCertificate of Registration cancelled”.

5. Insertion of new FORM No. XVI.— In theprincipal Rules, after FORM No. XV, thefollowing form shall be inserted, namely:—

1. Short title and commencement.— (1)These rules may be called the Goa InlandVessels (Construction and Survey) (ThirdAmendment) Rules, 2014.

(2) They shall come into force at once.

2. Amendment of rule 1.— In rule 1 of theInland Steam Vessels (Construction andSurvey) Rules, 1965 (hereinafter referred toas the “principal Rules”) the word “Steam”shall be omitted.

3. Amendment of rule 2.— In rule 2 of theprincipal Rules, in clause (i), the word “Steam”shall be omitted.

4. Substitution of rule 46.— For rule 46 ofthe principal Rules, the following rule shall besubstituted, namely:—

“46. Fees.— Fees to be paid by owners forundertaking survey work and for formsspecified in Appendix 4 are given inAppendix I and such fees shall be paid by aTreasury Challan.”.

5. Substitution of Appendix 1.— ForAppendix 1 appended to the principal Rules,the following Appendix shall be substituted,namely:—

“Appendix 1

A – Survey.— Every application for survey shallbe accompanied by a fee calculated on the basis oftonnage of the motor vessel in accordance with the

rates given below:—

(1) In respect of Inland Vessel of which the grosstonnage, —

(i) does not exceed 100 tons Rs. 750/-.

(ii) exceeds 100 tons but does not Rs. 1,000/-.exceed 900 tons

(iii) exceeds 900 tons but does not Rs. 1,500/-.exceed 1,200 tons

(iv) exceeds 1,200 tons but does R s. 1,750/-. not exceed 1,500 tons; and

(v) for every 300 tons or part thereof Rs. 500/-.in excess of 1,500 tons

(2) Special survey fees chargeable Rs. 1,000/-.when a vessel is surveyed for the firsttime for issue of Certificate of Survey

(3) For change of name of Master or Rs. 500/-.Serang on Certificate of Survey

(4) For change of name of Driver on Rs. 500/-.Certificate of Survey

(5) Issue of extra copy of Certificate ofsurvey,—

(i) if request is made alongwith the Rs. 500/- application for survey. per copy.

(2) For the consideration of water- Rs. 2,000/-. tight sub-division arrangement

(3) For consideration of the fire Rs. 1,500/- protection arrangement .

(4) For bilge and ballast pumping Rs. 1,500/-. arrangement

(5) Oil, fuel, storage, pumping and Rs. 2,000/-. overflow arrangement

(6) Electrical system, layout, main Rs. 2,000/-. and emergency arrangement

(v) Establish collaborative linkages withthe National Institute of Rural Development,Administrative Staff College of India andsuch other institutions of other States inIndia having similar objectives, byexchange of faculty and scholars, byconducting joint research and trainingprogrammes and generally in such manneras may be conducive to the developmentof public administration and ruraldevelopment;

(vi) Function generally as the apexinstitution of Goa on public administrationand rural development to provideknowledge and services to set standards ofproficiency;

(vii) Establish, administer and maintainlocal branches or institutions at suitableplaces in Goa; and

(viii) Do such other deeds and actsconducive or incidental to the achievementof all or any of the above objectives.

(d) The society shall consist of aresidential campus as well as non--residential centers. It shall be open topersons of either sex, of whatever race,creed, caste, class, religion, nationality, etc.and no test or condition pertaining toreligion or region shall be imposed inadmitting students or in appointingmembers, teachers and staff of the society,provided, however, that the Board ofGovernors may make special provisions forthe advancement of scheduled castes,scheduled tribes and socially andeducationally backward classes of citizensin accordance with the relevant provisionsof the Constitution of India.

5. Board of Governors.— The managementof the affairs of the society shall vest, inaccordance with the Rules and Regulations ofthe society, in the Board of Governors and theExecutive Committee of the society.

Rules and Regulations

1. Short title.— These Rules and Regulationsshall be called “the Rules and Regulations ofthe Goa Institute of Public Administration andRural Development (GIPARD)”.

