PROCLAMATION NO. 26/1996A PROCLAMATION TO REPEAL THE NATIONAL

RESEARCH INSTITUTE OF HEALTH ESTABLISH-MENT PROCLAMATION

WHEREAS, it is found necessaryto repeal the NationalResearch Institute of Health Establishment Proclamation No.271/1985;

NOW, THEREFORE, in accordance with Article 55 (I)of the Constitution of the Federal Democratic Republic ofEthiopia, it is hereby proclaimed as follows:1. Shari Title

This Proclamation may be cited asthe "National ResearchInstitute of Health Establishment Proclamation RepealingProclamationNo. 26/1996." .

2. RepealThe National Research Institute of Health Establishment

Proclamation No. 271/1985 is hereby repealed.

3. Transfer of Rights and ObligationsThe rights and obligations of the National ResearchInstitute of Health are hereby transferred to the EthiopianHealth and Nutrition Research Institute established underCouncil of Ministers Regulations No. 4/1996.

PROVIDE FOR THE ESTAB,LISHMENT OF THEETHIOPIAN HEALTH AND NUTRITION RESEARCH

INSTITUTE

These Regulationsare issued by the Council of Minis-ters pursuant to Article 5 of the Definition of Powers andDuties of the Executive Organs of the Federal DemocraticRepublic of EthiopiaProclamationNo.4/1995.

1. Short Title

These Regulations may be cited as the' 'EthiopianHealth and Nutrition Research Institute EstablishmentCouncil of Ministers Regulations No. 4/1996."

2. Estabiishment

1) There is hereby established the.EthiopianHealth andNutrition Research Institute (hereinafter' 'the Ins-titute") as an autonomouspublic authority having itsown legal personality.

Q)The Institute shall be accountable to the Minister ofHealth.

3. Head Office

The Institute shall have its Head Office in Addis Ababa,and may establish branch offices elsewhere as may benecessary.

4. Objectives of the Institute

The Institute shall have the following objectives:1) to conduct research on the causes and spread of

diseases, nutrition, traditional medicines andmedical practices and modem drugs and therebysupport the activities for the improvement of healthin the country.

2) to contribute to the developmentof health science andtechnology.

5. Powersan,dDuties of the Institute

The Institute shall have the following powers andduties:1) to collect and compile data for research;2) to conduct research on the production of diagnostic,

prophylactic and therapeutic substances;/3) to make joint efforts with the concem~d offices or

institutes for the initiation of research activities;

4) to undertake research on ways of preventing diseasesdue to malnutrition and nutritional deficiencies, aswell as nutritional improvements at family level;

5) to undertake studies on the causes, health impacts anddistribution of diseases, in collaboration with thoseconcerned;

6) to do research on traditional and modern drugs as well- as on traditional'medical practices and study the

integration of those found to be useful into the healthservice system;

- 7) to conduct nutritional science and technology researchon food items in collaboration with other necessarybodies within the country;

8) to study the production of traditional drugs whosetherapeutic efficacy and safety have been proven bylaboratory and clinical researches;

9) to prepare a preliminary pharmacopoeia ontraditionaldrugs; .

10) to prepare, in collaboration with those concerned,conducive situations whereby traditional medicinepractitioners can develop their profession throughtraining and education to improve the quality ofhealth services they render;

11) to cooperate with concerned organizations and put on. all efforts for the conservation and protection of

plants which serve as traditional drugs, and othermedical antiques from extinction;

12) to impart professional consultancy services asdeemed necessary, as well as receive and undertakelaboratory tests on samples submitted at referrallevel;

13) to charge fees for the services it renders;14) to own properties and enter itno contracts;15) to sue and be sued in its own name;16) to carry out such other activities as are necessary for

the attainment of its objectives.

6. Organizationof the Institute

The Institute shallhave:1) a Boardof Directors(hereinafter"the Board");2) a Directorto be appointedby the Governmentuponthe

recommendationof the Board;3) the necessary staff.

2) to analyze and approve policies and directivessqbmittedby the Institute;

3) to e~aluate, approve ~d monitor the researchp~gvammes of the Institute;

4) to appr~:>vetb,~ appointment of 9f:ficialsdirectlyaccountableto the Directorof the Institute;

5) '0 approveme personnelregulationsas w~Uas fix thesaJ;aryand t\llowan~s of the technica,\and scientific~U\ff9f th~wstitute;

(i) to.apprDve,¥ ~ell as detemMne~e ~location anddisbursementof the draftbudget of.the Institute.

9; Mccting$of theBoard

1) The BDardshall have its ordinary.meetings everythree months. Extraordinary meetings may beconvenedas deemednecessary.

2) There shall be a quorum where the majority Dfthemembersare present.

3) Decisionsof the Board shallbe p~sed by a majorityVDte.In caseof a tie theChainnan shallhave acastjngVDte.

4) Withoutprejudiceto theprovisionsof thisArticle,theBoardmay issue its own rules of procedure.

1o. Powe~ andDuties of theDirector

1) The Director shall be the chief executive of theInstitu~ and shall, subject to the general,directivesissued to him by the Board, be responsible for theproper managementand directionDfits activities.

2) Without limiting the generalityof the provisions Dfsub-Artjcle(1) ofthis Article, the Directorshall:(a) exercise the powers and duties vested in the

InstituteunderArticle5 of theseRegulations;(b) employand administerthe technical and scien-

tific staff in accDrdance with the personnelregulations approved,by the Board as well asadmini~terother personnel in accordance withfederalcivil servicelaws;

(c) preparethe annualbudget andwork programmeof the Instituteand submit sameto the Board;

(d) effectpaymentsin ~cordance withtl)eapprovedbudget and work programmeof tbe Institute;

(e) submit to the Board aJ;lannual report on theactivitiesDfthe Institute.

3) The Directormaydelegate,part,ofjris pDwersto theDeputy DirectDr or to. other employees of the'Institute to the extent necessary for the effectiveperformanceof the activitiesof the Institute.

11. Budget I

1) The budget of the Institute shall be drawn from thefollowing sources:(a) budgetary allocation by the Federal Government;(b) service fees collected in accordance with these

Regulations;(c) any other source.

2) The fund indicated in sub-Article (1) of this Articleshall be deposited in a bank in the name of theInstitute and shall be expended, in accordance withGovernment budgetary rules, to give effect to theobjectives of the Institute.

12. BQoksof Accounts.

I) The Instituteshallkeepcompleteand accuratebooksof accounts.

2) The books of accounts and financial documents ofthe Instituteshallbe auditedannuallyby the AuditorGeneralor by other auditorsdesignatedby him.

13. Effective Date

These Regulationsshall enter into force on the date oftheir publicationin the FederalNegaritGazeta.
