Bismarck-Mandan Permit Reports through March 31, 2016

April is here and that means the start of the construction season. The past couple of weeks I have seen excavation for water and sewers in both Mandan and Bismarck, landscaping companies performing that needed grass and bushes clean up. What a wonderful sight! I hope there are a few April showers to bring us May flowers.

The Parade of Homes is at the end of this month and at the last count we had over 40 homes in the parade. Over the last few parades we have had a parade app showing the location of each home and valuable information for that home, be sure to download that to your smartphone. Thank you to our builders who were able to participate in this year’s spring parade.

We continue to collect information for the new 2015 building code revisions. Please remember that we will be asking for input before those revisions become codes. This will help us be proactive with the building officials to help limit the new codes increasing unneeded costs.

In March we were able to meet with our North Dakota Congressional leaders in Bismarck for Bring Housing Home. In that meeting we were able to give them information that 25% of a new home’s construction costs are strictly for regulation and become expenses that have little return on investment. We are very fortunate that our Congressional leaders also lead the charge nationallly to change these regulations.

SPRING PARADE OF HOMES NEARS

The Bismarck-Mandan Home Builders Association is proud to present our annual Spring Parade of Homes. It is evident that local building professionals have been busy this summer and I am certain our communities will benefit as they showcase more than 40 homes in this Spring’s Parade of Homes. Our builders have worked hard to deliver each beautifully crafted home in price points everyone can appreciate.

Our fully-loaded parade boasts 34 homes in Bismarck, 6 in Mandan and 1 in Lincoln. CITY & COUNTY

Owners of campers, boats, and trailers are advised to keep in mind the parking ordinance change that occurred last year regarding parking on public right of ways.

Under the new law it is unlawful for anyone to park or leave standing on any public street or highway in the city any boat, snowmobile, bumper pull travel trailer, fifth wheel trailer, pull type camper, pickup camper, motor home, house car, bus, mini motor home, or trailer for a period longer than forty-eight hours consecutively. Any person violating this section is subject to a fine of one hundred fifty dollars ($150.00) per each day of violation.

Any unit found to be in violation of the forty-eight hour parking ordinance will be marked with a red warning tag advising of the violation and that the unit has to be moved a minimum of 1300 feet from its original parking spot. If the unit is not moved a parking ticket will be issued.

It should be noted that if the unit is still not moved after a parking ticket has been issued it can be towed by the Police Department, which will incur more costs to the owner.

BISMARCK PARKING LAW CHANGE

The Mandan Police Department implemented a new organizational structure in March. Police Chief Jason Ziegler expects the community policing model to improve services provided to the community by balancing the division of labor and streamlining communication. He says the model also allows for more flexible scheduling, which will help address manpower needs.

The model divides the police department into two bureaus, enforcement and support. A deputy chief is appointed to command each bureau.

• The enforcement bureau is responsible for patrol operations, warrant services and calls for service. The bureau is overseen by Deputy Chief Jason Bier. It includes 27 sworn officers, including two lieutenants and four sergeants. It is divided into two platoons. Each platoon is divided into two squads.

• The support bureau handles investigations and support services, such as youth services, school resources, recruitment, evidence and training. The bureau is overseen by Deputy Chief Paul Leingang. It includes two investigators, two lieutenants, two sergeants and a school resource officer.

The new approach divides budgetary and operational responsibilities. Ziegler says it also promotes succession planning and empowers officers to succeed in current and future capacities. For more information, visit www.mandanpd.com.

MANDAN ADOPTS COMMUNITY POLICING MODEL

Jason Tomanek, 39, a senior planner for the City of Bismarck, was named the assistant city administrator. Bismarck City Commissioners interviewed five candidates for the position including Tomanek.

Tomanek will complete a master’s degree in business from the University of Mary in April with an emphasis in project management and employee retention, and holds two bachelor’s degrees; one in landscape architecture and one in environmental design from North Dakota State University in Fargo.

“I am deeply humbled by this opportunity and truly look forward to the challenges that lie ahead. I am excited to continue working for the City of Bismarck in this new role and eager to help this community to continue to progress and grow in the years ahead,” said Tomanek.

As assistant city administrator, Tomanek will coordinate and direct the development of departmental goals, interdepartmental operations, and policies; aid in strategic planning activities, operations and policies within the city’s public service

departments, manage the development of efforts to improve operations, decrease turnaround times, streamline work processes, promote cooperative activities and act as a communication liaison with citizens.

