Permit Check Critical When Buying Home

Most houses are inspected by a home inspector before they’re sold. However, home inspectors usually don’t inspect the permit record on a house. To be sure you have the complete picture, it’s wise to go to the local planning department and check the permit history on the home you’re buying before your inspection contingency is due.

Why is this important? Some planning departments require that any open or expired permits that haven’t received � nal approval must be completed before a new permit on the property will be issued. In one case, a seller took out a permit to replace the roof. He never had the job done and the permit expired.

The new owners applied for a permit and were denied. They needed to pay to reopen the roof permit and complete the job before they could obtain a permit to do additional work on the house. This could add a considerable cost to your improvement budget.

You might be able to � le a claim against the seller, depending on the circumstances. However, he may not have been aware of the expired permit if a previous seller took out the permit and your seller didn’t check the permit record when he purchased the property.

HOUSE HUNTING TIP: Go to the city planning department before you remove your inspection contingency and � nd out if there are any open or expired permits. You might be able to negotiate an acceptable solution before closing. This would be less hassle and expense than taking legal action after closing.

A good home inspector should be able to point out any glaring building code violations in work done by previous owners. This could be an indication that the work was done without building permits.

For example, a recent homebuyer was informed by her inspector that the relatively new electrical circuit breaker box was installed in a fashion that would not

pass a city building inspector’s scrutiny. The box had several irregularities.

Further investigation revealed that the seller had recently added the circuit box. Although he used a licensed electrician, the work was done without a permit. The buyer hired an electrician to inspect the box and it turned out it needed to be replaced in order to meet code requirements.

The buyer made a request for a price concession from the seller to compensate for this new information discovered during inspections. He agreed to lower the price. The buyer took responsibility for replacing the box with permit after closing.

Sometimes homeowners bypass the permit process in order to save time and money. Busy contractors don’t like to wait for inspectors and sometimes encourage sellers to forgo permits. If you’re adding additional living space, don’t even consider doing the work without permit.

Appraisers often won’t give unpermitted additions full value as livable square feet. This could affect the sale price of the property. It’s possible to take out permits after the work is done, but it will cost more in fees, and walls might have to be opened to make sure that any plumbing and electrical work was done correctly.

Don’t assume that if work is done by a licensed contractor, it will meet local code requirements, particularly if the contractor is from out of the area and is not familiar with local code requirements. Taking out a permit can provide the homeowner with protection against code violations.

You can run up costs bringing the last owner’s work up to code in order to receive � nal approval on work you’re having done to the home. If a building inspector sees something at your home that isn’t code-complying when he’s inspecting, he’s likely to require you to bring that work into compliance before giving � nal approval to your permit.

The garden of one famous English estate boasted all of these features and more. It was called Stourhead, and these

architectural elements, called follies, were artfully placed along a meandering circular path nearly two miles long. The garden and its follies were designed in 1744 by an amateur landscape designer with the unenviable name of Henry Hoare.A folly is an architectural structure in the landscape that exists for no reason other than to add interest. Follies were all the rage in English gardens of the late 1700s, when they were an integral part of an architecture and landscape design movement known as the picturesque. The movement espoused pretty much what you might guess -- designs were meant to be artfully composed and, well, pretty as a picture. Stourhead was, in fact, literally based upon a landscape painting by Claude Lorrain done a century earlier.Alas, most gardens don’t have room for Stourhead’s highly creative follies. But a folly doesn’t need a lot of room to be effective. The same design elements that worked for Hoare and others during the golden age of English landscape design can still be used to lend picturesque elements to your own garden.

Whether square, octagonal or round, they make a fine endpoint for a garden path.Try looking beyond the usual four-by-four-and-latticework construction -- the more exotic the design, the better. Gazebo designs of a century ago featured everything from unpeeled logs to river rock to iron columns and onion domes. In fact, the whole point of a folly is to go a little nuts.

2. A bridge can form the centerpiece of a garden with

suitable terrain.

It can cross either a dry rockbed or actual water. The scale needn’t be large; look at some of the diminutive bridges found in Japanese landscape architecture. It’s just the act of crossing from one side to the other that engages people’s interest.Do make sure that the bridge actually crosses something (not just flat ground). Even more important, make sure that there’s something worth reaching on the other side -- another folly,

perhaps, or just a bench on which to sit and enjoy the surroundings.

3. Small fountains or pools can add immeasurably to the

pleasure of a garden.

Besides mere appearance, the soothing sound, cool touch, and refreshing smell of water are a banquet for the senses. For this reason, famed gardens such as Stourhead contained whole networks of artificial ponds and creeks. But a tiny garden can benefit from water as well. You don’t need a torrent -- something as simple as a small basin fed by a trickle of water can transform a garden into an oasis of tranquility.

4. Other follies are limited only by your imagination

Stourhead’s obelisk, for example, was a scaled-down version of a monumental Egyptian form. Locate follies at natural stopping points in the garden where they reveal a vista or a favorite plant. Even something as simple as a bench, bird bath or sundial can effectively add an unexpected element to the landscape.

For instance, if there are cracks in the foundation, it might indicate that the foundation needs work, which could be costly. A structural engineer might evaluate the foundation and � nd that the cracks are typical for similarly aged homes in the neighborhood. They should be monitored, but there’s no corrective work recommended.

In other words, a red � ag could point to relatively minor or major problems. In either case, they should not be ignored.

