WHEREAS, Kelly Orland is a lifelong resident of Kane County, and has been an employee of the Kane County State's Attorney's Office since 1996, a Kane County Assistant State's Attorney since 2001 and heads the office's Special Prosecution Unit; and

WHEREAS, Kelly Orland has distinguished herself as a tireless servant of the people of Kane County, particularly in her efforts to remove illicit and dangerous narcotics from the community and discourage individuals from trafficking, selling, buying or using illicit and dangerous narcotics; and

WHEREAS, Kelly Orland in 2010 collaborated with the Drug Enforcement Agency and the North Central Narcotics Task Force in an investigation that led to the indictments of 10 individuals with connections to the Chicago area on numerous marijuana trafficking and delivery charges and the seizure of more than one ton of marijuana; and

WHEREAS, Kelly Orland in 2010 was honored by the Illinois Metropolitan Enforcement Group Directors and Task Commanders Association Narcotics & Dangerous Drugs Enforcement for her work on narcotics investigations; and

WHEREAS, Kelly Orland remains committed to fairness, strict ethical standards and the rules which guide the legal profession; and

WHEREAS, Pamela Bradley proudly has lived in Aurora and Kane County since 1979; me

WHEREAS, Pamela Bradley was hired as a Kane County employee in 1999, working first as an administrative assistant for the Civil Division of the State's Attorney's Office until 2002, when she joined the office's Community Prosecution Unit, which is her current position; and

WHEREAS, Pamela Bradley wears many hats for the State's Attorney's Office, also serving as the program director of Weed and Seed, an early intervention program that helps at-risk youths stay on the right path, a peer mentor as selected by the U.S. Department of Justice, a program coordinator for the Law Enforcement Youth Academy, Pre-Trial Diversion and the Community Pride High School Forum, community liaison for the office and a grant writer for Weed and Seed; and

WHEREAS, Pamela Bradley is a beloved and iconic member of the Aurora Community, and has been honored many times for her dedication and service to the city of Aurora - in particular its at-risk, young and elder citizens - by East Aurora School District 131 with its Making Choices for Excellence Award, by Aurora's African-American Heritage Advisory Board with the Mayor's Hometown Hero Award, and by the Aurora YWCA with its Women of Distinction Racial Justice Award; and

WHEREAS, Pamela Bradley, because of her office's location, might be the most isolated employee of the Kane County State's Attorney's Office.

RECOGNITION OF SEPTEMBER AS HISPANIC HERITAGE MONTH

WHEREAS, September is designated as Hispanic Heritage Month; and

WHEREAS, it is desirable and appropriate the we reflect upon the contributions of Hispanic Americans in this county in the areas of Arts, Sciences, Politics, Education, Culture and Law; and

WHEREAS, it is periodically appropriate to focus on the significant contributions of Hispanic Americans; and

WHEREAS, the list of exceptional Hispanic Americans includes the late Under Sheriff Pete Perez, an Aurora Police officer and the first Latino to play professional football for the Monsters of the Midwest Chicago Bears; Hector Jordon, Aurora's first Hispanic police officer; the Honorable Manny Barbosa, founder of Club Guadalupano scholarship fund and currently serving as a Federal Judge; Jaime Garcia, educator and co-founder of Centro de Informacion, Cip Siete, Elgin's first Hispanic police officer and veteran; Sheriff Pat Perez, Kane County's first Latino sheriff; Representative Linda Chapa-LaVia, first Hispanic State Representative in Kane County; Lupe "Mary" Camacho, one of the first Hispanic families to settle in Elgin; the late Aurelio Aviles, a Korean War Veteran and Purple Heart recipient; Art Lomas, United States Army veteran and active Post 84 honor guard; and Mary Lou Chapa who opened the first Hispanic Real Estate office in Aurora.

WHEREAS, Illinois Association for Home and Community Education was organized under the name Illinois Home Bureau Federation for the purpose of improving rural living and family and community life; and

WHEREAS, Illinois Association for Home and Community Education was initiated in July, 1915; an Advisor was hired by the University of Illinois to develop a home improvement association. Kane County joined this University of Illinois Extension program in 1918; and

WHEREAS, Illinois Association for Home and Community Education evolved from Kane County Home Bureau Federation to Kane County Homemakers Education Association to the 2008 change, Kane County Association for Home and Community Education; and

WHEREAS, Kane County Association for Home and Community Education is based at the University of Illinois Extension, 535 Randall Road, St. Charles, Illinois; and

WHEREAS, Kane County Association for Home and Community Education is dedicated to addressing the issues of community outreach, cultural enrichment, family living, international study, public relations and community involvement for the entire population of Kane County, regardless of race, color, national origin, sex, age or creed.

Re: Request for Opinion - Zoning Petition # 4260 - Colleen Thurow et ux. - F to F-I Section 29 Hampshire Township

Gentlemen:

By letter of July 26, 2011, Mark D. VanKerkhoff, Kane County Zoning Enforcement Officer, requested the opinion of the Kane County State's Attorney on whether or not the captioned Petition #4260 (the "Petition") seeking rezoningof a five acre parcel in Section 29 - Hampshire Township from the F-Farming District to the F-i Zoning District qualifies for the requested map amendment based on the facts and the record developed before the Zoning Board of Appeals and the Kane County Board Development Committee. For the reasons that follow, it is the opinion of this office that the Petition does not meet and could not meet the standards established under the Kane County Zoning Ordinance for rezoning to the F-I District unless the County Board elects to amend the current zoning ordinance by the appropriate legal process.

FACTS

Petitioners Colleen Thurow and her husband ("Petitioners") are the owners of a five acre parcel of land on the east side of Walker Road approximately one-half mile north of Illinois Route 72 in Section 29 of unincorporated Hampshire Township (the "Property"). The Property is currently zoned F-District Farming under the Kane County Zoning Ordinance (the "Ordinance.") Petitioners have filed a Petition seeking a map amendment to rezone the Property to the F-i District. Petitioners or their family have owned and farmed the Property for more than sixty years.

Kane County Technical Staff recommended denial of the Petition. After the required public hearing, the Zoning Board of Appeals voted 3-3 on approval of the Petition, and, accordingly, made no recommendation or findings with respect to the Petition.

It is undisputed that the Property constitutes prime farmland based on the long years of cultivation as well as the LESA ("Land Evaluation and Site Assessment") score determined by the independent Kane-DuPage Soil and Water Conservation District. The LESA score of 29 out of a possible 33 points means that the Property is considered to have "high value" as farm land. No testimony or other evidence was presented to the Zoning Board of Appeals that the Property was not prime farmland, and, as noted, no findings were made by the Zoning Board.

KANE COUNTY ZONING ORDINANCE

Section 4.1 of the Ordinance provides for the position of Zoning Enforcing Officer, who is charged with enforcement and administration of the Ordinance. "To that end, he shall have the power to make such orders, requirements, decisions and determinations as are necessary with respect to applications for permits and the enforcement of this Ordinance."

Section 8.2 of the Ordinance establishes the uses and procedures for the "F-I District - Rural Residential." Specific provisions of Section 8.2 are discussed below.

