Both gave little evidence of importance to the state's side of the case. Tho they admitted that rates are higher from the twin fitiee west than from Chicago to the twins, they both main- tained that existing conditions made this difference "just. Mr. Conley was the first examined. He was asked as to the relation of spe- cial-commodity rates to classification rates. Substantially all the commodi- ties carrying special tariffs have rates also under classifications, he stated. He thought commodity rates, except on coal, grain and lumber, might be elimi- nated with advantage. Explains the Charges. Mr Conley said the North-Western has the short line from Minneapolis to Chicago, 412 miles. "What should be the pioportionate relation, Mr. Conley, on say a 112-mile haul out of Minneapolis west, com- pared with the same distance on the Chicago haul?" "I think it would be higher."- "Assuming the rate on a carload of salt west from Minneapolis is twice as high as from Chicago to Minneapolis. Would such a condition be fair to your mind?" "The rates between Minneapolis and Chicago are governed largely by the bulk of traffic and competition with other roads. I maintain the present adjustment of tariffs from Chieago to Minneapolis, and Minneapolis west, is fair, and justifiable by conditions." Mr. Stone then called attention to an actual shipment of a car of apples Oct. 12 last. From Oxford, Mich., to Chicago, 327 miles, the cost was $43.40* Chicago to Minneapolis. 420 miles. $36.40; Minneapolis to Morris, 156 miles, $56. The car contained 175 bar- rels weighing 28,000 pounds. Could the witness see how, comparatively, the Minneapolis to Morris charge was fair? Rate Is Special. "That shipment was governed by a special commodity rate into the twin cities," said Mr. Conley. "The ton- nage was large. From the twins to Morris it went at a class rate. The cheaper rates into the twin cities en- able the dealers to get the apples into the market, the point of concentration, on a reasonable basis. I do not think the rates compared are unfair." Continuing his explanation of the specific case mentioned, Mr. Conley said: "My recollection is, there is a thru commodity rate on apples to the twin cities from Michigan and New York, where the apples are raised. This rate, if lower than the class rate from the twin cities west, enables a dealer, say at Ortonville, to get the apples cheaper than if they came from the east to the twin cities by a classified and higher rate.'' "Is not the rate on the latter part of such shipments arbitrarily higher?" ^ "I contend, considering everything, Ihe rates as they are. are not unfair." Commissioner Ira B. Mills asked a question. Basis Is Relative. "Is there any reason why there should be a lowpr rate from the apple country to Minneapolis, than to Wino- na, Rochester and other points in south- eastern Minnesota? "The rates on apples are on a rela- tive basis with the twin cities. These points mentioned carry no higher rales The rates are made on the theory of distributing centers." „ Cr. I. Why was the reduction fixed at 10 per cent? The witness did not know. He stated bis company took ear- load freight in preference to less than carload freight, when there was oppor- tunity for a choice. Would Get Both. "Which is the preferable class of traffic; livestock or grain?" "In a choice between a carload of grain and one of livestock. I" cannot say which I'd take. It would depend on conditions. I would try to get them both." Mr. Sweeney was <hen shown the waybill on the shipment of apples on which Mr. Conley had been questioned. The witness was non-eommittal. He re- fused to say he crnsidered the rate in part or whole unreasonable. He called attention, however, to the fact that the severe weather on the western end of the route would call for higher cost because of the increased risk,- NOVEMBER WEATHER WAS ABNORMALLY WET GOES BACK TO MISSOURI Man Accused of Big Fur Thefts Must Return. Governor J. A. Johnson today hon- ored requisition for the removal of Ollie Deads, under arrest in St. Paul, to Jackson county, Missouri, where he is wanted for burglary. The goods taken were a handsome lot of furs, part of which the St. Paul police have already recovered. The loot included eight seal- skin coats worth $2,500, an otter coat valued at $225, a squirrel coat worth $250, and six boas worth $300. The pusoner is to be turned over to Sheriff F. A. Wilson of Jackson county, Mia' souri. Official confirmation of the suspicion that the month of November was wet and cloudy is given by the summary of the month issued fiom the local weather observatory today. According to the official scoresheet twenty-two days of the month were cloudy. Of the remaining eight three were partly cloudy. Only five of the thirty days of the month were clear. Moreover, the total rainfall of the month, 2.52 inches, was 1,32 inches in excess of the average precipitation for the month for the last seventeen years. This rain fell on nine days of the month. Rain is where the month came up strong. Only two Novembers in the seventeen-year period covered by the local records beat it. They were No- vember, 1896, with 3.8 inches, and No- vember, 1905, with 3.07 inches. This weather is in keeping with that of. the entire year, which now shows an ac- cumulated excess of precipitation above the average of the seventeen-year pe- riod of 5.81 inches. Both gave little evidence of importance to the s t a t e ' s side of the case. Tho they admitted tha t rates are higher from the twin fitiee west than from Chicago to the twins, they both main­tained tha t existing conditions made this difference "just.

