The new owner of the site currently home to the Napa Valley Register has filed an application with the city to build 51 townhouses and 6,000 feet of commercial space along Second Street.

Vesta Pacific Development, based in San Diego, proposes a $40 million mixed-use development on the downtown block, includ-ing townhouses ranging from about 1,000 to 1,600 square feet.

“Our project is very simple in concept – cre-ate housing downtown,” said Barry McComic, a spokesperson for Vesta Pacific and the devel-opment.

The Register’s parent company, Lee Enter-prises, sold the block in September for about $5 million. The proceeds will be used to pay down debt, officials said. Lee, like many news-paper-owning companies, has been exploring the sale of large downtown newspaper offices across the chain.

The Register’s building was damaged during the August 2014 earthquake, and the press was rendered inoperable. After studying the mat-ter extensively, the company concluded that it made economic sense to outsource printing to the Rohnert Park-based press owned by Sonoma Media Investments, which has been printing the

Register since shortly after the earthquake.Outsourcing the printing meant the Reg-

ister no longer needed the 21,000-square-foot headquarters on Second Street, leading to the sale and eventual relocation of the offices. An announcement of the new location of the Reg-ister’s offices is said to be imminent.

According to the tentative map and design submitted to the city, the redevelopment proj-ect would include five buildings — four on the block bounded by Second, Wilson, Third and Seminary streets, and a fifth on the small parking lot at the southwest corner of Third and Seminary.

The 6,000 square feet of commercial space would run along the Second Street frontage. The development would have a 61-space, street-level parking garage.

Residential units would be located above the commercial space and parking. Additional three-story residential units are planned to front on Third Street on both sides of Seminary.

Creating more mixed-use residential proj-ects in downtown Napa “is what we have been talking about for a long time,” said Ryan Greg-ory, a local representative for the project. He is a principal with RSA+, a Napa civil engineering and surveying company.

Adding inventory to the city’s housing stock, particularly in downtown, “could be a way for some folks to enter the housing market,” Greg-ory said. Because they will be built in smaller

sizes, the townhouses will be “affordable by design,” especially compared to single-family homes, he said.

McComic said this was Vesta’s first project in Napa County. He acknowledged that the 2014 earthquake, while devastating for many Napans, also presented “a very unique opportunity to others who were willing to come in and take some active hand in retrofitting.”

The Register is a good example, McComic said. “That project would not exist but for the earthquake. That’s the good, the bad and the realistic of the world.”

McComic said he would be careful not to overprice the units. “I’ll be perfectly satisfied if we can come in at less than $500 per square foot,” which would mean the townhouse prices could likely start in the high $400,000 range, he said.

Such housing will appeal equally to both locals, Bay Area buyers and international buy-ers, he predicted.

Napa’s proximity to wealthy areas of the Bay Area and its world-famous wine region make the area very desirable, he said. “I think our market is going to be very broad.”

“I’m excited about Napa in general,” he said. “I think it’s going to be a very nice project.”

Gregory said he hopes to present the project to the Planning Commission this summer. If all goes smoothly, work at the site could begin as soon as September, said McComic.

Latitude 38 Entertainment has announced its 2016 BottleRock Napa Valley lineup and it is star-studded at the top and broad and deep, with 80-plus bands and the “something for everyone” vari-ety that has been the hallmark of the event since its inception.

The headliners, who will close the festivities on the main stage each of the three evenings, May 27-29, and not necessarily in this order, are Red Hot Chili Peppers, Stevie Won-der and Florence + the Machine.

Red Hot Chili Peppers have been among the top-ranked rock bands nationally and internationally for the past three decades, with 80 million albums sold, seven Gram-mys and induction in the Rock and Roll Hall of Fame in 2012. Their live shows are legendary, with lead singer Anthony Kiedis and bassist Flea typically out front and shirt-less, combining funk-flavored hard rock and hard bodies in a leave-it-all-on-the-stage aerobic musical celebration.