Real estate law and custom varies from one state to the next. In California, real estate agents are required to do a “reasonably diligent and competent visual inspection” of a one- to four-unit residential property. This means that the seller’s and buyer’s real estate agents are required to walk through the property and note in writing any red � ags they see.

California real estate agents are even held responsible for failing to point out red � ags they should have known about. For instance, if there are known slides in the area, an agent working there should be aware of that. If agents in the area see signs of sloping on a property in a slide area, they should include that in their agent inspection.

HOUSE HUNTING TIP: Even if you are buying or selling in a state that doesn’t require a real estate agent to inspect for red � ags, ask your agent to walk through a property you’re considering before you write an offer and point out anything that might be considered a red � ag. Then ask your agent to ask the listing agent if there are any reports or disclosures for the buyer to review.

By doing this, you could save yourself time and disappointment if the house appears to have serious problems that you can’t afford to correct and the property is being sold in its present condition with no concessions for repair work from the seller.

Sellers should ask their agent to do a walk-through and visual inspection before the property goes on the market. This will give sellers time to gather more information about a red flag. For instance, if you’re agent says that

your roof has cracked tiles and looks weathered and old, call a reliable

roofer for an expert opinion.

The roofer may feel that the roof is at the end of

its life. If so, you can replace it before you sell, get a second

opinion, or simply disclose this information

and roof report to the buyers so that they can factor this

information into the purchase price.

In some areas, the custom is to wait until there is a rati� ed purchase contract before giving reports and disclosures to buyers. A problem with this strategy is that buyers don’t have adequate

information about the property’s condition before they make an offer. The roof report could become a negotiable item or a deal killer.

Sometimes sellers or their agents hold back “bad” information about a property for fear that the information will keep the property from selling. This is counterproductive if it results in a failed transaction when the buyers who are in contract receive the news.

If you have information pertinent to the sale, it is far better to make it available for buyers to review before they make an offer. That way, you don’t risk having to put the listing back on the market when the buyers discover they paid too much for a house that needs a new roof or foundation repairs.

THE CLOSING: A proactive approach usually yields the best results.

that there might be something serious going on with the property that

requires further investigation.

Think subprime mortgages have gone away? Think again, we have one lurking within FHA, with

features that are eerily similar to those of the private market that went into hyper-drive in the 2000s, and collapsed in 2007.Expensive marketing: The techniques used in the two recent subprime markets to target potential customers are the same. A letter I received recently described “an event sponsored by a real estate company/mortgage company to help people that have had a foreclosure or short sale get back into a house. We did a short sale on our house about two years ago. While there our qualifications were checked, and a few days later they approved us.” The approval was for an FHA. Other than that, this letter could have been written 10 years ago.Liberal qualification requirements: The private subprime market depended on the substantial liberalization of underwriting requirements that arose out of the housing bubble during 2000-2007. The prevailing assumption was that rising house prices would convert the otherwise weak subprime loans into good loans -- which they did, until the bubble burst, at which point the default rate ballooned.In a similar vein, the FHA subprime market today depends on FHA’s very liberal underwriting requirements. FHA requires a down payment of only 3 percent, and has no minimum credit score. Further, the mortgage insurance premium does not vary with the credit score. While FHA borrowers in total have an average score of about 700, a small

group of FHA borrowers have scores below 620. This is the subprime lender’s target market.Most mortgage lenders do not take advantage of this, imposing underwriting “overlays” which are requirements more restrictive than FHA’s. The reason they do this is that they want to retain their status as approved FHA lenders. They know that if the default rate on the loans they submit exceed some limit set by the agency, they will lose their FHA accreditation. None of the six lenders offering FHA loans on my website, for example, will accept a credit score below 640. But there is a small group of lenders who will accept any score, their only concern being whether or not they can get the loan approved by FHA. Because of what I do, I am solicited by these people every day, and the messages they email me are outrageously misleading and dishonest. Overcharges: The profit margins for those originating subprime FHA mortgages are three or four times as large as those on other mortgages because the borrowers view themselves as dependent on the originator who solicited them. And they are right, mainstream lenders will reject them. Subprime FHA lenders are largely shielded from competition.High default rates: FHA loans with very low down payments to borrowers with very low credit scores have very high default rates. Who are these lenders willing to make FHA loans that carry high default

risk? As far as I can determine, they fall into two groups. One group intends to make enough money during the period until they are bounced from the program -- which could be some years -- to make it worth their while. A second group will make the occasional high-risk FHA loan as an accommodation to a referral source, such as a real estate agent or a mortgage broker. The purpose is to encourage the referral source to send them more quality loans. If such lenders keep the number of high-risk loans to a small share of the total, they don’t endanger their accreditation with FHA. Implications for policy: The FHA subprime market results in higher losses to FHA, and allows the most vulnerable borrowers to be overcharged. These borrowers should pay more, but the payments should go to FHA to defray the higher loss rates, not to loan originators. The appropriate remedy is to scale mortgage insurance premiums to credit score.In 2008, FHA attempted to increase mortgage insurance premiums on low credit scores, and to reject scores less than 500 unless the loan-to-value ratio was 90 percent or less. The proposal was shot down by Congress. Premiums are scheduled to rise this year, but will not be scaled by credit score. The method FHA currently uses to control its losses, which is to blackball lenders whose loan submissions have high default rates, is clumsy and only partly effective. Lenders removed from the program are replaced by others, and lenders who spread their subprime loans among larger numbers of good loans are never caught.Implications for borrowers: When you need a mortgage, select the lender, don’t allow the lender to select you.
