Happy New Year to all! I hope you and yours had a happy holiday. I look forward to seeing all of you at our first luncheon of the year on January 8th where we will be welcoming back Bill Staples of, Archer Norris returning with the latest case law decisions affecting the P&C insur-ance claims world.
I am honored to be serving as your President for 2014-15 and want to thank Jodi DeVillier, of Coast Construction Company, for serving as President for the last two years and laying the great ground work for the bettering of our association. Her leadership has seen that we become incorporated and that we move forward with our nonprofit status. She always led the board with heart. Jodi will continue to help shape our great association as Immediate Past President.
I am happy to introduce our 2014 Officers and Board of Directors. Serving as my Vice President is Gemma Houser of Paul Davis Restoration, John Ehlert with JR Structural will serve as our Treasurer, Michelle Wind-sor with Certified Restoration Drycleaning Network (CRDN) will step in as our Secretary and as mentioned before, Jodi will stay on as immediate past President.

Jim Krueger has recently made the transition to the vendor side of our industry. Jim will be working as the Business Develop-ment Manager for ServiceMaster Advantage. They service the Sacramento, San Joaquin, and El Dorado Counties and are owned by Brock and Franse Mathews.
Jim will be bringing over 17 years of claims experience and over 25 years of customer service
to his new position which will allow him to assist their cus-tomers in every aspect of their claims. Jim is well connected to the industry and its representatives in the Northern California region in many levels. The energy, knowledge, and compassion he has for his job and people in general are going to be a great asset to the team.
Most recently Jim worked as the Senior General Adjuster at Sams & Associates. Prior to that, Jim worked in Northern California for Farmers Insurance as a Branch Claims Super-visor and a Senior General Adjuster for the Large Property Center of Excellence. Prior to moving to Northern California in 2005, Jim worked for State Farm as a Multi-line Claim Rep-resentative, Catastrophe Claim Representative, and a Senior
Claim Representative based out of Reno, Nevada. Jim graduated from the University of Nevada-Reno in
1994 with a Health Sciences Degree. He ran track and cross country in college and high school. Jim also attended Porter-ville Junior College. Jim grew up in the Midwest in Colorado and Nebraska and was born in Toms River, NJ.
Jim is an avid runner, cyclist, triathlete, and golfer. He is a proud father of three girls and one son. Jim is engaged to Marianne Neil. Jim and Marianne will be getting married in Maui this upcoming summer.
I have known Brock and Franse since 2005. We have always had a great friendship and almost brotherly like connec-tion. It is a perfect fit for us to work together with our like-mind-ed thinking of taking care of yourself, your employees, and your customers with the utmost respect. I am very enthusiastic to bring my experience and energy to their company and help them grow even more successful than they already are. Having worked closely with the ServiceMaster franchises throughout the country and the ties I had from Farmers Insurance it was an easy decision to switch careers into a management and market-ing type role for this awesome company. Being an “out-of-the box” kind of guy, I am hoping to bring some new concepts and claims experience to the vendor side of our industry to help everyone become more efficient and successful.

Staples To Return for Legal Review at January 8, 2014 EBCA
Known for his courtroom command and credibility, William H. Staples is a veteran defense litigation generalist. He heads the litigation group for Archer Norris, and resolves complex disputes and achieves numerous defense verdicts and cost-effective settlements.
He represents businesses, employers, manufacturers and their insurance carriers. He will return to the EBCA Wednesday, January8, 2014 to kick-off the new year with a return to his annual case law review.
For the past three decades, Mr. Staples’ practice emphasis has included product liability, construction defects and disputes, employment and commer-cial litigation, premises liability, toxic torts and catastrophic injuries. Elevator and escalator injuries are a special practice focus.
Representative achievements include minimizing a $360 million product liability class action for a national window manufacturer and prevailing before the Supreme Court of California on a housing discrimination claim.
The firm web site states: “Bill positions cases to refute plaintiffs and achieve early resolution, managing the critical investigation process and expert teams. Former broker-agent charged with multiple felonies for identity theft and forgery; more victims are possible
LOS ANGELES, Calif. - Eugene Shy-Ren Hsu, 31, of West Covina, a former insurance broker-agent, was arrested by Department of Insurance officers December 19, 2013, and charged with multiple felony counts including grand theft, forgery, and identity theft for allegedly using another agent’s identity to obtain a credit card and purchase life insurance policies without consumers’ knowledge, which netted him tens of thousands in commissions.
“My department regulates more than 325,000 licensed profes-sional agents and brokers who work hard to safeguard sensitive client information,” said Commissioner Dave Jones. “It is inconceivable that a former agent whose license was already revoked by my office would go to such lengths to game the system for his personal gain. I will not tolerate deceitful actions that smear the reputation of honest agents and brokers.”
An investigation led by the California Department of Insur-ance (CDI) revealed that Eugene Hsu, owner and operator of NCP Insurance Center, allegedly stole the identity of an unsuspecting licensed California insurance agent who applied for a job with Hsu. Hsu allegedly stole the licensed agent’s Department of Insurance identity in order to write several life insurance policies without the agent’s knowledge.
As a result, Hsu collected more than $16,000 in fraudulent commissions on policies issued between June 25, 2010 and October 19, 2010. The individuals named on the life insurance applications had no idea a life insurance policy was purchased in their name. In addition, the investigation determined that Hsu used the licensed agent’s identity to obtain a credit card with GE Money Bank and charged close to $4,000 in insurance premium charges to keep his scheme going and continue collecting commissions.
The Department of Insurance is asking anyone who responded to a job posting on Craigslist.org from Eugene Hsu with NCP Insurance or purchased insurance from the suspect to check their credit report for unusual activity and confirm with their insurance company the validity of any policies. Consumers who have concerns or find they do not have legitimate coverage are asked to contact the Department of Insurance’s Consumer Hotline at 800-927-4357.
Hsu is being prosecuted by the Los Angeles County District Attorney’s office with bail set at $70,000 and faces a maximum of three years in prison if found guilty on all counts.