Stevie Wonder is a national musical treasure, a singular artist, recording and performing for more than 50 years, with over 100 million

records sold, 10 No. 1 hits on the pop charts and 20 No. 1’s on the R&B charts. His honors include 25 Grammy Awards, the Grammy Lifetime Achievement Award and membership in both the Songwrit-ers and Rock and Roll Hall of Fame. In 2014 he received the Presidential Medal of Freedom.

Florence + the Machine is one of the hottest indie rock bands in the world. The British group has been recognized over the past six years with a slew of Brit, MTV and Grammy nominations. Like the Chili Peppers, their live per-formances, featuring lead vocalist Florence Welch, take them to a level well beyond their successful record-ings. About Welch, one critic wrote, “The singer could have burst into flames with the amount of energy she was putting out.”

Right behind the headliners are three acts that are each worthy of topping the bill at a major festival: The Lumineers, Death Cab for Cutie and Lenny Kravitz.

A sampling of the rest includes Walk the Moon, Rodrigo y Gabriela, Ziggy Marley, Grouplove, Michael Franti & Spearhead, Gogol Bor-dello, Buddy Guy, Iration, Shovels & Rope, Ozomatli and BottleRock perennials Moonalice. At least five Latino bands will be in the mix, and, as in the past, a large number of local bands will perform, includ-ing The Deadlies, who will open the festival on the main stage on Friday.

BottleRock will begin selling ticket packages on Thursday, with single-day tickets to go on sale at a later date. The daily lineup has not yet been announced.

BottleRock Napa Valley 2016 will include a larger (if you could imag-ine) main stage in all dimensions and larger video screens. There will also be a bigger culinary stage with an expanded cast of chefs, musi-cians and other celebrities. The VIP Village will be expanded and have a larger viewing platform, and the Skydeck will have views of both the main stage and the culinary stage.

Other changes include a new Platinum Lounge located next to the main stage, an expanded Kids Zone, increased merchandise offer-ings, more wine tasting/purchasing locations and new art installations.

Last week at his Latitude 38 office, CEO Dave Graham talked about booking the 2016 festival, particularly the challenge of sign-ing what he calls “bucket list” acts like the Chili Peppers and Ste-vie Wonder.

“We started to make offers for

2016 in March of 2015, prior to our 2015 festival,” Graham said. “It’s an extremely competitive marketplace for bands in the Bay Area. You have AEG, Live Nation, Another Planet, the independent promoters, all vying for the same bands, the hottest bands.

“We wanted to let the agents and agencies know who we were think-ing about. We wanted to get ahead of the game. And if there was any question whether BottleRock was here to stay, well that answered it, because we were putting out offers for 2016 before our 2015 festival. That implied that things were going well with our business model, which we knew at the time.

“The first headliner that we signed for 2016 was Stevie Wonder, and then Florence and the Red Hot Chili Peppers happened at about the same time. With regard to the Chili Peppers, we’ve had an offer

essentially out there since we took over the BottleRock brand. It’s been one of those bands that we wanted to have. They are iconic, they are a bucket list band.”

According to Graham, “when we first put in our offers for 2014, we had zero chance of getting them. We thought we did, but we didn’t because we didn’t have the credibil-ity to attract a band of that caliber, especially given what had happened in 2013.”

Latitude 38 took over the Bot-tleRock franchise in 2014 after the original promoter, BR Festivals, plunged into bankruptcy after the inaugural festival in 2013.

“It’s taken us a lot of time and a lot of effort to build credibility with the agencies and agents and man-agers that represent bands like the Chili Peppers,” Graham said.

“We’d gone through a series of I don’t know how many offers for

the Chili Peppers. This one came together at the last minute. We thought they were out, that they were going to go straight to Europe for their summer tour. It turns out they wanted to play a few gigs before leaving for Europe. I think we signed them in October.”

Latitude 38’s patience and per-severance were rewarded. Graham returned repeatedly to trust as the indispensable ingredient for book-ing artists of headliner caliber. “You begin to build credibility (with) an agent, whose job it is to not only maximize revenue and profitabil-ity for an artist, but to protect the brand,” he said.

“Once they believe that you are not going to screw up their fran-chise brand — the Chili Peppers is a franchise brand — then you can actually talk seriously about the pos-sibility, then you can get to the table to have the conversation.

