ONLINE TENDER FOR "THREE YEARS RATE CONTRACT FOR SUPPLY OF CROCKERY BONE CHINA”

1. INTRODUCTION :-

Madhya Pradesh can easily be described as the best state of the nation, in terms of richness

and diversity of tourism destinations. The state has three world heritage sites namely Sanchi,

Bhimbetka and Khajuraho. Madhya Pradesh is not called the 'heart of India' only because of its

location in the centre of country. It has been home to cultural heritage of Hinduism, Buddhism,

Jainism and Islam. Innumerable monuments, exquisitely carved temples, stupas, forts and

palaces are dotted all over the State. The natural beauty of Madhya Pradesh is equally varied.

Consisting largely of a plateau, the State has everything. Spectacular mountain ranges,

meandering rivers and miles of dense forests. But perhaps the best part about MP is its

accessibility. It is equally close to major tourist destinations from the North, South, East and

West.

At present MPSTDC is operating 74 Hotels and resorts in all over the state of Madhya

Pradesh and in this context Managing Director, Madhya Pradesh State Tourism Development

Corporation, Bhopal invites online tenders from reputed manufacturers and authorised

distributors, For "THREE YEARS RATE CONTRACT FOR SUPPLY OF CROCKERY BONE CHINA ",

under the terms & conditions given below: -

3. Essential Qualification: Selection of qualified bidder would be based on experience and

turnover. Therefore, bidders must enclosed their balance sheets and cliental list in support of the required qualification. Tenders are invited only from manufactures & authorised distributors.

4. Tender Fee: Online tender fees Rs.2000+ E-tendering charge+GST. Both Fees are non-refundable.

5. Earnest Money Deposit: EMD of Rs. 1,00,000/- in favor of Madhya Pradesh State Tourism Development Corporation Ltd. Bhopal. EMD is essentially required through online only. EMD of disqualified tenderer will be returned after 45 days from the date of finalization of the tender.

6. Specification: Tenderers are advised to submit their online tender with complete specifications of their products along with relevant literatures and any other information pertaining to the same.

7. Eligibility: Tenderers must have following eligibility criteria for participating in tender.

(i) The Manufacturer/distributor/firm participating in the tender must have PAN No., TIN No., VAT Registration, GST Registration, updated VAT clearance certificate and Service Tax Registration. The documentary proof of PAN No., TIN No., GST No., Registration Certificate, updated VAT clearance certificate shall be attached with the technical bid through online only.

(ii) Self signed of all required documents to be submitted online with the Tender as per Annexure -A .

(iii) Minimum turnover average 05 crores (five crores) per annum in the last three years for the same business (certified by CA).

(iv) The bidder shall not be black listed by any Govt./Semi Govt./Private Institution. A self certificate in this regard shall be enclosed.

(v) The company should be registered with all applicable taxes and other required statutory registrations are mandatory.

(vi) The bidder shall have valid trade license for sale/supply of the items in question.

(vii) Required Brand: Reputed Brands only.

8. Samples of Tendered items: Tenderer are requested to bring samples of the tendered items at the time of opening of Technical bid.

9. Mode of submission of tender: Tender submitted online only through www.mpeproc.gov.in.

10. Terms of Payment: Payment will be released from MPSTDC, Head Office Bhopal, within 15 days, after satisfactory delivery of the goods. No advance payment will be made in any case. . In view of the provisions of the Goods and Service Tax (GST) the amount of GST charged in the bill shall be paid only on compliance of payment of tax and filing of return of the particulars months by the successful bidder with respect to the supplies made to the Corporation and its units. In case of non compliance of GST provisions relating to timely payment of tax and filing of returns the Corporation reserves the right to recover the ITC losses to the corporation. Repeated default on this account may lead to termination of the agreement.

11. Validity of Offer: Rates are required for "THREE YEARS RATE CONTRACT FOR SUPPLY OF CROCKERY BONE CHINA" these may be extendable for further period of one year on the same rates, terms and conditions with mutual consent of both the parties.

12. MPSTDC, H.O.Bhopal reserves the right to reject any or all tenders in part or in full without assigning any reason or to be negotiated with any of the tenderer(s).

13. The rates approved by Madhya Pradesh State Tourism Development Corporation, Bhopal against this tender will be valid for a period of minimum 36 months and these may be extendable for further period of one year on the same rates, terms and conditions with mutual consent of both the parties.

14. MPSTDC has right to postpone the date of opening of Technical and Financial bid or cancel it at any point of time without assigning any reason.

15. In case of failure of delivery or refusal of the Purchase Order on the basis of final rates or agreement under the terms and conditions of the tender, Earnest Money will be forfeited.

16. Delivery Period: It is mandatory that all ordered items to be supplied within 20 days from the date of purchase order otherwise L.D. @ 0.5 % will be imposed on weekly basis.

17. Supply order will be issued to the manufacturers/distributors/agency as an when required during the duration of the contact once the rates are finalized.

18. In case of breach of any terms and conditions of the contract, the Performance Security Deposit of the successful bidder will be liable to be forfeited by MPSTDC besides annulment of the contact.

19. The rates quoted shall be “all inclusive” except taxes as applicable for the time being in force. it is clarified that "all inclusive" mean FOR destination i.e. FOR destination. In view of GST the successful bidder is required to pass on the Input Tax Credit(ITC) to the Corporation and also comply with the provisions of the GST law and should timely deposit the tax and file the returns. The rates should be given both in figures and words. No reference to existing or previous rates should be made. Conditional tenders containing alternative proposals/ rates are liable to be rejected.

