ACP’s Legislative Updates Updated 7/5/2016At the beginning of the 2016 NC General Assembly short session, Senator Phil Berger (Senate pro tempore) said that they would adjourn in time to watch fireworks from home and it appears he was correct. The final week was full of lengthy days and nights as they worked on finalizing the budget while also hoping to wrap up other legislation and committee meetings required before adjournment. The Senate and the House held uncommon Friday sessions over the past two weeks attempting to meet the July fourth target. Senator Apodaca (Senate Rules Chair) filed an adjournment resolution on Thursday evening, June 30, which originally called for a Saturday adjournment on July 2. Soon after it was filed, an amendment was passed in Senate Rules to switch the adjournment date to Friday, July 1. The House and Senate were pushing to move legislation in the waning hours as quickly as possible and did leaving many important issues on the table.

House Bill 1030The state budget finally passed in the last hours of the session. There were no changes to Medicaid fees in the budget and no other direct attack on pharmacy. The budget reduces the Division of Medical Assistance (DMA) base budget for the impact of enrollment utilization, and pricing based on the DMA forecasting model and year-to-date trends in spending and enrollment. The reduction in the Medicaid rebase represents 7.9% from the enacted budget from last session. The revised net appropriation for DMA is $3.6 billion after all changes and is a $310 million reduction. The budget also includes a requirement that prescribers of controlled substances register with the Controlled Substance Reporting System (CSRS) within 30 days of obtaining authority to prescribe controlled substances. The next session of the North Carolina General Assembly will convene on January 11, 2017.

Federal LevelCMS has been urged to act on DIR by 46 members of Congress, sixteen Senators and 30 members of the House. These members wrote to CMS urging the agency to finalize its proposed guidance on how Medicare prescription drug plan (PSP) sponsors report pharmacy price concessions, often referred to as direct and indirect remuneration (DIR) fees, to provide more accurate information to beneficiaries, pharmacies, and the Medicare program. Specifically, CMS’ proposed guidance would require that these “fees” be reflected or estimated at the point of sale – which would enable pharmacist to get an accurate picture of what their ultimate reimbursement amount will be.

On the Humana front, Humana has stated they will be measuring a pharmacy’s performance on each quality measure based on Humana Part D EQuIPP performance scores as compared to other pharmacies in Humana’s Quality Network. This means that each pharmacy is being graded on a curve, and must be in the top 20 percent of pharmacy performers (in the 80th percentile or higher) in a quality measure to qualify for the full Pharmacy Performance Payment.

From this Humana explanation, you can see how important it is to have Congress fully engaged in the DIR process and for them to understand this is just the beginning by PBMs to completely change the reimbursement process… end result, add dollars to their bottom line with no concern for the patient or access.

Trividia Health (Formerly Nipro Diagnostics) is initiating a recall, to the retail level, of multiple lots of TRUEread, TRUEbalance, TRUEtrack, and TRUEtest blood glucose test strips.

The company has determined that certain isolated TRUEread, TRUEbalance, TRUEtrack and TRUEtest blood glucose test strip lots packaged during a specific timeframe, may include open test strip vials within the sealed test strip boxes. Test strips contained within strip vials that remain open for long periods are exposed to the outside environment, which can affect test strip performance. If a user does not notice an open test strip vial upon opening the sealed test strip vial box, and then uses the test strips to measure blood glucose, the meter may provide incorrect low blood glucose results. There have been no reports of injuries related to this recall.
