IN JANUARY OF 2013, the New York Times published an article touting Nashville as the “It City.” In March of 2014, Time magazine published an article calling Nashville “The South’s Red Hot Town.” GQ magazine referred to Nashville as “Nowville,” and Nashville has long been called “The Athens of the South.” I could go on and on, but suffice it to say, the rest of the world is acknowl-edging what we locals already knew—which is that we live in a city alive with economic advantages and strong Southern sensibilities. In other words, a good place to call home. I like to think that Nash-ville is cool and hip but still feels like a warm home-cooked meal. It’s that kind of good.
Nashville has been one of the top five fastest growing cities for several years running, and a good bit of that growth has occurred in the multi-family industry. A total of 4,476 apartment units have been completed in the Nashville MSA over the past two years. There are 8,992 units underway at this time, and the most astonish-
ing number I can report is 9,139, which is the number of units reported in speculative construc-tion. The record growth for Nashville calls for appropriate adaptation within the GNAA in order to remain a strong and relevant organization. To safeguard this revered 46-year-old asso-ciation, this year the Governance Committee comprised of Past Presidents and those widely considered to be the backbone of the organization began working to develop long-term goals and a succession plan.
With this record growth, the GNAA has evolved and adapted to the changing needs of the association and its members by launching several initiatives. Outreach has become paramount with the expansion of the MSA, so the GNAA has committed to hosting events in outlying areas, such as Murfreesboro and Clarksville, in order to make it easier for members in those areas to participate. Technology has also played an important role in the association staying relevant. The new GNAA website launched this year and is more user-friendly than the previ-ous site. The new website has created increased accessibility for members, making it easier to secure reservations for events, learn of sponsorship opportunities, and more. The GNAA team also recently started utilizing a text messaging program as a way to remind and/or notify mem-bers of upcoming events.
We are a healthy organization, one with strong ties to the community as evidenced by the efforts of the Community Service Committee and the membership. The GNAA gave time and money to support many worthy organizations during 2014 such as The Homeless Coalition, Nashville Rescue Mission – Women and Children’s campus and Kings Daughters Daycare, to name only a few. We care deeply about the education of our membership as shown by the con-tinued growth of the GNAA Education Conference; launched in 2012, it has grown exponen-tially and this year promises to be epic. We care deeply about the promotion of our associate membership. A good example of this would be the 2014 Trade Show, which was the largest in the history of the GNAA. We work in an industry worthy of being promoted as a viable career choice for young, hard-working, brilliant minds. This year the Governor issued a proclamation to the GNAA, proclaiming February as Apartment Careers Month in Tennessee. All of that said, I would say WE have had a successful 2014. It has been an honor and an absolute pleasure to serve as your 2014 President.

WHEN TENANTS LEASE THEIR APARTMENT HOME, they are being granted exclusive property and residential rights to the apart-ment. Even though they do not become the property owner, they do become the sole person to whom access is granted. During their ten-ancy, the landlord’s right to access is regulated according to the specific circumstances stated in the Landlord Tenant Act. This article and our next article will briefly discuss under what circumstances the landlord has an absolute right to enter the leased premises. Our next article will discuss when a landlord may enter without the tenant’s consent, but this article will discuss the conditions under which a landlord may enter only with the tenant’s consent.
The Landlord Tenant Act specifically requires, prior to entry, that the landlord gain the tenant’s consent in the following situations. Addi-tionally, the law does not allow the tenant to unreasonably withhold consent to enter, so long as access is being sought in order to do one of the following:
• Inspectthepremises;• Makenecessaryoragreedrepairs,decorations,alterations,orimprovements;• Supplynecessaryoragreedservices;or• Exhibitthepremisestoprospectiveoractualpurchasers,mortgagees,workersorcontractors.
In all these situations, written consent by the tenant would be ideal, but it would be very inefficient to maintain this policy. If written consent is not obtained, be sure to have procedures in place to document consent.
If entry is necessary due to a tenant’s request for maintenance or service, the documentation to support the landlord’s access will be the fact that the tenant has so requested. As stated above, be sure to either require that requests for service or maintenance be submitted to you in writing or document the tenant’s verbal request as soon as possible. Also, the documentation provided by online or email requests is very useful.
Our industry standard is that we give notice of entry for periodic preventive maintenance, regular inspec-tions, scheduled pest control, etc. While this advance notice is not consent, it does give the tenant the opportunity to refuse access to the premises.
If a landlord is trying to enter to show the premises to prospective or actual purchasers, mortgagees, workers, or contractors, we suggest that you get the tenant’s consent in writing. There are additional regu-lations when showing to prospective tenants. That right of entry and others that do not require the tenant’s consent will be discussed in the next article.
Be aware that your lease may restrict access beyond the statute. If your lease restricts your access or requires more notice, then you must comply with your lease and the law. If your lease gives you more access than allowed by statute, that additional access could be deemed to be invalid because the Uniform Residential Landlord and Tenant Act strictly prohibits lease terms that waive a tenant’s rights under the Act.
Remember, while a tenant cannot unreasonably withhold access from the landlord, his refusal does not give the landlord the right to force entry.

Carter Realty Advisors, LLCChristopher Carter, CPA, has joined Carter Realty Advisors, LLC, which self-manages its own real estate portfolio. They are headquartered in Mt. Juliet, Tennessee. Christopher will serve as the company’s Chief Financial Officer and will also work to develop new real estate
opportunities. He will be working with his father, Henry Carter,
CPM, CAPS. Henry has been a member of the Apart-ment Association for 30 years. He is very excited about having Chris on board. He looks forward to the new ideas and the enthusiasm that the younger generation brings to the table.
Chris received his BBA from Middle Tennessee State University. He then obtained his MBA from Belmont University, then earned his CPA designation while work-ing for Crowe Horwath, LLP, a large national accounting firm.
Chris is married to Chelsea Carter. He is a member of various professional associations. Chris and Chel-sea make their home in Nashville, Tennessee.
Elmington Property ManagementJenny McClain has joined Elmington Property Man-agement as Director of Marketing and Web Services. Marketing maven by day, devoted wife, mother, and work-a-holic by night, Jenny has enjoyed a success-ful career in the multifamily business for over 16 years. She began in 1998 as a property manager in Mt. Juliet, TN. She crossed over to the vendor side in 2002 as the
apartment account executive for The Tennessean and Apartments.com. In 2006, Jenny was offered a sweet deal with Apartment Guide where she spent over eight years providing print and digital marketing solutions for her clients as well as a wide variety of leasing/marketing seminars, onsite training and market research. She has served on the board of directors for GNAA and has been honored as their Associ-ate of the Year and Volunteer of the Year twice. Jenny will lead all of Elmington’s marketing efforts including branding, communications, advertising, websites, training programs and more. She graduated with honors and a marketing degree from Belmont University, despite large parking fines. In addition to her passion for marketing and multifamily, Jenny is also a great lifeline for movie/music trivia, loves a good antique fur-niture store, and is crazy about her husband of 12 years, Jay, and their two daughters, Olivia and Mackenzie.
