arrives mid-year. However, we will do our best to ensure she has a course which is suitable to her and her level of achievement. Students

Student Contract: As an International Student enrolled at Marist College and in accordance with the conditions of my

student visa, I understand and agree that:

1. My course of study depends on the results of placement tests. All courses at Marist College include religious education. 2. I must have an official guardian approved by the Principal of Marist College. 3. I must attend every class at school each day. If I am unable to attend (because of sickness or similar) I shall contact the school on the

day I am absent and will bring a note to school, signed by my homestay parent, explaining my absence. If I am absent for 3 days or more I have to bring a doctor's certificate.

4. If living in a homestay family this must be arranged by the International Student Department. I must not change my homestay family without consulting the Principal and getting her permission.

5. If a change of homestay family is approved by the Principal I will give my new address, homestay family's name, and contact phone numbers to the College office.

6. I must have medical insurance. 7. I must obey all the school rules. 8. I will not receive a refund of fees if I leave Marist College except under those conditions explained in the college's Refund Policy

(issued separately). 9. Only Year 13 students are allowed to drive a car to school. If, as a Year 13 student, and I wish to drive a car to school I must register my

car with the College and show a valid New Zealand Driver's Licence. 10. I undertake to stay at school until the date required for course completion for my year level. 11. I understand that if in the opinion of the Principal the school can no longer meet my needs, the contract will be terminated. 12. I agree to accept and uphold the standards of conduct set by Marist College and the host family for the duration of the programme.

I also agree to maintain friendly and respectful relations with teachers and classmates and with the members of my host family, to accept rules of conduct and to participate in family life as much as possible.

I fully understand that the conditions of this contract are binding on me and that my New Zealand student visa will be cancelled if I break any of these conditions. The Principal will be the sole judge in this matter.

Authorisation and Release Contracts: 1. Travel It is necessary for all holiday travel plans to be documented on a Marist College Travel Form and approved by the school, prior to travel plans or reservations being made. This form must also be completed and approved prior to the actual travel. Approval will not be given for any independent travel or for travel to be undertaken without adult supervision. It is necessary that parents are informed of all travel and give approval. Below is authorisation by parents for Marist College to make the decision on student travel. This is not mandatory and if the school does not have this authorisation, the school will need to contact parents and receive permission for every trip that is planned by the student.

TRAVEL AUTHORISTATION: We, the parents of the student, do hereby authorise Marist College to make the determination for her to

travel for the length of the student’s enrolment at Marist College. This authorisation is given in advance only when the student is travelling and supervised by a host parent, representative of the school or a school approved Travel Company.

2. Medical Release Form We grant Marist College, it’s employees and the Host Family, at their discretion and if necessary at the cost of the student or her parents or legal guardian, in the case of expenses exceeding the coverage of the insurance policy, the power to place the student in a hospital or in any other institution for any type of assistance or medical treatment, or if there is no hospital available to place her under the care of a local medical doctor for her treatment. We also grant Marist College or the Host Family all necessary permissions to act as legal guardians and ‘in loco parentis’ in any situation especially in emergencies whatever medical or other including the possibility for surgical operations or any other treatment.

We also authorise Marist College to return the student to the home country at her cost, if necessary to submit to medical treatment, if deemed necessary after consultation with medical authorities. We confirm that at the time of signing this document the student enjoys perfect health and that her health record as filled by the parent on the application form is true and complete. We also grant Marist College the power to act on our behalf in anything pertaining to possible representation before local authorities. This authorisation should be valid for the entire duration of the student’s study programme and Marist College.

3. Motor Vehicle Ownership and Driving Approval We agree that the student may drive a motor vehicle while enrolled at Marist College in Year 13 and only on the condition that she undertakes a driving instruction course with a New Zealand registered driving instructor and has sat and passed a New Zealand driving test in accordance with New Zealand law. In the case that the student has an International Driver’s Licence, she will complete the required conversion of her licence and undergo a New Zealand driving test in accordance with New Zealand law. We agree the student will have full insurance cover if owning a car and must show ownership papers and insurance cover to the International Department. We agree to allow the student to carry passengers only on the condition that she has a full (unrestricted) New Zealand drivers’ licence and full insurance cover.