ANALYSIS

Section 8.2-1 of the Ordinance states as follows:

"The Kane County Board has established and adopted as a long-range goal, the preservation of prime agricultural land and has implemented this long-range goal through adoption of a Comprehensive Plan and a Zoning Ordinance. However, the County Board is aware that some of the land indicated as agricultural in the Comprehensive Plan and zoned as agricultural will not be utilized as such because of soil productivity, vegetation, topography, man-made barriers, etc. The Rural Residential District is intended only for single-family residences and only for those areas indicated in the Comprehensive Plan for agriculture and for those areas therein shown to be unsuitable for such use." (emphasis added).

Section 8.2-3, entitled, "Conditions for Rezoning," provides in part as follows:

"The Zoning Board of Appeals shall not recommend a rezoning to this zone district class?fication unless the applicant shall present clear and convincing evidence to the Zoning Board of Appeals that the property sought to be rezoned is not suitable for agricultural use." (emphasis added).

Section 8.2-3 requires the Zoning Board "in determining suitability ofproperty for agricultural use shall make findings offact with respect to the following: ..." The Ordinance then lists six specific factors that the Zoning Board is required to consider in its findings.

"Clear and Convincing Evidence" is a legally recognized standard of proof in Illinois law. The Illinois General Assembly has approved a definition of clear and convincing evidence as follows: "Clear and convincing evidence" means that measure or degree of proof that will produce in the mind of the trier offact a high degree of certainty as to the truth of the allegations sought to be established This evidence requires a greater degree ofpersuasion than is necessary to meet the preponderance of the evidence standard' 735 JLCS 5-2/1 115.05.

OPINION

Under the Ordinance, the Zoning Board is specifically required to make a finding that the property which is the subject of the F-I rezoning petition is not suitable for agricultural use. Here, the Zoning Board made no findings whatever on the issue, and based on the record, could not have made any findings favorable to the Petition because there was no evidence clear and convincing or otherwise, that the Property was not suitable for agricultural use. The Petitioners do not dispute that the Property is prime farmland, and the LESA score and the opinion of the Kane-DuPage Soil and Water Conservation District clearly establishes that the Property has a "high value" as farmland. Based on the clear and unambiguous requirements of the Ordinance, it is our opinion that the County Board cannot validly rezone the Property to the F-I Rural Residential District. It further appears that the evidence overwhelmingly demonstrates that the Property is prime farmland, and thus even if additional evidence was presented and findings of fact made, the Petitioner would be unable to meet the "clear and convincing" standard of proof the Zoning Ordinance requires.

We note, however, that the County Board is vested by statute with the legislative power to amend its ordinances, including the zoning ordinance. Nothing in this opinion is intended to suggest that the County Board could not, as a policy matter, and after proper notice and public hearings, elect to amend the Zoning Ordinance in a manner that would permit the proposed rezoning under a different standard.

CONCLUSION

For the reasons stated herein, in the opinion of this office, the answers to the Zoning Enforcement Officer's specific inquiries are as follows:

I) Has the Petitioner provided sufficient evidence that the proposed rezoning to the F-I District meets the specific criteria in the Zoning Ordinance? ANSWER: NO

2) Does the County Board have the legal latitude to even consider approving the Petition because the Petitioner has not provided evidence nor has the ZBA made the finding of fact required by the Ordinance? ANSWER: The County Board is required by the terms of its Zoning Ordinance to consider and act upon the Petition based upon the record before it; while vested with legislative discretion on approving a zoning map amendment, the plain language of the Zoning Ordinance

demonstrates that absent a change to the text of the Zoning Ordinance, Board approval of the Petition would be contrary to the Zoning Ordinance and the policy expressed in the Comprehensive Plan.

Summary: There are two requests within this resolution.

The first is to enter a license agreement with CASA. CASA has occupied office space within the 3 rd Street Courthouse for over 15 years. They have been an excellent tenant and a formal license agreement is in the best interest of CASA and the County. This resolution authorizes the Chairman to execute a license agreement with CASA.

The second request is to approve a use permit and license agreement for CASA to plant and maintain a flower garden on the west side of the 3 rd Street Courthouse. This garden will be a wonderful addition to the property and will be enjoyed by citizens utilizing the Courthouse. The garden will be constructed (planning, labor, and expenses) solely by CASA, and CASA will maintain this garden for 5 years after it is completed.

The Judiciary supports both requests.

WHEREAS, Court Appointed Special Advocates of Geneva, IL ("CASA") has been a valuable asset to the community and the youth of Kane County for many years; and

WHEREAS, CASA has occupied space in the 3rd Street Courthouse for over 15 years; and

WHEREAS, It is in the best interest of the County and CASA to enter into a license agreement for said space CASA currently occupies at the 311 Street Courthouse; and

WHEREAS, Facilities Management staff and CASA have drafted a license agreement which is mutually agreeable to both parties, a copy of said license agreement is attached to this resolution as Exhibit 1; and

WHEREAS, CASA further desires permission and authority to enter into a use permit and license agreement (copy of said agreement is attached to this resolution as Exhibit 2) to plant and maintain a flower garden on the West side of the 3rd Street Courthouse; and

WHEREAS, the Administration Committee has reviewed this request and support entering into said use permit and license agreement with CASA.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman is hereby authorized to execute the license agreement attached to this resolution as Exhibit I with Court Appointed Special Advocates of Geneva, IL.

LICENSE AGREEMENT

This License Agreement is made by and between the County of Kane, (" Owner") and CASA Kane County, Inc., an Illinois Not For Profit Corporation (" Licensee"), effective on the date which the latter of Owner and Licensee have signed this Lease Agreement

1. Licensee.

Owner hereby grants to licensee the Licensed Premises as defined herein;

This Licensed Agreement is subject to the terms, covenants and conditions herein set forth and each party covenants as a material part of the consideration for this license to keep and perform each and all of its terms, covenants and conditions.

2. Definitions and License Conditions. As used herein, the following terms have the following meanings:

f. The Owner is hereby committed to provide general office space of approximately 1,675 square feet to Licensee. The office space is currently located at 100 S. Third Street, Suite 460, Geneva, IL. Upon ninety (90) days written notice, the Owner, at its sole discretion and for any reason, may change the office space provided to Licensee to another location within Geneva or St. Charles Township, providing comparable office space. The determination of comparable office space shall be made solely by Owner.

Uses Prohibited. Licensee shall not do or permit anything to be done in or about the Premises or Common Areas nor bring anything therein or thereon which is not within the permitted use of the Premises which will in any way increase the existing rate of or affect any fire or other insurance upon the Building or any of its contents, or cause a cancellation of any insurance policy covering the Building or any part thereof or any of its contents. Licensee shall not do or permit anything to be done in or about the Premises or Common Area which will in any way obstruct or interfere with the rights of other licensees or occupants of the Building or injure or annoy them or use or allow the Premises or Common Area to be used for any improper, immoral, unlawful or objectionable purpose; nor shall Licensee cause, maintain or permit any nuisance in, on or about the Premises or Common Area. Licensee shall not commit or allow to be committed any waste in or upon the Premises or Common Area.

Licensee's Right to Terminate. Licensee shall have one opportunity to terminate this Agreement prior to its natural expiration without being held in default of its obligations under this Agreement. To properly terminate Licensee must send notice to Owner at the beginning of the ninth month following the Commencement Date, notifying Owner of its intention to terminate the license at the end of that year. Written notice of the Licensee's intention to terminate must be sent to Owner via certified mail, return receipt requested, at Owner's Mailing Address.