CITY & COUNTY

The City of Mandan Community Beautification Committee and Mandan Progress Organization are seeking volunteers to pick up litter on Saturday, April 30, from 9 a.m. to noon. Volunteers will meet at Dykshoorn Park on west Main Street. Wear long pants and bring protective work or gardening gloves.

Organizers have a goal of recruiting 200 volunteers. Volunteers will be treated to lunch after the event and will have a chance to win prizes donated by local merchants and organizations. More than 300 registrants, including 25 from the BMHBA, tuned in on March 15 to get the details about the Environmental Protection Agency’s new, streamlined single-lot permit template designed to meet federal stormwater management requirements.

Right now, home builders in the four states that EPA directly oversees on stormwater − New Hampshire, Massachusetts, New Mexico and Idaho, as well as Washington, D.C. − can start using the new compliance template. But more than half the callers who participated in the webinar are regulators: water quality officials interested in figuring out how to apply the streamlined template in their own jurisdictions when their programs are up for their every-five-year EPA renewals.

The simplified template introduced in December is “a game changer,” said Greg Schaner, attorney advisor for EPA. Cutting its size from about 100 to less than 20 pages is expected to save home builders time, money and environmental consultant fees.

According to ND Stormwater Program Manager Dallas Grossman, North Dakota has authority to manage the EPA’s

stormwater program. As a result, they have state-specific requirements that were incorporated into a new ND SWPPP template that is now online at https://goo.gl/GIZ9Ve.

“It [the EPA’s modified SWPPP] is not perfect yet,” said NAHB Program Manager for Environmental Policy Eva Birk, who worked closely with EPA to advise them on the new template. “But it’s a great first step.”

“We still have a long way to go to revamp duplicative and confusing compliance processes on water – our builders want clean water in their communities,” Birk continued. “They also want common-sense regulations that you don’t need a doctoral degree to unravel. NAHB is happy to be facilitating the conversation with EPA around how we can move in this direction at the national level.”

Locally, the BMHBA is working with the state to compare both plans to see if they can be further condensed.

NAHB KIDS TO SHINE IN NEW CONTEST

Nationwide housing starts rose 5.2% to a seasonally adjusted annual rate of 1.178 million units in February, according to newly released data from HUD and the Commerce Department. Single-family production increased 7.2% to 822,000 units, its highest level since November 2007, while multifamily starts edged up 0.8% to 356,000 units.

“This month’s report is consistent with positive builder sentiment and other economic indicators showing that the housing market continues to recover at a gradual pace,” said NAHB Chairman Ed Brady.

“February’s single-family gains indicate that this sector is strengthening in line with our forecast,” said NAHB Chief Economist David Crowe. “As the U.S. economy firms, job creation continues and mortgage interest rates remain low, we should see further growth in housing production moving forward.”

Combined single- and multifamily starts rose in three of the four regions in February, with the West, Midwest and South posting respective gains of 26.1%, 19.9% and 7.1%. The Northeast registered a 51.3% loss.

A decline in the volatile multifamily sector pushed overall permit issuance down 3.1% in February. Multifamily permits fell 8.4% to a rate of 436,000 while single-family permits ticked up 0.4% to 731,000.

Regionally, permits increased in the Northeast by 40.4 %. The Midwest, West and South registered respective permit losses of 11.4%, 7.2% and 4.4%.

CONFINED SPACES REGULATION NOW IN EFFECTA temporary stay of enforcement by the Occupational

Safety & Health Administration (OSHA) on the Confined Spaces in Construction Standard ended March 8, 2016. The rule became effective Aug. 3, 2015.

The confined space standard applies to workers who enter spaces that are not designed for continuous occupancy and are difficult to exit in the event of an emergency, such as manholes and crawl spaces.

In general, the rule requires employers to:

• Evaluate the jobsite to identify confined spaces.

• Develop a written program and permitting system for permit-required confined spaces.

• Control physical hazards and conduct monitoring for atmospheric hazards in confined spaces that are permit required.

• Provide training for confined space entrants, attendants, supervisors and emergency duties.

Builders who hire trade contractors (i.e., subcontractors) to do work in a confined space may have additional responsibilities under the new standard.