20. Rates should be quoted strictly according to the unit of the measurement specified against each item. For the evaluation of the tender, the rates quoted shall be presumed for the units of the measurement given in the tender document only. In case of discrepancy in rates quoted in numbers and words, the one mentioned in words will be considered.

21. No rates column should be left blank otherwise the highest rate quoted by any other tenderer for that items shall be taken for evaluation of the tender. In case the tenderer is still successful in getting the contract on the basis of his being the lowest, he would be paid lowest rates quoted by other tenderers for those items not quoted. Tenderes are requested to fill/write all the columns and no column should be left blank of the particular category.

22. Totals calculated on the basis of estimated quantities and the rates quoted should also be indicated in Amount Column of the price bid.

23. For selection of lowest bidder individual item wise lowest rate shall not be considered.

24. The evaluation of Financial Bid (L-1) shall be carried out on the basis of rates calculation of all Items in totality as per the terms of the tender.

25. The bidders have to bid for all items and have to supply all items at HO, MPSTDC, Bhopal.

26. Initially the agreement shall be executed for a period of three years and may be extend for further period of one year based on satisfactory performance with mutual consent on the same rates, terms and conditions.

27. Destination of Delivery: Head Office, Madhya Pradesh State Tourism Development Corporation Ltd. Paryatan Bhawan Bhadbhada Road, Bhopal, Madhya Pradesh, India.

28. Responsibility for executing Rate Contact : The Manufacturer/Distributor/Firm is to be entirely responsible for the execution of the rate contract in all respect in accordance with the terms and conditions as specified in the tender documents.

29. MPSTDC will not be responsible for any damage, theft etc of the items which may occur due to natural calamity like fire, earth quake etc before satisfactory delivery of the items at specified location.

30. Any damage due to transportation will be borne by the supplier.

31. Clarifications

Agency may request a clarification on any of the bid documents in Pre Bid Meeting on the indicated date. MPSTDC will respond to such requests and will post the response on E -tendering website: www.mpeproc.gov.in and will inform the Pre- Bid Attendees by Email.

At any time before the submission of Proposals, MPSTDC may, for any reason, whether at its own initiative or in response to a clarification request by an invited firm, modify the bid documents (RFP) by amendment. E -tendering website: www.mpeproc.gov.in and will inform the Pre- Bid Attendees by Email. MPSTDC may, at its discretion, extend the deadline for the submission of Proposals.

32. Rejection of Bids

The Authority reserves the right to accept or reject all or any of the Bids without

assigning any reason whatsoever. It is not obligatory for the Authority to accept any Bid

or to give any reasons for their decision.

The Authority reserves the right not to proceed with the Bidding Process at any time,

without notice or liability, and to reject any Bid without assigning any reasons.

33. Correspondence with the Bidder

The Authority shall not entertain any correspondence with any Bidder in relation to

acceptance or rejection of any Bid.

34. Security Deposit

Rs 1,00,000/- (Rupees One lakh Only) shall be paid by the successful bidder by way of

Bankers Cheque / Demand Draft drawn in favour of MPSTDC within 7 days from the

acceptance of contract. The Earnest Money Deposit of the successful firm shall be

refunded after receipt of Security Deposit.

The Performance Security should remain valid for a period of 60 days beyond the

completion of the period of contract.

35. OTHER TERMS AND CONDITIONS

35.1 Claims and Disputes:

Any claims or disputes arising out of the contract should be promptly submitted in writing

to MPSTDC within 7 days from the Date of cause of action, so that the point of issue could

be immediately verified at site by the field officers, facts ascertained and a prompt

decision given. Claims raised well beyond this time as to make it difficult to verify the facts

are liable to be rejected. The tenderers shall carefully note this stipulation.

35.2 Legal:

Any legal dispute shall be subject to the Jurisdiction of Bhopal Courts only.

35.3 Arbitration Clause:

In the event of any dispute or differences arising between the parties as to the

interpretation, operation or effect of any clause of the agreement to be executed with the

Corporation or any of the terms and conditions contained herein which shall be made

integral part of the agreement such dispute or difference shall be referred to the sole

arbitration of a person appointed by Principal Secretary, Tourism Department Govt. of

Madhya Pradesh and there shall be no objection if Govt. appoints any officer who has in

the discharge of his duties as such officer, has either expressed any opinion or issued any

direction in the matter and the provisions of the Arbitration Act 1996 shall apply to such

arbitration.

Addendum issued by the Authority; and

Agreement in accordance with the draft that provided to me We agree not to seek any changes in

the aforesaid draft and agree to abide by the same.

understand that except to the extent as expressly set forth in the bid document we shall have no

claim, right or title arising out of any documents or information provided to us by the Authority or

in respect of any matter arising out of or concerning or relating to the Bidding Process including

the award of Authorization.

16. The amount has been quoted by me/ after taking into consideration all the terms and conditions

stated in the TENDER, our own estimates of costs and after a careful assessment of the identified

locations of the hotels and all the conditions that may affect the Bid.

17. I agree and understand that the Bid is subject to the provisions of the Bidding Documents.

In no case, I shall have any claim or right of whatsoever nature if the Project / Authorization is not

awarded to me or our Bid is not opened or rejected

18. I agree and undertake to abide by all the terms and conditions of the TENDER document which

inter alia includes furnishing of the Performance Security to the Authority in the manner provided

in respect thereof in the TENDER.

19. We confirm that all the terms and conditions of the Proposal are firm and valid for acceptance for

Notes:
