We are happy to see our April showers now bringing on the May flowers.

May is here and many of you are looking forward to a great construction season. We at the HBA have had many conversations about the perceived outlook of “doom and gloom”. Yes, oil is down, but there are many home building and home improvement opportunities out there. Our Parade of

Homes showed that there is a positive outlook this year. Thanks again to those builders who participated in the parade.

We are about half way through the process of adopting the new building codes. Now is the time to get the code amendments that will help keep housing affordable and not over regulated. It is imperative that you stay in touch with Dot has she leads this important undertaking for the good of the BMHBA and our consumers. I know Dot has reached out to our builders and she has received little response. Please, PLEASE help us be leaders for positive change!

On a personal note, after nine years working at Ferguson Enterprises I have chosen to move on to a new endeavor. I want to thank the team of people I have worked with over the last nine years each one of them has helped me grow professionally and personally. My new endeavor, will be working for Northern Plains Plumbing, Heating & Air.

SAFEGUARD YOURREPUTATION

Avoid Online Embarrassment

It takes several years to build a strong reputation, but just seconds for it to crumble.

Though the Internet opens countless growth opportunities for businesses, it also provides an audience to anyone with an opinion. Remodelers and home builders who neglect to continually monitor their online reputation are putting their business at serious risk.

Google Consumer Surveys found that when making a big purchase, more than 67% of consumers say their decisions are influenced by online reviews. If they discover several negative reviews about a company, its products or services, they’re likely to take their business elsewhere.

Reputation monitoring firms like ReviewTrackers, ReputationDefender and Status Labs are growing rapidly. But investing in their services won’t likely produce a big enough return for smaller businesses that can typically get the job done themselves.

It’s much easier to keep tabs on what people are saying about you online when you know how and where to look. And by approaching each issue with calm professionalism, you can turn even a nasty review into a potential lead generator.

Where to StartGoogle yourself. In other words, perform an online search for your business to see what results come up. This should be done regularly, so save yourself some time and set up a Google Alert to receive email notifications whenever your company name is mentioned online.

Then, determine which sites your customers are most likely to use (some of the most common include Angie’s List, Houzz and Yelp) and regularly set aside time to check them at least once a week. The Better Business Bureau is another great resource that allows you to read and respond to consumer reviews.

Never fight fire with fireGetting into an argument online with a reviewer rarely ends well, even if the complaint is totally inaccurate. Keep in mind the reviewer has nothing to lose, but your business could experience significant, long-term consequences. However, no response can be just as damaging as an argumentative response.

Rather than immediately going on the defensive, consider posting a concise apology or an acknowledgment of the customer’s concerns and your willingness to work toward a resolution. Potential clients who see your composed response will be more assured of your professionalism and commitment to customer service.

Make it more personalDo not think the conversation is confined to websites, text messages or emails. Always follow up your online response with a more personal conversation either face to face or by phone. Smaller companies – especially in the remodeling and home building industries – can more easily identify and directly contact their dissatisfied clients, than can larger companies that serve thousands of consumers.

Amplify the positive reviewsNot all of your reviews will be negative (hopefully), but unfortunately, the positive reviews get far less attention. That’s why it’s critical to emphasize each positive review even if it means simply posting “Thank you!” as your response. It shows you’re in tune with your clients and appreciate their feedback. Share positive reviews as often as possible on social media, your website and other marketing materials.

The cost of doing businessDespite even your best efforts, many clients will feel the need to express their discontent online. Setting the client’s expectations as early as possible is the best way to help ensure client satisfaction and strengthen your bottom line.

CITY & COUNTY

The City of Mandan offers a Storefront and Landscape Improvement program for two business districts: Downtown Mandan and Memorial Highway. The purpose of the program is to encourage redevelopment and improve the appearance of the downtown area and Memorial Highway.

Commercial property owners and business tenants in the districts may apply for matching funds in the form of a forgivable loan for improvements to building facades such as exterior finish, windows, doors, awnings, canopies and signage, plus landscaping.

Storefront funds are provided in the form of a maximum $30,000 forgivable loan for up to 50% of the investment in rehabilitating a building facade. Up to $60,000 may be considered for a downtown corner building depending upon the extent of the project.

STOREFRONT AND LANDSCAPE IMPROVEMENT

PROGRAMThe Missouri River Correctional Center

has announced the expansion of its work release program. Work release programs provide career and vocational training to inmates who qualify. There are currently 36 eligible inmates available to work in various positions.

