NOTICE INVITING TENDER 1 Tender in the prescribed form is hereby invited on behalf of The Director, U.N. Mehta

Institute of Cardiology & Research Centre for LAUNDRY WORK OF HOSPITAL of the U.N. Mehta Institute of Cardiology & Research Centre at Civil Hospital Campus, Asarwa, Ahmedabad - 380016. The estimated value of the daily turnover of tender is Rs. 5000/- & yearly estimated value of tender is Rs. 17.5 lacs (Rupees Seventeen lacs & Fifty thousand only).

2. Tender documents may be downloaded from the site https://unmicrc.nprocure.com or

www.unmicrc.org. on 23.12.2010 onwards. Tender fee Rs.1000/- (Rupees One Thousand only) (non refundable) paid in the form of Demand Draft drawn on a Nationalized bank / HDFC Bank / ICICI Bank/ Axis Bank payable at Ahmedabad, in favour of The Director, U.N. Mehta Institute of Cardiology & Research Centre.

3. The required physical submission of the documents should be submitted in sealed cover

with Name of the work and Name of the Bidder written on the envelops will be received at the office of the Director, U. N. Mehta Institute of Cardiology & Research Centre on or before 11.01.2011 up to 1:30 pm

4. Contractor fulfilling pre-qualification criteria of the tender can fill up Tender online on or

before 10.01.2011 up to 6:00 pm. 5. The tender shall be accompanied by EMD amounting to Rs. 25,000/- (Rupees Twenty Five

Thousand only) in the form of Demand Draft drawn on a D.D. of Nationalized bank / HDFC Bank / ICICI Bank/ Axis Bank payable at Ahmedabad in favour of The Director,

U. N. Mehta Institute of Cardiology & Research Centre on 11.01.2011 at the Institute before opening of the tender i.e. 1:30 pm.

Any Physical submission not accompanied by the requisite EMD is liable to be rejected.

It is understood that EMD will not bear any interest and shall be returned to all

unsuccessful bidders after the award of the work to the successful bidder. The EMD will stand forfeited in the event of the contractor whose tender is accepted and fails to execute the contract when called upon to do so.

6. The EMD of successful bidder will be converted is security deposit after signing the

contract agreement. 7. The tender bid shall be valid for 90 days from the date of submission of the tender.

PREQUALIFICATION CRITERIA 1. Contractors are requested to submit the details about their organisation, their technical

experience, their spare capacity and their competency and suitable evidence of their financial standing. Contractors shall be liable for rejection due to any false or incomplete information furnished.

INITIAL CRITERIA FOR ELIGIBILITY FOR PRE-QUALIFICATION

I. The Bidder should have the site area within 30 kms. from UNMICRC.

II. The Bidder should have minimum five year Experience of this type of work.

III. The Bidder must have experience and work completion Certificate for LAUNDRY WORK in organizations like Big Govt. Hospital, Corporate Hospitals, Multi/Super Speciality Hospital, Western RLY., Semi Government and Local Self Government Body etc…

IV. The Bidder should have Average Annual turn over of more than Rs. 20 Lac. for the last

three financial year ending 2009-10. CA certificate with copy of balance sheets should be enclosed.

V. UNMICRC shall give to preference who is certified by Gujarat Pollution Control Board.

VI. The Bidder Should have any one financial year Bill / Purchase Order of Rs. 4 lac from one

firm.

PREAMBLE & SCOPE OF WORK

1. PREAMBLE

1.1 It is proposed to provide LAUNDRY WORK of the U. N. Mehta Institute of

Cardiology & Research Centre, Civil Hospital Campus, Asarwa, Ahmedabad 380 016

1.2 The contractor should work with high efficiency.

2. SCOPE OF WORK - Contractor will have to wash dry all Clothes by Automatic Laundry Machine.

- Ironing of Linen will be as requirement mentioned in BOQ.

- Big clothes: Bad sheet, Draping sheet, OT Sheet, Woollen Blanket, Cotton Blanket,

Big Curtain, Gown, Apron, Screen Curtain, Mattress cover etc.

- Medium clothes: Draw sheet, Pillow, Pillow Cover, Shirt, Pent, Medium Curtain, Dirty

Clothes Bag, Operation / isolation towel, White Turkish Towel, Hall Towel, Squire

cousin cover, Ring towel, PPI Cap, Trey cover, Cautry Cover, etc.

- Small Clothes: White Napkin, Green Napkin, Mops, Cap, Mask, Duster pieces,

Triangular, Side pieces, Shaft cover etc.

- The wash linen with soap, washing detergent powder, emulsifier, Industrial salt,

Hydrogen peroxide, Hydrofluoric acid (H.F.) Borax, Liq. Ammonia, Sofener, Oxalic Acid,

Tinopol, Soda ash Bleaching Reagent and other required chemical.

PROCEDURES FOR SUBMITTING TENDERS

A) EARNEST MONEY TENDER FEE

Should be submitted on 11.01.2011before 1:30 p.m. in a separate, sealed envelope at the Institute’s Office marked with the wordings “EARNEST MONEY & TENDER FEE” at U. N. Mehta Institute of Cardiology & Research Centre, Civil Hospital Campus, Asarwa, Ahmedabad 380 016.

B) Technical Bid (TB) TECHNICAL BID should be submitted ON LINE as per details asked on website. Copies of supporting documents can be attached in scanned format online while Physical Original submission's verification is must and to be carried out on 11.01.2011before 1:30 p.m. before opening of Tender at U. N. Mehta Institute of Cardiology & Research Centre, Civil Hospital Campus, Asarwa, Ahmedabad 380 016. a) prequalification information b) All the technical Documents like, Performance

Certificates, Copy of Income Tax Return of last three years along with Annual account, Profit & Loss account, Balance sheet etc. duly stamped and signed by the bidder.

C) Price Bid (PB) PRICE BID should be given ON LINE as per details asked on web site.

1) Please note that NO PRICES SHALL BE INDICATED in the Earnest money Bid or the Technical Bid, otherwise the Bid will be rejected outright without any further correspondence.

2) All physically submitted documents like Original Earnest Money Bid, as above must be

kept in single sealed cover marked with name of the Bidder and Name and Address of the Bidder.

3) If the Earnest money Bid does not comply the requirement, it shall be rejected and

Technical & Price bid shall not be opened. 4) If the Technical bid does not comply the requirement, it shall be rejected and the Price bid

shall not be opened.

B) PRICE BID

a. Price Bid to be submitted Online. C) Procedure for evaluation of Bid

a. This is three cover bid system. b. The physical submission of cover one and two (tender fee & EMD) will be checked and

verified (Technical + Pre qualification). The successful bidder’s, cover 3 will be opened.

c. The Bid Committee will evaluate the bids and may visit the Site of work. The Technical

Committee will approve / recommend the Qualified Bidders.

d. The Price Bid will be opened of only Technically Qualified Bidders and the Contract will be awarded to the bidder which has the lowest bid total in aggregate.

Present manpower and other resources. - The above Assessment will be for fulfilling the quantity and Technical Specifications of

Cardiac Hospital LAUNDRY WORK provided elsewhere in the contract. - The cost for carrying out Inspection will be paid by the Contractor.

ARTICLES OF AGREEMENT ARTICLES OF AGREEMENT made at Ahmedabad, on this _____________ day of ______ 2010 between

M/s. UN Mehta Institute of Cardiology & Research Centre, (hereinafter referred to as ‘The Owners’ which

expression shall include his heirs, executors, administrators, and assignees) of the ONE PART.

AND

M/s. ___________________________., (hereinafter referred to as ‘The Contractor’ which express in shall

include his heirs, executors, administrators and assigns) of the other part.

Whereas the owner is desirous of getting executed the Services of proposed of UNMICRC which is

described as Hospital LAUNDRY WORK.

WHEREAS THE Contractor has expressed his desire by Applying in Advertised E Tender to provide

Laundry Work to UNMICRC, Ahmedabad under this Agreement .The Contractor has represented that they

have the necessary experience and expertise, infrastructure , manpower , training facilities for providing

compressive Laundry Work and they possess financial capability to deliver Laundry and related Work as

may be assigned to them from time to time by the institute.

NOW IT IS HEREBY AGREED AS FOLLOWS:

1. The Owner shall pay the Contractor the said Contract Amount or such other sum as shall become

payable at the times and in the manner hereinafter specified in the said Conditions.