2. Definitions.— In these Rules andRegulations, unless the subject or contextotherwise requires,—

(a) “Act” means the SocietiesRegistration Act, 1860 (Act 21 of 1860);

(b) “Board” means the Board of Governorsof the society;

(c) “Chairperson” means the Chairpersonof the Committee;

(d) “Committee” means the ExecutiveCommittee of the society;

(e) “Director-General” means theDirector-General of the society appointed bythe State Government from time to time;

(f) “Financial year” means budget yearcommencing on first day of April and endingon thirty-first day of March of thesubsequent year;

(g) “President” means the President of theBoard;

(h) “Secretary” means the Secretary ofthe society appointed by the StateGovernment from time to time;

(i) “Society” means the Goa Instituteof Public Administration and RuralDevelopment (GIPARD);

(j) “State Government” means theGovernment of Goa.

3. The authorities of the Society.— Theauthorities of the Society shall be,—

(i) the Board of Governors;

(ii) the Committee; and

(iii) such other committees as may beconstituted by the Board.

4. General Body and membership.— Themembers of the Board shall constitute theGeneral Body of the society and shall consistof not more than thirteen members.

5. Roll of members.— The society shallmaintain a register of members giving theirnames, occupations and addresses and everymember shall sign the register. Any changein such address shall be promptly notified tothe Secretary.

6. The Board may co-opt more members,from time to time, for such specific periods, asit deems desirable and necessary subject tothe limit prescribed in rule 4.

7. Tenure of the non-official members ofthe Board shall be five years from the date ofappointment.

8. When a person, including the Presidentand Vice-President, is a member of the Boardby virtue of his office or appointment, he shallcease to be such member when herelinquishes or vacates the said office and thevacancy so arising shall be filled up by his

successor in that office. Such membershall, however, be eligible for re-nominationi n a n o t h e r v a c a n c y, i f a n y, o n t h eBoard.

9. Cessation of membership.— Notwith-standing anything contained in these Rulesand Regulations, a member of the Board shallcease to be such member if, during his tenureof office he resigns, or becomes insolvent orotherwise unable or incompetent to hold officeor his membership is terminated by theGovernment.

10. Resignation.— A member of the Board,other than an ex-officio member, may resignhis membership by a letter addressed to thePresident and such resignation shall takeeffect from date of its acceptance by thePresident.

11. Casual vacancies.— Any casual vacancyarising on the Board by resignation, death orotherwise of a non-official member, may befilled up by the Government by appointing anew member and the member so appointedshall hold office so long as the member inwhose place he is appointed would have heldit, if the vacancy had not occurred.

12. The Board shall function notwith-standing any vacancy on the Board, and anydefect in the appointment or nomination of anyof its members or change of designation of itsex-officio members, and no act or proceedingsof the Board shall be invalidated, nullified orcalled in question merely by reason of theexistence of any vacancy on the Board or byreason of any defect in the appointment ornomination of any of its members.

13. Subject to the provisions of the Act andsubject to any general directives issued by theState Government in furtherance of theobjectives of the society or in public interest,the Board shall be ultimate authority for theconduct of the affairs of the Society.

14. Meetings of the Board.— Subject to theprovisions of the Act, the Board shall meet at

least twice in a year, of which one shall bethe Annual General Meeting.

15. Annual General Meeting.— ThePresident shall convene Annual GeneralMeeting within four months of the closure ofthe financial year,—

(i) to receive and consider the annualreport and audited accounts of the societyof the preceding financial year;

(ii) to appoint auditors and fix theirremuneration;

(iii) to review progress of work duringthe year ended and consider and approvegenerally the budget demands andprogrammes for the ensuing year; and

(iv) to discuss any other business as maybe necessary.

16. Special Meetings.— The President mayconvene special meetings to discuss anymatter of special importance or urgency or onwritten requisition of not less than sixmembers of the Board specifying the purposefor which the meeting is proposed to be called.

17. Venue of the meeting.— Meeting of theBoard shall ordinarily be held at the registeredoffice of the society. However, a meeting maybe held at other place also as may be deemedexpedient or necessary by the Board.