Work or education release is a privilege granted to some inmates of the MRCC. Work release gives them a chance to earn some money to prepare for the release from the institution, to readjust to society, and a job that they may be able to continue after upon released. Tyler Gensrich and Nick Friez with the Missouri Valley Correctional Center pointed out, “Studies have shown that individuals released from incarceration with financial stability are far less likely to return to criminal behavior. It also gives area employers an opportunity to fill vacant positions and possibly retain that employee upon release.

• A $2,4000 tax credit for each felon hired.

• Opportunity to for up to 50% of wages paid to inmates.

• Inmate transportation provided to jobsites within 6 miles of the Bismarck/Mandan Area.

Work release may only be attained when housed at the MRCC. They must meet all eligibility criteria to apply, which includes attaining community eligibility. In addition to work opportunities, inmates are provided guidance and counseling services to enhance their experience in the program, and to increase the likelihood of success upon release.

In 2015 Bismarck-Burleigh Public Health (BBPH) partnered with CHI St. Alexius Health and Sanford Health in Bismarck to complete a community health needs assessment. Topping the list of concerns is affordable housing, with respondents ranking it above chronic disease, access to affordable health care and obesity among others.

“It comes as no surprise that affordable housing tops the list,” said Bismarck-Mandan Home Builders Association (BMHBA) President Greg Zenker. “Housing is a basic need and if it’s not affordable impacts all areas of life.”

Research shows that access to affordable housing reduces stress, increases student success, has a positive impact on crime and more.

“We’re committed to working together with various stakeholders to ensure the availability of affordable housing,” Zenker added. “We fight to reduce costs

of construction through smart regulation and access to labor, and we rally to support resources that aid in home purchasing like the 30-year mortgage, interest deduction, ND Roots and FirstHome programs.”

Bismarck-Burleigh Public Health selected the following concerns as priorities to be included in the agency’s strategic implementation plan:

• Access to affordable health care

• Chronic disease

• Obesity/poor nutrition/lack of exercise

“We understand that BBPH choose the concerns they did because they align with their mission, vision, and core functions. As a leader in home building, the BMHBA is taking it upon itself to address the concern of affordable housing and will work across industries to promote, educate and advocate,” said Zenker.

SRF Consulting is kicking off a process to update Morton County’s future land use plan. The study area consists of an unincorporated portion of Morton County, which is in close proximity to Mandan, I-94, and the Missouri River.

Moving into this pivotal election year, BUILD-PAC has hit the ground running with a war chest of over $1.7 million raised – more than half way to its cycle goal of $3 million.

“We’ve got a great story to tell lawmakers, voters and the American people,” said 2016 BUILD-PAC chair Eugene Graf. “The home is central to American family life, and housing is key to job creation and economic growth. It is important that we have the resources we need to support candidates who understand our perspective and will provide a pro-housing, pro-business voice on Capitol Hill.”

BUILD-PAC, NAHB’s bipartisan federal political action committee, helps elect the most qualified pro-housing, pro-business candidates to federal office. In the 2014 election year, BUILD-PAC supported more than 370 pro-housing candidates, and 95% of these candidates won their seats in November.

As the PAC moves full steam ahead, its main focus is not only to reach its lofty fundraising goal, but to also increase member participation throughout the NAHB federation. BUILD-PAC launched its Fair Share Campaign to encourage every member to do their part and invest at least $25 in BUILD-PAC. This gives participating members a chance to get more involved in the political process while simultaneously making housing’s voice stronger and louder in Washington, D.C.

BUILD-PAC is housing’s voice in the 2016 elections. When a builder, remodeler or trade partner writes a personal check to a federal candidate’s campaign, there is one voice behind it. But there are more than 140,000 voices behind every check that BUILD-PAC writes to a candidate for Congress.

To keep up its strong momentum going into the November elections, BUILD-PAC is focusing its outreach to members who are new to giving, or have yet to take the plunge and invest. In 2015, BUILD-PAC received support from over 1,000 new donors, and it’s hoping to double that number in 2016.

BUILD-PAC KEEPS THE MOMENTUM GOING

New rules implemented on Oct. 3, 2015 have overhauled the disclosure process for closing on a home mortgage. The forms that have been used for decades — the Good Faith Estimate, the Truth in Lending and HUD-1 Settlement Statements — have been replaced by the Consumer Financial Protection Bureau’s new integrated disclosure forms, the “Loan Estimate” and the “Closing Disclosure.”

Under the new rules, the Closing Disclosure must be provided to the consumer a full three days prior to closing, and if there are certain changes during that 72-hour period, the closing could be delayed. In addition, the hefty penalties assessed on lenders for failing to meet the new disclosure requirements also are lengthening loan processing times.

