    Letter to the Buzz

KELLYONOMICS and BEHEALOGICAL FINANCIALMODELS- Lets stop the dancing, BSing, and spinning andput the issues in a Nutshell Review. Economatricians speako Reaganomics, Keynesian Economics, Guns or ButterEconomies....but we have to deal with Kellyonomic andBethealogical financial approaches to St. Marie economics. With all the lawsuits past and present pending, the MAINocus is primarily on PROPERY ILES and LAND/BUILDINGS OWNERSHIP that are in question. Along with

these clouded challenges one must include issues o LIENS,FORECLOSURES, CONFESSION o JUDGMEN and AXSALES. Failure to pay bills cause the previously mentioneditems. Some havent paid their taxes, water, or associationbills but have money to file lawsuits....maybe they shouldbe in the category o HOOLIGANOMICS! Standup Folkskeep the St. Marie inrastructure going by paying all theirbills and serving on the Association Boards voluntarily. Teyoperate on an ethical, legal plane and dont expect to getsomething or nothing.RIGGER- My previous BUZZ article on pastSHENANIGANS in St. Marie was repeated, re enorced, andexpanded upon by Kellys article in last weeks BUZZ, thenagain by a conversation I had with Ilene Hathaway. I raninto her at the VFW steak ry last Friday and she verifiedthat what Kelly quoted her as saying WAS COMPLEELY

RUE.BROADER/DEEPER- Inormation that all people shouldknow about the why and what is going on in St. Marie, alittle HISORY, so here goes:HE EARLY YEARS- Pat Kelly bought St. Marie housingand commercial buildings built and paid or by the tax payers, the ORIGINAL developers. He sold some 211 condo unitsthen sold the remaining properties to erry Parks. Parkswent BANKRUP and then came Valley Park Liquidatingrust with Marv Bethea leading the way. Parks is currentlygoing to college (serving 10 years in the State Penitentiary).PROBLEMS SAR- Representing Valley Park Liquidatingrust, Bethea sends out a proposal to St. Marie unit owners(April 23, 2001) stating the ollowing: Te Bankr uptcy Judgehas ordered that we are to SEPARAE the units CURRENLYILED to us rom St. Marie Condominium (SMCA)and FORM a separate Condo Association or ownhouseSubdivision. We are in the process o determining how thiswill be accomplished, WHA units will be included andhow the COSS will be allocated. Our interpretation o theJudges ruling gives us what we have been seeking or sometime now- the ability to REMOVE rom the existing SMCAALL o the units owned by the VPL, Wrights and othersthat have been considered Developer units. What is not

clear is whether or not units owned by other individuals canbe included in this separation. Tese units currently areincluded in the SMCA and are subject to its assessments andregulations, notwithstanding the act that they may not becurrently assessed.NVCCA-On May 25, 2001 VLP drafs a DECLARAIONor North Valley County Condominium....stated as theDeclarant whereby LANDS and PROPERY hereinaferdescribed are submitted and subject to the Montana UnitOwnership Act. On March 22, 2002 the new separateAssociation NVCCA is filed with the Secretary o State asa non profit Corporation, signed by its registered agentM.W. Bethea. On March 24th o 2003 an Annual Report

was filed with the State o Montana signed by M.W. Bethea,Vice President o the Board o NVCCA. As President o theBoard o NVCCA Bethea wrote and signed RESOLUIONNo. 2004-01 declaring that any member 30 days or moredelinquent in payment o their assessments is not in GOODSANDING and thereore not eligible to vote or serve on theNVCCA Board. (Yet he tried to serve on the Village Boardwhile in arrears, which subsequently went to Court andruled against his serving and he was kicked off the board)He resigned rom the NVCCA Board, enorced liens andoreclosures or his lawn mowing contract which he wrote tohimsel, took all o NVCCA properties and monies and lefNVCCA bankrupt and non operational.KELLY-Got a RO (temporary restraining order) approvedon the day o the scheduled Sheriffs Sale o his SMDC (StMarie Development Corp) properties. He has an agreement

signed by Bethea, OCI (Olympic Coast Investment), Edson, and Pat Kelly in which he claims Bethea breached theagreement - Cause No. DV-2013-31 which is still pending.DM Corporation-Now enter Merrill Frantz, dated August7, 2014 claiming that hes a Party in Interest as a creditorrelating to Valley Park Inc.- past Debtor in Bankruptcy CaseNo. 97-12587-JLP-11. Frantz requested that the Court granthis Motion Seeking Enorcement o Judge Petersons Orderand order the signing and recording o a corrected deed. But the Federal Bankruptcy Court in Butte was the wrongCourt and this matter should be addressed in District C ourtin Valley County. So the Motion was denied on July 17, 2014.Tis goes along the same lines as erry-Lee, Te Living Beingfiling Case No. DV-2014-35 requesting a Motion to surveyout his condo building 403 A,B,C,D. Tey claim to attemptto get clear title to their property.LEGAL OPINION-

On July 24, 2014, Legal Council or St.Marie Condo Association responded to DMs Frantz anderry-Lee, Proxy or NSM (New St. Marie, LLC- Mitchell)stating the ollowing: Te developer DID NO WANO PAY a proportionate share o the cost o maintainingthe common elements until the units were sold. Uponthe expiration o the developers rights to add or subtractunits and adjust the percentage ownership o COMMONELEMENS, a substantial number o units remained unsold.

Michael Uphues, grand-son o Laverne Davis, completed his Spartan riectaon Saturday, September 27thin Chicago, Illinois.

A Spartan Race is anobstacle race in whichparticipants run, jump, climb, crawl, carry heavyobjects, push, pull and, inthe case o the Chicago SuperSpartan, swim their way tothe finish line.

In order to complete aSpartan riecta, the athletemust finish three types oSpartan Races in a calendaryear. In Michaels case, hecompleted them as ollows:a 4-mile Spartan Sprint with15+ obstacles in Big Fork,Montana on May 10th; a13-mile Spartan Beast with

25+ obstacles in Salt LakeCity, Utah, on June 28th; andthe 8-mile Super Spartan inChicago on September 27th. Tough Michael likes allthe obstacles in the races, hisavorite is the swimming; hewishes there was more o thatin every race. His avoritedistance is the 13-mileSpartan Beast because o themental toughness required tocomplete it.

He uses obstacle racingas a means o cross-trainingor hockey as he continueshis journey towards the NHL(National Hockey League).

Come out to the ValleyEvent Center or Ice Dawgshockey this all and winterand cheer on your hometeam.

    Spartan rifecta accomplished!
