We have some amazing volunteers and I guarantee you, they will not disappoint. We are well under way with planning our chapter programs for the first quarter as well as our next Professional Development Seminar and Networking events. I would like to thank Rana Katsha for her service on the board as the 2012 chapter President. In 2002, Congress enacted the Sarbanes-Oxley Public Company Accounting Reform and Investor Protection Act (SOX) in reaction to the type of malfeasance that pro-duced the Enron and WorldCom scandals. In 2010, in the wake of the fiscal meltdown that plunged the nation into recession, the Dodd-Frank Wall Street Reform and Consumer Protection Act updated SOX—as it has come to be known—and heightened corporate liability for retaliating against employees who blow the whistle on suspected illegality. Both laws make it easier for whistleblowers to come forward and more risky for employers to retaliate against them for having done so. Both laws bring significant responsibility to the HR desk. Owners of Businesses Can Now be Held Personally

Liable under the Maryland Wage Payment and Collection Act

The Maryland Court of Special Appeals, in Campusano v. Lusitano Construction, LLC, has just held that an individual owner of a business can be sued personally under the Maryland Wage Payment and Collection Act (the “Act”). The Act is used by many employees to collect wages due and owing to them. In order for the business owner to be held personally liable for these amounts there must be evidence that the owner: (i) supervised and controlled the employ-ee’s work schedule or conditions of employment, (ii) had the power to hire and fire the em-ployee, (iii) determined the rate and method of payment to the employee and (iv) maintained employment records . If an employer is found to have violated the Act, the employee can recover up to three (3) times the amount of the wages owed and his legal fees.

Health Care Cost Increases Projected to Slow in 2013 By: Stephen Miller, CEBS– Retrieved 12/31/12 from SHRM online

Projected cost increases for all types of medical plans in the U.S. are anticipated to slow a bit through the first half of 2013, according to a survey by Buck Consultants. For the first time since 2001, Buck’s annual National Health Care Trend Survey indicated projected cost increases less than 10 percent for any plan type for 2012, a trend that will continue into 2013.

The national survey of 123 insurers and administrators measured the projected average annual increase in em-ployer-provided health care benefit costs. Insurers and administrators providing medical cost trends for the sur-vey covered a total of approximately 109 million people.

Buck’s late 2012 survey (forecasting 2013 cost increases) found that costs are projected to increase at rates that are slightly lower than the prior year’s survey, as shown below.

A Certified Association Executive, Sherrie Borden has worked for a number of health care nonprofits and is also a past president of the American Academy of Physician Assistants. She earned her mas-ter’s degree in public health policy at the Bloomberg School of Pub-lic Health at Johns Hopkins University. Sherrie’s coach training is from the Institute for Professional Excellence in Coaching and she is a member of the International Coach Federation.

Montgomery County SHRM (MCSHRM) is proud to be a 100%

chapter. This means all chapter members also maintain an active

national SHRM membership. If you do not renew your national

SHRM membership, your MCSHRM membership will become inac-

tive. You can check your national SHRM membership status by log-

ging in at www.shrm.org

Q: As a SHRM member, am I automatically a member of a local

chapter?

A: No. SHRM membership is separate from membership in your local chapter. Each chapter has its

own membership application process and dues structures. While there are more than 575 locally

affiliated SHRM chapters, they are autonomous entities in their operations and membership require-

ments. To become a member of the MCSHRM local chapter, please visit http://mcshrm.shrm.org and

then click JOIN.

Q: As a member of my local chapter, am I automatically a SHRM member?

A: No. Please see the previous answer. To join SHRM, please visit www.shrm.org

Q: Can I belong to more than one SHRM chapter?

A: Yes. You can belong to as many chapters as you desire, but we ask that you indicate our

MCSHRM chapter as your primary chapter.

Q: How do I know when MCSHRM chapter membership expires?

A: MCSHRM membership follows a calendar year (Jan 1 – Dec 31). Membership for everyone ex-

pires on Dec. 31 and all members must renew for the following year. To renew your membership,

Q: Why should I belong to a local chapter?

A: Membership in a SHRM-affiliated local chapter means access to a local network of HR profession-

als, as well as professional-development programs, products and services in your community that can

vices available through SHRM that our MCSHRM chapter can’t possibly duplicate, and there are re-

It's that time of year again! New Year's Resolutions are made! Have you made yours yet? Is it to take and pass the PHR or SPHR exam? If so, don't forget a special added benefit to membership of MCSHRM....scholarships! Each calendar year the chapter has scholarships opportunities for members who take and pass the PHR or SPHR. Members can submit their confirmation of success and receipt of payment to take the exam and get the amount reimbursed to them by MCSHRM. We celebrated two members success in 2012, by paying their testing fees and would love to in-crease that number in 2013.