18. Notice of the meeting.— (1) Everymeeting of the Board shall be convened by anotice issued by the Secretary or any otherofficer of the society so authorized in thisbehalf by the Secretary.

(2) Every notice calling for a meeting of theBoard shall be issued to every member not lessthan fifteen days before the day scheduled forthe meeting, except in the case of a specialmeeting, when the notice shall be issued atleast seven days before the day fixed for themeeting. A summary of the business to betransacted at the annual general meeting shall

be communicated to the members atleast seven days before the day of themeeting.

(3) The accidental omission to give noticeto or non receipt of the notice of any meetingby any member shall not invalidate theproceedings of that meeting.

19. Presiding Officer.— The President shallordinarily preside over all meetings of theBoard. In the absence of the President, theVice-President shall preside and in case theVice-President is also absent, the memberspresent shall choose one amongst them topreside over that meeting.

20. Quorum.— Six members including thepresiding officer shall constitute the quorumfor any meeting of the Board, provided that, ifa meeting is adjourned for want of quorum, asubsequent meeting called on the basis ofsame agenda shall not be required to have aquorum.

21. Attendance.— No member shall attenda meeting of the Board otherwise than inperson, provided that a member who is anex-officio representative of Government ofIndia or an organization is unable to attendthe meeting, such member may authorize hissubstitute to attend that meeting on his behalfwho shall have the rights and privileges of amember for that meeting.

22. Invitation to attend the meeting.— The

President may invite any person other than a

member of the Board to attend a meeting of

the Board but such person shall not be entitled

to vote at the meeting.

23. Voting.— In case of any difference ofopinion amongst the members on any matterunder discussion in a meeting, the opinion ofthe majority present at the meeting shallprevail. Every member present at the meetingincluding the President shall have one voteand if there be an equality of votes, thePresiding Officer shall have second or castingvote.

24. Voting by circulation.— Any business,which may be necessary for the society toperform and which is of an urgent nature andcannot be held over till the next meeting ofthe Board, may be transacted by circulationamong all members of the Board and anyresolution so circulated and approved by amajority of the members forming quorum shallbe as effective and binding as if such resolutionhad been passed at a meeting of the Board;provided, that any business so transacted shallbe reported at the subsequent meeting of theBoard.

25. Service of notice.— A notice may beserved upon any member of the Board inperson or through post addressed to suchmember at the address mentioned on the Rollof members. Any notice so served throughpost shall be deemed to have been served onthe day following that on which it was posted.

26. Committee.— Subject to the overallsuperintendence and policy directions of theBoard, the Committee shall be responsible forthe management, administration and controlof the affairs of the society and its income andproperties in accordance with these Rules andRegulations, orders and instructions issued bythe Government from time to time, and shallhave, and exercise powers which may benecessary, incidental, conducive or expedientfor the said purpose.

27. Composition of the Committee.— TheCommittee shall comprise of not more thannine members including the MemberSecretary of the Committee.

28. Meetings of the Committee.— TheCommittee shall meet at least once in everythree months. The meetings of the Committeeshall ordinarily be held at the Registered Officeof the Society. However, a meeting may be heldat any other place also as may be deemedexpedient or necessary by the Committee.

29. Notice of the meeting.— (1) Everymeeting of the Committee shall be convenedby notice issued by the Secretary or any otherofficer of the Society so authorized in thisbehalf by the Secretary.

(2) Every notice calling for a meeting of theCommittee shall set the date, time and venueof the meeting and shall be issued to everymember not less than seven days before theday scheduled for the meeting, provided thatthe Chairperson may, for reasons to berecorded, convene a meeting at such shorternotice as he may deem it fit. A summary ofthe business to be transacted at the meetingshall be communicated to the members notless than five days before the day of themeeting.

(3) The accidental omission to give noticeto or non-receipt of the notice of any meetingby any member shall not invalidate theproceedings of that meeting.

30. Presiding Officer.— Every meeting of theCommittee shall ordinarily be presided overby the Chairperson. In the absence of theChairperson, the senior most member shallpreside over the meeting. The Chairpersonmay invite any person or persons to attend ameeting but such person or persons shall nothave the right to vote.