The onetime home of Napa’s city Parks and Recreation depart-ment will receive a new home.

Two new owners are preparing to move the historic 105-year-old wooden structure to the south of town, after the City Council accepted their offer in December. Napa will transfer the building to Robert and Richard Moreira free of charge, according to Jeff Frietas, the city’s real estate manager.

By not putting a price tag on the building, the city wanted to encourage someone to take it and preserve the historic portion.

360 S. Jefferson St. will receive both the parks building, which city staff vacated last year, and a second Craftsman-style home from another location, Robert Moreira said before the vote. The city has set a goal of clear-ing the building’s current site at 1100 West St. by May 1 to open the space for expanded parking areas downtown.

The transfer heads off the possibility of demolition for the structure, whose upper floor dates to 1910 and has a historic desig-nation from the city. Napa County Landmarks, a historic preservation group, earlier endorsed the move.

Online profiles on LinkedIn describe Richard Moreira as a real estate agent representing Napa Valley winery owners. The website lists Robert Moreira as a business development manager for the

cybersecurity firm Infocyte Inc., and a former account manager for vineyard acquisition at Del Dotto Vineyards from 2009 to this year.

Only the upper floor will be pre-served. Napa is scheduled to spend $10,000 from its general fund to tear down the non-historic lower floor, disconnect utilities and check for any residual asbestos.

Plans filed by the Moreiras call for the parks building to be depos-ited temporarily at South Jefferson Street while its new foundation is built.

To complete the move of the parks building, the new owners will need a design review as well as a certificate of appropriateness from the city’s Cultural Heritage Commission.

The 1910 building, which faces the new Oxbow Commons flood bypass channel and shared

a parking lot with the since-razed Cinedome movie theater, housed a teen community center before its conversion into city office space. The structure was formerly located on First Street near City Hall.

In April 2014, the Parks and Recreation department relocated to an office complex on Soscol Avenue east of downtown. Later, Nordic Industries Inc., lead contractor for the nearby flood control bypass project, kept a temporary office in the former parks building before leaving this August.

December’s handover wrapped up Napa’s second attempt to find a new home for the historic build-ing. An earlier offer, to a candidate planning to take the structure into the unincorporated county, col-lapsed in July, leading the city to withdraw its earlier requirement for a buyer to pay the demolition costs.

Christian Palmaz dreams of piloting his helicopter to and from the family home at Palmaz Vineyards where eastern Napa Valley meets the steep slopes of Mount George.

But his dream is a nightmare to some of his neighbors.

He wants a county permit to build a helipad on the rural prop-erty about three miles east of the city of Napa at 4031 Hagen Road. The county is about to launch an environmental impact report to explore the proposal.

Palmaz stressed the helicopter trips would involve private use only, not taking people to the Pal-maz winery. He said trips can be handled in such a way as to not disturb neighbors.

“Any friend who knows me knows I live and breathe aviation,” Palmaz said. “It is an incredi-ble passion.”

Some neighbors worry about the noise. The Vision 2050 coa-lition of local environmental and neighborhood groups doesn’t want to see a precedent-setting project result in an increasing number of helicopters zipping over bucolic Napa Valley.

“Where will it stop?” Vision 2050 President Dan Mufson said. “If one wealthy person can do it, then everyone can try.”

This past year, Napa County saw disagreements over whether its agricultural atmosphere is threatened by too much winery success and glitz on the ground. In 2016, that dispute could spread to the air.

Palmaz Vineyards is located on 600 acres where Henry Hagen operated a winery in the late 1800s. Julio and Amalia Palmaz founded their winery more than 15 years ago, and their son Christian Palmaz is president.

In an interview, Christian Pal-maz talked about trying to allevi-ate the concerns of neighbors who don’t want a helicopter flying over their homes.

“We are setting the gold stan-dard for what it means to have a

helipad on private property for private use in this county,” he said.

The proposal calls for estab-lishing a no-fly zone over the adjacent Olive Hill rural area, using flight paths that concen-trate the greatest amount of noise on the Palmaz property and flying 1,000 to 1,500 feet above ground when possible.

A twin-engine Bell 429 Global Ranger helicopter or something comparable would be used for flights to and from the heli-pad. This type of helicopter has advanced technology to reduce noise, a county report said.

The 50-foot-by-50-foot helipad would be paved with asphalt con-crete and located on a hillside with terraced vineyards at an elevation of 321 feet. A hangar 29 feet tall at the roof ridge would be built into the hillside.

The state Department of For-estry and Fire Protection could use the helipad during emergencies, a county report said.

Christian Palmaz keeps his heli-copter at Napa County Airport. If and when the helipad is built at Palmaz Vineyards, he would make an average of four helicopter arrivals and four departures at the family home per week, a county report said.

He had a noise study done, but some neighbors distrusted

the results, Christian Palmaz said. He realized a full environmen-tal impact report overseen by the county is needed.

“The community deserves to know the Palmazs didn’t pen-cil-whip this project into approval,” he said.

Christian Palmaz sees his proj-ect as a precedent-setter for Napa County, but in a good way. If other people want a private helipad, they should have to meet the same, high standards, he said.

Robert Pursell shares a property line with Palmaz Vineyards. His family doesn’t want a helipad for a neighbor.

“Our contention is not only for this site, but for any residential site in Napa County, it’s just not com-patible,” Pursell said.

The Palmaz request is the “canary in the coal mine.” County approval could lead to many more applications and more helicopters flying over a valley where the wine industry relies on quiet outdoor entertainment for its livelihood, Pursell said.

In addition, he’s afraid the county’s ability to regulate the helipad operations is preempted by a Federal Aviation Administration that is unwilling to regulate private operators. That leaves a vacuum, he said.

concerns. Highly flammable avia-tion fuel would have to be trucked through the rural neighborhoods to the Palmaz property, he said.

Mufson said Vision 2050 has collected several hundred sig-natures from Coombsville area residents who are against the pro-posed helipad. This petition says that those signing don’t want to sacrifice their right to enjoy their properties in peace and quiet.

“We have chosen to live in one of Napa County’s most quiet residential pockets at the foot of Mount George,” the petition says.

Napa County has had a least 12 applications for helipads and airplane landing strips since 1965, county Planner Dana Ayers said. The county approved six of them – two for St. Helena Hospital – as well as two for limited periods. It denied two requests and two were withdrawn.

One of the higher-profile cases took place in 2005. Developer and San Diego Chargers owner Alex Spanos and his son-in-law, Ron-ald Berberian, proposed building a helipad on Pritchard Hill near Lake Hennessey. Berberian with-drew the application after neigh-bors protested.

In 1979, the county Planning Commission approved a helipad for Stags Leap Associates southeast of Yountville. The Board of Super-visors overturned the approval on appeal.

A 2011 real estate advertisement in the Napa Valley Register listed a $24 million home on Spring Mountain near St. Helena that included a private helipad.

Christian Palmaz began meet-ing with county Airport Advisory Commission and CalFire repre-sentatives in December 2013 to discuss helipad designs. This com-ing year, he could learn if he can join the few that have won helipad approvals from Napa County.

Once the draft environmental impact report is released — Ayers expects this to happen in late win-ter or early spring — the public will have 45 days to submit comments. The helipad proposal will then be heard by the Planning Commission at public meetings.

CALISTOGA — The old Calistoga hospital, a wreck of a 19th century stone building that is on the National Register of Historic Places, seems finally poised for a bright future.

Built in 1886 as an elegant home, the structure later served for almost 50 years as the town’s hospital. When the state closed the facility in 1965 for not meeting stan-dards, the property deteriorated, becoming the town’s white elephant.

Multiple owners came in went in recent decades, but plans to revive the landmark, known as the Francis House, never devel-oped traction ... until now.

The newest owners, Richard and Dina Dwyer, last week began demolishing a wood-frame 20th century addition and will soon gut the original home, main-taining the stone exterior which has land-mark status.

The Dwyers plan to make it their home, and eventually operate a bed-and-breakfast with six rooms.

