The South African Revenue Service has apparently in recent times

attempted to draw the aforementioned trust distribution rights within the

scope of Section 3(3)(d) of the Estate Duty Act in an effort to deem the trust

assets part of the estate of a deceased for EstateDuty purposes.

Certain trust specialists are still of the opinion that this attempt by the South

African Revenue Service is incorrect and are adamant that if tested, the

Courts would agree to the fact that the SouthAfrican Revenue Service is not

entitled to draw trust assets in such circumstances within the scope of

Section 3(3)(d) of theEstateDutyAct.

In the light of SARS’ apparent intention, it might be prudent to revisit your

trust deed in order to amend the trust deed to avoid the possibility of

additional Estate Duty or incurring unnecessary legal costs opposing such

possible SARS’ rulings in Court. A letter of wishes filed with your Will may

serve a similar purpose.

It is also suggested that should your Will contain such trust dispositions, you

consider discussing thematter with your attorney or auditor in order to obtain

more clarity in this regard.

THE Kouga Municipality will write-off closeto R500 million - much to the dismay of theDA councillors.

At a Special Council meeting on February10, Council resolved to write off a total ofR465.5 million unauthorised, irregular, fruit-less and wasteful expenditure. Although the

DA opposed this decision, the ANC overruledthem with one vote.

Since the 2009/2010 financial year up toJune 30 last year, the municipality incurreda total amount of R364 934 533 million in unau-thorised expenditure, while the total amountof irregular and fruitless and wasteful ex-penditure rings up to R69 086 733 million andR31 437 254 million respectively.

The majority of the unauthorised expendi-ture was incurreddue to employee re-lated costs (R50.8million), loss ondisposal of proper-ty and equipment

(R2,29 million) and remuneration of council-lors (R211 970).

The fruitless and wasteful expenditure in-cludes interest and penalties to the tune ofR23.7 million, payments made to directorswhile on suspension for more than sixmonths which amount to R23.7 million, R1.5million for legal costs relating to unfair dis-missal and a settlement of R859 401 paid to theprevious municipal manager.

A whopping R13.8 million was spent on atender awarded to a business associate of adirector of the municipality, while R1.8 mil-lion needed to be paid for a forensic investiga-tion implicating two officials for irregulari-ties. Other irregular expenditure includes

performance bonuses paid to employeeswhich was contrary to legislation (R368 665),receipts misappropriated from the caravanpark (R40 000) and the forging of a signaturefor a service provider procured for grass cut-ting (R19 500).

According to the DA it remains an openquestion how many millions lost could havebeen wisely spent on infrastructure and prop-er service delivery. “The ANC component allvoted for the writing off of the expenditure,while the DA voted against the recommenda-tions. With irrational resolutions like this, itis clear why the Kouga community is de-manding a change to the DA at the helm ofthe Kouga Municipality.”

KOUGA Municipality is a step closer to ob-taining a clean audit following the authorisa-tion and condoning by Council of unautho-rised, irregular, fruitless and wasteful ex-penditure dating back seven financial years.

This is according to Kouga municipalspokesperson Laura-Leigh Randall.

The resolution to authorise unauthorisedexpenditure of some R364,9-million and con-done irregular expenditure of R69-millionand fruitless and wasteful expenditure ofR31,4-million was taken by the Kouga Coun-cil at a special Council meeting at St FrancisBay on February 10.

“The resolution brings the municipalityback in line with national requirements aspart of the institution’s drive to achieve aclean audit,” says Randall.

Kouga Executive Mayor Booi Koerat ex-plained that Councils were expected to con-sider and authorise or condone unautho-rised, irregular, fruitless and wasteful ex-penditure on an annual basis.

“This process was not followed by the previ-ous administration. Consequently, it becamethe responsibility of the current administra-tion to correct this oversight,” says Koerat.

“While we were unable to rectify the mat-ter in the previous financial year (2012/2013),we are pleased that Council has since beenable to deal with the matter as prescribed bylaw.”

The Mayor said that unauthorised, irregu-lar, fruitless and wasteful expenditureshould not be mistaken for fraud and corrup-tion.

Unauthorised expenditure refers to moneythat was used differently to what was origi-nally approved by Council in the budget. On-

ly Council can approve the budget, henceCouncil is required to authorise the expendi-ture even if it is after the fact.

Irregular expenditure refers to instanceswhere supply chain processes were not fol-lowed. A simple example would be if the mu-nicipality made use of a service provider thatwas not on the supply-chain database.