31. Quorum.— Four members including thePresiding Officer shall constitute the quorumfor any meeting of the Committee, providedthat, if a meeting is adjourned for want ofquorum, a subsequent meeting called on thebasis of the same agenda shall not be requiredto have a quorum.

32. Voting.— In case of any difference ofopinion amongst the members on any matterunder discussion in a meeting of theCommittee, the opinion of the majority presentat the meeting shall prevail. Every memberpresent at the meeting including theChairperson shall have one vote and if therebe an equality of votes, the Presiding Officershall have second or casting vote.

33. Voting of Circulation.— Any business ofan urgent nature may be transacted bycirculation among all members of theCommittee and any resolution so circulatedand approved by a majority of members shall

be as effective and binding as if such resolutionhad been passed at a meeting of theCommittee; provided that at least the numberof persons constituting a quorum hadrecorded their views on the resolution; andprovided further that any business sotransacted shall be reported at the subsequentmeeting of the Committee.

34. Powers of the Committee .— TheCommittee shall have the following powers,namely:—

(i) to prepare and execute detailed plansand programmes for establishment anddevelopment of the society and for carryingout its administration and management;

(ii) to receive grants-in-aids and acceptother grants of money, gifts, donations,securities, negotiable instruments and otherforms of assistance from the StateGovernment and the Government of India,and from other sources, Indian and foreign,Government and private and enter into anyagreement or arrangement for receivingsuch assistance which are not inconsistentor in conflict with or repugnant to theobjectives of the Society; provided that inrespect of external sources of assistanceprior approval of the State Governmentand the Government of India shall beobtained;

(iii) to impose and recover fees andcharges for the services rendered by thesociety; raise moneys and funds as deemedfit and necessary for accomplishment of theobjectives of the Society;

(iv) to keep custody of and expand thefunds and moneys, invest, deal with andappropriate account for such funds andmoneys and manage that income andproperties, movable and immovable,according to the bye-laws formulated in thisbehalf, provided that for all capitalexpenditure exceeding rupees fifty lakhs ata time, prior sanction of the StateGovernment shall be obtained;

(v) to receive, acquire, take over and holdmoveable and immoveable property of anykind by means of purchase, transfer, hire,lease, gift, donation or other lawful meansfrom Government, public or private bodiesor individuals and to construct, build, alter,improve, maintain, repair, equip, furnish anybuilding, develop lands and execute worksnecessary or convenient for purposes of thesociety, and suitably manage and deal withproperty of any kind in the best interestsand for purposes of the Society:

Provided that no moveable propertiescosting more than rupees five lakhs and noimmoveable properties shall be transferredby sale, mortgage or otherwise withoutprior sanction of the State Government;

(vi) to enter into arrangements/contractswith national and internationalorganizations, corporations, foundationsand research institutions and otheragencies, governmental or private, fortechnical assistance, for the developmentof sectors and for undertaking projectson their behalf, for training and develop-ment and research in the fields ofpublic administration including ruraldevelopment:

Provided that in respect of arrangementswith foreign governments or internationalorganizations, prior approval of the StateGovernment and the Government of India,as the case may be, shall be obtained;

(vii) to pay all preliminary or incidentalcosts, charges and expenses of study,training and for undertaking research andconsultancy in pursuance of the objectivesenunciated in the Memorandum ofAssociation;

(viii) to recommend to the Board the grantof degrees, diplomas, certificates,distinctions and prizes to students andparticipants, who have successfullycompleted the prescribed course of studyand training;

(ix) to institute and award fellowships,scholarships, stipends, freeships, loans andother forms of financial assistance tostudents to facilitate their study;

(x) to approve the nomination of facultyfor courses of higher studies, training andteaching assignments, for participation inconferences, visiting fellowships, etc. inIndia and abroad under such terms andconditions as may be laid down in the bye--laws framed in this behalf, provided thatfor tours outside India prior approval of theState Government shall be obtained;

(xi) to provide for and supervise theresidence, health amenities, discipline andthe general well-being of the students andother participants in training programmes;

(xii) to print, publish, issue, acquire andcirculate books, papers, periodicals,exhibits, films, slides, CDs, pamphlets andother audio-visual materials dealing with orhaving a bearing upon the activities andprogrammes of the Society;