Mr. Conley was the first examined. He was asked as to the relation of spe­cial-commodity rates to classification rates. Substantially all the commodi­ties carrying special tariffs have ra tes also under classifications, he stated. He thought commodity rates, except on coal, grain and lumber, might be elimi­nated with advantage.

Explains the Charges.

Mr Conley said the North-Western has the short line from Minneapolis to Chicago, 412 miles.

" W h a t should be the pioportionate relation, Mr. Conley, on say a 112-mile haul out of Minneapolis west, com­pared with the same distance on the Chicago h a u l ? "

" I think i t would be h igher ." -"Assuming the rate on a carload of

salt west from Minneapolis is twice as high as from Chicago to Minneapolis. Would such a condition be fair to your m i n d ? "

" T h e ra tes between Minneapolis and Chicago are governed largely by the bulk of traffic and competition wi th other roads. I maintain the present adjustment of tariffs from Chieago to Minneapolis, and Minneapolis west, is fair, and justifiable by condi t ions . "

Mr. Stone then called a t tent ion to an actual shipment of a car of apples Oct. 12 last. From Oxford, Mich., to Chicago, 327 miles, the cost was $43.40* Chicago to Minneapolis. 420 miles.

$36.40; Minneapolis to Morris, 156 miles, $56. The car contained 175 bar­rels weighing 28,000 pounds. Could the witness see how, comparatively, the Minneapolis to Morris charge was fair?

Rate Is Special. " T h a t shipment was governed by a

special commodity ra te into the twin c i t i e s , " said Mr. Conley. " T h e ton­nage was large. From the twins to Morris i t went a t a class rate . The cheaper rates into the twin cities en­able the dealers to get the apples into the market , the point of concentration, on a reasonable basis. I do not think the rates compared are u n f a i r . "

Continuing his explanation of the specific case mentioned, Mr. Conley said:

" M y recollection is, there is a thru commodity rate on apples to the twin cities from Michigan and New York, where the apples are raised. This ra te , if lower than the class rate from the twin cities west, enables a dealer, say at Ortonville, to get the apples cheaper than if they came from the east to the twin cities by a classified and higher r a t e . ' '

Why was the reduction fixed at 10 per cent? The witness did not know. Mr. Sweeney was <hen shown the waybill on the shipment of apples on which Mr. Conley had been questioned. The witness was non-eommittal. He re­fused to say he crnsidered the ra te in par t or whole unreasonable. He called at tention, however, to the fact t ha t the severe weather on the western end of the route would call for higher cost because of the increased risk,-

Governor J . A. Johnson today hon­ored requisition for the removal of Ollie Deads, under arrest in St. Paul , to Jackson county, Missouri, where he is wanted for burglary. The goods taken were a handsome lot of furs, pa r t of which the St. Pau l police have already recovered. The loot included eight seal­skin coats worth $2,500, an ot ter coat valued a t $225, a squirrel coat worth $250, and six boas worth $300. The pusoner is to be turned over to Sheriff F . A. Wilson of Jackson county, Mia' souri.

Official confirmation of the suspicion tha t the month of November was wet and cloudy is given by the summary of the month issued fiom the local weather observatory today. According to the official scoresheet twenty-two days of the month were cloudy. Of the remaining eight three were par t ly cloudy. Only five of the th i r ty days of the month were clear. Moreover, the total rainfall of the month, 2.52 inches, was 1,32 inches in excess of the average precipitation for the month for the last seventeen years. This rain fell on nine days of the month.

Rain is where the month came up strong. Only two Novembers in the seventeen-year period covered by the local records beat it . They were No­vember, 1896, wi th 3.8 inches, and No­vember, 1905, with 3.07 inches. This weather is in keeping with tha t of. the entire year, which now shows an ac­cumulated excess of precipitation above the average of the seventeen-year pe­riod of 5.81 inches.
