Article 50 Treaty on European Union 1.  Any Member State may decide to withdraw from the Union in accordance with its

own constitutional requirements. 2.  A Member State which decides to withdraw shall notify the European Council of its

intention. In the light of the guidelines provided by the European Council, the Union shall negotiate and conclude an agreement with that State, setting out the arrangements for its withdrawal, taking account of the framework for its future relationship with the Union. That agreement shall be negotiated in accordance with Article 218(3) of the Treaty on the Functioning of the European Union. It shall be concluded on behalf of the Union by the Council, acting by a qualified majority, after obtaining the consent of the European Parliament.

1.  Todo Estado Miembro podrá decidir, de conformidad con sus normas

constitucionales, retirarse de la Unión. 2.  El Estado Miembro que decida retirarse notificará su intención al Consejo Europeo.

A la luz de las orientaciones del Consejo Europeo, la Unión negociará y celebrará con ese Estado un acuerdo que establecerá la forma de su retirada, teniendo en cuenta el marco de sus relaciones futuras con la Unión. Este acuerdo se negociará con arreglo al apartado (3) del Art. 218 TFUE. El Consejo lo celebrará en nombre de la Unión por mayoría cualificada, previa aprobación del Parlamento.

An Act is necessary to convert the UK’s international obligations under the various

European treaties into law with domestic effect. Without the Act, those European rules would have had effect between States at the international level but would not have been part of domestic UK law and so would

not have bound UK citizens individually.

29 March 2017 The European Council adopted a statement on the UK notification:

We regret that the United Kingdom will leave the European Union, but we are ready for the process that we now will have to follow. (...) In these

negotiations the Union will act as one and preserve its interests. Our first priority will be to minimise the uncertainty caused by the decision of the

United Kingdom for our citizens, businesses and Member States.

El Consejo Europeo adoptó una declaración sobre la notificación de UK: Lamentamos que el Reino Unido vaya a dejar la UE, pero estamos

preparados para el proceso que debemos seguir ahora (…) En estas negociaciones la Unión actuará como una sola entidad y protegerá sus

directives in Annex cover the first phase of the negotiations, which will prioritise matters which, at this stage, have been identified as

strictily necessary to ensure an orderly withdrawal”

3. The Treaties shall cease to apply to the State in question from the date of entry into force of the withdrawal agreement or, failing that, two years after the notification referred to in paragraph 2, unless the European Council, in agreement with the Member State concerned, unanimously decides to extend this period.

3. Los Tratados dejarán de aplicarse al Estado de que se trate a partir de

la fecha de entrada en vigor del acuerdo de retirada o, en su defecto, a los dos años de la notificación a que se refiere el apartado 2, salvo si el Consejo Europeo, de acuerdo con dicho Estado, decide por unanimidad prorrogar dicho plazo.


The date of entry into force of the withdrawal agreement should be at the latest 30 March 2019,

unless the European Council, in agreement with the United Kingdom, unanimously decides to extend this period in

accordance with Article 50(3) TEU.

La fecha de entrada en vigor del Acuerdo de Salida deberá ser como muy tarde el 30 de marzo de 2019, salvo que el Consejo Europeo, de acuerdo con el Reino Unido, decida

por unanimidad extender el periodo según lo previsto en el Art. 50(3) TEU


Failing that, on 30 March 2019 at 00:00 (Brussels time), all

Union Treaties and the Treaty establishing the European Atomic Energy Community cease to apply to the United

Kingdom. The United Kingdom will become a third country from the withdrawal date.

En caso contrario, el 30 de marzo de 2019 a las 00:00 (hora de Bruselas), todos los Tratados de la Unión y el Tratado por

el que se establece la Comunidad Europea de la Energía Atómica dejarán de aplicarse al Reino Unido. El Reino Unido será un tercer país desde la fecha de la salida.


On the same date, the Treaties cease also to apply to the

overseas countries and territories having special relations with the United Kingdom and to the European territories for whose external relations the United Kingdom is responsible, to which the Treaties apply by virtue of Article 355 TFEU

En la misma fecha, los Tratados dejarán también de

aplicarse a los territorios de ultramar y los territorios que tienen relaciones especiales con el Reino Unido y a los

territorios de la Unión de cuya política exterior es responsable el Reino Unido, a los que se aplican los

Tratados en virtud del Art. 355 TFUE