4. Liability Release The undersigned as participant and parents on behalf of ourselves and our representatives, renounce to claim against Marist College, teachers, co-ordinators, any person intervening on behalf of the school, that may arise due to injury, damage, sickness, accident, delay, unusual circumstances or expenses due to strikes, war, atmospheric conditions, quarantine, government restrictions or regulations, act of God, or those derived from acts of omission of airlines, shipping companies, railroads, buses, transportation in general, hotels, restaurants or any other service given by companies, individuals or anyone related with the aforementioned.

5. Photographs and Marketing Material We the parents grant permission for the school to take photographs and/or video footage of the student during school activities and that the school may use that material on the Marist College website, social media, international and school newsletters, magazines and marketing collateral.

6. Privacy Waiver in regard to Student Visa information with Immigration New Zealand We authorise Marist College or a representative of the school to obtain any personal, medical or character information in regard to the student’s visa status. We also give permission for Marist College to obtain information from Immigration New Zealand in regard to the progress of student visa applications for her.

7. Conditions of Enrolment I/we are the parent(s) of the student named on this application form and declare that:

8. Parent Contract for Enrolment I/we, the undersigned, accept as conditions of enrolment:

1. I/we will support and encourage the student in the full participation in the Catholic life of the College. 2. I/we will ensure that the rules and regulations as laid down by the Board of Trustees are observed, particularly the cyber-safety

agreement, uniform and personal appearance requirements. We understand that the student will be subject to authorities and teachers of the school and that she will have to follow the rules given by family. We also understand that Marist College reserves the right to terminate the programme of any participant whose conduct may be considered detrimental or incompatible with the interest and security of the school or student.

3. Enrolment is subject to availability of places and the results of the student’s placement test. The final decision rests with the Principal. 4. I agree to Marist College collecting personal information that will be used for student records, accounting purposes and PTFA contact. 5. The student must have a guardian approved by the Principal of Marist College or appointed by Marist College. 6. The student must attend class at school each day. If she is unable to attend (because of sickness) she shall contact the school on the

day she is absent. If she is absent for 3 days or more she must bring a doctors certificate. 7. If not living with ourselves or a designated caregiver as appointed by me/us, she must live with a homestay family arranged by

Marist College. 8. If we wish her to change homestay, we must consult the Homestay Co-ordinator and seek approval from the Principal. 9. The student will have full Medical and Travel insurance and provide a chest x-ray if required by Immigration NZ. 10. The student will remain at Marist College until the date required for course completion for her year level. 11. I/we understand we will not receive a refund of fees if she leaves Marist College before the completion of her course. I/we have read

and understand the College’s refund policy. 12. If in the opinion of the Principal the school can no longer meet the needs of the student, then this enrolment will be terminated. 13. I/we understand that the personal information supplied on this enrolment form is being collected to assist the College in

understanding and educating the student. The College may pass this information to other educational professionals but only for the same purposes. Similarly, the College will obtain whatever personal information it legitimately requires regarding the student from the student’s present or previous schools (Privacy Act 1993).

Cybersafety Agreement

This agreement covers the use of all digital devices (including mobile phones) at Marist College. This includes both school-owned and personal devices while you are at or representing the school, and any school resources used off site. Computers and other digital equipment belonging to Marist College are provided for educational purposes, and should be treated as such. ICT refers to any information and communication technology.

I agree that:

1. My computer password is private and is not to be shared with other students

2. ICT must not be used for harassment, bullying, etc. I will not send intimidating, offensive or otherwise inappropriate emails, messages, images or any other communications.

3. I will report offensive and inappropriate activities to my teacher, parents or my Dean immediately.

4. I will not reveal home addresses or phone numbers (mine or anyone else’s) in cyberspace.

5. Any videoing, photos or voice recording will be for learning purposes as directed by my teacher. I will complete the appropriate form and get permission from those I wish to film, photograph or record before I do so. I will not reproduce, distribute or post these recordings on any public sites e.g. Facebook, Youtube without permission from a teacher at Marist College.

6. I will not intentionally disrupt the smooth running of any computer or the school’s network, or cause damage to any school-owned digital device or resource.

7. Digital equipment belonging to Marist College is provided for educational purposes. Any other ICT equipment that I use within the school environment (e.g. mobile phone, own laptop, iPod) will be used for learning purposes as directed by my teacher.