Compliance with Law. Licensee shall not use the Premises, or permit anything to be done in or about the Premises, which will in any way conflict with any law, statute, ordinance or governmental rule or regulation now in force or which may hereaftêr be êfiact6d or promulgated. Licensee shall, at its sole cost and expense, promptly comply with all laws, statutes, ordinances and governmental rules, regulations, requirements now in force or which may hereafter be in force and with the requirements of any board of fire underwriters or other similar bodies now or hereafter constituted relating to or affecting the condition, use or occupancy of the Premises.

Repairs. Owner shall thereafter, at Owner's sole cost and expense, keep the Premises and every part thereof in good condition and repair including without limitation, the maintenance, replacement and repair of any doors, window casements, glazing, plumbing, pipes, electrical wiring and lighting fixtures and conduits, and heating and air conditioning system which exclusively serve the Premises. Any repairs or improvements desired to be completed by the Licensee shall be approved in writing by the Owner prior to said repairs being commenced.

Liability Insurance. Licensee shall, at Licensee's expense, obtain and keep in force during the License Term a policy of commercial general liability insurance insuring Owner and Licensee against any liability for bodily injury, property damage (including loss of use of property) and personal injury arising out of the ownership, use, occupancy or maintenance of the Premises and all areas appurtenant thereto. Licensee provided that said insurance shall have

Owner's protective liability endorsement attached thereto.

Utilities. Owner shall pay for all water, gas, heat, light, power, sewer charges, telephone service and all other services and utilities supplied to the Premises, together with any taxes thereon, if applicable.

Rules and Regulations. Licensee shall faithfully observe and comply with the reasonable rules and regulations that Owner shall from time to time promulgate and/or modify. The rules and regulations shall be binding upon Licensee upon delivery of a copy of them to Licensee.

Entry by Owner. Owner reserves and shall, upon reasonable notice when practical by Owner, have the right to enter the Premises to inspect the same, to repair the Premises and any portion of the Building of which the Premises are a part that Owner may deem necessary or desirable, and may for that purpose erect scaffolding and other necessary structures where reasonably required by the character of the work to be performed, always providing that the entrance to the Premises shall not be unreasonably blocked thereby, and further providing that the business of Licensee shall not be interfered with unreasonably. Owner at any and all times shall have the right to use any and all means which Owner may deem proper to open said doors in an emergency, in order to obtain entry to the Premises without liability to Licensee except for any failure to exercise due care for Licensee's property and any entry to the Premises obtained by Owner by any of said means, or otherwise, shall not under any circumstances be construed or deemed to be a forcible or unlawful entry into, or a detainer of, the Premises, or an eviction of the Licensee from the Premises or any portion thereof. Licensee shall not change locks or restrict access to any part of said premises without written authorization from the Owner.

General Provisions.

Plats and Riders. Clauses, exhibits, schedules, plats, riders and addenda, if any, affixed to this Lease are a part hereof.

Waiver. The waiver by either party of any term, covenant or condition herein contained shall not be deemed to be a waiver of such term, covenant or condition or any subsequent breach of the same or any other term, covenant or condition herein contained.

C. Marginal Headings. Other than those identified in the Definition section of this license agreement, the marginal headings and section titles to the sections of this License are not a part of this License and shall have no effect upon the construction or interpretation of any party hereof.

Time. Time is of the essence of this License and each and all of its provisions in which performance is a factor.

Prior Agreement. This License Agreement contains all of the agreements of the parties hereto with respect to any matter covered or mentioned in this License, and no prior agreements or understanding pertaining to any such matters shall be effective for any purpose. No provision of this License may be amended or added to except by an agreement in writing signed by the parties hereto or their respective successors in interest. This License shall not be effective or binding on any party until fully executed by both parties hereto.

Inability to Perform. This License and the obligations of Lease and Owner hereunder shall not be affected or impaired because the other is unable to fulfill any of its obligations hereunder or is delayed in doing so, if such inability or delay is caused by reason of strike, labor troubles, acts of God, or any other cause beyond the reasonable control of such party. In the event of delay in the fulfillment of obligations, the time for performance shall be extended only by the time of the delay due to the event beyond the reasonable control of the non-complying party.

Partial Invalidity. If any provision of this License is deemed to be invalid, void, or illegal, such provision shall in no way affect, impair or invalidate any other provision hereof which can be given effect and such other provision shall remain in full force and effect.

Choice of Law and Venue. This License shall be governed by the laws of the State of Illinois and venue is proper in the Sixteenth Judicial Circuit, Kane County, Illinois.

Indemnification. CASA, its volunteers, agents, representatives, employees and contractors agree to pay for the cost of and hold COUNTY harmless from any and all losses of or damages to property, including environmental and economic losses, or injuries to or death of any person resulting from its activity or use on the Premises, or any property affected by such activity or use by CASA, its employees, volunteers, contractors, affiliates, subsidiaries or successors. CASA shall indemnify and save harmless COUNTY, its officers and employees, from all claims, litigation and liability asserted against them or any of them, and any costs and attorney's fees incidental thereto, on account of injury to or death of any person or persons whomsoever, on account of damage to any property, caused by, connected with, or anyway attributable to, the rights herein granted or CASA' s failure to comply with any of the terms or conditions hereof. CASA shall pay for the defense of COUNTY, its officers and employees in any such litigation, with COUNTY having the right to designate its own local counsel.

Termination. Either party may terminate this license agreement for cause upon thirty days written notice to the other. Provided, however, that the breaching party shall have fOrty-five days thereafter to remedy any default or defect.

12. Compliance. The parties hereto agree to comply with all applicable federal, state and local laws, regulations, codes, ordinances and administrative orders having jurisdiction over the parties, property or the subject matter of this Agreement, including, but not limited to, the 1964 Civil Rights Act and all amendments thereto, the Foreign Investment in Real Property Tax Act, the Comprehensive Environment Response Compensation and Liability Act, and The Americans with Disabilities Act.

Summary:

The Purchasing and Facilities departments jointly have determined that the County should rebid the janitorial services contract. The current vendor completing this work, Perfect Cleaning, has agreed to terminate their existing contact with the County. This resolution authorizes the termination of this contract. The contract will terminate on a Sunday, anticipated to be September 25, 2011.

The janitorial work was rebid. The Facilities Department determined the best method to meet the janitorial needs at our facilities is to split the janitorial work between two vendors. The reason for splitting this work is in the event of a problem with one of the vendors, the other vendor could readily take over that work with minimal delays and minimal disruptions.

The first janitorial contract is for the Judicial Center which consists of the Judicial Center, Sheriffs Department, and the Juvenile Justice Center. The lowest responsive bidder is GSF USA, Inc from Buffalo Grove, at an annual fee of $170,784.00. This resolution authorizes the Chairman to enter into a janitorial contract with GSF USA for two years with an optional annual extension as mutually agreed to.

The second contract is for the Government Center, 3 rd Street Courthouse, 6th St. Center, Public Defenders Annex, Child Advocacy Center, Diagnostic Center, Circuit Clerk North Campus, Aurora Heath Department, Elgin Health Department, Elgin and Aurora Court Services, and Division of Transportation. The lowest responsive bidder is Peterson Cleaning from Rockford at an annual fee of $192,348. This resolution authorizes the Chairman to enter into a contract with Peterson Cleaning, Inc for two years with an optional annual extension as mutually agreed to.

Rebidding and re-awarding this work realizes a savings of $11,448 per year.

WHEREAS, the bid specifications call for the successful bidders to begin janitorial services starting on the date of transition as determined by the Purchasing and Facilities Management Departments, each contract being a two-year contract with and three annual one year extensions as mutually agreed upon; and

WHEREAS adequate funds have been budgeted and exist to cover allexpenditures defined in this resolution.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board, that the Chairman of the Kane County Board is hereby authorized to terminate the Janitorial Services agreement with Perfect Cleaning effective on an agreed upon transition date.

BE IT FURTHER RESOLVED by the Kane County Board, that the Chairman of the Kane County Board to enter into a contract with GSF USA, INC, to provide janitorial services for the Judicial Center complex which includes the Judicial Center, Sheriff's Department, and Juvenile Justice Center at an annual cost of One Hundred and Seventy Thousand, Seven Hundred, Eighty Four Dollars ($170,784.00) peryear. Said contract shall be for a two-year term with three additional extension years as approved by the Kane County Board. St. Peter's Evangelical Lutheran Church is being recommended for landmark designation based on its architectural significance as a Romanesque form church with Craftsman style detailing and for its historic significance in the development and history of the Village of Pingree Grove and Kane County.

WHEREAS, the people of the County of Kane take great pride in the historic buildings, structures, sites, and landscapes of the County that exemplify the heritage or culture of the County of Kane, State of Illinois; and

WHEREAS, the County of Kane has conducted a comprehensive survey identifying certain buildings, structures, areas, sites, and landscapes that are of historic, architectural, cultural, archaeological, educational, or scenic significance; and

WHEREAS, the County of Kane is empowered pursuant to 55 ILCS 5/5 - 30001 (1992), to establish and appoint by ordinance a preservation commission and to designate by ordinance landmarks and preservation districts upon the recommendation of the preservation commission; and

WHEREAS, the Kane County Board adopted the Kane County Historic Preservation Ordinance establishing said Commission on June 14, 1988 as Ordinance 88-99; and

WHEREAS, the Kane County Historic Preservation Commission has recommended that the St. Peter's Evangelical Lutheran Church located at 14N205 Reinking Road (PIN 02-33-477-004) in Rutland Township be designated a Kane County Historic Landmark for its architectural significance as a Romanesque form church with Craftsman style detailing and for its historic significance as having character and value in the development and cultural character of Pingree Grove and Kane County.

On August 8, 2011, the Purchasing Department opened bids for the Plank Road Estates Cost-Share Drainage Project. Ten bids were received. The bids ranged from the low bid from J&L Excavating, Inc. of $91,542.50 to the high bid of $221000.00. A tabulation of bids is attached.

We have reviewed the bids and recommend awarding the contract to J&L Excavating, Inc. of Maple Park, IL in the amount of $91,542.50.

We have reviewed the references for J&L Excavating, Inc. and received a very positive response regarding the quality of work they have performed.

The Plank Road Estates Cost-Share Drainage Project was previously authorized by the Development Committee. The bids received were below the engineer's estimate. The cost of construction will be funded by Kane County Cost-Share, Plato Township Road District and an SSA that was approved at the July 12, 2011 County Board meeting. The work will begin immediately upon approval by the County Board in September.

The Finance Department with the assistance of the Purchasing Department solicited Request for Proposals to retain the services of a financial advisor familiar with Illinois municipal finances. The financial advisor will perform a variety of tasks, including but not limited to, analyzing financial needs of Kane County, constructing bond issues, assisting in selection of an underwriter or organizing a competitive sale, dealing with the rating agencies, and advising on potentially new revenue sources and continuing compliance findings.

After reviewing four responses and based on the firm's qualifications, approach and offer per scope of services, staff interviewed the top two firms. Staff recommends awarding this contract to Speer Financial, Inc., of Chicago, IL.

Speer Financial, Inc., fee for bond sales is payable from bond proceeds. The fee is based upon the par amount of bonds issued and is calculated as follows: $25,000.00 plus 1/10 of 1% of bonds issued in excess of $25,000,000 with a fee cap of $50,000.00 per sale. (This fee structure is lower than the previous contract which was 1/4 of 1% of bonds issued.) None related capital borrowing tasks will be done on a hourly basis.

The County Clerk applied for and received a HAVA Acceptance Agreement Grant for the establishment and maintenance of the Elections Department Pollbooks.

The criteria for the application was to improve, acquire, lease, modify, or replace voting systems and technology and methods for casting and counting votes to comply with requirements of Section 301 (a)(3) (accessibility), preventative maintenance or annu?l maintenance of voting equipment.

This Grant covered the transition from the traditional paper pollbooks to electronic pollbooks, and maintenance thereof, utilizing our laptop computers in the polling place which access our yoter registration system to verify the registration of an individual who presents him/herself at the polling place on election day.

Summary:

The Illinois Department of Commerce and Economic Opportunity has awarded Kane County $2,277,941 in federal disaster aid for five infrastructure projects that will help alleviate chronic flooding in Aurora Township and the Village of Big Rock. The funding awarded to Kane County will be matched with approximately $3 million from various state and local sources, including $106,107 from Kane County's Cost-Share Program.

The federal funding is part of the Illinois "Ike" Disaster Recovery Program, which was established after the remnants of Hurricane Ike swept through the state in September 2008. The storm dumped between eight and 10 inches of rain on Kane County, causing then-President George Bush to declare Kane and 40 other northeast Illinois counties a federal disaster area.

A portion of the "Ike" funding will be received and expended during County Fiscal Year 2011, and the attached resolution amends the County's budget to reflect the revenue and expenses expected during the remaining months of the fiscal year.

No new personnel shall be hired unless specifically approved by the County Board"; and

WHEREAS, from May 1st to August 4, 2009, the Department of Building Management has reduced it's total headcount from 31 to 27, and requires to hire an Administrative Officer to fill a position which was vacated in August, 2011 to meet the requirements of this department; and

WHEREAS, the filling of this position has been included in the FYI I budget; and

WHEREAS, as required by Resolution 08-278, the hiring of said lead Administrative Officer has been approved by the Administration and Finance Committees; and

WHEREAS, the passage of this resolution does not require a budget amendment for fiscal year 2011.

SPECIALTY COURT FEES

WHEREAS, 55 ILCS 5/5-1101 (d-5) authorizes a county board to establish a $10.00 fee to be paid by the defendant upon a judgment of guilty or grant of court supervision pursuant to Section 5-9-1 of the Unified Code of Corrections, and directs such fee to be deposited in the county general fund and used to finance county mental health courts, drug courts, veterans and servicemembers courts, or any or all of the above (herein, "Specialty Court Fee"); and

WHEREAS, pursuant to 55 ILCS 5/5-1101(d-5), the Kane County Board previously adopted Resolution No. 06-10 providing for Kane County Mental Health Court fees to be paid by a defendant on a judgment of guilty or a grant of supervision under Section 5-9-1 of the United Code of Corrections, and now, due to statutory revisions to 55 ILCS 5/5-1101(d-5) which expand the types of specialty courts which may be financed by said fee, such resolution requires amending and updating; and

WHEREAS, Section 5-9-1 of the Unified Code of Corrections applies to all felony, misdemeanor, driving under the influence, traffic, local ordinance, county ordinance, petty offense, business offense, and conservation violations that require or result in a court appearance.

NOW, THEREFORE, BE IT RESOLVED that the Kane County Board hereby amends Resolution No. 06-10, effective October 1, 2011, to incorporate the amended language of 55 ILCS 5/5-1101 (d-5) and to authorize the assessment of a Specialty Court Fee of $10.00 on all appropriate cases, including all felony, misdemeanor, driving under the influence, traffic, local ordinance, county ordinance, petty offense, business offense and conservation violation cases. The Kane County Board requests that the Chief Judge issue a General Order assessing the Specialty Court Fee on all such applicable cases and hereby authorizes and directs the Clerk of the Circuit Court, beginning Oôtober 1, 2011, to c011ect said SpeiaIty Court Fee of

WHEREAS, 705 ILCS 105/27.2 sets forth minimum and maximum fee ranges for certain fees of the Clerk of the Circuit Court in a County in excess of 500,000 inhabitants but less than 3,000,000 inhabitants; and

WHEREAS, 705 ILCS 105/27.2 authorizes the County Board to pass a resolution establishing such fees within the minimum and maximum range; and

WHEREAS, the Kane County Board seeks to establish certain fees of the Clerk of the Circuit Court from the minimum levels established as a default by 705 ILCS 105/27.2.

NOW, THEREFORE, BE IT RESOLVED that effective December 3, 2012, certain fees of the Clerk of the Circuit Court shall be amended, and the Clerk of the Circuit Court shall collect all fees as set forth herein and as authorized by 705 ILCS 105/27.2 and shall remit said fees to the Kane County Treasurer for deposit into the County General Fund, and for accounting and record-keeping of such amounts, into Revenue Line item titled "Circuit Clerk Additional Fees."

WHEREAS, 705 ILCS 105127.3a and 705 ILCS 105127.3c permit a county board to establish fees of up to $15.00 for automated record keeping and up to $15.00 for maintaining a document storage system, to be collected by the clerk of the circuit court; and

WHEREAS, pursuant to 705 ILCS 105/27.3a and 705 ILCS 105/27.3c, the Kane County Board previously adopted Resolution No. 07-31 establishing the following fees: (1.) automated record keeping fee and the document storage system fee of $15.00 each, respectively, for any pleading, paper or other appearance filed by any party in all civil cases or by the defendant in any felony, misdemeanor, traffic, ordinance violation or conservation case upon a judgment of guilty or a grant of supervision, and (2.) automated record keeping fee and a document storage system fee of $5.00 each, respectively, for any traffic, ordinance violation, or conservation case satisfied without a court appearance; and

WHEREAS, the Kane County Board seeks to equalize the fees that are charged for automated record keeping and the document storage system for all cases.

NOW, THEREFORE, BE IT RESOLVED that the Kane County Board hereby amends Resolution No. 07-31, effective October 1, 2011, to establish a uniform fee of $15.00 for automated record keeping for all cases pursuant to 705 ILCS 105/27.3a, and hereby directs the Clerk of the Circuit Court of the Sixteenth Judicial Circuit for the County of Kane, beginning October 1, 2011, to charge and collect ,a court automation fee of $1500 to be paid at the time of filing the first pleading, paper or other appearance filed by each party in all civil cases or by the defendant in any felony, traffic, misdemeanor, municipal ordinance, or conservation case upon a judgment of guilty or a grant of supervision, as provided in said statute; and such fees collected shall be deposited and distributed according to 705 ILCS 105/27.3a; and that the record keeping system which processes the case categories set forth herein have been approved for automation.

KANE COUNTY TASK FORCE ON DRINKING AND DRWING

ARTICLE I

Purpose and Authority

Section 1: Name

The name of this body shall be known as the Kane County Task Force on Drinking and Driving,

referred to in these Bylaws as the DUI Task Force.

Section 2: Purpose of this Organization

The DUI Task Force is a local anti-crime program created by the Kane County Board pursuant to

Resolution number 11-XXX. The purposes of this organization shall be:

To enhance public safety by aiding law enforcement agencies in the apprehension of drivers impaired by alcohol andlor other drugs, thereby reducing the threat of DUI related traffic crashes,

fatalities, and injuries posed by impaired drivers within Kane County.

To provide funding for appropriate projects to curb drunken driving that meet the statutory

requirements under 730 ILCS 515-6-3.1(c)(13).

Its primary goals include: encouraging the public to report incidences of DUI violations to law enforcement agencies, assisting such agencies in the apprehension of impaired drivers, and providing a forum for the exchange of information and ideas between law enforcement and other agencies relating to combating the problem of impaired driving in Kane County.

Section 3: Administration

The DUI Task Force program is facilitated by, and receives administrative support from, the Kane County State's Attorney with a mailing address of 37W777 Route 38 Suite 300, St. Charles, IL. 60175.

Section 4 Authority

The DUI Task Force was established in 1982 by County Board resolution 82-122 with a goal of "an identifiable reduction in the DUI related death and injury losses" within the County. In 1983 by Resolution 83-123, the Kane County Board approved the continuance of the Kane County Task Force on Drinking and Driving. In 2011 by Resolution 11-### The Kane County Board approved the continuance of the DUI Task Force in a restructured form.

Funding for the task force comes primarily from fines levied against DUI offenders sentenced to court supervision pursuant to 730 ILCS 5/5-6-3.1, which authorizes such fines to be contributed to a "local anti-crime program," as defined in Section 7 of the Anti-Crime Advisory Council Act.

The Kane County State's Attorney's Office is the lead agency for the DUI Task Force and oversees the implementation of the recommendations proposed by the DUI Task Force. The DUI Task Force has no authority in any other department of County or State government.

ARTICLE II

Membership

Section 1 The DUI Task Force will be composed of not more than 13 voting members and 5 non-

voting members.

A. Voting Members

The Chairman of the County Board, with the advice and consent of the County Board, will appoint

the initial members of the DUI Task Force. Those members will serve until 2013. Beginning in September 2011 at the September 2011 meeting or as soon as possible thereafter, and starting at the February 2013 meeting, and at the February meeting every two years thereafter, the executive

committee of the DUI Task Force will prepare a list of voting and non-voting members which the Task Force will submit as recommendation to the County Board Chairman for appointment to the

Task Force for the following two year term.

Every two years, the Chairman of the Kane County Board, with the advice and consent of the County Board shall appoint not more than 13 voting members to serve for two years.

At least 7 of the Task Force voting members will be Chiefs of Police or other senior members of law enforcement agencies in Kane County. The Kane County Chiefs of Police Association will recommend to the Executive Committee seven such candidates. Candidates should be drawn from police departments distributed evenly from the different geographic regions of the county. (An

equal number of police chiefs should be drawn from the north, central, and southern regions of the county, if feasible.) Any such member, who ceases to serve in the capacity of police chief or senior member of his or her police agency, while a member of the Task Force, will be replaced on the Task

Force by a senior member of the same police agency for the duration of the two year term.

No more than two of the Task Force voting members will be DUI treatment providers.

To fill the remaining voting members, the State's Attorney will recommend the initial members. Thereafter, the Task Force executive committee shall recommend individuals with diverse backgrounds. The executive committee should consider for recommendation, members of the public, county board members, DUI treatment providers, the Kane County Coroner or his or her

deputies, members of DUI awareness agencies, or other persons with relevant experience or interest in aiding law enforcement in combating the problem of drunken driving in Kane County.

B. Non-voting members

Five non-voting members shall be selected by the Kane County State's Attorney to serve for two year terms. The non-voting members shall be selected from the following offices: the Kane County

State's Attorney's Office, the Office of the Circuit Clerk, the Regional Office of Education, the Kane

County Health Department, and Court Services.

Non-voting members shall not have the right to hold office or vote.

The Task Force will publish annually a list of all voting members and non-voting members.

Section 2: Membership application

Applications for membership in the DUI Task Force shall be submitted to the Secretary of the Task Force on the prescribed form. All applications presented shall be announced by the Secretary

and then tabled until the next regular meeting of the Task Force. A recommendation for approval of membership in the Task Force shall be by majority vote of the active voting members present which will be submitted to the county board chairman. The county board chairman shall appoint not more than 13 voting members from a list of recommended candidates as provided in Part B, Section 2.

Section 3 Member Replacement/Dismissal

A member may voluntarily leave the membership in good standing. A member may resign by written notice to the Chairman.

Any member may be dismissed from the DUI Task Force by an affirmative vote of two-thirds of the

entire voting membership.

When a member resigns or is dismissed, the Chairman of the County Board shall appoint a replacement to serve the remainder of the member's term. The Executive committee shall

recommend the name of a replacement to the County Board Chairman.

ARTICLE III

Officers and Election

Section 1: The officers of the DUI Task Force shall consist of a Chairman, a Vice Chairman, a

Secretary, and a Treasurer. Elected officers must be voting members. Any officer who loses his or her status as an active member while in office will become ineligible to hold that office.

Section 2: The officers shall be nominated and elected by a majority of all the current voting

members of this Task Force at the regular meeting held each March. They shall assume office at the April meeting and shall hold office for a term of one year or until their duly elected successors

have been qualified.

Section 3 The election of officers shall be by written secret ballot, except where there is only one nominee for an office, in which case, on proper motion made, an officer may be elected by acclamation. The candidate for any office receiving the highest number of valid votes shall be

declared elected.

ARTICLE W

Duties of Officers

Section 1: Chairman

It shall be the duty of the Chairman to ensure that the DUI Task Force carries out its role as described in Article II, Section 1 - Purpose of the Kane County Task Force on Drinking and Driving. It shall be the duty of the Chairman to develop an appropriate agenda and preside at meetings. In conducting the meetings, he or she shall be governed in all decisions by "Robert Rules of Order." The Chairman shall appoint any and all committees which the business of this Task Force may require. Committee members shall serve during the term of the officer appointing them. The Chairman shall also fill any vacancy occurring in the ranks of the officers by appointment until such vacancy is filled by election. The Chairman shall establish applicable

operating procedures to ensure the following:

Public notification of committee activities, Public meetings to discuss activities and events that promote Alcohol and Drug awareness, and that would enhance the mission of the DUT Task Force, Acknowledgment of public comments, Response to public comments.

Section 2: Vice-Chairman

It shall be the duty of the Vice Chairman to assist the Chairman in performing his or her duties and, in the absence of the Chairman, to assume and perform the duties of the Chairman.

Section 3: Secretary

The Secretary shall record the minutes and proceedings of all meetings held by the DUI Task

Force. He or she shall have charge of such correspondence as the Chairman shall direct, or the business of the DUI Task Force may require, and shall accurately maintain all DUI Task Force records and correspondence. The Secretary shall have charge of all membership matters and shall

serve as the Press Release Officer for the DUI Task Force. He or she shall perform such other duties as directed by the Chairman. No later than 30 days after each meeting, the Secretary shall publish on the Kane County website the minutes approved at the meeting and all public

documents presented at the meeting.

Section 4: Treasurer

The Treasurer shall collect and keep an accurate record of all financial transactions. He or she shall arrange with the Kane County Treasurer to disburse and give receipts for all monies

handled. The Treasurer shall perform such other duties as directed by the Chairman. No later

than January 31st of each year, the Treasurer shall cause to be prepared a complete accounting of

all funds collected and disbursed during the previous calendar year.

Section 5: Salaries

Service as a Task Force member is voluntary and no salaries, stipend or other compensation shall be authorized except as reimbursement for expenses incurred as a result of board activity and said reimbursement shall only be for expenses not covered by the member's employer or other source of funds. No double reimbursement is allowed.

Section 6: Disposition of Funds

(a) All approved expenditures shall be documented on an accounts payable approval form which will be signed by two officers, the Task Force Treasurer and the Chairman, or in the Chairman's absence, by the Vice Chairman. The accounts payable approval form will then be submitted to the Kane County State's Attorney's Office to be processed for payment via

the Kane County accounts payable process, with final approval given by the Kane County Auditor.

Funds will be in the form of grants and not subject to repayment. Funds will be disbursed only to organizations that have completed a grant application approved by the DT.JI Task Force. To be eligible for a contribution of any funds generated by 730 ILCS 5/5-6-3. 1(c)(13), or by any similar provision of the law, applicants must provide written documentation specifying how they will use the funds to either encourage the public to reporting DUI offenses to the police, or to assist the police in the apprehension of intoxicated drivers. The written documentation shall be distributed to the each of the voting members prior to any vote on the grant application. In reviewing the grant application, the voting members should take into consideration not only the current grant request, but also any history of performance with regard to good usage of DUI Task Force Funds.

Every grantee shall be required by the next calendar year to report on how the grant funds were spent and give a report to the DUI Task Force on how the received funds were utilized in accordance with 730 ILCS 5/5-6-3.1(c)(13).

Funds expended must be approved by a majority vote of the DUI Task Force members present at a regularly scheduled meeting at which a quorum is present.

Section 7 Sub-Committee Chairperson

As Sub-committees are formed for the good of the DUI Task Force, the Chairman shall appoint a

Süb-cômmittee Chairperson. The Sub-committëé Chairperson serves at the pleasure of the

Chairman. As such, the Sub-committee Chairperson may be removed from such a position at the

discretion of the Chairman.

Section 8: DUI Task Force Executive Board

The Chairman of the DUI Task Force may conduct business at times other than regularly

scheduled meetings. On such occasions, business may be conducted by convening the DUI Task Force Executive Board. The Executive Board shall consist of the Chairman, Vice Chairman, Secretary, and all Sub-committee Chairpersons. Any such meeting shall only be called to conduct emergency business or business of a time sensitive nature. A full written report of any such meetings and decisions made, or actions taken, must be disclosed to all members at the next regular meeting of the DUI Task Force. A majority vote of the Executive Board members is required for any Executive Board decision. The Executive Board is not authorized to approve the

expenditure of funds.

ARTICLE VII

Meetings

Section 1: Meeting Schedule

Regularly scheduled meetings of the DVI Task Force will be held no less frequently than every other month on the second Tuesday of each month or any other date as designated by the

Chairman supported by a majority vote of the voting membership.

Any change to a meeting date, time, location or cancellation and rescheduling of a DVI Task Force

meeting may occur if approved by the Chairman and the Vice Chairman.

Any changes must be communicated to all members of the DVI Task Force giving members

adequate time for such schedule changes.

Section 2: Special Meetings

Special meetings may be called by the Chairman or by majority vote of the membership assembled

at a regular meeting.

Section 3: Rules of Order

The rules contained in the current edlition of "Robert's Rules of Order, newly revised" shall govern

the DVI Task Force in all cases to which they are applicable and in which they are not inconsistent with the by-laws and any special rules of order the Task Force may adopt.

Section 4: Sub-committee Meetings

The Chairman has the authority to appoint sub-committees.

Section 5: Quorums

A quorum shall be required any time official voting action takes place at any regularly scheduled DVI Task Force meeting. A quorum shall be defined as no less than one half of the total voting members of the DVI Task Force. The Vice-Chairman shall be responsible for determining if a

quorum is present for any regularly scheduled meeting.

VI. Sub-committees

Section 1: Standing Sub-committees

The audit/finance sub-committee shall be the Standing Sub-committee of the DUI Task

Force. The sub-committee has the responsibilities of ensuring that all Task Force Funds are disbursed in a manner consistent with these bylaws and that all funds are

appropriately accounted for.

Section 2: Special Sub-committees

Special sub-committees may be established by the DUI Task Force Chairman for the purpose of

satisfying a need. Such sub-committees shall have a sub-committee Chairperson appointed by the DUI Task Force Chairman and the sub-committee will serve until its mission is completed. Upon

conclusion of its mission, the sub committee and its Chairperson will be considered dissolved

Amendments

Section 1: The bylaws, or any section or provision thereof, may be amended, rescinded or enlarged by referral to a committee and subsequent approval by 2/3 vote of the membership assembled at a regular meeting at which a quorum is present. Summary:

From 2006 thru December, 2010 the Health Department occupied 10,000 square feet of office space at 113 S. Grove in Elgin. With the reduction in work force in fall 2010 and the ending of the lease for this location, an assessment was completed to determine the appropriate number of square feet of office space needed. Working with a realtor from the Elgin area; 7 properties in Kane County in the City of Elgin were investigated ranging from $10 - $15 square foot. It was determined that the Health Department could operate efficiently in less than two thousand five hundred square feet of office space.

An office space of 2250 square feet located at 1750 Grandstand Place, Elgin, IL was determined to be a desirable office location that would provide convenient access for the community. To continue to keep the cost to a minimum, the Health Department was able to negotiate with Burnidge Properties Ltd. a lease agreement that offers office space for less than $10 a square foot, if Kane County agrees to lease the property for a minimum of 3years.

Therefore the Health Department is requesting the authorization to enter into a 3 year agreement with Burndige Properties Ltd. To keep cost at a minimum and provide office space in Elgin to continue to provide Public Health services to the community in Northern Kane County.

WHEREAS, the Kane County Health Department determined that it was necessary and desirable to reduce the office space leased for operations in Elgin from 10,000 square feet to 2,250 square feet, and, hence, moved from 113 S. Grove, to the current location of 1750 Grandstand, Suites 2 and executed a 1 year agreement for this space with an option for three additional years; and

WHEREAS, by entering into this extended agreement the costs to lease 2,250 square feet of office space will be reduced from $12 to $8.15 per square foot, with an annual 3% increases; and

WHEREAS, the Health Department's experience in utilizing this space to date has been very satisfactory in every respect.

Summary:

The Kane County Health Department is responsible for providing the essential services of public health to the residents in Kane County. Public Health Nurses play a critical role in providing the essential services. Substantiation of successful outcome of their role in the community has been supported by the various evidence based programs administered and monitored by their efforts.

Kane County Health Department has an opportunity to increase the public health nursing staff in Kane County by being offered two (2) grants that would fund two public health nursing positions. The grant funding for the positions would be acquired through two grants, one from the Illinois State Board of Education and the Department of Human Services Evidence Based Home Visiting Program. This additional funding would increase the Health Department head count from sixty (60) full time equivalent positions to sixty two (62) full time equivalent positions.

The Health Department is requesting to be authorized to: (1) to increase the departments head count by two full time equivalent public health nurse positions and (2) to hire two full time public health nurses based on the funding from two separate grants mentioned above. The two nurses that are currently on our recall list from last fall's layoff would be offered these positions first, as per our contract with AFSCME. If this grant funding is discontinued, the positions would be eliminated.

WHEREAS, on September 9, 2008 the Kane County Board had deemed it necessary to adopt by Resolution a moratorium on the hiring of new County personnel and the replacement of existing or future personnel vacancies; and

Whereas, Kane County Board Resolution 10-216 states "...that the Kane County Health Department is authorized to employ up to sixty (60) full-time equivalent employees in such jobs and organized in such a manner that is determined by the Department's Executive Director in consultation with the Chairman of the Kane County Board and Kane County Board"; and

WHEREAS, the Kane County Health Department is responsible for providing the essential services of public health to Kane County residents; and

WHEREAS, the Department has received new grant funding to expand its nationally recognized Kane Kares public health nursing services; and

WHEREAS, grant funding provides resources to hire two additional non-exempt full time Public Health Nurse positions; and

WHEREAS, the two (2) non-exempt positions with a salary range of $38,220 through $43,680, would be included in the FY12 budget and therefore passage of this resolution does not require a budget amendment for fiscal year 2012; and

WHEREAS, the Executive Director of the Kane County Health Department is requesting the Kane County Board to allow an exception to the Kane County Board Resolution 10-216 to authorize the Health Department to employ more than sixty (60) full time employees as the grant funding requires two (2) public health nurses; and

WHEREAS, the Executive Director of the Kane County Health Department is requesting the Kane County Board to allow an exception to the hiring moratorium in order to fill these new positions.

The Community Health Specialist Ill: Community Health Initiatives Coordinator position is responsible for promoting individual and population health through health promotion and education initiatives and health behavior-change programs in a variety of settings for the diverse populations represented in Kane County. Responsibilities include developing, implementing, and evaluating programs and public health initiatives, establishing, leading and maintaining community partnerships, and managing work plans and timelines. With Kane County's population exceeding 500,000 according to the 2010 United States Census, the Kane County Clerk's office is directed by statute (55 ILCS 5/3-2007: Office Quarters and Hours) which states:

"(a) In counties of 500,000 population from 8 a.m. to 5 p.m. of each working day except Saturdays and legal holidays, but in such Counties the office shall remain open until noon the Saturday before general, primary or special election days. Provided, that the days on which such office shall be open and the hours of opening and closing of the office of the County Clerk may be changed and otherwise fixed and determined by the County Board of any County. The County Clerk recommends the County retaining the present operation hours of Monday, Tuesday, Thursday and Friday from 8:30 a.m. until 4:30 p.m. and Wednesday from 8:30 a.m. until 8:00 p.m. Additionally, the Clerk will continue to comply with the opening of the office from 9:00 a.m. until noon the Saturday before general, primary or special election days.

In particular, remaining open Wednesday evenings until 8:00 p.m. permits the Citizens of Kane County, particularly those who work traditional daytime hours, the chance to avail themselves of the extended hours to conduct business with the Clerk's office.

Summary:

In 2009, the Kane County Board passed Resolution 09-161 Authorizing Grant Agreements for 2009 for external projects. Grant 09-58 for $200,000 was included in those grant allocations to be used for miscellaneous emergency services with priority for north and central Kane County food pantries, crisis centers, and homeless programs that did not include administrative costs. The County Board, at that time, noted that the current economy has contributed greatly to the problems facing residents in the northern part of the County as well as the south.

Feeding Greater Elgin, a not-for-profit agency, was recently incorporated to meet this demand and will serve as a centralized resource for the coordinated collection and distribution of food to Elgin and South Elgin residents. It is a large-scale food pantry located in Elgin and will provide food assistance to low-income people who need emergency help. In 2011, FGE received a $50,000 capital grant for freezers, coolers, and equipment for the food pantry, and this request for $60,000 is to purchase food.

If granted, FGE will be required to meet the requirements of all other riverboat grantees in that they will be reimbursed for food purchases and will be required to provide periodic reports. This grant request meets riverboat guidelines and also meets the requirements established under Resolution 09-161.

Summary:

FY2012 Purchase of Ice Control Salt For the 2011-2012 winter season, the Division of Transportation will be using salt for ice and snow removal on the County Highway System. From past winters, staff estimates that we will use approximately 12,500 tons of salt. The Division used over 13,500 tons for the 2001 0-2011 season.

As in previous years, KDOT will purchase our salt from the State bid. This year the State bid came in at $52.93 per ton and the chemical application (enhanced) to the salt will be $15.00 per ton for a total of $67.93 per ton. The low bidder was Hutchinson Salt Company and the salt contract allows for a minimum purchase of 10,000 tons and a maximum purchase of 15,000 tons of salt.

The proposed FY2012 Budget for salt is $1,065,625.00 based upon previous year expenditures. Staff is proposing an initial appropriation of $1,018,950.00 which allows for the purchase of up to 15,000 tons of enhanced salt.

WHEREAS, bids have been solicited and received for the annual supply of ice control salt for the Maintenance Department of the Kane County Division of Transportation through the Joint Purchasing Program for the State of Illinois; and

WHEREAS, it is estimated that the Kane County Division of Transportation (KDOT) will use approximately twelve thousand five hundred (12,500) tons of ice control salt for the 2011-2012 winter season and the contract allows for the purchase of up to fifteen thousand (15,000) tons; and

WHEREAS, KDOT utilizes a pre-mixed deicing rock salt (ice control salt) for winter roadway maintenance, which necessitates a chemical application to the ice control salt; and

WHEREAS, the State of Illinois Bulk Rock Salt Contract for 2011-2012 winter season will be effective July 1, 2011 at a cost of $52.93 a ton with an additional $15.00 per ton for the chemical application to the ice control salt.

NOW, THEREFORE, BE IT RESOLVED that the Kane County Board authorizes the purchase of said ice control salt through the State of Illinois Procurement Contract from Hutchinson Salt Company, Inc. of Baxter Springs, KS in the amount of Fifty Two and 93/100 Dollars ($52.93) per ton plus Fifteen Dollars ($15.00) per ton for the chemical application to the ice control salt for a total price of Sixty Seven and 93/1 00 Dollars ($67.93) per ton be accepted.

This location has been working out very well for Kane County. The City of Elgin has concurred with extending the use of the facility for three years and is proceeding forward to approve the attached agreement. The use of this facility provides for both increased highway safety during snow events and economic savings for Kane County. As part of the agreement, KDOT will continue to provide snow removal on Elgin's part of Highland Avenue between Coombs Road and Damisch Road. KDOT currently has jurisdiction of Highland Avenue between Randall Road and Coombs Road.

WHEREAS, at the request of the Village, the Village and the County again wish to amend the terms of the Intergovernmental Agreement (Second Amended Intergovernmental Agreement) (a copy of which is on file with the County Clerk's Office) to allow for the permitting of a full access located approximately 2400 feet north of Oak Street subject to the agreement and County permitting regulations; and

WHEREAS, the Second Amended Intergovernmental Agreement will facilitate the safe and efficient movement of traffic and shall provide for the safety of the motoring public.

A bid opening was held on August 11, 2011 at the Division of Transportation office for the Virgil Township Road District Resurfacing Program. This bid award requires the rescinding of County Board Resolution No. 11-191 as the State of Illinois has prohibited the awarding of any state Motor Fuel Tax contracts to Road Oil Inc. and the Township Highway Commissioner has withdrawn the contract for the initial project scope.

The contract includes pulverizing and applying a bituminous binder course of approximately 1.33 miles of Winters Road in the Township. This road will be pulverized, shaped, and have a binder course applied, which will improve the ride quality of the roads and extend the service life.

The construction is funded with MFT funds.

WHEREAS, the lowest responsible bidder for the Project is:

Summary:

Renewal of contract with AFSCME Council 31 for the Kane County Department of Employment & Education. KCDEE provides training and job search assistance to area residents and is 100% federally funded under the Workforce Investment Act.

Historically, KCDEE contracts have been re-negotiated each year because of the cyclical nature of federal funding for workforce services. Some years the funding is up, some years it's down. Excluding the stimulus funds, federal funding for workforce services has been trending downward.

This contract is for Program Year 2010 (July 1, 2010 - June 30, 2011) and covers a total of 18 employees in various Employment & Training Representative positions. Two components of the contract include an increase in the number of sick/personal days from 4 to 5 and a one-time 1-1/2% lump sum ratification payment that is not added to base wages.

COLLECTIVE BARGAINING AGREEMENT BETWEEN THE COUNTY OF KANE AND THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES,

COUNCIL 31, LOCAL 3966 FOR THE KANE COUNTY DEPARTMENT OF EDUCATION AND EMPLOYMENT

WHEREAS, the American Federation of State, County and Municipal Employees, Council 31, Local 3966, is the exclusive representative of the Kane County Department of Education and Employment employees within the meaning of the Illinois Public Labor Relations Act and having been certified as such by the Illinois State Labor Relations Board; and

WHEREAS, the current agreement between the parties expired on June 30, 2010. The County of Kane and the American Federation of State, County and Municipal Employees, Council 31, Local 3966, have engaged in effective and meaningful negotiations concerning wages, hours and other terms and conditions of employment relative to the employees of Kane County Department of Education and Employment and have reached a tentative agreement; and

WHEREAS, the staff representative for American Federation of State, County and Municipal Employees, Council 31, Local 3966, has represented to the County of Kane negotiators that the employees of Kane County Department of Education and Employment have ratified the tentative agreement.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof is hereby authorized and directed to enter into a Collective Bargaining Agreement on behalf of the County of Kane, a copy of said Collective Bargaining Agreement shall be kept on file at the Office of the County Clerk, the County Auditor and the County Board Office.

The agreement shall have an effective date of July 1, 2010, and shall terminate on June 30, 2011.
