    SAVING the prestigious Billabong Pro JBaywill be on the agenda when Kouga ExecutiveMayor Booi Koerat meets with Billabong SAthis week.

    In a television interview on Tuesday, May-oral Committee member Vernon Stuurmansaid the Kouga Council would be doing all inits power to help Billabong SA reclaim Afri-cas biggest surfing competition.

    The Billabong Pro JBay is the only WorldChampionship Tour (WCT) event on the Afri-can continent, he said. Billabong Interna-

    tionals decision to drop the contest from theWCT is, therefore, not only a great loss for Jef-freys Bay but for South Africa and the entirecontinent as a whole.

    Stuurmans interview followed the an-nouncement by Billabong International lastweek that the JBay leg of the WCT would bedowngraded to an ASP qualifying event for2012 as part of the companys cost-cuttingmeasures.

    The official statement by Billabong Interna-tional reads: The change in event status fol-

    lows a broader review in which we are seekingto identify cost-savings throughout the busi-ness.

    Stuurman said the Council would decide onan action plan after its meeting with BillabongSA but that they were ready to lobby both pro-vincial and national government for assist-ance to save the contest.

    He said the Billabong Pro JBay had becomepart of the very fibre that makes up the townand that the Kouga Council was not willing tosit back and do nothing to try and save it.

    KOUGA Municipality has won a Vuna Awardfor its performance during 2010/11.

    The awards, an initiative of the Eastern CapeDepartment of Local Government and Tradi-tional Affairs, were presented at a ceremony inPort Elizabeth on February 14.

    Kouga Executive Mayor Booi Koerat thisweek dedicated the award to the staff of the mu-nicipality, stating that the award recognisedtheir dedication to taking service delivery for-ward despite tough financial constraints.

    The year 2010/11 was fraught with financialand leadership challenges but, despite this,Kougas staff kept their eye on the goal crea-ting a better life for our people and scored sig-nificant success, he said.

    The award recognises the progress theymade in the key performance areas of basicservice delivery, good governance and publicparticipation, institutional transformation andorganisational development, and local econom-ic development.

    He said the new Council was proud to have

    such a dedicated workforce.It is this workforce that will help us over-

    come the financial challenges we inherited, sothat Kouga once again becomes the top munici-pality in the Eastern Cape.

    Local Government Department spokesmanMankeli Ngam said municipalities had been as-sessed for making progress in basic service de-livery, economic development, deepening de-mocracy, practising good governance and man-aging finances.

    Information to enable the Department to as-sess performance was gleaned from annual mu-nicipal performance reports, audited financialstatements, Municipal Infrastructure Grant ex-penditure reports and municipal audit reports,he said.

    Kouga won R35 000 with the award. The firstprize of R45 000 went to the Maletswai Munici-pality in Aliwal North. Kougas district munici-pality, Cacadu, also received recognition at theawards ceremony, for continuously maintain-ing an unqualified audit outcome.

    A 52-year-old man was sentenced to life impri-sonment on Friday 17 for raping his daughter.

    According to w/o Gerda Swart, the accusedwas charged for raping his own daughter, whowas only 9-years-old at the time of the incidents,which commenced during 2008. The father al-

    legedly took the child as his wife, after his wifepassed away. The child reported the matter tothe police in January 2011 and he was arrestedduring January 2011. The accused remained incustody until the finalisation of the case on Fri-day, 17 February 2012, said Swart.

    DESPITE photos and several eye witness-es, the municipality is convinced that notraffic officers were involved in the inci-dent were a tree was hacked down in DaGama Road.

    On February 9, the Kouga Express re-ported that two traffic officers in JeffreysBay instructedamandressed in civil cloth-ing to cut down a tree in Da Gama Road,which was allegedly obstructing theirview of oncoming motorists.

    When the traffic officers saw someone

    taking photos, they got into their vehicleand drove off.

    Municipal spokesperson, Mfundo So-bele, said: An internal inquiry was con-ducted by the traffic department and hav-ing considered all, there is no evidence tosupport claims that it was indeed our offic-ers who hacked down the tree.

    Our officers went to set up on the loca-tion for the following day and no object wasunderstood to be obscuring their view. Itwas also not the first time we had officerson the same location with the speed cam-era and they have never had a problemwith their view being obscured.

    THE residents of Jakobstreet in Arcadia,Humansdorp are responsible for the regu-lar sewerage overflow in the area and notthe municipality.

    This is according to municipal spokes-person, Mfundo Sobele, in response to thearticle Inwoners keelvol vir rioolgemorspublished on February 23.

    According to residents, who have beenliving in these unhygienic conditions ofraw sewage in their streets and right attheir front doors for the past several years,the sewage overflow are due to insufficientdrainage systems and a manhole that ispermanently clogged.