“We cleaned around it. Now you can see the original building,” Richard Dwyer said.

“It’s a disaster that we’re fixing up.”The shell of the three-story home, built

of locally quarried stone by Calistoga mer-chant James H. Francis, will be restored, while the interior, corroded by years of roof leaks, will be reconstructed, he said.

“We’re going to restore the building, try to bring it back to its original grandeur,” said Richard Dwyer, a general contractor and a real estate broker.

“It’s been raining inside the building, there’s nothing left. The only thing left is the stone structure,” he said.

Significant structural strengthening will take place, with steel framing used for each floor. The outside will be left intact.

Neighbors are relieved that the blighted

building is getting cleaned up, Dwyer said, and a few have stopped by to say hello. For years the property was a magnet for trash and abandoned cars.

Dwyer has restored several buildings with his wife, who is an interior designer. The interior of the Francis House will be “more functional,” he said.

In late 2006, the Calistoga City Council was considering exercising a nuisance abate-ment declaration because the entire site had become a magnet for all sorts of trash and unwanted items.

In 1970 Donald Selvey purchased the property — which was placed on the National Register of Historic Places in 1979 — from hospital owner Jack Oughin, but neglected it.

Neil Shafer entered into a sales agree-ment with Selvey — an agreement that was not settled until 2008 by the courts — and began cleaning up the property with an eye to developing it, but the recession of 2008 stalled the project.

Most recently, Mario Sculatti, owner of Roam Antiques, proposed to create a high-end vintage wine tasting center and 18-room inn. More investors were needed, but after a two-year search Sculatti gave up.

Napa County has decided that property it owns along the Napa River in the bustling Oxbow district has a higher and better use than being a small cor-poration yard for storing gear and janitorial services.

The county Board of Supervisors declared the 2.2 acres at 933 Water St. as surplus in January. That means the “for sale” sign should be going up at some point.

Oxbow Public Market hums with activity, and the Culinary Institute of America plans to revitalize the empty Copia building. Now the county wants a piece of the action.

What the property’s highest and best use is remains a question.

A study done for the county by Jones Lang LaSalle found that the property might be worth up to $6.6 million for multifamily housing and $11 million for a hotel. It deemed a “resort-style desti-nation hotel” the best use.

But the county isn’t necessarily going that direc-tion. The firm ACA Financial Guaranty controls the adjacent south parking lot of the Copia complex, and that site could be targeted for development of some type.

“Water Street really works best looking at Copia at large,” Supervisor Brad Wagenknecht said.

The city of Napa and ACA would be the lead for master planning the area, county Housing and Intergovernmental Affairs Director Larry Florin said. The city would issue the permits for what could be built there.

Money from a land sale could go toward building a new county jail, officials have said.

The site has some constraints. Although 2.2 acres, the developable portion will be 1.84 acres should a planned flood wall be built. A 1992 county report noted petroleum hydrocarbons had been found in the soil and groundwater, raising the need for further environmental review.

Napa County uses the site for janitorial oper-ations, surplus storage and housing staff from its communications departments. These functions will

move to the county’s South Campus in Napa Valley Commons and a county maintenance yard on Cal-ifornia Boulevard.

The county has one task remaining before it can legally sell the property to a private developer. First, it must make the land available at fair market price for 60 days to government agencies.

County supervisors also talked about what might eventually happen to property on Old Sonoma Road that is home to the Health and Human Services Agency. The agency is to move to the South Cam-pus in late spring.

Then the county will have another property that it can declare surplus and sell. Supervisors on Tues-day talked about wanting to see residential develop-ment there with an amount of affordable housing that is above the norm.

“There are not that many 8.5-acre parcels with full infrastructure, with public transportation, with (nearby) schools available in the city of Napa,” Supervisor Keith Caldwell said. “If we’re ever going to move the needle, this is going to be the project.”

He talked of working with the city of Napa on zoning. He talked about doing the environmental work and other permitting chores ahead of time, then entering into an agreement with a developer.

The Jones Lang LaSalle report said the site could sell for $4 million to $14 million for multifamily housing, depending on whether the county sells the entire property or a portion.

