THE INTERSTATE COMMERCE COMMISSION adopted on June 15 the recommended report and order of Examiner Edward L. Boisseree, that the southern ports foreign freight committee’s application to amend its agree- ment under Section 5a of Part I of the Interstate Commerce Act, which authorizes rail carriers to form cooperative rate bureaus to publish rules and charges for transportation. The proposed amendments would change the Southern Ports Foreign Freight Committee’s Articles of Organiza- tion and Procedure as follows: "(1) Estab- lish an Executive Committee as the govern- ing body with power of review over actions of the general committee, (2) Provide that Committee action applies for account of all lines, (3) Redesignate the Tariff Publishing Agent as a Tariff Publishing Officer, (4) List the current tariff pub- lications, (5) Name a new individual Chairman and Attorney-in-Fact for the carrier parties, (6) Revise the list carriers currently signatory to the agree- ment, (7) Change the Territorial Applica- tion to reflect abandonment of lines, (8) Substitute the General Freight Traffic Committee-Eastern Railroads fcr the now abolished Central Territory Railroads Freight Traffic Committee, (9) Amend the independent action provision to cover final action of the Executive Committee, and (10) Make other incidental changes neces- sary to clarify or effectuate the described changes." The area of controversy primarily the subject of protests by the Gulf Forts Association and the Houston Fort Bureau, along with other interested parties, was the establishment of the Executive Com- mittee as a review committee. It was con- tended that this establishment would delay decisions regarding the proposed changes in freight rates. The Southern Ports Foreign Freight Committee has operated without any appeal committee for the last sixty years. Examiner Boisseree concluded that "It is impossible to determine with any certainty what the amended agreement actually pro- vides," and he held that the provisions are "indefinite, ambiguous, and conflict- ing" with a "conflict between the explana- tion offered in the instant application and the provisions in the agreement itself." He recommended that a provision for appeal by interested parties, other than carrier members, be instituted; that the provisions that votes may be taken by members prior to receipt of shipper objections is un- acceptable, and there is no standard for the five day vote by telegram; that no provision is made for publicizing certain amendments that may affect interested parties; and, that there is no provision for mandatory public notice of independent action proposals. Examiner Boisseree sug- gested that the proceeding be held open to afford the applicants an opportunity to submit revised amendments. The proceeding will be held open for three months, begin- ning with the May 15th date of his order. THE UNITED STATES DISTRICT Court for the District of Colorado has granted a tem- porary restraining order in the case of Admiral Merchants Motor Freight, Inc., et al. vs. the United States of America and Interstate Commerce Commission. This order prevents the Interstate Commerce Commission and the United States of America from en- forcing or attempting to enforce the order and requirements of the Interstate Com- merce Commission entered in its Docket No. 34971, requiring the refund of overcharges resulting from an increase in freight rates in the Middlewest territory which the Commission found to be unreasonable and ordered cancelled. THE ASSOCIATION OF AMERICAN Railroads has announced increases in demurrage charges from $5 to $i0 for each of the first four days, and from $I0 to $20 for each of the next two days instead of the next four days, and from $15 to $30 for each subse- quent day. In addition, Saturdays, Sundays or holidays were to be considered as chargeable days when the last day of free time began at 7 a.m. of the day immediately prior to the Saturdays, Sundays or holi- days.