As lenders adjust to the new rules, industry surveys have indicated that loans on average were taking longer to close. NAHB is working to determine if the new disclosure requirements are creating problems for home sellers and buyers and whether there are aspects of the new home financing process that are creating particular difficulties for NAHB members.

CHANGES TO FLOOD INSURANCE RATES NOW EFFECTIVESeveral changes to the National Flood Insurance Program

(NFIP) took effect on April 1, impacting a wide range of builders, developers, businesses, home owners and insurance agents operating in areas covered by the NFIP.

FEMA has indicated that the maximum individual rate increase for any individual policy is 18%, with a few exceptions. The guidance also states that average premiums – once certain fees are accounted for – will increase 9% for policies written or renewed on or after April 1. For most risk classes, the average annual premium rate increases are limited to 15%.

Many of the changes are a result of continued implementation of the Homeowner Flood Insurance Affordability Act of 2014 (HFIAA) and the Biggert-Waters Flood Insurance Reform Act of 2012 (BW-12). Congress passed BW-12 and subsequently HFIAA to reauthorize and reform the program.

In its summary, FEMA notes that changes will also affect mapping, mitigation efforts and program outreach. Each property

will see distinct impacts because characteristics such as flood zone, year built (which affects whether it is depicted on the Flood Insurance Rate Map, or FIRM) and property type still play a role in individual premiums.

Other changes include new rating methodology for properties newly mapped into a Special Flood Hazard Area and the elimination of subsidies for certain pre-FIRM policies that lapse and are reinstated past 90 days. In instances where a policyholder wants to return to the NFIP program after the lapse, he or she must obtain an elevation certificate and use the full-risk rate.

This round of implementation activity occurs at the same time as regulators look ahead to the next round of program reauthorizations. Congress must pass NFIP reauthorization by Sept. 30, 2017.

FEMA ‘DISASTER DEDUCTIBLE’ NEEDS WORK, NAHB SAYSNAHB is asking the Federal Emergency Management Agency

(FEMA) to reconsider whether requiring stricter building codes is an effective way to meet a “disaster deductible” that has been proposed as a requirement that states and localities must meet before being eligible to apply for federal disaster relief assistance.

In a January notice, FEMA said its rationale for instituting the disaster deductible is this: Under the Stafford Act, local governments are typically reimbursed for 75% of eligible clean-up costs beginning at $1 million in assessed damages. FEMA believes the Stafford Act is skewed too heavily to federal aid, while state and local governments need not demonstrate sufficient pre-disaster preparedness.

FEMA’s proposal suggests that governments can demonstrate they have met such a disaster deductible in several ways, including creation of a self-insurance fund, adoption of a disaster relief fund at the state or local level, or adoption of stricter

building codes.

NAHB comments took issue with FEMA’s suggestion that local governments could demonstrate they met this disaster deductible requirement by simply adopting stricter building codes. UPDATING EXISTING WIRING FOR NEW TECHNOLOGY

A new tech-savvy generation of home buyers is bringing challenges to renovations and updates of existing homes. Wiring schemes that were sufficient for yesterday’s electronics are becoming obsolete, as the demand for adding complex integrated systems to existing homes is rising.

According to a survey published by Better Homes and Garden Real Estate, the newest group of buyers, ages 18-35, have made technology a top priority in the buying decision. The specifics of the technology needs should be thoroughly discussed with home-owners before any renovations or new construction begins to insure that all electrical requirements are accounted for in the design of the new wiring schematic.

In addition to lightning-fast data speed and constant connectivity, homeowners are also asking for home automation. They want the ability to control lights, temperature, and security systems from a single touch pad or smart phone. Home buyers are also asking for entertainment to be accessible in any room, at any time, including whole-house sound and video systems.

Since all of these capabilities come at an expense, homebuyers also look to energy management to keep living costs down. Energy efficient appliances, fan controls and motion sensors are all tools that appeal to millennials.

Each of these features require the old wiring of existing homes to be brought up to speed. Category 1 wire, used for simple telephone service, must now become Category 5 wire in order to accommodate new Internet speeds and sophisticated home computer networks. Daisy-chain wiring is being replaced by home-run wiring, allowing schemes to be centrally located. Enhanced coaxial cables are preventing signal loss in new televisions, and RJ75 plugs jacks are allowing space for up to eight conductors.

NAHB and the National Federation of Independent Business (NFIB) filed a lawsuit against the U.S. Department of Labor (DOL) asserting that the agency’s new union persuader rule violates business owners’ First Amendment rights, making it nearly impossible to consult with legal counsel when facing union organizing.