2. The said Conditions and appendices there to shall be read and construed as forming part of this

Agreement, and the parties hereto shall respectively abide by and submit themselves to the

Conditions and perform the Agreement on their part respectively in said Conditions contained.

All the said documents shall be read and construed together as forming part of this contract, and the

parties hereto will respectfully abide by this submit themselves to the conditions and stipulations and

perform the contract on their parts respectively.

6 The contractor hereby agrees to comply all the laws which may be applicable.

7 Any and all disputes or differences arising out of or in connection with this contract and not

amendable to amicable settlement shall be referred to arbitrator or panel arbitrators in accordance

with Indian Arbitration Act. Place of Arbitration shall be at Ahmedabad. One of the arbitrator shall be

appointed by the Director, UNMICRC, and other arbitrator by the Contractor, and both arbitrators will

finalize the third Arbitrator.

8 Time is essence of contract. Work is to be completed as per the time schedule mentioned in the

Letter of Intent bearing No. Cardio:_________ dated :______2010.

9 Contract labour requirement and duties as per chart which annexed herewith and marked Annexure

“B” will form part of this Agreement .The Contractor is required to follow the same in consonance

with the SOPs formed for this Work.

10 The Contractor shall pay wages to their contract labourers rendering Laundry Work at the rates

applicable under Minimum Wages Act.

11 The Contractor would be liable for wages, Service Tax, Service Charge, EPF & ESI contribution,

Workman Compensation, Gratuity and Other Benefits as per other Act/Laws applicable to the

Contract Labours.

12 TDS will be deducted from the bill amount as per the Income Tax Act.,1961.

13 The Contractor shall be responsible for all the acts done by the personnel / contract labourers

engaged by the Contractor’s personnel and contract labourers in the premises of UNMICRC,

Ahmedabad.

14 Payment will be release 15 days after receipt of necessary documents of completion of satisfactory

works by contractor.

15 If the Linen is not returned with washing, drying and ironing within 24 hours from its receipt even

during rains, Rs. 500/- (Rupees Five Hundred only) will be deducted from the monthly bill of the

bidder. 16 All the parts of this contract have been read and fully understood by the undersigned.

thereto affixed and signed on its behalf by its Director, and the Contractor has/have signed this Agreement

General Terms & Conditions: I. i) Tender document shall be downloaded from the web site & duly filled in and signed

with full validity as per Tender Enquiry, failing which Tenders will be liable to be rejected.

ii) Covering letter should clearly indicate the list of enclosures.

i. It shall be presumed that the Terms & Conditions mentioned in the Tender have

been duly accepted by bidder in the case he submits the Tender. The Bidder shall have no right to modify / alter / amend / delete any Terms / Conditions mentioned in Tender document.

ii. Each page of the Tender should be signed by the bidder with the seal of his firm while physically submitting tender in a sealed cover.

iii. Telegraphic / Telex / Fax and Letter Head quotations, and physical quotations / tenders are not acceptable and will be rejected.

iv. The owner has the right to reject, withdraw / revoke / cancel whole or any part of Tender / or at any stage without assigning any reason.

v. No correspondence shall be entertained after opening of the Tenders. II. Earnest Money Deposit (EMD-Refundable), as per Annexure-2

Tender Fees as mentioned on the page 3 of the tender document mentioned in Notice Inviting Tender (Non Refundable).

III. Each Tender must be accompanied by a Demand Draft/Pay Order for EMD payable at

Ahmedabad in the name of The Director, U. N. Mehta Institute of Cardiology & Research Centre for Rs. 25,000/- (Twenty Five Thousand only), duly discharged.

IV. The DD shall be payable by the contractor as the Earnest Money Deposit. V. No interest shall be payable by the owner on the Earnest Money Deposit. It is understood that EMD will not bear any interest and shall be returned to all

unsuccessful bidders after the award of the work to the successful bidder. The EMD of successful bidder will be converted is security deposit after signing the

contract agreement. VI. The EMD is liable to be forfeited if the Bidder withdraws or awards or impairs or regret the

Bid in any respect within the period of validity of this offer. VII. Income Tax Return (As per Annexure-3) VIII. The Bidder must attach a scanned image of last three Income tax return (ITR) and PAN

number, Issued in the name of the firm, along with Technical bid. Failure to submit the same shall render invalid automatically. Govt. of India / State Government Undertaking is exempted from submitting the Income Tax Return. The Original Document shall be presented for verification on 11.01.2011 before 1:30 p.m. along with EMD.