8. I will not intentionally access inappropriate images or information online. If I accidentally encounter inappropriate, dangerous or illegal material I will immediately remove it from the screen/turn off the screen and notify a supervising teacher without disclosing the material to any other student. If I become aware of other students intentionally accessing inappropriate items I will notify a school staff member.

9. I recognise that any work or data stored on digital devices or associated with Marist College is not private and may be viewed by school staff at any time. This includes data on my own device.

10. I will not deliberately waste computer resources - e.g. unnecessary printing or internet use.

11. If I borrow a piece of digital equipment from the school it will only be used for school-related purposes. I will return it in the same condition in which I found it. I will cover the costs of any damage caused to school equipment that result from my misuse or negligence. I will report any accidental damage to a teacher immediately.

12. I will not plagiarise by copying text without referencing the source.

13. I will not use digital devices or resources for any purpose that will reflect negatively on Marist College.

14. I am personally responsible for the use and security of any device I bring to school. I understand that the school is not liable for loss or damage to personal devices, However any loss or damage should be reported to the school immediately.

I understand and will abide by the conditions and rules as set out in this Cybersafety Agreement. I further

understand that there may be consequences (including the possible loss of access and disciplinary action) if I

should breach any of these conditions.

General use of information and communication technologies (ICT):

As the parent or guardian of this student, I have read the Marist College Cybersafety Agreement. I believe my child

has read the document and understands her obligations. I understand that any breach of the rules and conditions

as set out in this agreement can lead to loss of privileges or disciplinary action. I understand that if my daughter

loses or damages equipment belonging to the school then this could result in a bill for the cost of replacement parts

or repairs. I also understand this agreement applies to ICT equipment my daughter brings into Marist College. I

understand that Marist College is not responsible for students’ personal devices.

The internet:

As the parent or guardian of this student, I understand that it may not be possible for the school to fully restrict

exposure to inappropriate material in cyberspace, accessed via such means as the internet, email or text

messaging. I also understand that while the College will take appropriate measures to limit access to illegal,

dangerous or inappropriate material, ultimately it is each student’s responsibility not to initiate access to, or have

any involvement with such material.

Permission to publish

Under the Privacy Act 1993 we are required to seek your permission to publish material related to your daughter,

including images and samples of her work. Marist College’s website, newsletters, assemblies, presentations and the

school magazine contain images of students and examples of their work to celebrate achievement, promote

community and to give students examples of good practice. Marist College therefore undertake to ensure that no

unnecessary or inappropriate material is published.

her to be published by the school.

The student’s well-being while away from her own environment is of great importance to her family and Marist College. Please note you must be a NZ Citizen or Permanent Resident in New Zealand to act as Guardian.

Guardians are responsible to:

1. Welcome the student at Auckland International Airport upon arrival and take to the homestay family.

2. Assist the student in buying their school uniform, stationery and other items that they may require.

3. Assist the student in setting up a New Zealand bank account at a suitable bank.

4. Ensure the student receives accurate and reliable orientation to New Zealand when student first arrives. Making sure that the student follows New Zealand Laws and Marist College rules at all times. Students may lose their place in the school if they don’t follow the school’s rules, and New Zealand Immigration is always notified in such cases.

5. Attend the school parent/teacher interviews and send reports back to the parents.

6. Forward translated copies of all school reports to the student’s parents.

7. Respond to any request for information or enquiry from the student’s parents.

8. Act as the parent’s representatives with the school’s Principal or other management.

9. Stay in regular contact with the school and pass on any relevant information to the student’s parents with regards to her general, academic progress and any attendance or emotional and behavioural issues.

10. Make all travel arrangements for the student as required. Arrange airport transfers at start and end of course.

11. Ensure the student has a valid NZ Student Visa and refer any visa renewals to the school at least 2 months before the visa expires.

12. In an emergency seek medical assistance and contact the School and homestay.

13. Arrange for any specific medical needs, such as dental check-ups and doctor’s visits.

14. Keep the School informed of all matters concerning the student including: health, accidents, behaviour concerns, absences without reasonable explanation, legal issues, any other information requested by the School.

15. Immediately report to School any circumstances of a student in a dangerous or unsafe situation. This includes suspicions of physical, sexual or emotional abuse.