How much land might be used for housing is a question mark. First, the county must decide what to do with three century-old buildings along the crescent driveway to the complex.

In 2011, Napa County Landmarks put the buildings on its at-risk list. A county study says they appear eligible for the National Register of Historic Places.

“It certainly appears to be housing versus land-marks,” Florin said. “Maybe there’s an elegant solu-tion that combines them.”

But the Board of Supervisors isn’t quite ready to declare the Health and Human Services Agency complex as surplus property. The county will need this land for about another half-year.

You are likely not surprised when your doctor recom-mends a periodic physical to

detect any health issues you might not be aware of, as it also makes good sense to service your automo-bile frequently to receive needed

maintenance and avoid future repair. Similarly, the recommendation that you have your home inspected by a pest control profes-sional or home inspec-tion company every few years is a small

investment today that could save you a far greater amount of money down the road.

Just last week we had the annual visit from our company attorney who provides an update on “risk management” for our clients, ourselves and the company. Risk management is the trade term for minimizing the exposure to litigation in the process of selling or buying a home. He highlighted the six major areas of litigation in home sales which rarely changes from year to year.

struction• Roof Problems• EasementsThe advice from lawyer to

agents and sellers has not changed over the years; Disclose, Disclose, Disclose. In addition to disclosure the best preventative to reach-ing litigation with a buyer is to maintain the condition of your home with professional third party inspections.

If you are considering putting your home on the market this year, it is a great time to obtain a check-up on the parts of your home that are least visible or acces-sible. While most home owners wait until they put their property up for sale to consider obtaining reports on the condition of their home, it’s a good idea to make the small investment of a pest control inspection or home inspection that can prevent a large expense later.

Depending on the age and type of construction, obtaining a report should be done about every two to three years, even if you have no intention of putting your home on the market for sale. The invest-ment of $200 to $300, depending on the size of your home, for the report may detect a moisture or pest condition that could end up costing multiple thousands of dol-lars just several years later.

If you have bought or sold a home recently you are most likely familiar with obtaining a “Wood Destroying Pests and Organisms Inspection Report,” commonly called a pest control report. Although not required by law in a real estate sale, to buy a home or building without having obtained a pest control report is unusual and unwise. Pest control operators are licensed and regulated by the State as to inspection practices and utilization of approved pesticides for treatment.

By getting reports in advance you can obtain competitive bids on discovered work to be done or factoring discovered defects into the pricing your home when put-ting it on the market for sale. The reality is that most homeowners do not get a pest report until they sell and often find major damage

to their home that could have been prevented by early detection and preventive maintenance.

There are several reasons to obtain a Pest Report before going to market:

• Termites are hard to detectas they can be in the foundation, in concrete, under paint or in areas not frequently visited or easily detectable by occupants.

• Prior to remodel or home improvements, you will want to inspect the sub-floor and walls for dry rot or termites before you install floor or wall finish materials. If you use a contractor other than the inspection company to do the repairs, you will want to have the job inspected while the work is in progress.

• Ventilation, moisture and foundation problems. Often vents get covered, water can collect or other conditions can occur that can lead to moisture damage in areas not visible.

• Select who will do the work and obtain bids. By obtaining a report in advance of selling your home, you will be able to cre-ate your own calendar to com-plete the work and you will have more options as to who is doing the work.

• When installing a new

roof you can obtain a pest con-trol inspection that may discover support damage in the eaves and roof structure. These repairs can be made at the same time the roof work is done.

By having professional reports are in hand show that you care about every aspect of your home. Also, you have deferred the liability of discovery and disclosure of structural issues to a third party professional further insulating you from potential litigation after sale.

Napa County has a number of reputable pest control and home inspection companies that are licensed, bonded and carry errors and omissions insurance. Call your Realtor for a recommendation or get a personal reference on the com-pany you select. As with complete service records on a car, periodic home inspections will reflect on you as a responsible home owner and add to the value of the home at the time of sale. These will also place you in a great position as a seller to disclose all you know of your prop-erty at time of sale.
