VIIEREAS, thc dcvclopmcnt of the ports of Our Empire and thc expansion of Our merchant navy rcquire that a comprehensive Maritime Code bo cnactcd; and

WEEREAS, a Maritime Code has been prepare2 ~ d e r Our supervision and has rcccivcd the approval of O u r Senate and Chamber of Deputies;

NOV, TI.IEI<EFOIiE, in accordancc with Articles 31 and 88 of Onr Revised Constitution, W e approve the resolutions of Our Senate and Chambet of Deputies and We hereby proclaim a3 follows:

1. This Proclamation max be cited as the "blaritime Code Proclama- tion, 1960".

2. The I\Iaritime Coclc oE 1960, as publisl~ed in a separate volume appearing as Extraordinary Iastte n o . 1 of 1960 of the Negarit Cazeta, shall come into force on the 5th day of blap 1960.

3. Nothing contained in the blaritime Code shall affect the nation- ality of ships registered prior to the coming into force of eaid Code.

4. The Maritime Proclamation No. 137 of 1953, as amended by the Maritime (Amendment) Proclamation of 1956, is hereby repealed except f a t Articles 2 to 5 inclusive, ~ a r a g a p h s (e) to (g) inclusive of Article 6, Articles 28 to 31 inclusive, and Articles 36 to 47 induive .

of the register officc, the entry and notice b.eing required to

contain an indication as to the domicile of the purchascr; (c) No objection has been notified by the creditor to the purchaser

d~uing the month following publication.

( 2 ) After tics period has expired, the creditor's lien shall ubsist on th purcl~ase money for as long as such purcllasc money has not been paid, provided &at before payment the crcditor has lodged an objection

Section Mortgage h 30. Scope of Mortgage.

Ships of two tons gross tonnage and above may be mortgaged, but only under an agreement Letwcen the parties.

Art. 81. Liability by reason of ownersl'ip, possession, custody or control of the ship.

Art. 154. Prohibition against discharge from payment of freight by abandon- ment of goods.

A charterer may not free himsell from payment of freight by abandoning the g o o b even where, during the voyage, such goods have diminished in valuo or quantity- or have been damaged.

Vhere a dispute arises between holders of several negotiable parts of a single bill of lading to order, before any delivery of the goods by the carrier, preference shall be given to the holder of the part bearing the earliest endor- semen t.

(1) The carrier shall be bound by the dutiea set forth in Art. 138.

Art. 197. Liability of a Cmier.

(1) Neither the carrier nor the ship shall b e responsible for loss or damagc arising or resulting from :

Act, neglect, or default of the master, marker, pilot, or the servants of the carrier in the navigation or in the manageaent of the ship; Fire, ndoss caused by the actual f a d t or privity of the carrier; Perils, dangers, and accidents of the sea or other navigable waters; Act of God;

Act of war; Act of publ ic enemies;

Arrest or restraint of princes, rulers, o r people, o r seizure under legal process;

Quarantine restrictions; Act or omission of the shipper or o~vner oE the goods, h'u agent or

representative;

Art. 202. Termination of Contract of Carriage.

The provisioxu of Articles 144 and 145 shall regulate thc termination of a contract of carriago of goods under b i l l of lading.

Art. 203. Limitation. (1) Tlie rights arising out of a contract of carriage skaU bc bnrrcd after one

Art. 205. Nullity of Clauses in a Bill of Lading reticving a Carrier from Liability.

(I) Any clause in a bill of lading o r any instrument of mari t ime carriagc o&ez than a charter pa r ty vhi& directly or indirectly relieves a carrier f rom the liability imposed o n such carrier by common law or t h e pro-

Art. 207. Special Cases.

Notwithstanding the provisions of the preceding Articles, in any cosc

where either the special nature of the goods or the exceptional circumstance; of the carriage warrant a ~ ~ e c i a l ageemcat, suoh agreement shall be batvn up by the parties, provided that no negotiable bifl of lading is issued.

Art. 208. Jurisdiction.

The consigncc or the dlippcr may bring procccdhgs against the carrict at the port of arrival of the goods where such port i s in Ethiopia.

Art, 209. Arbitration Clause.

An arbitration &use inserted in a bill of lading may in no event grant to the arbitrators the power to settle a diffcrenec by wry of composition.

Chapter 3. Carriage of Passengers

Art. 210. Definitions.

( 1 ) In &is Chaptcr, the term ''cmier" includcs any of thc following persons who entcrs in a contract of carriage, namely the shipa~vncr, thc chartcrcr or thc opcratot of the skip.

Art. 279. Intcrest on Losses made good in General Average.

Art. 343. Non-admission by the Underwriter of Expiry.

Where an undenvriter alleges that the period provided in ArticIea 338 (1) (b), 339, 340 or 331 had not expired at the time of notice of abandonment, he shall lodge his objection wi t l~ in air months from the notice.

Art. 344. SpcciaE Znsuranco of Freight.

Art. 345. Naturc of Abandonment.

Abandonment may not be partial or conditional.

Art. 346. Duty of the Assured to declare all Znsurances taken Out.

(1) I n giving notice od abandonment, the assured shall declare all insurances t h a t he has taken oat.

( 2 ) An assued who hils made an incorrect declaration in bad faith, shall not have the benefit of the insurance.

Art. 347. Effect of Abandonment.

(1) A n abandonment which ie aacepted o r acljudged proper shall transfer to the underwriter the property in the t h i n g iinaured. The underwriter shall h e required to pay t h e amount insured.

(2) As Lctween underwriter and assured, abandonment dates from the day of the occurrence which gave rise to abandonment.

Chapter 4. Limitation Art. 338. Limitation of Actions arising out of an Insurance Contract.

All actions ariaing out of an insurance policy shall be barred after two yeara.

Art. 349. Action jor payment of premium.
