Dear Donna: I have a landlord that refuses to let me

out of my lease. I have lived in the house for eight months but it costs me over $500 per month to heat the home. There are also other issues including mold. I have four months left on the lease, but the conditions of the house are making my family sick. The house is for sale and I am thinking about putting large yellow tape with hanging lem-ons over the sign. Thoughts?

I have plenty of thoughts with very little detail. If you are looking to get out of the lease, have you discussed potential liability to the landlord if there are “truly” mold and the other issues causing health related concerns to your family or have you simply asked to

New taxes are here!

The Affordable Care Act ushers in sweeping and broad reaching taxes throughout the health insurance industry. Many of these new taxes will simply be ab-sorbed through the health insurance pre-miums that each of us pay, however some of the taxes are specific to “high-income earners.”

High income earners are defined as:• $250,000 for married taxpayers filing jointly; • $125,000 for married taxpayers filing separately; • and $200,000 for other taxpayers.

1) The Affordable care Act imposes an additional 0.9 percent Medicare tax on FICA wages, or self-employment income that exceeds certain threshold amounts.

2) The law also imposes for the first time ever a 3.8 percent Medicare tax on passive, or unearned, income, such as capital gains and dividends for tax years beginning in 2013. This new surtax will apply to indi-viduals, estates and trusts. C corporations will not be liable however. How does this new tax work? For individuals, the un-earned income Medicare tax is imposed on the lesser of:

— an individual’s net investment in-come for the tax year, or

— any excess of modified adjusted gross income (MAGI) for the tax year over a “threshold amount

be released from your lease? The validity of your facts and assessment of the premises are beyond the scope of this article; however, if you believe that your home is uninhabitable and causing health issues, you may want to contact applicable agencies and seek legal ad-vice. Keep in mind, however, that “slumlord,” habitability,” and “related health causation” are often subjective and costly to prove.

The interesting fact that you raised is that the house is for sale. If the premises are “actu-ally” uninhabitable or even habitable but in need of substantial repairs, this can affect the marketability of the property. More impor-tantly, once the owner and real estate agent are put on notice of any items that may affect habitability, there may be a duty to disclose to a potential buyer.

Instead of hanging the lemons, make lem-onade and invite your landlord over. Even if your allegations fall short of “legal” liability or justification to terminate the lease, having

you in the home when a potential buyer ar-rives is risky. If your landlord disagrees with your assessment of the property, agree to dis-agree. Negotiate with your landlord in a calm manner. If you cannot remain calm, have your spouse or someone that can communi-cate the issues and negotiate on your behalf. If there is an imbalance of power or either of you are difficult to deal with, consider hav-ing a neutral third party there to facilitate the communication, help to understand the is-sues, evaluate potential risk and reality, and explore all options.

Do your homework before approaching your landlord. Are there code violations? Have there been similar claims or lawsuits regarding this property? If not, consider ne-gotiating the security deposit and other items to get out of the lease. If there is evidence to support your allegations, talk to your attor-ney before hanging the lemons.

Self-closing doors are now required be-tween garages and houses. For nine years the code was silent on this requirement but it’s now back in text.

Note also that garages need to be separated from the living area by ½-inch gypsum wall-board on all bearing walls and 5/8-inch gyp-sum wallboard on the ceiling.

Robert Leach graduated from the Uni-versity of Washington and earned his PE in 1971. He began his engineering career in Port Angeles in 1976 with Peterson & Associates (later to become NTI) where he worked until 1983. Bob returned to the UW where he earned his MBA in 1989. He came back to Port Angeles and NTI in 1993 after time at the City of Seattle Engineering De-partment and as general manager and engi-neer at Public Utility District No. 1 of Jef-ferson County. In 2003, Bob became NTI’s principal engineer and an owner of the busi-ness.

After many years of service to our com-munity at NTI we are wishing Bob a happy retirement. He has certainly earned it!

During his many years at NTI, Bob has been responsible for major projects includ-ing a downtown beautification project and the LID #215 sanitary sewer retro-fit for the City of Port Angeles, a roadway/utility sys-

tem for an industrial park complex for the Port of Port Angeles, a sanitary sewer retro-fit for the community of Sunland, a resort/hotel development and site grading/utility systems for the Makah Marina at Neah Bay, the Dry Creek Elementary School complex, the Port Angeles Library, Valley Creek Estu-ary, several assisted living facilities, many subdivisions and related utility systems.

We will be honoring Bob for his service Thursday, June 20, at NTI’s office at 717 S. Peabody St. in Port Angeles. Please come by between the hours of 3-6 p.m. to offer con-gratulations and well wishes as he begins the next adventure in his life.

Estes Builders announces expansion/relocation to new office

After nearly 14 years in its downtown Sequim location, Estes Builders has ex-panded and relocated its operations to a new U.S. Highway 101 location. “When Jo Anne and I started Estes Builders 23 years ago,

we worked out of the laundry room of my parents’ house in Sequim,” said Kevin Estes, owner of Estes Builders. “I had to make tele-phone calls between spin cycles.”

“It has been a long time in planning but the time was right to make the move,” said Jo Anne Estes. “Our new location is over 3,000 square feet of welcoming space.”

The interior finishes of the new office were designed to showcase common interior home details which will allow clients to see up close and in-person those elements that go into building their new custom home. The new showroom includes a selection of millwork, ceiling details, countertops and many other interior and exterior finishing details. The reception room includes a cus-tom-made mantle from a 75-year-old Hoh River area maple tree, a gift to the company.

“It is great to see our new office ready for operations and we look forward to our first day there,” said Kevin Estes. “We appreci-ate our trade partners and suppliers who worked with us and particularly our con-struction manager Mike Lyckman.