16. Take responsibility for the student outside school hours while she is enrolled at the school.

17. Keep in communication with the homestay family and ensure a quality homestay.

18. Liaise with homestay parents on all matters regarding the student and help homestay parents to set and enforce guidelines for student behaviour and curfews.

19. Discuss any concerns or needs the student may have at any time and be available 24 hours a day, 7 days a week in case of genuine emergency.

20. Advise the International Manager at Marist College, homestay parents and the student’s own parents, if you wish to withdraw as a guardian.

21. You must advise the International Office immediately if your contact details change and if the student’s living arrangements change.

We understand that Marist College requires us to live with the student while in New Zealand. If this is to change, we must discuss it with Marist College at least 2 weeks in advance.

We must send Marist College a copy of our visitor visa prior to the student’s enrolment.

We must send an updated copy to Marist College for every year of the student’s enrolment while we live with her in New Zealand. We agree to abide by the conditions on our visas during our stay in New Zealand.

We undertake to communicate in a timely and prompt manner about any matter which may affect the school’s ability to carry out its responsibilities effectively, including any changes of address or phone numbers for either ourselves or the student.

We understand that if we wish the student to become a domestic student due to a change in our visa status, we need to discuss this with Marist College to ensure we follow the correct enrolment procedures. Further we understand it is not a direct transition and a domestic student place is not guaranteed.

We understand that Marist College cannot be responsible for proving our living costs to Immigration New Zealand.

We understand that Marist College is not responsible for assisting us with applying for a visitor visa.

We understand that Marist College is not responsible for airport transfers for us, the student or family.

We agree if in the event that we must leave the country, we must notify the International Manager before leaving New Zealand and provide the contact details of the alternative accommodation for the student and complete any other documentation pertaining to that.

Acknowledgement and Indemnity

We acknowledge that the student will be within the care of a Designated Caregiver (DCG) vetted and monitored by myself/ourselves in order for her to attend Marist College as an International Student. Accordingly we take full responsibility and accept the decisions made by the DCG about the accommodation placement and day to day requirements of the student. The student will live with the DCG at all times. The DCG guarantees the accommodation for the student. If she leaves the care of the DCG, it is compulsory for her to come under the care of Marist College.

We take full responsibility for placing the student with the DCG named above and understand that Marist College is not responsible for her outside of normal school hours and activities. Should this arrangement change we undertake to inform Marist College immediately.

We do however understand that Marist College will make every endeavour to provide for the care and welfare of the student at all times while studying at Marist College. Further, we understand that should Marist College have any concerns regarding her welfare, the school may relocate the student in an approved school homestay. If necessary, the school will also refer the matter to the relevant welfare authorities or any other appropriate agencies in New Zealand.

We understand that Marist College will:

Visit the home of the Designated Caregiver prior to enrolment to determine that the living conditions are of an acceptable standard and meet the conditions of the Code of Practice for the Pastoral Care of International Students.

Assess whether the Designated Caregiver will provide a safe physical and emotional environment for the student.

Determine that the accommodation is not a boarding establishment (i.e. Does not accommodate 5 or more International Students).

Meet with the Designated Caregiver and establish communication with the caregiver.

Meet the student at least quarterly to ensure the accommodation is suitable.

Require a Police Vet to be undertaken, on all residents in the Designated Caregiver’s home aged 18 and over.

Require a copy of the Designated Caregiver’s passport and visa which must be valid for the term of the student’s tuition.

We will advise Marist College immediately if the arrangement changes.

Marist College has agreed to observe and be bound by the Education (Pastoral Care of International Students) Code of Practice 2016. Copies of the Code are available at www.nzqa.govt.nz/providers-partners/education-code-of-practice/code-of-practice-resources-languages.

If there are any concerns that are not resolved by the College, we have been given a copy of the Complaints Procedure at Marist College. This refers to appropriate school staff and contact information to take the matter further to an external authority under the Disputes Resolution Scheme (DRS) and Student Complaints.

1. Be polite and friendly to my homestay family and show respect for their property.

2. Interact with my homestay family using English on a regular basis.

3. Keep my room tidy and make my bed every day.

4. Let my host parents know where I am at all times, obey the school rules and my host parent’s rules.

5. Be on time for all meals, and inform my host by breakfast time if I won’t be home for lunch (in weekends) or by 4pm if I won’t be home for dinner.