Special Terms & Conditions

1. Daily number of different size of cloth to be washed & pressed approximately is as

under. Big cloth 475, Medium cloth 250, small cloth 100 and press for big & medium

cloth. You are required to give rates for each type of cloth for wash & press. On this

basis daily charges towards washing & pressing will be calculated and party quoting

lowest (L1) will be awarded the contract. This break-up of number of cloth to be

washes & pressed daily is an approximate estimate.

2. The actual number may increase or decrease and accordingly bill is to be raised on

number of Linen actually washed & pressed.

3. The bidder has to quote for all the items mentioned in Bill of Quantities. If the bidder

fails to fill up the full Bill of Quantities, the tender of the same bidder is liable to be

rejected.

4. Collection of Dirty Linen from various wards and returning of dry / pressed Linen back

to respective wards will be the responsibility of the bidder.

5. Washed / pressed linen should be returned within 24 hrs. Late delivery is liable for

penalty.

6. The LAUNDRY WORK will be provided even on the Sundays/ Public Holidays and

during the emergency.

7. The bidders interested in the LAUNDRY WORK will have to wash and dry the cloths

with automatic LAUNDRY WORK machine.

8. The bidders / agencies having certificate of Gujarat Pollution Control Board will be

given preference.

9. The Prices filled in the Price Bid will be inclusive of the transportation from the

respective wards, wash, drying of the linen, ironing of Linen and return it to respective

wards with applicable taxes/ levies/ duties etc…

10. No increase in the price will be given in form of taxes / levies / duties increase in

wages, material rate etc…

11. The bidder should use branded raw materials during the LAUNDRY WORK process of

the linen. U N Mehta Institute of Cardiology and Research Centre reserves the right to

Accept/Reject the material to be used in the process of Laundry work.

12. If any Linen from the Institute will be returned in the torn/burnt manner OR if the Linen

is lost during the transport or washing will be the responsibility of the bidder and the

original price of the damaged OR lost material will be deducted from the monthly bill of

the bidder.

13. No Acidic liquid should be used for the LAUNDRY WORK of Clothes.

14. If the Linen is not properly washed OR ironed it will be returned back and it has to be

rewashed OR Re-ironed by the bidder. No extra charges will be paid for this purpose.

15. The bidder cannot transfer this contract to some one else OR even cannot appoint the

Sub Contractor for the Laundry Work.

16. The contract will be valid for One year.

17. The Director of the Institute reserves the right to terminate the contract at any stage

without any pre notification and on Immediate basis.

18. The bidder has to submit the monthly bill in two copies (Original & Duplicate)

addressing to the Director, U. N. Mehta Institute of Cardiology & Research Centre.

19. Penalty Clause: If the Linen is not returned with washing, drying and ironing within 24

hours from its receipt even during rains, Rs. 500/- (Rupees Five Hundred only) will be

deducted from the monthly bill of the bidder.

20. The Director UNMICRC Reserve the right for the implementation of penalty clause.

21. The Director of the Institute may extend the contract subject to same terms and

conditions, if found necessary, for a period of six month to which the contractor will

have to abide by. However, the extension for a period of more than six month can be

granted on mutual agreement by both parties.

22. The legal jurisdiction for any dispute will be Ahmedabad only.

23. If any dispute arises out of the transaction in any manner that shall be resolved by the

sole arbitration which shall be appointed by the Director, UNMICRC and in case such

person is not acceptable to the supplier, Director-UNMICRC shall be the final and sole

arbitrator who shall undertake the exercise of arbitration to resolve the dispute and

such award as may be given by Director-UNMICRC shall be final and binding on both

the parties.

24. In case if L1 fails to provide satisfactory services, the Director, U. N. Mehta Institute of

Cardiology & Research Centre reserves the right to terminate the contract to give the

same to L2.

25. In such case the security deposit of the terminated contractor is liable to be forfitted.

26. The contractor would be engaged purely on temporary and trial basis for a period of

three months to observe the working of the system by the contractor and if within the

said period, the work is not found satisfactory, the contract would be discontinued

automatically on the expiry of the said period.