(xiii) to create academic, administrative,technical and other posts (other than theDirector) for which the prior sanction of theState Government shall be obtained;

(xiv) to appoint, retain, engage for thetime being, professional and technicaladvisers, consultants, experts to further theobjectives and programmes of the societyand to pay them such honorariums, fees,remuneration or compensation as may bedeemed fit and commensurate withperformance;

(xv) to invite scholars and eminentprofessionals from any part of the countryor abroad to take advantage of the facilitiesoffered by the society in order that thesociety may benefit by their knowledge,wisdom and experience; provided that priorapproval of the State Government shall beobtained for inviting guest faculty fromoutside India;

(xvi) to establish contributory providentfund, pension fund and gratuity schemes,welfare fund and other financial assistanceschemes for the benefit and welfare of thestaff of the society and their families;provided that prior approval of the StateGovernment shall be obtained for thepurpose;

(xvii) to prepare annual reports, financialstatements of accounts, financial estimatesof the society and submit them at the AnnualGeneral Meeting for the approval of theBoard, approve expenditure within thelimits of sanctioned budget subject to thebye-laws framed in this behalf;

(xviii) to appoint sub-committees for thedisposal of any business of the society orfor tendering advice in any matterpertaining to the conduct of the affairs ofthe society and to delegate to suchCommittee such powers as it may deemnecessary and expedient;

(xix) to enter into agreement for and onbehalf of the Society with any Governmentor authority, municipal, local or otherwise,and to obtain from such authority any rights,privileges or concessions fiduciary orotherwise that the society may deemnecessary and desirable;

(xx) to sue and defend all legalproceedings on behalf of the society;

(xxi) to make, frame and adopt rules, bye--laws and regulations for the proper andeffective administration and management ofthe affairs of the Society and amend, vary,add or rescind such rules, bye-laws fromtime to time as may be deemed necessary.Such bye-laws may provide for matterssuch as:

(a) norms and guidelines for theconduct of courses of study and trainingand standards of proficiency;

(b) norms and procedures foradmission of students;

(c) levy of fees, commissions andcharges for service;

(d) maintenance of accounts, audit andother financial regulations regardingcustody and operation of funds;

(e) budgeting;

(f) recruitment rules, the terms andconditions of service of the faculty;

(g) the pay and allowances and otherbenefits to be given to the staff and otherofficers of the society;

(h) rules of discipline and code ofconduct for the employees and studentsof the society;

(i) maintenance of library;

(j) purchase and maintenance of stores,stocks and ledgers;

(k) delegation of powers;

(l) such other matters as may benecessary; and

(xxii) to do all other acts as may beappropriate, and necessary for theachievements of any or all of the objectivesof the Society.

35. Powers and functions of the Director--General.— The Director-General shall,—

(i) oversee the day-to-day working of thesociety as head;

(ii) be the appointing and the disciplinaryauthority for the Group “C” and “D”employees though selection for posts inthese categories shall be made by therecruitment committee nominated by himand the final approval shall be accorded bythe Committee;

(iii) incur expenditure within thesanctioned budget, as delegated to him bythe Committee;

(iv) submit proposals for creation andappointment to Group “A” and “B” posts tothe State Government;

(v) oversee the working of both theadministrative staff and the academicfaculty;

(vi) recommend specific researchprojects to the Committee; and

(vii) approve the organization of variousseminars and workshops.

36. The powers of the Chairperson of theCommittee.— The Chairperson shall have allsuch powers as may be delegated to him bythe Committee.

37. Duties of the Secretary.— The Secretaryshall be responsible for,—

(i) maintenance of the records of themeetings and their circulation to members;

(ii) maintenance of the register of the rollof members of the society;

(iii) assisting the Director-General in theday-to-day supervision of administrativeand financial matters of the society; and

(iv) performance of such other duties asmay be authorized by the Board or theCommittee or the Director General.

38. Funds, accounting and audit.— Thefunds of the society shall consist of,—

(i)grants-in-aid received from the StateGovernment and/or Government of India;

(ii) donations and contributions fromother sources; and

(iii) other incomes and receipts.