6. Ask permission from my host parents if I wish to go out after dinner. Students are expected to be at home at night from Sunday to Thursday nights unless they are at school or a family function.

7. Obtain my host parent’s and guardian’s permission if I want to stay overnight or longer at another place. I understand I must be supervised by a suitable adult.

8. Ask permission of my host parent’s if I want to have friends over to visit or for the night.

9. Complete an Application to Travel form and give to the International Student coordinator at least two weeks before I undertake travel outside of Auckland that is not with my host family.

10. Basic internet (up to 5GB per month) will be provided by the homestay, but that I will pay any extra charges incurred should I be a heavy internet user.

11. I will not use/abuse alcohol or be in possession of, or use, illegal drugs. I am aware that these behaviours could result in the termination of my enrolment at Marist College.

Fee Protection Policy for International Students

Rationale: International Student Fees must be processed in a manner that is consistent with normal accounting practice. Funds

need to be secure from misappropriation, and be available to the student in accordance with the Refund Policy and

in accordance with the Education Act should the school not be able to continue to provide tuition. Funds should only

be made available to the school once the income associated with those funds has been earned.

Purpose 1. To ensure that funds from international students are accounted for in such a way that individual student

contributions can be monitored and protected.

2. To ensure that if in the event that the school is unable to continue to run a course or programme that the

unspent portion of the fees is available to be returned to the student.

3. To ensure that refunds of fees can be made to the student in accordance with the Refund Policy.

4. To ensure that funds are released to the school in a timely manner once the revenue associated with

those funds has been earned.

Policy Statement 1. Funds from international student fees will be separately coded and accounted for.

2. The Board of Trustees will ensure that there are always sufficient cash reserves available to refund unspent

international fees throughout the year.

3. Accounting and administration procedures are in place to record and identify funds held on behalf of each

individual student.

4. Funds shall be released to the school for course costs not more often than fortnightly, in arrears. Where

funds are held by the school on behalf of other parties

(e.g. homestay payments) then funds shall be released for payment as required.

5. Accounting records and bank accounts will be audited on an annual basis.

6. Details of this Fee Protection Policy will be provided to parents in written form upon enrolment.

Refund Policy for International Students This policy is based on Section 4B(7) of the New Zealand Education Amendment Act 1991.

Policy Statement

Marist College has established the following policy for tuition and homestay refunds of International student fees.

1.1 Either party may terminate the Agreement at any time by giving the other party one month written notice.

1.2 On termination by the school:

The student is entitled to a refund of a portion of the tuition fee paid. This portion shall be calculated on the

basis of the proportion that the number of School days remaining in the contracted tuition period, counting

from the day after the student last attends the College, less twenty School days, bears to the total number of

days in the contracted tuition period.

1.3 On termination by the student: a) Where the tuition period is for six months or longer - If your application is made after the start of your

course, but before the second half of your course, your fees may be refunded less:

An administration charge of $1000.00.

Costs to the school already incurred for tuition.

Components of the fee already committed for the duration of the course, including appropriate proportions of salaries of teachers and support staff (if applicable).

Costs already incurred for the use of facilities and resources.

The proportion of the Levy the school is required to pay to the proprietor.

Any other costs already incurred.

(i) In the first two months of the tuition period the student is entitled to a refund of 50% of the tuition

fee paid;

(ii) If your application is made during the second half of your course, you will not receive a refund except in

exceptional circumstances. The first day of Term 3 is the start of the second half of a full year course.

b) Where the tuition period is for less than six months, no refund of tuition fee shall be made.

1.4 In addition to the amounts calculated under 1.2 or 1.3 above, the student shall be entitled to a refund of any

unused portion of any homestay fees paid.

1.5 Notwithstanding the conditions of clauses 1.3 and 1.4 above, in exceptional circumstances (such as a serious

illness to the enrolled student or a member of the student’s immediate family resident overseas) the school

may decide to grant a refund greater than the amount to which a student may otherwise be entitled.

Refund Procedures

Marist College has established the following procedures with regard to tuition refunds.

