LivePod continually respects the principle of data minimisation and will seek to psedunomise personal data wherever feasible.

The data collection of LivePod is lawful since:• the data subject has given consent to the processing of his or her personal data for

one or more specific purposes including the purchase of the LivePod ICO Token; • processing is necessary for the performance of a contract to which the data

subject is party or in order to take steps at the request of the data subject prior to entering into a contract;

• processing is necessary for compliance with a legal obligation to which the controller is subject including but not limited to anti-money-laundering and know your-client laws and regulations;

• processing is necessary in order to protect the vital interests of the data subject or of another natural person.

We collect personally identifiable information including your name, email, address, telephone, fax and mobile numbers, device information, IP address, geographical information and any other information that you provide us through forms or data collection pages within the Platform including the form filled while registering the Account. Information is also collected automatically through your continued regular usage of Tokens and the Website. The information collected as mentioned in this clause is retained in our server and/or the backup server and we cannot entertain requests for deletion of such information without restricting your access to services and blocking you from the Website and the LIVEPOD ecosystem. Request for deletion may be made through the contact details and/or form provided on the Website. Cookie Policy: Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Platform. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.

Legal action: The User’s Personal Data may be used for legal purposes by the Data Controller, in Court or in the stages leading to possible legal action arising from improper use of the LivePod Platform or the related services. LivePod will provide a copy of the personal data undergoing processing. For any further copies requested by the data subject, the controller may charge a reasonable fee based on administrative costs.Where the data subject makes the request by electronic means, and unless otherwise requested by the data subject, the information shall be provided in a commonly used electronic form.

The right to obtain a copy referred to above shall not adversely affect the rights and freedoms of others.

The request shall be submitted electronically in writing tothe controller to [email protected].

B. Having inaccuracies in one’s personal data corrected, the right to rectificationThe data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.The rectification request shall be submitted electronically in writing tothe controller to [email protected].

C. The Right to be forgotten through the erasure of one’s data,the right to erasure 1. The data subject shall have the right to obtain from the controller the erasure of

personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:•thepersonaldataarenolongernecessaryinrelationtothepurposesforwhichthey were collected or otherwise processed;•thedatasubjectwithdrawsconsentonwhichtheprocessingisbasedandwherethere is no other legal ground for the processing;•thedatasubjectobjectstotheprocessingandtherearenooverridinglegitimategrounds for the processing, or the data subject objects to the processing;

2. Where the controller has made the personal data public and is obliged pursuant to paragraph 1 to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

3. Paragraphs 1 and 2 shall not apply to the extent that processing is necessary: •forexercisingtherightoffreedomofexpressionandinformation;•forcompliancewithalegalobligationwhichrequiresprocessingbyEUorMalteselaw to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;•forreasonsofpublicinterestintheareaofpublichealth;• for archiving purposes in the public interest, scientific or historical researchpurposes or statistical purposes in so far as the right referred to in paragraph 1 is likely to render impossible or seriously impair the achievement of the objectives of that processing; or•fortheestablishment,exerciseordefenceoflegalclaims.The request for erasure shall be submitted electronically in writing tothe controller to [email protected].

D. The Right to Object to direct marketing1. The data subject shall have the right to object, on grounds relating to his or her

particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1) of GDPR, including profiling based on those provisions. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

Automated individual decision-making, including profiling

LivePod is not engaged in any automated individual decision-making or profiling.The objection shall be submitted electronically in writing tothe controller to [email protected].

E. The Right To Restrict processing1. The data subject shall have the right to obtain from the controller restriction of

processing where one of the following applies: •theaccuracyofthepersonaldataiscontestedbythedatasubject,foraperiodenabling the controller to verify the accuracy of the personal data;• the processing is unlawful and the data subject opposes the erasure of thepersonal data and requests the restriction of their use instead;

• the controller no longer needs the personal data for the purposes of theprocessing, but they are required by the data subject for the establishment, exercise or defence of legal claims;•thedatasubjecthasobjectedtoprocessingpendingtheverificationwhetherthelegitimate grounds of the controller override those of the data subject.

2. Where processing has been restricted under paragraph 1, such personal data shall, with the exception of storage, only be processed with the data subject’s consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of European Union or Malta.

