NATIONAL LOGISTICS SAFETY CODE OF PRACTICE

CHAIN OF RESPONSIBILITY EXPLAINED Chain of Responsibility (CoR) means all parties in a supply chain are required to implement positive actions to prevent breaches of the law relating to speeding, fatigue, mass limits and load securing. The aim of CoR is to make sure everyone in the supply chain takes their fair share of responsibility for ensuring breaches of the road transport laws do not occur.

If you consign, pack, load or receive goods as part of your business, you could be held legally liable for breaches of road transport laws. At stake are civil and criminal liabilities, as well as reputational damage. Companies cannot ‘contract out’ their CoR obligations, no matter what their industry sector or part of the supply chain.

CoR is embedded in the Heavy Vehicle National Law, a uniform heavy vehicle code which applies in all states (with the exception of Western Australia and the Northern Territory).

It describes a series of obligations relating to heavy vehicle road transport and the people who are responsible for ensuring those obligations are met, and who will be liable for breaches.

WHAT IS THE NLSC?The ALC National Logistics Safety Code of Practice (NLSC) provides industry with a simple, equitable and effective way to maintain and improve Safety & Compliance across the entire supply chain. The Code sets out participants’ responsibilities when they control or influence the movement of freight, and applies to a range of Chain of Responsibility (CoR) obligations such as fatigue, safe loads, speed management and equipment.

HOW CAN THE NLSC BE APPLIED TO MY INDUSTRY SECTOR?A number of industry sectors have developed their own specific code under the NLSC:• Retail Logistics Supply Chain Code of Practice (RLSC)• Coal Seam Gas Logistics Safety Code (CSG LSC)• Australian Steel Industry Logistics Safety Code (ASI

LSC)• Electrical Cable Logistics Safety Code (ECLSC)• Tanker Logistic Safety Code (under development).

Development of an industry specific code maintains a level of national consistency under the NLSC, while allowing the sector to develop their own industry solutions to best suit their needs. ALC is currently working with other industry sectors to increase the reach of the NLSC across the supply chain.

HOW DOES THE NLSC APPLY TO COR?NLSC assists participants to manage their obligations under CoR laws through practicable and enforceable guidelines across the entire supply chain. Compliance with the NLSC may assist participants to meet their CoR obligations and could be evidence that ‘all reasonable steps’ were taken to prevent a contravention of CoR laws.

COR IN THE HEAVY VEHICLE NATIONAL LAWThe National Transport Commission and the National Heavy Vehicle Regulator will be developing the Heavy Vehicle Roadworthiness Program during 2015 and 2016.

It is designed to establish a national system that has systemic integrity and supports a rigorous risk-based approach to assuring the roadworthiness of heavy vehicles used on Australian roads. This could include changes to chain of responsibility duties on chain participants which could include broader responsibilities on participants to take all reasonable practicable steps to prevent breaches of the Heavy Vehicle National Law as well as ensuring that vehicles used to freight goods are properly maintained.
