Modern networking and computer systems allow employers to have much greater knowledge of an employee’s activities, both during and outside working hours. What may an employer properly monitor, when and what potential liability does an employer face for monitoring improperly?

Jana H. Woelfel is a Board Certified labor and employment attorney with experience in a

wide variety of labor and employment issues, including representing management in

anticipating and responding to all types of employment issues, including litigation,

compliance and policy formulation with respect to federal employment laws, including

nondiscrimination and anti-harassment laws. Jana counsels HR professionals and senior

management in navigating complex employment issues, including negotiating employment

contracts, noncompetition and nondisclosure agreements, preparing employment

handbooks and HR policies, developing affirmative action plans and providing advice

regarding enforcement of leave policies, termination procedures and pay practices, as well

as defending claims of employment discrimination, harassment and retaliation, both before

the appropriate administrative agencies and in court. Jana has also litigated many

noncompete and nonsolicitation agreements. Jana is experienced both in conducting

external investigations and assisting companies in conducting internal investigations, into

allegations of harassment, discrimination, retaliation, as well as other professional

misconduct, including embezzlement, kickback schemes, fraud, and breach of fiduciary

duty.

Share Your Ideas

The Board always welcomes your comments and suggestions. See an interesting article online or have a process that could benefit other members? Share it with your BV-SHRM Chapter.

June - 2016

Well, today was the first day that I realized the students were gone! Driving was a bit

easier even through the rain. I’m ready for school to be out and enjoy vacation and the

lazy days of summer!

Our board is hard at work finalizing details for the Business Seminar on September 13

which will be followed by a social event open to all seminar attendees and BV-SHRM

members. It should be a fun time at Phillips! Look for more information soon on the

great speakers we have lined up!

Our certification class has finished. Please keep your thoughts on those who will be

sitting for the test both now and at the end of the year. Those who have taken it know

it’s a tough test and our students need all the good vibes they can get! We will

continue evaluating offering a SHRM certification class. If you have an opinion,

please let Alyssa know ([email protected]).

A big thank you to Bob Hensz and Candi Nelson who have done a great job of getting

all of our members into the website directory and fine-tuning our new member

process. We are still exploring better ways to engage our members through the

website, social media, and other communication.

And if you haven’t heard, our chapter has earned the Silver Excel Award as well as

the Foundation Chapter Champion award. I’m always so proud of our group.

As always, thank you for your membership and for participating in our events. We

appreciate you!

“All of the sessions I attended were

absolutely

topics were current.

Information shared was applicable to my

current position, and after each session, I

found myself more energized about my job.

I have attended many conferences over the

years and HRSWC is the first one that I have

attended

information that I can use daily.”

“Hands down the best conference I have

ever attended in my over 15 years of being

an HR

energy and knowledge in their

field of expertise.”

“Thank you for an amazing experience! This

was my first visit and I was significantly

impressed. The content of the sessions were

both thought provoking and invigorating. I

left the conference reenergized, filled with

more purpose and excitement to continue

to love what I do as an HR professional!”

“I have attended HRSWC the past four years

and my experience gets better each and

every time. Because HRSWC is so valuable to

me, I no longer attend any other

conferences. I return to my office each

year with more knowledge, information

and contacts than I would ever think

possible.”

Despite an outpouring of negative commentary from the business community and a Congressional attempt to block

enactment (more on that below), the DOL’s WHD Final Rule “Defining and Delimiting the Exemptions for Executive,

Administrative, Professional, Outside Sales and Computer Employees” is here. The White House issued an email last

night, announcing that publication of the Rule would occur today. And it did. The rule is a whopping 508 pages long, but

here are the basics gleaned from the summaries:

· Effective date is December 1, 2016 . . . you’ve got some time to get your house in order.

· The minimum salary needed to preserve most exemptions (in addition to meeting the proper duties test) will rise

from $23,660 to $47,476 per year (lower than expected, based on the proposed reg).

· The minimum salary needed to preserve the Highly Compensated Employee (HCE) exemption will rise from $100,000

to $134,004 per year (higher than expected, based on the proposed reg).

· The minimum salary will reset every three years, starting on January 1, 2020. The new minimum will be announced

150 days in advance (on August 1, 2019 for the January 2020 increase).

· Those minimum salary levels are tied to a percentage of the earnings of full-time salaried workers in the lowest-

earning Census region, the South, which is comprised of AR, LA, OK, TX, AL, KY, MS, TN, DE, DC, FL, GA, MD, NC, SC, VA

and WV. The non-HCE minimum salary is pegged at the 40% mark when looking at the weekly earnings of all full-time,

salaried workers in the South census area. The HCE rate is pegged at 90%.

· Up to 10% of the salary minimum for non-HCE workers can be met via payment of non-discretionary bonuses,

commissions or incentive pay so long as the payments are made quarterly or more frequently.

· No changes were made to any of the duties tests.

The administration purposefully pushed the reg out now, to try to avoid nullification via the Congressional Review Act

after the upcoming elections. The Protecting Workplace Advancement and Opportunity Act, which attempts to block the

reg and requires further economic impact study, has 36 sponsors in the Senate (S. 2707) and 155 in the House (H.R.

4773) so not a lot of traction there yet. Time to review those job classifications and your compensation levels and make

some decisions. Do you increase the minimum salary, where needed, to preserve the exemption? Or do you concede

nonexempt status and manage the overtime liability by clamping down on hours worked? Policies and procedures will need

updating and plan on educating newly nonexempt workers and their managers on unfamiliar topics such as proper record-

keeping, compensability of travel time and more.

More details to follow, once I get through reading all 508 pages. Oh joy.
