With nearly 70 degree weather the Fircrest Golf Club was the perfect scene for the MBA Remodelors™ Council Remodeling Excellence Awards (REX). More than 150 guests attended the gala awaiting to hear the winners
announced. From hidden water heaters behind bookcases to extreme “man caves” and a million dollar whole house project with a curved tile ceiling, the winners let us know the remodeling business is still doing well in Pierce County. Anyone with an old pink sink or tub was a good candidate to watch for stunning kitchen and bathroom makeovers and great storage ideas as well. 16 members brought in 41 entries in 22 categories, and MBA gave out 23 winning awards. (see winners page 15) This was by far one of the best REX Awards and it ran seamlessly with a great committee – Stefanie Brooks, Lynne Hill, Gayle Kassen, Barb Berntsen, Karen Hirschman, Billie Jo Hyland, Janelle Swanson and Loris Candiloro- Thank you! As the political season winds up this presidential election year,
it’s important that all MBA of Pierce County members get involved and
follow which local, state and federal candidates have homebuilding as a priority and which don’t. I include below an article from NAHB’s Mike Kurpiel (2011 NAHB Associate Members Committee Chair) because he states so well how important politics are for our industry - and vice versa. We are not democrats. We are not republicans. We are “housers.” In order for you to fully grasp the benefit of advocacy check your overall political views at the door before you enter. Understanding your legislators’ political views, and how they mesh with yours, confirms that he or she has your values in their hearts. Think about these next two questions for a few minutes; what if they didn’t have your
business, your career, your livelihood in their heart? Suppose you deeply believe in what your incumbent or candidate stands for but you are struggling to keep solvent? There are quite a few passions one can have but if you are constantly and consistently “looking for business” from your membership, if nothing that was written previously has swayed you, then the one thing you can be passionate about is your job. There is no arguing this point; legislators make law and those laws can alter, redirect or dramatically change the building industry path. The term “houser” has been utilized quite often to describe a legislator, state or federal, that has the good sense to understand the importance of a healthy home building industry. They don’t always side with the HBA’s point of view, but they support the HBA’s position a major portion of the time. These men and women gain our friendship because friends care. If you’re looking on a return on investment, what better return than business opportunities? Does that bring out the passion in you? I can tell you one thing’s for certain and that is that the builder members are very passionate about the politics that will either harm or grow their business. Associates who directly do business with builders are just as passionate about “housers.” There are quite a few associates that have services or products that are for both builder and associate use. If it affects builders it will affect associates. If it affects both builder and associate it will affect those “indirect” associates as well. The passion of the building industry is the passion of earning a living; establishing a better way of life and having that living help provide men, women and children with shelter. Food, clothing and shelter are the three most needed necessities in life. The home building and remodeling industry is a noble

industry. It builds quality shelter and improves later on that shelter. Most fond memories come from your home, either growing up or later in life. Not only does building create shelter, it helps provide the structure for memories. If having a career and knowing what you do contributes to providing shelter and the memory making process doesn’t make you feel like you are doing something special, it should. That’s where your personal passion and advocacy passion blend to form the industry passion. Having that passion within you can give you more clarity to how you can maximize your HBA investment. What steps can you take to become more engaged in the political arena? Start by investing financially in the political process. No, a second mortgage is not needed but something as little as $3 a week can have you investing in the process. Attending MBA’s Legislative Strategy Committee that discusses proposed legislation can give you valuable insight to where your state or nation’s capitol may be heading with your income. Attending a legislative day with your HBA is a great way to talk with legislators and let them know how the proposed bill, or bills, may affect you. Politicians understand the power of passion and how that passion can rally potential “obstacles” or “easier path” to becoming elected or re-elected. I can get into the specifics on how the process structurally works, but it would be best for you to speak to your local executive officer and find the path that they have decided is best. The only way you can know for sure is by having a little passion for continuing to earn a living in this industry. Of course once you have checked your personal politics at the door on the way in.

Builders across the country continue to face an uphill battle when seeking accurate valuations on new
homes, but taking pro-active steps to engage and communicate with lenders and appraisers can help raise awareness and address this problem, according to participants in a May 16 “Builders Guide to Appraisals” NAHB webinar. Steve Linville, NAHB’s director of single-family finance and moderator of the event, noted that NAHB has taken a leadership role on appraisal issues in the four summits it has conducted at the National Housing Center in Washington, D.C. that have brought industry stakeholders and regulators to the table. A fifth summit is being planned for the coming fall on Oct. 17 at the National Housing Center.
NAHB earlier this year also adopted new policy on appraisals that calls for:
• Strengthening education, training and
experience requirements for appraisers of new construction; • Improving the quantity and quality of data for new construction; • Developing new appraisal standards and best practices for conducting appraisals in distressed markets; • Developing a process for expedited appeals of inaccurate or faulty appraisals; and • Strengthening oversight of appraisal activities.
While incremental progress has been made in the past couple of years on improving the appraisal process, several vexing problems remain. With sales of distressed properties continuing to far exceed new home sales in many markets, finding suitable comparables for new homes can be a difficult proposition. Inaccurate appraisals have also hampered new and existing home sales this spring. Meanwhile, some big appraisal management companies (AMCs) that tend to be fixated on a quick turnaround time and the bottom line are promoting the use of appraisers who are willing to work for the lowest fees rather than appraisers who are the most knowledgeable. Market value used to be determined by what a “willing buyer and willing seller agree on,” said Martin Mitchell, vice CEO and vice president of land and business development for Mitchell & Best Homes in the Washington, D.C. and Baltimore metro areas. Unfortunately, he said, “appraisers have been on the hot seat” and not giving accurate valuations because they have been blamed for over valuations during the boom years. “As a result, appraisers are providing valuations that are ultra-conservative and below market value,” said Mitchell.
Opening up the Lines of CommunicationHe said that the best strategy for builders is to find out as much as they can about the process and insist that their homes are reviewed by individuals who are the best qualified to assess their worth. Opening up communications with lenders as well as appraisers is also key for builders who want the true value of their homes recognized. “Builders and developers know more about their market than some appraisers,” said Mitchell. “It is important that builders and appraisers have

good communications and that builders are open in sharing data with their appraisers,” added Joan Trice, CEO and founder of Allterra Group, LLC. The challenge is for lenders to identify a competent appraiser, she said. “If I were a builder, I would ask the lender for their appraiser’s qualifications in a non-confrontational way,” said Trice. “You want to find out if the appraiser is familiar with your general market, your local market and specifically the neighborhood where your property is being built.” While urging builders to provide appraisers with as much information as possible on their developments, on comparable sales in the area and on cutting-edge techniques and products being employed to construct high-performance homes, Trice cautioned that it is illegal to attempt to coerce the appraiser to come up with a final value in order to allow a transaction to move forward. “That does not mean you cannot communicate in a proper manner with them,” she said.
Challenging a Faulty AppraisalTo avoid an appraisal coming in below the actual construction cost, Trice advises builders to take preemptive action to mitigate that problem. “Once again, this starts with good communication with the lender and understanding how they select their appraiser,” she said.Keeping a detailed record of all exchanges with an appraiser is essential, Trice added.“If you gave them information you deemed relevant and the appraiser ignored it, you can submit it to the lender,” she said. “If you have a flawed appraisal, you should talk to your lender. There is nothing that prohibits the lender from ordering a second appraisal.”

M National and State Legislative Issues to Watch
NAHB Launches Campaign to Protect Homeownership Even though most Americans overwhelmingly support
homeownership, legislative and regulatory proposals are now under consideration that would greatly harm home owners, home buyers, the housing market and the nation’s economy. The National Association of Home Builders (NAHB) has launched a new website to bring attention to the threats to homeownership and inspire the public to take action to protect it. “American families aspire to homeownership because they know that it promotes stability and is critical in creating wealth and providing upward mobility and financial security for families. Equally important, homeownership supports the economy by creating jobs,” said NAHB Chairman Barry Rutenberg, a home builder from Gainesville, Fla. “Government policies that negatively impact families’ ability to own a home would be devastating for home owners, the housing market and the nation’s economy.” Tax, legislative and regulatory policies currently under consideration would scale back or eliminate the mortgage interest deduction and make mortgages and small business loans unaffordable and even more difficult to obtain. NAHB’s new site, protecthomeownership.com, explains some of these threats and documents homeownership’s importance to individual households and to local, state and national economies through a FAQ, poll data, economic analysis and reports. The site also provides multiple ways for the public to take positive action to protect this very important aspect of American life. These include an online petition urging policymakers to keep housing a national priority, information about how to participate in homeownership rallies that are being held in a number of communities in 2012, and links to social media communities on Facebook.com/ProtectHomeownership and Twitter.com/4Homeownership. “New home construction spurs productivity, creates jobs for millions of Americans and generates revenues for all levels of government,” said Rutenberg. “This website will help educate the public about the imminent threats to the American Dream of homeownership and empower them to make sure their voices are heard.”
Do You Have Endangered Species On Your Land? The US Fish & Wildlife Service (FWS) has entered into two settlements with several environmental groups related to the Endangered Species Act (ESA) listings. These settlements force FWS to either list or delist species. There is concern from NAHB that FWS has unlawfully contracted away the agency’s discretion to circulate candidate species back to the candidate list. NAHB is looking for landowners who would be impacted by the listings, if they occur. Washington species include the white bluffs bladderpod, umtanum desert buckwheat, Taylor’s checkerspot butterfly, yellow-billed cuckoo, Oregon spotted frog, streaked horned lark, greater sage grouse, Mardon skipper, WA ground squirrel, northern wormwood, eastern massasauga, and a number of pocket gopher types. WA Home Warranties Are Back The 2012 state legislative session has come to a close and BIAW is actively gearing up for the campaign and election season, during which we’ll hopefully send more building industry friends to the marbled halls of Olympia. In the meantime, BIAW advocacy staff continues to work legislative issues. One major issue involves home warranties. The Washington State Bar Association (WSBA) has a workgroup for the proposal of a WSBA-sponsored bill to implement the Uniform Common Interest Ownership Act (UCIOA) for the 2013 legislative session. BIAW is currently reviewing the first three sections of UCIOA that include: definitions, organization of common interest ownership properties and developer control. The WSBA committee is working through the fourth and final section, which pertains to home warranties, and will make a recommendation regarding its inclusion in their potential proposed bill. So far, it looks like the committee will be split. This could mean the recommendation would be for the Washington State Legislature to pass UCIOLA without the fourth warranty section—a good result for BIAW members. BIAW is following this issue closely as it moves through the WSBA process and into the 2013 legislative session. BIAW has successfully defeated state-mandated warranties and is continuing in the battle to protect the home building industry from more high-cost and risk directives from those in government who know little to nothing about building homes for Washington’s citizens.

The first half of the year has seen some
strong recruiting efforts by not only the MBA’s long-time recruiters, but by some new faces in the recruiting realm as well. The Membership/Spike Club Committee has been working hard to create some great networking opportunities for new and prospective members in a variety of locations to draw even more interest. As of June 5th, we have recruited 65 new members to our Association! For that, I thank you all for your hard work! Getting involved in recruiting is easy, fun and most importantly rewarding! Here are just few examples of our recruiter rewards this year:
