GENERAL INFORMATION

1. Definitions

A. Admitted to hospital –means a person being transferred from an emergency room to a ward for further treatment or to an operating room for treatment.

B. Hazardous Material –means those substances which create a risk of death or injury to living things, or destruction or damage to property if uncontrolled ignition or exposure occurs during transportation, handling or storage.

C. Serious Injury –means any injury/trauma which is potentially life threatening.

D. Service Vehicle-means for this topic, a vehicle used by the Winnipeg Police Service, including any private vehicle authorized for use by the Service.

2. Dispatch Criteria

A. Major Collision

1) The Winnipeg Police Service shall respond to Calls for Service regarding major traffic collisions where:

a) Fatalities are involved.

b) Serious injuries are involved.

c) Hazardous material is present.

d) Emergency vehicle is involved.

e) Criminal offence has occurred.

f) Hazardous traffic situation has been created.

B. Minor Collision

1) The Winnipeg Police Service may respond to Calls for Service regarding other traffic collisions where:

a) City of Winnipeg property is destroyed or damaged.

b) City of Winnipeg emergency vehicle is involved.

c) There is a disturbance.

d) Hit and run has just occurred.

A. Motor Vehicle Collision Reports are notaccepted from Manitoba drivers involved in any collision outside of Manitoba.

1) Those collisions must be reported to law enforcement within the jurisdiction of occurrence.

B. The Highway Traffic Act stipulates that a driver must report all collisions where a person:

1)Is seriously injured and admitted to hospital

2)Is fatally injured.

3)Is an unlicensed driver.

4)Is operating an unregistered vehicle.

5)Is operating an unidentified vehicle (i.e. hit and run)

6) Has failed to obtain/exchange particulars from/with the other party.

7) Has consumed alcohol or another intoxicating substance and is suspected to have caused or contributed to the collision.

D. The WPS will accept reports of collisions even if the reporting person does not have the other involved person’s particulars.

4. Reporting Hit & Run Collisions [CALEA 61.2.1 (c)]

A. Complainants may report Hit and Run Collisions as follows:

1) No Suspect Information With Damage Under $1,000:

a) In person at any Police Service Centre, with the vehicle, if drivable.

2) No Suspect Information With Damage Over $1,000:

a) In person to any Police Service Centre with the vehicle, if drivable.

3) Known Suspect Information Regardless of Damage amount:

a) In person to any Police Service Centre with the vehicle, if drivable.

5. Statement of Involved Persons

A. Statements play a significant role in the investigation of any collision but are particularly important in situations where there is a fatality, serious injury or the likelihood serious charges may be the outcome.

B. Every attempt should be made to obtain statements from all involved persons.

6. Assistance of Outside Agencies for Traffic Collision Investigations

A. The Service may approve the use of outside resources to provide technical/specialty assistance. Examples are:

1) City of Winnipeg Traffic Engineers.

2) City of Winnipeg Signals.

3) Manitoba Hydro.

4) Railway Police.

7. Traffic Collision Investigation Section –Responsibilities

A. The TCI Section will be responsible for investigating all:

1) Fatal and serious injury collisions.

2) Hit and run collisions as directed by the Supervisor, TCI section.

3) Fatality/serious injury events involving railway units if requested to assist.

4) Any collision deemed appropriate by the Duty Officer or Staff Sergeant, Central Traffic Unit.

8. Collisions Involving Hazardous Materials [CALEA 61.2.1]

A. Many hazardous materials are manufactured, stored and transported within the City.

B. WPS members will be dispatched to collisions involving a vehicle transporting hazardous material by road or rail.

9. Collisions Involving Railway Units

A. Peace Officers are empowered by the HTA to investigate all collisions occurring on a highway. Railroad rights-of-way, including railway level crossings, are, by virtue of the Railway Act, federally controlled property and thus, all jurisdiction over such property lies exclusively within the he Federal Government.

B. WPS Members will be dispatched to investigate all collisions/fatalities involving railway units and motor vehicles/pedestrians occurring at level crossings or railroad rights-of-way within the boundaries of the City of Winnipeg.

C. There is no statutory requirement for the operator of a railway unit to remain at the scene of a collision or to make any statement to investigating members.

D. WPS members will be assisted by Railway Police, who will contact and arrange for interviews with railway employees.

GENERAL PROCEDURES

1. Member shall:

A. Collisions Involving Service Vehicles

1)If involved in a collision operating a Service Vehicle, contact the Communications Centre via radio or telephone to notify of the collision and request a Street Supervisor to attend.

2) Submit a completed Collision Review Board Report (P-335) to the Street Supervisor who attends the scene, prior to retiring from duty.

3)If required by the Highway Traffic Act, complete the Vehicle Collision Reports (MG-9956 & MG-13973) complete with a Driver Statement separate and apart from the Collision Review Board Report Narrative.

a) Submit a copy of the P-335 to their Supervisor.

2. Police Member shall: [CALEA 61.2.1; 61.2.2]

A. Traffic Collisions –Reporting

1) Statements

a) When investigating a motor vehicle collision and a charge may result, attempt to obtain a statement .

i) If obtaining a formal statement, process the person prior to taking any statement under the provisions of the HTA

2) When taking a report of a collision:

a) Complete all required Motor Vehicle Collision Reports [Motor Vehicle Collision Face Report (MG-

9956) &Motor Vehicle Collision Report (MG-13973)]

i) If completing the electronic MVC report while in a police facility, print a copy of the report and have the reporting person review and sign their statement.

Add “Signed by: name of person”to the signature portion of the electronic copy.

ii) If completing the MVC report while in the cruiser car, have the reporting person review the text for accuracy.

Add “Read by: name of person”to the signature portion of the electronic copy.

b) Ensure all applicable code boxes are completed.

c) Query the plates of the involved vehicles to determine if a report has already been created. If yes, either:

i) Add second vehicle and driver information to the report, or

ii) Link the reports.

d) Complete all appropriate RMS reports.

3) Examine the vehicle(s) involved and include observations in a Narrative Report.

4) If circumstances prevent a member from obtaining all necessary information at the scene of a collision, conduct a follow-up investigation and ensure the following:

a) All witnesses have been interviewed and statements recorded.

b) Obtain available medical information on all persons transported to hospital and include this in the narrative associated to the MVC Occurrence report which includes:

i) Nature of injuries.

ii) Attending physician.

iii) Condition of the person.

iv)If any persons were admitted to hospital.

c) Obtain the results of mechanical examinations.

d) All reports are completed and notifications made.

5) If the collision involves property owned by the City of Winnipeg, and the Vehicle Collision Reports are not required:

a) Generate a Niche report, using the person reporting as the complainant.

b) Enter the call type as "MVC".

c) Notify City Claims.

d) In the details section of the event include:

i) Brief details of the MVC.

ii) "Reported for City Claims only, no written MVC report".

iii) "City Claims notified per (record name of person notified)".

6) Forward the Vehicle Collision Reports (MG-9956/MG-13973) to Manitoba Public Insurance

a) Include the first page and either the signed 2nd page, if the report was taken in a police facility or the unsigned page if the report was taken electronically.

b) If there are witnesses to the collision, forward the MVC reports to the Central Traffic Unit in addition to Manitoba Public Insurance.

7) If a Provincial Offence Notice has been issued as a result of a collision, forward the PON to the Central Traffic Unit.

B. Traffic Collisions - Investigation [CALEA 61.2.2]

1) If dispatched to, come upon, or witness a traffic collision where the Traffic Collision Investigation Section is not required, be responsible for conducting the necessary investigation.

2) If a traffic violation has occurred:

a) Issue Provincial Offence Notice (PON) if appropriate.

b) Arrest the person if appropriate.

i) Include all Highway Traffic Act charges and any applicable Criminal Code charges in the Arrest Summary.

3) Seize exhibits .

4) Forward the completed Vehicle Collision Reports to the Central Traffic Unit.

C. Fatal / Serious Injury Traffic Collisions [CALEA 61.2.2 (a)]

1) Render first aid to the injured.

2) Request the Traffic Collision Investigation (TCI) Section to attend.

3) Request additional personnel and/or other essential services as required.

4) Utilize the necessary equipment to protect and secure the scene (flares, traffic cones or barricades) and preserve any evidence.

a) Turn off the vehicle and remove keys of involved vehicles.

i) Turn keys over to Supervisor, Traffic Collision Investigation Section.

b) Do not turn the vehicle on or move it in any way unless required to render first aid.

i) If the vehicle is turned on or moved, document the reason in a narrative report.

5) Assist ambulance/first responder personnel as required.

6) If death is obvious ensure the body is not disturbed.

7) If possible, outline the position of seriously injured/deceased persons before they are transported to hospital.

a) Ensure a member accompanies the victim(s) to hospital.

8) Direct and/or detour traffic as required.

9) If necessary, interview witnesses to determine the driver(s) of vehicle(s) involved.

a) Ensure drivers/passengers are isolated and placed in separate patrol units under constant supervision.

b) If TCI is attending do not interview the driver(s) unless directed by the Supervisor, TCI.

10)If the collision involves a hit and run, broadcast the following:

a) Description of the suspect vehicle.

b) Probable damage to the vehicle.

c) Description of the driver and occupants.

d) Direction of travel.

11) Obtain the names, addresses and telephone numbers of all witnesses.

a) If possible, obtain written statements from witnesses at the scene.

12)Assist TCI investigators as required.

13)Ensure a Niche report and officer’s notes are submitted prior to end of shift.

14)Perform other duties as assigned by the Street Supervisor or Supervisor, TCI.

D. Hit & Run Collisions –Reports [CALEA 61.2.2]

1) No Suspect Information

a) Generate a report.

b) Ensure all pertinent information is added to the report. Including but not limited to:

i) Names of driver and all passengers.

ii) Driver’s Licence information

iii) Vehicle description and registration.

c) Include a synopsis of the collision with the last line being, “Verbal report only.”

d) Advise the complainant that a written and signed Vehicle Collision Report may be required to be submitted should additional information come to light.

2) No Suspect Information With Damage Over $1,000:

a) Generate a report.

b) Ensure the names of all parties are added to the report.

c) Complete the Vehicle Collision Reports (MG-9956 & MG-13973).

d) Provide complainant with the Occurrence Number

3) With Suspect Information:

a) Generate a report.

b) Ensure the names of all parties are added to the report and complainant provided with an Occurrence Number.

c) Regardless of the amount of damage, complete the Vehicle Collision Reports (MG-9956 & MG-13973).

d) Seize any original note or evidence the complainant may have, mark for identification.

e) Obtain witness statements as required.

E. Hit & Run Collisions –Investigations [CALEA 61.2.2 (b)]

1) Examine the vehicle to see if the damage is consistent with complainant’s account of the incident.

2) Describe the damage on the Vehicle Collision Reports (MG-9956 & MG-13973).

a) Include photos, measurements and diagrams.

3) Seize evidence that might assist investigators.

4) If the incident has just occurred and was witnessed, notify the Communications Centre with a complete description of suspect vehicle and occupants.

5) Make every attempt to obtain a witness statement from any identified witnesses.

a) Clear, detailed statements may also be taken over the telephone.

6) Forward witness statements to Hit & Run Coordinator, Central Traffic Unit.

F. Collisions Involving Hazardous Materials [CALEA 61.2.2 (e)]

1) If dispatched to or arrive on the scene of a collision involving hazardous materials:

a) Exercise extreme caution.

b) Attempt to confirm whether any leakage or spillage has occurred.

c) Avoid inhalation or absorption by positioning all personnel and equipment upwind.

d) Attempt to locate and identify the Chemical Identification Placard (diamond shaped).

i) Obtain a full description of the placard (color, writing, symbols).

e) Relay all information to the Communications Centre and request WFPS - HAZMAT (Hazardous Materials) Unit to attend.

f) Follow procedures .

2) Provide crowd and traffic control duties.

3) Ensure a copy of all reports is sent to the Traffic Reader, Central Traffic Unit.

G. Private Property Collisions

1) Complete a narrative detailing the results of any investigation.

2) Not enforce traffic violations occurring on privately owned land, unless the violation is a Criminal Code offence.

I. Collisions Involving Railway Units

1) Follow procedures listed

J. Driver’s Licence Surcharge And Liability Information

1) Upon receipt of the Manitoba Public Insurance (MPI) letter:

a) Immediately forward a copy of the letter to the Revenue Accountant, Finance Division.

b) Pay any assessed fees by the due date.

c) Forward the original receipt for payment to the Revenue Accountant, Finance Division and provide any further information requested or received in a timely fashion.

3. Street Supervisor shall:

A. Fatal / Serious Injury Traffic Collisions

1) Update Communications Centre and manage scene pending arrival of Traffic Collision Investigation Section.

2) Request additional personnel as required. (eg. traffic and crowd control; search area for suspects; assist TCI Section)

3) Submit a narrative report prior to retiring from duty.

4. Staff Sergeant shall:

A. Hit & Run Collisions -Investigations

1) If incomplete Hit & Run Collision reports are returned from the Hit & Run Coordinator, Central Traffic Unit, re-assign back to original investigating member(s) for completion.

AUXILIARY FORCE CADET SECTION

1. Cadet shall:

A. Assisting On-Scene

1) Under direction of the police member in charge of the scene provide pedestrian and traffic control.

2)If happen upon a MVC during the course of their duties, determine if the MVC meets thedispatch criteria for a police unit to attend and if so request police assistance.

3)If the MVC does not meet the dispatch criteria, advise involved parties to report the collision to Police within 7 days where required.

B. Service Centre

1) Refer hit-and-run motor vehicle collision reports to the Service Centre police member.

2) When taking a report of a collision:

a) Complete all required Motor Vehicle Collision Reports [Motor Vehicle Collision Face Report (MG-9956)&Motor Vehicle Collision Report (MG-13973)]

i) If completing the MVC report while in a police facility, print a copy of the report and have the reporting person review and sign their statement.

CENTRAL TRAFFIC UNIT

1. Hit & Run Coordinator shall:

A. Hit & Run Collisions -Investigations

1) Review all Hit & Run Collision reports submitted to the Central Traffic Unit.

2) Process Hit & Run Collision reports according to established guidelines:

a) Data Entry.

b) Pre-screening.

c) Investigation.

3) Forward Hit & Run Collision reports requiring data entry and prescreening to Traffic Accident Coordinators.

4) Forward reports ready for investigation to the Supervisor, Traffic Collision Investigation Section for assignment.

5) Return all incomplete reports to the Staff Sergeant, district of occurrence for completion.

6) Receive completed Hit & Run investigations and prepare court packages as required.

7) Forward a copy of all Hit & Run Collision reports where charges have been laid to DVE for scanning into RMS.

2. Traffic Accident Coordinators shall:

A. Hit & Run Collisions - Investigations

1) Receive Hit & Run collision reports requiring data entry or prescreening from the Hit & Run Coordinator.

2) Ensure required information is entered on RMS and return those reports to the Hit & Run Coordinator for further processing.

3) Make appropriate inquiries on reports for prescreening.

4) Where vehicles are brought in by their owners for examination, request a Service Center Police Member examine the vehicle, complete the Vehicle Collision Reports (MG-9956 & MG-13973) and seize any evidence in accordance the procedure.

5) Complete witness statements as required.

6) Return updated reports to the Hit & Run Coordinator for processing.

3. Traffic Reader shall:

A. Vehicle Collision Reports

1) Review all Vehicle Collision Reports (MG-9956/MG-13973) for completeness.

2) Issue offence notice(s) if required.

B. Collisions Involving Hazardous Materials

1) Ensure copy of all reports are sent to Vehicle Inspection Section for information.

4. Shift Supervisor shall:

A. Hit & Run Collisions

1) Process all requests from Traffic Collision Investigators for photos of vehicles involved in hit and run collisions.

2) Ensure photos are supplied in a timely fashion.

COMMUNICATION CENTRE UNIT[CALEA 81.2.3 & 81.2.6]

1. Call Taker shall:

A. Traffic Collisions - General

1) If collision does not meet the Dispatch Criteria, instruct the involved parties to:

a) Remove vehicles so as not to obstruct traffic.

b) Exchange driver and vehicle information and / or property owner’s information.

c) Obtain any witness information.

d) Report the collision to their respective insurance companies if there is damage only.

e) Attend to any Police Service Centre to report the collision if:

i) They are aware that someone involved in the collision was injured and admitted to hospital.

ii) They are aware that someone involved in the collision has succumbed to injuries after being admitted to hospital.

iii) An unlicensed driver was driving one of the vehicles involved in the collision.

iv) An unregistered vehicle was involved in the collision.

v) An unidentified vehicle (i.e. hit and run) was involved in the collision.

vi) Someone failed to exchange particulars with the other party.

vii)The consumption of alcohol or another intoxicating substance is suspected and was a cause or contributing factor of the collision.

viii)The collision involves a domestic animal and the owner could not be located.

a) Ask the person to remove the animal from the roadway if it is safe to do so.

b)If the animal is still alive, refer the caller to the Humane Society.

i) If the Humane Society is unavailable notify:

311-Animal Services; or

Pembina Veterinary Hospital, after hours.

ii)If the animal is deceased, refer the caller to Works and Operations, Dead Animal Pickup, via 311.

2. Dispatcher: [CALEA 83.2.6]

A. Traffic Collisions -General

1) If the incident meets the major collision dispatch criteria, shall dispatch police units to the scene.

2) If the incident meets the minor collision dispatch criteria, may dispatch police units to the scene.

B. Fatal / Serious Injury Traffic Collisions

1) Dispatch available patrol units.

2) Dispatch a Street Supervisor, District of Occurrence.

3) Notify the Winnipeg Fire Paramedic Service (WFPS) dispatch.

4) Notify the Shift Supervisor, Central Traffic Unit, if on duty.

5) Notify the Duty Officer.

C. Collisions Involving Hazardous Materials

1) Notify Winnipeg Fire Paramedic Service dispatch.

2) Dispatch required police units to the scene.

D. Collisions Involving Service Vehicles

1) Dispatch a Street Supervisor, District of Occurrence.

2) If a Specialty Unit is involved, dispatch the Street Supervisor on duty, for that Unit if possible.

DIRECT VOICE ENTRY UNIT

1. Operator shall:

A. Traffic Collision Reports

1) Scan the following Traffic Collision Reports into RMS:

a) All fatal or serious collisions where Traffic Collision Investigation (TCI) members have investigated.

b) All Hit & Run collisions where charges have been laid.

DUTY OFFICER UNIT

1. Duty Officer shall:

A. Fatal / Serious Injury Traffic Collisions

1) In consultation with the Street Supervisor/Member in Charge at the scene and the on call Supervisor, Traffic Collision Investigation (TCI) Section:

a) Determine if the TCI Section is required and initiate the necessary call backs.

2) If an individual is transported to hospital with serious injuries, consult with the on call Supervisor, TCI Section:

a) Determine if the TCI Section is required and initiate the necessary call backs.

3) In consultation with the Supervisor, TCI Section, notify the Forensic Identification Unit to attend.

4) Arrange for dispatch of additional resources as required.

FORENSIC IDENTIFICATION SECTION

1. Forensic Identification Specialist shall:

A. Fatal / Serious Injury Traffic Collisions [CALEA 83.2.6]

1) Attend and conduct forensic examination in consultation with the Lead Investigator.

2) Ensure one (1) set of photos is delivered to the Lead Investigator as soon as possible.

SERVICE CENTRE SECTION

1. Police Member shall: [CALEA 61.2.1 (c)]

A. Hit & Run Collisions -Investigations

1) When requested by the Hit & Run Coordinator, Central Traffic Unit, examine the vehicle to see if the damage is consistent with complainant’s account of the incident.

2) Describe the damage on the Vehicle Collision Reports (MG-9956 & MG-13973).

a) Include measurements and diagrams.

3) Seize evidence that might assist investigators.

4) If the incident has just occurred and was witnessed, notify the Communications Centre with a complete description of suspect vehicle and occupants.

5) Make every attempt to obtain a witness statement from any identified witnesses.

a) Clear, detailed statements may also be taken over the telephone.