Home builders in federal OSHA jurisdictions should continue to make strides toward compliance. For specific questions and concerns about the rule or compliance, NAHB members should contact Rob Matuga, assistant vice president of NAHB Labor, Safety & Health, at 202-266-8507.

OVERTIME RULE ONE STEP CLOSER TO IMPLEMENTATIONIn a move that could have major ramifications for

members of the residential construction industry, the U.S. Department of Labor (DOL) has sent its final rule changes expanding who is covered by overtime laws to the Office of Management and Budget (OMB).

The rule would impact employees who were previously exempt from the overtime requirements, such as construction supervisors and outside sales staff, among other administrative employees.

The new rule would double the federal overtime salary threshold from $23,660

to $50,440 and, for the first time ever, index the salary threshold annually.

By 2030, employees who make less than

approximately $69,720 would be eligible for overtime. This could force many small builders to scale back on pay and benefits, as well as cutting hours to avoid overtime requirements.

The issue is a top priority of the administration, and President Obama is racing to release the rule now in a bid to thwart potential congressional efforts to overturn the measure. It is expected that the final rule will be released in April and will likely take effect by August.

NAHB has been working diligently to fight the proposed overtime rule. NAHB Chairman Ed Brady testified before Congress last fall against the proposal. NAHB is also working with congressional allies and stakeholder groups to see that an appropriations rider to stop the rule is included in this year’s budget. While NAHB will fight vigorously, it is important for our members to be prepared.

THE BEST MARKETING IS FREE MARKETING

Donald Trump’s presidential campaign proves at least one thing: you don’t have to spend the most money on advertising to beat (at least for the moment) the competition.

His advantage largely stems from the seemingly non-stop publicity in the press – publicity that costs him nothing, but has significantly more value than traditional paid advertising.

Using standard advertising rates, the media coverage Trump has received – for free – thus far in his campaign was reportedly valued at $2 billion. Yet the money he’s spent on advertising is a small fraction of that of the other candidates.

For those of us not named Trump, it’s slightly more difficult to gain media attention. But it’s still very possible, and definitely worth the effort.

The keys to effective media relations include recognizing the right opportunities and knowing who to contact.

2015 NAHB Remodelers Chair Robert Criner, GMR, GMB, CAPS, knows the tremendous value of working with the media, which has long been a big portion of his marketing strategy. Criner, owner of Criner Remodeling in Newport News, Va., was recently interviewed via Skype on the Weather Channel for a segment on seasonal weather tips.

“It’s a significantly better validation of the quality of your work and enhances the overall

reputation of your company,” said Criner. “It requires very little effort, and you’ll get a lot more bang for buck compared to paid advertising.”

Criner admits that being in the news won’t beef up business overnight and it can’t be your only marketing strategy. But he says it will certainly help to better position yourself as an authority on a given subject, setting you apart as the go-to professional in your area.

A few pieces of advice:

Look to the local media. Local media outlets will reach a much higher percentage of your potential clients. You are also much more likely to get a response from a local reporter, and you can more easily build a rapport with them over time. Determine which news programs and publications are the most relevant to your potential clients, and then identify specific people to contact. Many reporters and editors include their email addresses on their company websites and at the end of the articles they write.

Lean on your local HBA. Leaders at your HBA can help you get started. And being affiliated with your HBA also connects you to NAHB and its staff, who can create a customized media list of reporters you might want to contact. NAHB can also supply supporting data or information to help further emphasize the significance of the story topic.

Proactively pitch story ideas. Not everything is considered newsworthy, no matter how important something might be to you. Focus on recognizing unique connections

between your expertise and topics of broad public interest or timeliness (i.e., the weather, local economy, holidays, seasons, community events, etc.). When reaching out to reporters, be as brief and concise as possible. Boil down your story idea to just a few sentences explaining its significance. If you can readily provide a visual, such as high-quality photos or video, be sure to mention it. But do not send email attachments until after the reporter responds.

Show some social media savvy. Being featured in a news story is just the beginning. Social media gives you the power to get some extra marketing mileage out of that story. PROFITS MATTER:WHICH REMODELERS MAKE THE MOST

When it comes to the performance of your business, size doesn’t matter. What matters is the amount of profit in your pocket.

Profit envy shouldn’t be your primary motivation in running a successful business. But knowing how much the competition is bringing in can help you better gauge your financial performance and further enhance your industry intellect.