1. A copy of the refund policy will be given to parents prior to enrolment.

2. An application for tuition refund must be made in writing by the student’s parents to the Principal explaining the

reason/s for why a refund is requested, including any special circumstances.

3. The criteria for refund as detailed in the Refund Procedures will be applied by the Director of Middleton

Grange International College. The decision on the application for refund will be in writing.

4. If there is a dispute in the decision on the refund, then the process outlined in the Grievance Procedures

must be followed.

Marist College undertakes to comply with the accommodation provisions set out in Part 26 of the Education (Pastoral Care of International Students) Code of Practice 2016. Accommodation Policy for International Students

Policy Statements1. Provision of Accommodation1.1 Marist College will arrange accommodation for international students.2. Use of Accommodation Agents2.1 Marist College will under special circumstances approve the use of

Accommodation Agents to organise homestay accommodation in compliance with “the Code”. These homestays will be monitored for quality by the Marist College.

3. Accommodation Concerns3.1 All accommodation queries and issues will be dealt with by Marist

College Administration staff with responsibility for pastoral care. Pastoral care issues or concerns arising from accommodation arrangements will be referred to Marist College Administrator.

3.2 For each student, the full name, current address, contact phone number, occupation and relationship to student of the Homestay Carer will be held.

3.3 Any serious concerns relating to accommodation will be relayed promptly to the International Homestay Co-Ordinator.

4. Students not living with a parent4.1 Monitoring the quality of accommodation for students not living

with a parent.4.1.1 Any accommodation to be used by international students not living

with a parent will have:• An on-site assessment to determine that living conditions are

of an acceptable standard according to the Code of Practice.• An assessment to determine that the accommodation type is

not a boarding establishment or that the student is not livening in an external dwelling.

• An assessment of the Homestay Carers suitability and whether they will provide a safe physical and emotional living environment.

4.1.2 Each student will be consulted at least quarterly to ensure that their accommodation is suitable.

4.1.3 All accommodation residences will be visited at least twice yearly to ensure that they remain suitable.

4.1.4 Police vetting will be carried out on all adults aged 18 years and over living in a homestay, or designated caregiver accommodation used by a student. Police vetting will be renewed every three years.

4.1.5 Marist College will conduct follow up visits if there are reasonable grounds to suspect that the accommodation has become unsuitable.

4.2 Homestay4.2.1 Students in homestay accommodation must make homestay

payments in advance of the accommodation period.4.2.2 Students must not make their own private homestay arrangements

without the approval of the Principal.4.2.3 Students staying in a homestay are required to exhibit

appropriate behavior.4.2.4 Where the homestay student wishes to withdraw from a homestay,

at least two weeks’ notice must be given in writing to the Administrator and Homestay Carer.

4.2.5 Where a student’s behavior or demands are such that a Homestay Carer cannot reasonably be expected to have the student continue in their care, the homestay service may be discontinued. A two-week notice period is still required to the Administrator.

4.2.6 If a student is at risk because of a previously undisclosed or unknown health issue, a failed police vet or for any new issue that puts the student at risk, then the school reserves the right to remove the student without the two-week notice period.

4.2.7 If a student has approved leave from the homestay during the school year, there will be no reduction in homestay fees paid. During the summer holiday break, where a student leaves the homestay and will return to the same homestay for the following year, a reduced weekly fee can be negotiated with the Homestay Carer.

4.2.8 If a student damages the property of the Homestay Carer, the student must pay the cost for repairs to the extent that the damage is not covered by the Homestay Carer’s insurance policy.

4.2.9 If a member of the Homestay Carers family damages property belonging to the student, the Homestay Caregiver must pay for the cost of repairs, to the extent that the damage is not covered by the student’s insurance policy.

4.2.10 Marist College does not accept responsibility for losses or damage to property or persons caused or suffered as a result of the home accommodation.

4.2.11 Advice and support infrastructure for Homestay Carers will be provided by Marist College.

4.3 Designated Caregivers4.3.1 Parents of each student living with a designated caregiver are

required to sign an indemnity document stating that the designated caregiver is a relative or close family friend and that the parents have selected the accommodation for their child, subject to Marist College approving the accommodation.

4.3.2 On or before enrolment, Marist College will meet and establish communication with the designated caregiver.Evaluation