6) Forward witness statements to the Hit & Run Coordinator, Central Traffic Unit.

TRAFFIC COLLISION INVESTIGATION (TCI) SECTION

1. Traffic Collision Investigator shall: [CALEA 61.2.3; 83.1.1; 83.2.6]

A. Traffic Collisions Investigations

1) When assigned, assume responsibility for investigating a collision scene.

B. Fatal / Serious Injury Traffic Collisions

1) Lead Investigator

a) Assume responsibility for the investigation of the collision scene.

b) Notify all applicable city and/or provincial agencies as soon as practicable.

i) Ensure appropriate information is disseminated to each agency.

c) Complete a Mechanical Check Request Form (P-381) for each vehicle involved and forward to the Supervisor, Vehicle Services Unit.

i) Completed P-381 returned from Vehicle Services, is retained on file.

d) Consult with the Supervisor, TCI as required.

e) Assist with the determination of any charges to be laid if required.

f) Ensure overall completeness of collision report prior to final submission.

g) Forward a copy of all fatal or serious Traffic Collision Reports where TCI has investigated to DVE for scanning into RMS.

2) Total Station Operator

a) Electronically record scene details.

3) Collision Analyst [CALEA 83.2.6]

a) Ensure field sketch of scene is completed

b) Ensure accurate scene measurements and skid/drag factor tests completed, using involved vehicles where appropriate.

c) Submit copy of field sketch, scene measurements and test results to the Lead Investigator prior to retiring from duty.

d) If requested, meet with the Next of Kin and supply as much information and explanation as

possible.

i) Keep Next of Kin updated as to status of investigation.

C. Hit & Run Collisions

1) Investigate all assigned Hit and Run collision reports.

2) If Provincial Offence Notices are issued to an accused, attach the copy of PON to the report.

a) Forward completed report to the Hit & Run Coordinator.

3) If photos are required, forward a request to the Patrol Sergeant –Administration, Central Traffic Unit with the Occurrence Number and licence plate number(s).

4) If a suspect in a hit and run collision resides outside of the city, contact the appropriate police agency having jurisdiction and request assistance.

2. Supervisor shall: [CALEA 61.2.3]

A. Fatal / Serious Injury Traffic Collisions

1) Notify the Staff Sergeant, Central Traffic Unit.

2) Liaise with assigned Street Supervisor regarding the status of the incident.

3) Assign TCI members to the following roles as required:

a) Lead Investigator.

b) Total Station Operator.

c) Collision Analyst.

d) Any additional investigational resources (e.g. Commercial Vehicle Safety Alliance [CVSA] trained officers for truck collisions).

4) Take charge of the collision scene perimeter ensuring scene safety and the preservation of the integrity of the scene.

5) Oversee the collision scene and subsequent investigation.

6) Liaise with the Communications Centre, providing required information and status updates.

7) Monitor and liaise with any media outlets in attendance.

8) Arrange access and ensure involved vehicle(s) towed for evidence continuity.

9) Upon request for information regarding a traffic fatality from a Next of Kin (NOK), direct them to the Analyst and Lead Investigator who are assigned to the incident.

a) Ensure the Analyst and Lead Investigator meet with the NOK and supply as much information as possible.

10)Assign TCI members to attend traffic fatality autopsies as required.

B. Hit & Run Collisions

1) Receives all Hit and Run Collision reports forwarded for investigation.

2) Assign reports to Traffic Collision Investigators

3) Ensure investigations are completed.

4) Return completed investigations to the Hit & Run Coordinator.

VEHICLE SERVICES UNIT

1. Member shall:

A. Fatal / Serious Injury Traffic Collisions

1) Conduct complete mechanical inspection of involved vehicle(s).

2) Complete Mechanical Check Request Form (P-381) and return to the Lead Investigator, Traffic Collision Investigation (TCI) Section.

3) Arrange for removal of involved vehicle(s) to the MPI Compound or return to owner as required.

4) Provide assistance to TCI Section investigators as required.

2. Supervisor shall:

A. Fatal / Serious Injury Traffic Collisions

1) Review all Mechanical Check Request Form (P-381) and assign to Vehicle Services Unit member.
