Welcome to the International Property Collection, Gibraltar Edition, Spring 2014

We welcome you to the Spring Edition of our Gibraltar property magazine.

The calibre of the properties in this edition reflects the high confidence levels in both the future of Gibraltar’s economy and Chesterton’s ability to best represent the quality end of the local property market.

The Sanctuary, five of the most impressive villas Gibraltar has ever seen before, plus the striking New Aloes residence and Whitewater House have all been built, or are being built, in response to the demand for high quality properties in Gibraltar. Buena Vista Park Villas phase three will also launch soon with a mix of villas and townhouses aimed at the higher end. We are appointed agents on all of these developments.

At the other end of the price spectrum, we simply cannot source enough properties for the rental and buy to let investor market. Our sales pipeline is at record levels and most of our rental properties are let before making it to our website. Our drive is now to seek vendors and landlords of some cheaper properties for our waiting clients. This quest has achieved early success with Chesterton’s instruction as property agent for Plata Villa, a forthcoming development of 23 apartments in the South District to be sold off-plan most likely in quarter 2 of this year.

We continue to voice concerns regarding the lack of professional standards within our industry. Quite simply, there are no regulations. Any tenant, landlord or purchaser is relying on simple trust and professionalism of their estate agent when placing their money and their property with them. We encourage everyone to ask how their client money is handled. We also note the increase in the number of properties on estate agents websites which are advertised as available but are either not available or that agent has no instruction to market the property. Chesterton will always maintain high professional ethics and standards, as that positioning has been the foundation of our success over the last few years.

On the day of writing this foreword, the Development & Planning Commission has granted the developers of the Marriott Hotel outline planning consent to proceed. The development includes 8,000 square metres of prime office space adjacent to the hotel and we are proud that Chesterton has been appointed as sole agent to market the offices.

Selling and renting of commercial space is quite different from residential. We have demonstrated to landlords and tenants that we have the skillset and experience to deal with quite complex lease issues. This has resulted in our ability to present a number of off-market property investment opportunities to investors seeking a good rental return. In the next quarter we will be opening our dedicated Chesterton Commercial office in response to our growth in this sector.

None of the above could be achieved without a quality team of people. In the last quarter we have continued to invest in our team both in numbers and training. Whether myself, or one of my staff, we look forward to welcoming you and assisting you.

Personal Income TaxIndividuals can opt to be taxed under one of two systems, whichever is most advantageous.

(i) High Net Worth Individuals (Category 2)Persons with net wealth of £2M+ can apply to pay tax only on their first £80,000 of taxable income, equivalent to tax of approximately £29,000, but subject to a minimum of £22,000.

(ii) High Executive Possessing Specialist Skills status (“HEPSS”)Relocating executives with relevant skills pay tax only on the first £120,000 of their assessable income (maximum tax approximately £30,000). A minimum salary of £100,000 is required.

QROPSIt is possible to transfer a UK pension to Gibraltar under QROPS rules. A tax free lump sum of 30% is available and with income drawdowns subject to income tax at a flat rate of 2.5%.

Other TaxationAs well as a favourable income tax regime, Gibraltar has no taxes on:

Savings income (dividends and interest). Royalties and capital gains. Wealth, gifts, estates and inheritance. Sales (e.g. VAT).