NAHB is currently surveying all of its remodeler members to provide them with real-market benchmarks they can use to compare their business to others, pinpoint improvement opportunities and set budget targets.

Last year, NAHB conducted a similar survey among its builder members to develop the Cost of Doing Business Study, 2016 Edition. The study found that in 2014, single-family builders had an average revenue of $16.2 million, 9% higher than in 2012 and 130%

higher than in 2010. Builders also reported a gross profit margin averaging 18.9% and spent 12.5% of their total revenue on operating expenses.

Similarly, this year’s brief survey aims to produce information that is just as detailed and accurate as it relates to the remodeling industry. It asks remodelers a few basic questions about the type of business they run, followed by a set of financial questions that can be quickly answered by referencing their company’s final 2015 income statement and balance sheet.

The information is kept completely confidential. Only the NAHB research team conducting the survey will see the responses, and only industry averages will be published.

1965 is the Great Divide in Home Size Preferences

Age clearly impacts preferences in home size, and seniors and

baby boomers (those born before 1965) have different priorities

than millennials and Gen-X-ers (born in 1965 or later). According to an NAHB survey of more than

4,300 recent and prospective home buyers, this older-versus-younger divide is also apparent

in preferences for the number of bedrooms.

Advocacy and Resources

On Friday, March 11, members of the North Dakota Association of Builders came together in Bismarck to meet with Senator Heitkamp, Congressman Cramer, Attorney General Wayne Stenehjem, and a staff member of Senator Hoeven to discuss important home building industry policy items and to learn what our Association can be doing to offer support on these issues. This was all a part of the National Association of Home Builders Bringing Housing Home initiative where each state was asked to hold meetings with their National Delegation. I want to

personally thank all those who took time to join us for these important meetings. Along with our ND Delegation, we had special guests 2nd Vice Chairman Randy Noel, Regional Field Rep. Michael Bezruki, and Federal Legislative Manager Julies Bogue, all from NAHB, join us for the two days as well, and they told us our Board and Members represented the best attended and best prepared BHH meetings they have seen so far. Over the course of the day we not only got to put our industries views and requests front and center, we also were able to learn of many resources, individuals, and offices that work to help us in our industry. A great wealth of information was shared by Attorney General Stenehjem and I would encourage members to contact that office regularly, along with our Secretary of State’s office to get guidance in a variety of instances. Here are some of the agencies within the Office of the Attorney General, or overseen by that office. State law prohibits the Attorney General and his staff from providing legal advice to, or representing, members of the public. As you can see, by building relationships with our elected officials at local, state, and national levels, NDAB gives a voice to our members, as well as many valuable resources. We plan to continue providing this service and look forward to hosting additional opportunities like Bringing Housing Home in the future. My final takeaway of the event is key philosophy Mr. Stenehjem shared during our visit. He and his office constantly encourage North Dakotans to “Do business locally, and with people that you know.” Our Board appreciates this sound advice as NDAB members represent and employ 77,000 people across our state. 2016 Legislative Conference

The nation’s home builders and remodelers are doers. We work hard, take risks and get the job done. We are engaged in our communities, giving back day after day, year after year. We create jobs and build the homes that are the foundation of American family life.

Housing drives our nation’s economy. Our in-dustry contributes to Gross Domestic Product (GDP) through private residential investment (5%) and spending on housing services (12%),

representing roughly 17% of GDP in a typical year. Roughly 3.5 million people- including those who are self-employed – worked in residential construction and remodeling last year, accounting for 2.4% of the U.S civilian labor force.

Without a healthy housing market, the economy can’t flourish. The issues that are important to home builders, remodelers and others in our industry are the same issues that are key to a thriving econo-my. On Friday, March 11, members of the North Dakota Associa-tion of Builders came together in Bismarck to meet with Senator Heitkamp, Congressman Cramer and a staff member of Senator Hoeven to discuss critical policy items. This was all a part of the National Association of Home Builders Bringing Housing Home initiative where each state was asked to hold meetings with their National Delegation back in their home states. ND was proud of our meetings and the success we had in conveying our messages and the strong support of attendance from our volunteer members. Below are some of the topics NDAB covered:

Reduce burdensome regulations. Most home building and remodeling companies are small businesses. We are saddled with disproportionate share of costs associated with excessive – and often unnecessary – regulations. Promote energy efficiency. We need the freedom and flexibil-ity to build energy-efficient homes in the most cost-effective way we can. Adopt sensible workforce development and immigration policy. Properly conceived, immigration reform will help our industry fill open jobs, boosting our nation’s economy. Protect middle class tax breaks. The mortgage interest deduction is a key to the financial well-being of the middle class. We also need tax credits to encourage production of housing for less fortu-nate families. Address soaring health costs. Enable small businesses to help employees with healthcare costs through the use of Health Reimbursement Arrangements. Senator Heitkamp was the lead sponsor on this bill and we thanked her for her work! Enact housing finance reform. The nation needs federal back-stop that provides for a reliable and adequate flow of affordable housing credit in all economic and financial condition.

The BMHBA has been busy following ordinance updates in Bismarck and Mandan, Burleigh and Morton Counties. All are reviewing and updating dated codes. Eyes are currently on permit cost changes and development standards.

A housing analysis conducted by Bismarck and Mandan outlines a need for an additional 7,786 owner-occupied homes by 2030. The HBA is working on a task force to explore implementation of the study’s recommendations.

Members elected a new Builder board member at the Fall GMM on Nov. 24 to fill Past President Vance Vetter’s seat. The 2016 board of directors will be sworn in at the Annual Banquet on Jan. 14.

Board member Brian Eiseman of Stoneshire Builders was a panel speaker at the Chamber’s 2016 Economic Outlook Forum in March.

Members gathered on March 22 for Bowling with the Builders. The high scorer walked away with a logoed pin as the prize for 1st place.

Home Builders Care of Fargo-Moorhead Foundation hosted its annual Fish Fry last month. This year featured new kid-friendly activities like a photo booth and face painting! In addition attendees participated in meat and money raffles, an auction and a raffle to win one of two wheelbarrows filled with either alcoholic or non-alcoholic beverages. HBA of F-M members and staff traveled to Bismarck to attend NAHB’s Bringing Housing Home Legislative Conference. They met with U.S. Sen. Heidi Heitkamp, U.S. Rep. Kevin Cramer and North Dakota Attorney General Wayne Stenehjem. Thank you to NDAB for coordinating the meetings.

HBA of F-M members and staff traveled to St. Paul to attend the Builders Association of Minnesota’s Builder Day at the Capitol. They met with Minnesota legislators Rep. Ben Lien, Sen. Kent Eken and Rep. Paul Marquart.

The Herdina Academy for the Construction Trades applications are available at www.hbafm.com/herdina. The two-week construction trades academy is in its 19th year, and offers a hands-on experience to students between the ages of 15-21. After completion of the academy, the students are awarded three college credits to use at applicable schools.


The Structural Materials crew did a great job hosting the March Builders after Hours. They are in a newly remodeled location and it is wonderful!

The Forx Builders will sponsor a Lunch and Learn 19th presented by the Construction Law Practice Group of Zimney Foster PC Attorneys at Law. Attorneys Erin Zasada, Warren Roehl and Cassandra Marka’ presentation will be The “Nuts & Bolts” of Construction Lien/Mechanics Lien Law.

Our annual Sporting Clay Shoot will be May 24th at the Dakota Hunting Club.


We welcomed our new Executive Officer, Elysha Head, this month. We look forward to the exciting changes she will bring to our association!

The Home and Garden Show was last month. Over 5,000 people came through our doors. Next year we anticipate expanding the show and introducing new

the NDAB conferences in Bismarck last month. Many great contacts were made and she learned a tremendous amount about the North Dakota association.

Our 2016 Home & Garden Show is finally here!! The 6th Annual Home & Garden Show is gearing up to be bigger and better. We have added: Food Shelf Friday to benefit the Salvation Army, awesome kids activities, new seminars, woodworking demonstrations and Miss North Dakota will be here again this year! We have also opened up a few community booths for non-profit organizations to promote their non-profit organizations, and will have a Humane Society booth outdoors. There is also a Vendor/Member Social planned for Friday night. We hope to see you April 15-17th at the Williston Raymond Center!

Our May GMM is the annual update on the building codes, where City Officials and Builders continue to build a solid working relationship. Sponsored by the City of Williston and Montana-Dakota Utilities.

April is our membership drive month and members are gearing up to earn triple spike credits and compete for prizes.