    They continued, that whenever it rains,rawsewage comerunningdown the streetsinto their homes and despite several des-

    perate pleas to the municipality, nothinghas been done to date.

    However, according to Mfundo, theproblem is caused by the blockage of themanhole in the affected area and not insuf-ficient infrastructure.

    We are convinced that the manhole hasenough capacity to service the area, evenon rainy days. What becomes the problem,however, is people disposing of waste suchas food and disposable nappies by flushingthem down their toilets, said Mfundo.

    We have made numerous calls in thepast against this action as it threatens thelivelihoods of other residents and not ne-cessarily the perpetrators on most occa-sions. Our technical services team does re-spond promptly when there are overflows,but we need cooperation from the publicin order to avoid such unnecessary over-flows from occurring.

    JONATHAN Kettledas (21) from Humansdorpwas sentenced to 8 years imprisonment in theHumansdorp magistrates court for raping a 20year old woman in 2011.

    According to Lt Col Priscilla Naidu, the vic-tim and her friend were walking home to Don-kerhoek in Gill Marcus when they becameaware of two men following them.

    As the men came closer, the victim recog-nised Kettledas. He indicated to the woman thathe wanted to talk to her. When the woman told

    him that she had nothing to say, the accusedbecame aggressive and grabbed her. His friendleft the twoandwalkedaway.Kettledasdraggedthe woman into the nearby bushes and rapedher. He block off the womans frantic screamsby putting his hand over her mouth, saidNaidu.

    The victims friend went to her house and in-formed her family about the incident.

    The victim managed to get away from the ac-cused and went home.

    SIXTY-YEAR-OLD Sakkie Malherbe was founddead inhishomeat 22SandpiperStreet onTues-day, February 28.

    He was last seen alive on Friday, February 17.According to w/o Petra Els, the deceased was

    found by a family friend when he went to seeif everything is still in order at the house.

    The door of the house was unlocked and thefriend found Malherbe dead in his bed, saidEls.

    The two dogs of deceased were with him inthe house.

    A docket of inquest has been opened to deter-mine the cause of death.

    UP TO MONKEY BUSINESS

    Julien Nosworthy from Jeffreys Bay captured these monkeys playing in her back garden, with some even cooling of in the swimmingpool. According to Nosworthy this has become quite a regularthing, but only on very hot days.     THIS week, the Property Poserpanel contemplates the legalrights concerned with grantingthe use, or habitatio, of a property.

    A reader granted her pensioner fa-ther the right to stay in her house,a property separate from her resi-dence, but now wishes to sell it in or-der to use the proceeds elsewhere.

    Her father is not willing to leaveor seek alternative accommodation.The reader would like to know whather rights are in this regard.

    The right of habitatio is an exclu-sive personal right, says Herman Pi-eterse from Jan Visser Attorneys in

    Jeffreys Bay.It lives and dies with our readers

    father and cannot be transferred. Itcan be abandoned by him but isotherwise inalienable.

    This type of personal servitudeconfers on its holder the right todwell in another persons house, to-gether with his or her family, with-out detriment to the substance of theproperty, says Pieterse.

    It also carries with it the right togrant a lease or sublease to others.

    Pieterse says a second, lesser typeof personal right is referred to asusus. This entitles the user to occu-py a house with his or her family and

    guests and also let out a part of thehouse. The user may not alienatethe property or cede the right of useto another person, says Pieterse.

    It is always necessary in a situa-tion like this to examine the facts ofthe matter properly to determinewhat type of personal servitude oneis dealing with, as this will determinewhat the rights of the holder are.

    The reader may have permittedher father to stay in the house for anunspecified period without actuallyintending it to be indefinite, or with-out intending to formally grant hima real right of use or habitation, saysPieterse.

    One way of ascertaining whetherthe readers intention was to formallygrant her father a right of usus or ha-bitatio, is to determine whether thereal right was registered against thetitle deed of the property, says WandaHayes from Huizemark Jeffreys Bay.

    Once a right is granted, Hayes saysit cannot be revoked, except if anystipulated conditions have not beenmet or by mutual agreement.

    If it is absolutely necessary forthe house in question to be sold, ourreader would do well to approach herfather and negotiate his leaving thehouse voluntarily.

    Hayes suggests relocating him to

    a residence more suitable for him tosee out his remaining years, therebyavoiding family quarrels and poten-tial legal disputes.

    If agreement cannot be reached,the reader should cast her mind backto the exact terms mentioned at thetime that the right was granted.

    This will allow her to properly as-sess the content and validity thereof,says Hayes. Another aspect for thereader to explore with her attorneyis whether she was, in fact, entitledto grant the right in question; it maynever have been hers to grant.