39. Books of Accounts of the Society.— Thesociety shall maintain such books of accountsand other related records in such form and insuch manner as may be necessary and

prescribed in consultation with the auditorsof the Society and in accordance with the bye--laws framed in this behalf by the Committee.The accounts of the society shall be auditedannually by the auditors appointed for thepurpose and the audited statement of accountsshall be submitted along with the annualreport, at the Annual General Meeting for theconsideration and approval of the Board. Afterapproval of the audit report by the Board, itshall be submitted to the State Governmentand issued along with the annual report tomembers of the Board, State Government andother concerned. The accounts of the societyshall be open to inspection by the Director ofAccounts, Goa and the Comptroller andAuditor General of India or their authorizedrepresentatives.

40. Suits by and against the society.—Subject to the provisions of the Act the personin whose name the society may sue or be suedshall be the Director-General.

41. Remuneration of the non-officialmembers of the Board and Committee.— Thenon-official members of the Board and of theCommittee or of any sub-committee shall notbe entitled to any remuneration from theSociety for their services as such members,but they shall be paid such travelling and dailyallowances as may be provided in the bye--laws to be framed in this behalf by the Boardfor the journeys, for attending meeting orin connection with other business of thesociety.

42. Bank account.— The bank account ofthe society shall be opened in any nationalizedbank and shall be operated jointly by theSecretary who shall act as the “Drawingand Disbursing Officer” and the Director--General.

43. Amendments.— Any amendment to theMemorandum of Association and/or Rules andRegulations may be made by the Board at theAnnual General Meeting or Special Meetingby three–fifth majority after giving a minimumof ten days notice of the proposed

amendment(s) in writing to the membersof the Board. The amendment to theMemorandum of Association and/or Rules andRegulations approved by the Board shall besubmitted to the State Government for itsconcurrence. Such amendments as concurredto by the State Government shall be notifiedto the Registrar of Societies.

44. Until the bye-laws are framed by the

Committee, the corresponding rules and

customs adopted by the State Government

shall be followed by the society.

45. Removal of difficulties.— In the event of

any doubt or difficulty to give effect to any of

the provisions of these Rules and Regulations,

the Committee shall take appropriate decision

keeping in view the overall objectives of the

society.

46. Notwithstanding any of the provisions

of the Memorandum of Association or these

Rules and Regulations, it shall be lawful for

the State Government to give any directions

to the Board in the overall interest of the

society and it shall be incumbent upon all the

societies to comply with such directions with

due diligence.

47. Dissolution.— Dissolution or merger

shall be carried out as per the provisions of

the Societies Registration Act, 1860 (Act 21

of 1860). On dissolution of the society, the

assets remaining as on the date of

dissolution shall under no circumstances be

distributed among the members of the

Committee or Board but the same shall be

transferred to the State Government or

another society as directed by the State

Government whose objects are similar to

those of this society and which is duly

registered under the Act.

2. Motor vehicles carrying the followingdignitaries shall display red colour beaconwithout flasher:—

(a) Chief Secretary.

Category ‘C’

3. The following categories of vehicles shallbe entitled to use Blue and Amber coloursbeacon with flasher lights as specifiedhereunder while on duty:—

(a) Traffic Police Vehicles.(b) Police Department Vehicles while on

law and order duty.(c) Pilot and Escort Vehicles carrying the

high dignitaries of the State mentionedin Category ‘A’ hereinabove as pertheir entitlement.

4(a). Red and Amber colours beacon with flasher:—

(a) Fire Force Operational vehicles.

4(b). Blue colour beacon with flasher:—

(a) Ambulances/Specialized vehicles permitted for rescue/special

operations.

5. Amber colour beacon without flasher:—

(e) Director of Transport while on duty.

Name of the Scheme: Financial Assistanceto purchase Dwelling House of Mundkarunder the scheme “Mundkarache Ghar”

1. Introduction.— As per the provisions ofthe Goa, Daman and Diu Mundkar Act,Mundkars have right to purchase dwellinghouse from the Bhatkars at the pricedetermined by the Mamlatdar. Mundkar Actcame into force since the year 1975 howeverthere are many Mundkars who belong to STCategory, have not exercised their right topurchase Mundkarial dwelling house due topoor financial condition. Because the dwelling

house is not owned by them they have to facedifficulties in carrying out repairs/renovationsto their dwelling houses.

2. Objective .— To provide financialassistance to the needy Mundkars of STCategory to enable them to exercise their rightto purchase dwelling house at the pricedetermined by the Mamlatdar under theprovisions of the Goa, Daman and DiuMundkar Act.

3. Eligibility Criteria.— (a) Person should beof ST Category.

(b) The family income from all sourcesshould not exceed Rs. 3.00 Lakhs per annum.

(c) Person should be declared or registeredas Mundkar of the dwelling house.

(d) Applicant should possess PurchaseCertificate issued by Dy. Collector & SDOunder the provisions of the Goa, Daman andDiu Mundkar Act.

(e) There should not be any pending appealagainst the Order of the Mamlatdar under theprovision of the Goa, Daman and Diu MundkarAct.

(f) All cases where orders determiningpurchase price of the dwelling house havebeen passed by the Mamlatdar on or after fromthe date of Notification of the scheme will becovered for giving benefit under the scheme.

4. Benefit under the Scheme .— (a) FinancialAssistance of entire amount at the rate//purchase price determined by the Mamlatdarfor the mundkarial dwelling house subject tothe land area ceiling of 200 square meters inUrban area and 300 square meters in RuralArea or the area of the house with five metersaround the house as per the option of theMundkar in the purchase proceeding beforethe Mamlatdar under the provisions ofMundkar Act.

(b) The land price for the area exceedingthe land ceiling prescribed by the Mundkar

Act to be borne by the beneficiary from hisown sources.

(c) Maximum financial assistance under thescheme for purchase of dwelling house isRs. 30,000/-.

(d) The beneficiary under the scheme isalso eligible for benefit under the schemes likeIndira Awas Yojana or Atal Asra Yojana orRajiv Awas Yojana or Souchalaya Suvidha etc.He may avail such benefits in addition tobenefits under the scheme “MundkaracheGhar”.

5. Mode of Application.— The applicationin the prescribed Form to be submitted to theDirector of Tribal Welfare through Mamlatdar//Joint Mamlatdar after the order passed bythe Mamlatdar/Joint Mamlatdar determiningthe purchase price and the purchasecertificate issued by concerned Dy. Collectorand SDO.

Application to be supported with:

(i) ST Certificate issued by CompetentAuthority of State of Goa.

(ii) Income Certificate issued by V. P.Secretary countersigned by BlockDevelopment Officer.

(iii) Purchase Certificate issued by Dy.Collector and SDO.

(iv) Form I & XIV of the Land.

(v) Order passed by the Court ofMamlatdar/Joint Mamlatdar which hasdetermined the purchase price of the dwellinghouse.

6. Mamlatdar/Jt. Mamlatdar shall verify theapplication of Mundkar as regards to thecorrectness of the documents submitted andthe information furnished by the applicant.After verification, Mamlatdar/Jt. Mamlatdarshall endorse on the application that it isverified and found correct and shall submit

the application along with requireddocuments mentioned at Clause 5 to Directorof Tribal Welfare.

7. Sanctioning Authority.— Director ofTribal Welfare will sanction the amount ofbenefit under the scheme. Upon sanction thebenefit under the scheme, the amount will bereimbursed to the applicant through ECS(Electronic Clearance System).

Immediately upon sanction of the case,Mamlatdar/Joint Mamlatdar shall make theendorsement in the mutation record that thedwelling house is purchased with thefinancial assistance under the scheme“Mundkarache Ghar”.

8. Monitoring of the Scheme.— Issuesregarding eligibility or operation or of a newsituation which is not envisaged at the time offormulation of the scheme, would be resolvedby the Monitoring Committee, whose decisionwill be final.

The Monitoring Committee is consisting of:

(1) Secretary Tribal Welfare —Chairman

(2) Collector of the North — Member Goa District

(3) Collector of the South — MemberGoa District

(4) Director of Tribal Welfare — Member Secretary.