Fruitless and wasteful expenditure refersto expenditure that might have been avoidedthrough planning. Avoiding such expendi-ture is not, however, always possible becauseof factors outside the municipality’s controlsuch as legal processes.

The Mayor emphasised that the Councilresolution did not mean action could not betaken to recover monies where applicable.

“For example, where this expenditure re-lates to payments made to previous seniormanagers or unfinished work, the currentadministration will go back to investigatewhat attempts were made to recover themonies and whether it is viable to reopen thecases,” he says.

He further commended the current admin-istration for the significant decrease theywere able to bring about in unauthorised ex-penditure during their first two years in of-fice. The biggest portion of the unauthorisedexpenditure – R310,9-million of the totalR364,9-million – dates back to the last threeyears of the previous administration.

“There has been tremendous improve-ment in our financial management since theappointment of our current senior manage-ment. We remain committed to strengthen-ing the financial performance of the institu-tion in order to maximise service delivery toall communities.”

Council decision on expenditure takesKouga closer to a clean audit

THE Kouga Municipality’s bill is in thered with over R30 million.

The municipality’s outstanding credit-ors amount to a whopping R34,617 mil-lion, of which R17,483 is owed to the De-partment of Transport. Other debtors in-clude the Nelson Mandela Municipality(R2,910 million) and the Office of Auditor-General (R1,922 million).

According to municipal spokespersonLaura-Leigh Randall, the current admi-nistration has systematically been payingoff debt it inherited from the previous ad-ministration. “While there has been signif-icant progress, it is an ongoing process.The amount also includes payments notmade within 30 days. While most creditorsare paid within 30 days as per the MFMA,there are delays at times,” says Randall.

“The outstanding amount totalled morethan R20-million when the new admini-stration took office. This has since beenreduced to R2,9-million as per the reporttabled to Council on January 29. The cur-

rent administration has tried as far as ispossible to settle the inherited debt with-out compromising service delivery. How-ever, having to pay off old debt does havean impact on how much money is availa-ble for current projects.”

According to Randall monies collectedat Kouga’s traffic office for licensing andregistration are paid over to the Depart-ment of Transport. “The current accountis paid up. The outstanding amount iswhat was not paid over under the pre-vious administration. The municipalityappealed to the Department to write offthis debt, but an agreement could not bereached. We are, therefore, now in discus-sion with the Department regarding pay-ing over the amount.”

Randall continues that the municipali-ty has to pay the Office of the Auditor Ge-neral to conduct the annual audit. “Thisaudit cost the municipality about R5 mil-lion. The money reflected in the report iswhat is still owed to them.”

The South African National Blood Service iscurrently experiencing a national bloodshortage and is relying on the public to openup their veins to alleviate the pressure on pa-tients and their families.

The South African National Blood Service(SANBS) invites all healthy people, betweenthe ages of 16 and 65 years, who weigh 50kgor more and lead a safe lifestyle, to displaytheir compassion by donating blood.“Blood is essential for treating accident vic-

THE Seal Point Boardriders Surf Club, whowere coached by the legendary duo of Gra-ham Hynes and Ant Brodowicz, celebratedtheir first appearance in a National Interclubtournament with a victory when they posted168.1 points in the final of the 2015 BillabongSA Interclub Championships at Kitchen Win-dows in Jeffreys Bay on Sunday.

A disappointed CYOH Surf Club of PortElizabeth scored 150,2 points to take secondspot while 2013 champions, the JBay Board-riders posted 133,0 points to finish third.

The defending champions, JBU Surf Clubhad to settle for fourth place after scoring109,9 points in the final.

The defeated semi-finalists were the Natu-ral Energy Surf Club and the UCT Surf Club.A record fifteen teams representing thirteenclubs participated in the third annual Natio-nal Interclub Surfing Championships.

Tough weather and strong winds made thefirst day of competition difficult and event of-ficials made the decision to call a halt to com-

petition on day one after the first four heatsand although the weather improved on daytwo, strong winds made 2 – 3 foot surf difficultto handle throughout the day.

At the award ceremony held on the beachat Kitchen Windows, Surfing South AfricaVice President Johnny Bakker presented theSouth African Interclub Trophy and gold, sil-ver, bronze and copper medals to the team

members of the teams that reached the finals.The event was hosted by the JBU Surf Club,

who exercised their right to host the tourna-ment in Jeffreys Bay. Seal Point Boardridersnow have the right to chose a venue for nextyear’s tournament which will be held on Feb-ruary 13and 14.