The rule is fundamentally unfair because it requires employers to report to the DOL whether and when they consult with a lawyer to discuss union organizing. The unions, on the other hand, aren’t encumbered by any such requirement.

“DOL’s final persuader rule is another example of regulatory overreach that will impose far-reaching reporting requirements on employers and their consultants and result in significant monetary and legal implications for home building firms,” said NAHB Chairman Ed Brady in a joint press release with NFIB. “This lawsuit is necessary to maintain long standing policy on what union-related communications between employers and attorneys remain confidential.”

Previously, business owners were only required to report when outside counsel directly communicated with employees. Under the new rule, business owners will have to report any communication with legal counsel even if the matter ends there.

The persuader rule will take effect July 1.

116,000 CONSTRUCTION SUPERVISORS ELIGIBLE FOR OVERTIME THIS SUMMER

Please contact Sen. John Hoeven, Sen. Heidi Heitkamp and Rep. Kevin Cramer today regarding the U.S. Department of Labor’s (DOL) recent overtime proposal. Time is of the essence to halt a plan that could do our industry great harm.

If this proposal goes forward, you may have to pay overtime to employees who are now exempt. In fact, we estimate over 116,000 construction supervisors would become overtime eligible under this proposal, which could take effect as soon as this summer.

The new rule would double the federal overtime salary threshold from $23,660 to $50,440, and, for the first time ever, index the salary threshold to inflation. This would mean that for any employees earning less than $970 per week, you would need to track their hours worked and pay overtime. This could force many small builders to scale

back on pay and benefits, as well as cutting hours to avoid overtime requirements.

We are working on a solution, but need your help. The Protecting Workplace Advancement and Opportunity Act (Senate bill S.2707 and House bill H.R.4773) would force the DOL to withdraw this proposal until it has considered the economic effects of nearly doubling the overtime threshold. We need you to ask your member of Congress to co-sponsor and support this bill.

A new NAHB Economics research article shows that the effective real estate tax rates vary substantially across and within counties, with the highest rate area displaying rates that are often several times higher than the lowest rate areas within the same county.

As NAHB economist Natalia Siniavskaia explained in a recent Eye on Housing blog post, the report presents tables of effective property tax rates for more than 3,100 counties, mapped below, including the lowest and highest tract rates within each county.

At the low end of the national spectrum, there are 12 Louisiana parishes registering property tax rates that are effectively under $2 per $1,000 of value. At the high end, there are Orleans and Monroe Counties, New York and Camden County, New Jersey, with property tax rates averaging close to $29.

The regional location remains a strong factor in explaining substantial differences in effective tax rates. The South typically registers some of the lowest rates, with the exception of Texas, and the Northeast and Midwest have some of the highest rates in the nation. This is a reflection of a well-known and long-established tradition of southern states to rely less on real estate taxes as a source of government revenue.

As Builder Associations we work to ensure that housing is a national, state and local priority and that all Americans have access to safe, decent and affordable housing, whether they choose to buy a home or rent.

This goal is increasingly difficult in today’s contentious and unsettled political and financial environment, one in which the concept of homeownership as a national, state or local priority is very much under attack. The laws and regulations all forms of government are pressing forward are on a course that will affect the housing market. These laws and regulations will drive housing costs up and take more homeowners off the market because the costs no longer make it affordable for them. In 2015, NAHB, NDAB, and your local HBA all advocated on your behalf, they fought many of these laws and regulations that were being forced on us. Our advocacy victories and other services will save home builders about $5,700 for a typical house start. That is a big number and a tangible sign of the value the 3 in 1 membership delivers for its members. NAHB, NDBA, and your local association will continue to fight for you, but we need your help. We need for you to help get our voice heard. The next 2-4 years we will have many challenges in new laws and regulations that will drive the cost of home ownership up. Primary Vote Next month you will have the opportunity to vote in North Dakota. Tuesday, June 14 is primary election day. Have you ever taken the time to vote in the primary election? Historically, it is one of the lowest voter turnouts for an election time, but it is just as important to vote in the pri-maries as it is to vote in the general election in November. It is the time to have your voice heard and help decide who will be the candi-dates on the November ballot.