3. A data subject who has obtained restriction of processing shall be informed by the controller before the restriction of processing is lifted.

F. The Right of Data Portability1. The data subject shall have the right to receive the personal data concerning him

or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where: •theprocessingisbasedonconsentoronacontract;and•theprocessingiscarriedoutbyautomatedmeans.

2. In exercising his or her right to data portability pursuant to paragraph 1, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible.

3. The right referred to in paragraph 1 shall not adversely affect the rights and freedoms of others.

G. The Right to Withdraw one’s consent to have their personal data processedThe data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. The withdrawal shall be submitted electronically in writing tothe controller to [email protected].

H. The Right to Object to further processing of one’s personal dataThe data subject shall have the right to object to further processing of one’s personal data. The objection shall be submitted electronically in writing tothe controller to [email protected].

LivePod will take appropriate measures to provide any information and make any communication relating to processing to the data subject in a concise, transparent, intelligible and easily accessible form, using clear and plain language. The information will be provided in writing by electronic means.

LivePod will provide information on action taken on a request to the data subject without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests. The controller shall inform the data subject of any such extension within one month of receipt of the request, together with the reasons for the delay. Where the data subject makes the request by electronic form means, the information shall be provided by electronic means where possible, unless otherwise requested by the data subject.

Information and any communication and any actions taken shall be provided free of charge.Where requests from a data subject are manifestly unfounded or excessive, in particular because of their repetitive character, the controller may either: 1. charge a reasonable fee taking into account the administrative costs of providing

the information or communication or taking the action requested; or2. refuse to act on the request

Notification obligation regarding rectification or erasure of personal data or restriction of processingThe controller shall communicate any rectification or erasure of personal data or restriction of processing to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The controller shall inform the data subject about those recipients if the data subject requests it.

Information to be provided where personal data are collected from the data subject1. Where personal data relating to a data subject are collected from the data subject,

3. Where the controller intends to further process the personal data for a purpose other than that for which the personal data were collected, the controller shall provide the data subject prior to that further processing with information on that other purpose and with any relevant further information.

4. Paragraphs 1, 2 and 3 shall not apply where and insofar as the data subject already has the information.

The LivePod Platform does not support “Do Not Track” requests. To determine whether any of the third party services it uses honor the “Do Not Track” requests, please read their privacy policies.

The Data Controller reserves the right to make changes to this Privacy Policy at any time by giving notice to its Users on this page. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom. If a User objects to any of the changes to the Policy, the User must cease using the LivePod Platform and can request that the Data Controller remove the Personal Data to the extent permitted by regulatory requirements. Unless stated otherwise, the then-current Privacy Policy applies to all Personal Data the Data Controller has about Users.

The Data Controller is responsible for this privacy policy, prepared starting from the modules provided by Tarhely.eu and hosted on Tarhely.eu’s servers.

We do not intentionally gather Personal Data from visitors who are under the age of 18. If a child under 18 submits Personal Data to LIVEPOD and we learn that the Personal Data is the information of a child under 18, we will attempt to delete the information as soon as possible. Personal Data (or Data): Any information regarding a natural person, a legal person, an institution or an association, which is, or can be, identified, even indirectly, by reference to any other information, including a personal identification number. Usage Data: Information collected automatically from the LivePod Platform (or third party services employed in the LivePod Platform), which can include: the IP addresses or domain names of the computers utilized by the Users who use the LivePod Platform, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the User, the various time details per visit (e.g., the time spent on each page within the Platform) and the details about the path followed within the Platform with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User’s IT environment.User: The individual using the LivePod Platform, which must coincide with or be authorized by the Data Subject, to whom the Personal Data refers. Data Subject: The legal or natural person to whom the Personal Data refers. Data Processor (or Data Supervisor): The natural person, legal person, public administration or any other body, association or organization authorized by the Data Controller to process the Personal Data in compliance with this privacy policy. Data Controller (or Owner): The natural person, legal person, public administration or any other body, association or organization with the right, also jointly with another Data Controller, to make decisions regarding the purposes, and the methods of processing of Personal Data and the means used, including the security measures concerning the operation and use of the LivePod Platform.