27. The UNMICRC will have right to deduct Income Tax of TDS as applicable form time to

time.

28. The Contractor would be liable for wages, Service Tax, Service Charge, EPF & ESI

contribution, Workman Compensation, Gratuity and Other Benefits as per other

Act/Laws applicable to the Contract Labours. Contractor will have to provide prescribed

uniform & I-card to each staff. The Institute may refuse the entry of any personnel /

contract labour of contractor without proper uniform & I card.

29. The decisions, opinion, direction, certificate (except for payment) with respect to all or

any of the matters under relevant clause (which are herein referred to as the excepted

matters) shall be final and conclusive and binding on the parties hereto and shall be

without appeal. Any other decision, opinion, direction, certificate or valuation of the

Client or any refusal of the Authority to give any of the same, shall be subject to the

right of arbitration and review under clause 34 hereof in the same way in all respects

(including the provision as to opening the reference) as if it were a decision of the

Client.

All disputes and differences of any kind whatever arising out of or in connection with

the Contractor the carrying out of the works (whether during the progress of the works

of after their completion and whether before or after the determination abandon or

breach of the contract) shall be referred to and settled by the Client who shall state his

decision in writing. Such decision may be in the form of a final certificate or otherwise.

The decision of the Client with respect to any of the excepted matters shall be final and

without appeal as stated in relevant clause. But if either the Client or the Contractor be

dissatisfied with the decision of the Authority on a matter, question or dispute of any

kind (except any of the excepted matters)or as to the withholding by the Authority of

any certificate to which the Contractor may claim to be entitled, then in any such case

either party(the Client or the Contractor) may within 28 days after receiving notice of

such decision give a written notice to the other party through the Authority requiring

that matters in dispute be arbitrated upon. Such written notice shall specify the matters

which are in dispute or difference of which such written notice has been given and no

other shall be and is hereby referred to the arbitration and final decision of an arbitrator

to be agreed upon and appointed by both the parties or, in case of disagreements as

to the appointment of a single arbitrator, to the appointment of two arbitrators, one to

be appointed by each party, which arbitrators shall, before taking upon themselves the

burden or reference, appoint an Umpire. The venue for such arbitration shall be at

Ahmedabad.

The Arbitrator or Arbitrators, as the case may be, shall have power to open up, review

and revise any certificate, opinion decision requisition or notice, save in regard to the

excepted matters in dispute which shall be submitted to arbitration and of which notice

shall have been given as aforesaid.

The Arbitrator or Arbitrators, as the case may be, shall make his or their award within

one year (or such further extended time as may be decided by him or them as the case

may be with the consent of the parties) from the date of entering on the reference. In

case, during the arbitration proceedings, the parties mutually settle, compromise or

compound their dispute or difference, the reference to arbitration and the appointment

of the Arbitrator or Arbitrators, as the case may be, shall be deemed to have been

revoked and the arbitration proceedings shall stand withdrawn or terminated, with

effect from the date on which the parties file a joint memorandum of settlement thereof,

with the Arbitrator or the Arbitrators, as the case may be.

Upon every or any such reference, the cost of, incidental to the reference and award respectively, shall be in the

discretion of the Arbitrator or Arbitrators, as the case may be who may determine the amount thereof, or direct the

same to be taxed as between attorney and Client or as between party and party and shall direct by whom and to

whom and in what matter the same shall be borne and paid. This submission shall be deemed to be a submission to

arbitration within the meaning of the Indian Arbitration Act, 10 or any statutory modification thereof. The Award

of the Arbitrator or Arbitrators, as the case may be, shall be final and binding on the parties. It is agreed that the

Contractor shall not delay the carrying out of the works by reason of any such matter, question or dispute being

referred to arbitration, but shall proceed with the works with all diligence and shall, until the decision of the

Arbitrator or Arbitrators, as the case may be, is given, abide by the decision of the Authority and no award of the

Arbitrator or Arbitrators, as the case may be, shall relieve the Contractor of his obligation to adhere strictly to the

Authority 's instructions with regard to the actual carrying out of the works. The Client or the Contractor hereby

also agree that arbitration under this clause shall be a condition precedent to any right of action under the contract.