In the early twentieth century there was a movement to give more power to citizens in the selection of the candidates for the party’s nomination. The primary election developed from this reform movement. In a primary election, voters (ND is the only state that does not require voter registration) may participate in choosing the candidate for the party’s nomination by voting through a secret ballot, as in a general election. In North Dakota, not only do we not have voter registration, but we do have a closed primary in which you can only vote for one party. You cannot vote for one Democratic candidate and then vote for a Republican candidate. You can, however, skip voting for a certain candidate if you so choose. This is different from the general elec-tion where you can vote across party lines. It is still important to take time to vote because some races within the same party might have a contested race. Aside from statewide candidates, there will be city council seats, city commission seats, park board seats, etc. that will be included on the ballot along with ordinances and laws. While the primary is held on Tuesday, June 14 this year, some cities may offer in-person early voting opportunities and/or absen-tee or vote by mail. Regardless of how you choose to vote, ID is required for voting in ND. You will need an ID that shows your name, current residential street address and date of birth. Some valid forms include current driver’s license or non-drivers identifica-tion card, tribal government issued identification or long-term care certificate. If voting absentee or by mail requires a ND form of identification listed above, a passport or military ID. The BMHBA has been busy following ordinance updates in Bismarck and Mandan, Burleigh and Morton Counties. All are reviewing and updating dated codes. Eyes are currently on permit cost changes and development standards.

A housing analysis conducted by Bismarck and Mandan outlines a need for an additional 7,786 owner-occupied homes by 2030. The HBA is working on a task force to explore implementation of the study’s recommendations.

Members elected a new Builder board member at the Fall GMM on Nov. 24 to fill Past President Vance Vetter’s seat. The 2016 board of directors will be sworn in at the Annual Banquet on Jan. 14.

Tracy DeForest is the latest addition to the BMHBA staff. DeForest started April 18 as the membership services representative.

Close to 40 members attended the Spring Building Officials Roundtable event. Top concerns were building in floodplains, NFIP changes and the pending adoption of the 2015 IRC.

The Government Affairs Committee will soon determine their candidate support for the primary elections. Profiles were collected from citizens who filed for elected office.

The Spring Awards Mixer & GMM will celebrate Parade of Homes participants. NDAB members are welcome to join us at the May 12 event.

Our Home Show was April 9th and 10th and we had over 2,300 people through the door! Thank you to all of our committee members, exhibitors, and volunteers for helping put on a great show. The concessions were provided by the local speech team, and all profits went to them. This year we donated booths to local non-profit organizations including the Cub Scouts, Amen Food Pantry, DSU Heritage Foundation, and the Domestic Violence Center.

Executive Officer Tiffaney Dolechek will be attending the NAHB orientation in Washington DC this month. This will be a great learning opportunity and help her to become familiar with NAHB’s programs, products and services.

We are starting to plan our first Parade of Homes that will take place this fall. We are still working out all the details, but are excited for this new event. We are also planning our summer picnic event on August 10th, and golf scramble on August 18th.

The Spring Parade of Homes featured 99 homes by 51 Builders over two weekends: April 28 – May 1 & May 5-8. This was the third largest Parade in its 56 years. New this year included a parade-dedicated website (www.paradefm.com), mobile app, and re-vamped publication. Visit www.paradefm.com to view the homes.

Home Builders Care of Fargo-Moorhead Foundation hosted its annual Fish Fry in February. Over 1,000 tickets were sold for the event, 590 people attended and over $5,000 was raised for Home Builders Care. Thank you to the sponsors and volunteers

who made this event possible! The HBA of F-M is holding its Parade of

Homes Celebration May 12 at the Holiday Inn. This fun event celebrates the Builders on the Parade and the successful Parade of Homes. New this year is a social format with games, appetizers and drinks.

Registration for the Herdina Academy for the Construction Trades is full. The two-week construction trades academy is in its 19th year, and offers a hands-on experience to students between the ages of 15-21. After completion of the academy, the students are awarded three college credits to use at applicable schools.

The HBA of F-M is holding its golf outings July 12 & Sept. 13.

The Forx Builders sponsored a very successful Lunch and Learn presented by the Construction Law Practice Group of Zimney Foster PC Attorneys at Law. Attorneys Erin Zasada, Warren Roehl and Cassandra Marka’ topic was The “Nuts & Bolts” of Construction Lien/Mechanics Lien Law.

The East Grand Forks Economic Development Authority along with the Valley Golf Course will sponsor the May Builders after Hours at Valley Golf Course.

Our annual Sporting Clay Shoot will be May 24th at the Dakota Hunting Club. Fargo Glass & Paint will sponsor the event. The Italian Moon will cater the burgers and brats after the shoot.

Northland Custom Woodworking will host the June Builders after Hours. They are anxious to show their new showroom to our members.
