Regular Monthly Meeting of Board of CommissonersFebruary 14,2013Blountville Utility District Office

Present: I. Stewart, J. Dickens, J. Hicks, Manager Glover and Lynn Stewart.

Minutes of the January meeting were approved as presented.

Manager’s monthly report was presented to the Commission.

NEW BUSINESS

Discussion on commercial insurance that expires on 3-13-13. There are twoproposals with very little difference in cost. Commissioners decided to let theManager make the decision before the expiration date.

Motion was made by J. Dickens to look into taking debit and credit cards.Seconded by J. Hicks and the motion carried.

Ira W. Stewart resigned as a Blountvilie Utility District commissioner. This isto be effective on this date. Resignation accepted by the other Commissioners.The vacant seat to be posted in the news paper at least 21 days before the nextmeeting. Names will be given to the County Mayor in order of their preference.

No other business to discuss, a motion was made by J. Dickens to adjourn at6:35 P. M. Seconded by I. Stewart and the motion carried.

5. Consult with the State Commissioner of Labor and Workforce Development, asappropriate,regardingsafetyandheahli problerirs ~viniclrare consideredto be unusualor peculiar and are such that they cannothe achieved under a standard promulgatedby the State.

6. Provide reasonableopportunity for the participation of employeesin the effectuationof the objectives of this program, inchrding the opportunity to make anonymous

complaints concerning conditionsor practices injurious to employeesafety and health.7. Provide for education and training of personnel for the fair and efficient

administration of occupationalsafety and health standards, and provide for educationad notification of all employeesofthe existenceof this program.

COVERAGE: The provisions of the Occupational Safety and Health Program for theEmployees of Sullivan County Government shall apply to all employees of eachadministrative department, commission, board, division, or other agency of SullivanCounty whether part-time or full-time, seasonalor permanent.

STANDARDS AUTHORIZED: The occupational and health standards adopted by theCounty Commission are the same as, but not limited to, the State of TennesseeOccupational Safety and Health Standards promulgated, or which may be promulgated,in accordancewith Section6 of the TennesseeOccupational Safetyand Health Act of 1972(T.C.A, Title 50, Chapter 5).

VARiANCES FROM STANDARDS AUTI-IORIZEIJ: Sullivan County may, uponwritten application to the Commissionerof Labor and Workforce Development of theStateof Tennessee,request an order granting a temporary variance from any approvedstandards. Applications for variances shall be in accordancewith Rules of TennesseeDepartment of Labor and Workforce l)evelopnnent Occupational Safety and Health,Chapter 0800-1-2,as authorized by T.C.A., Title 5. Prior to requesting such temporaryvariance, Sullivan County shall notify or serve notice to employees,their designatedrepresentatives,or interested parties and present them with an opportunity for a hearing.The posting of notice on the main building board as designatedby Sullivan County shallbe deemedsufficient noticeto employees.

ADMINISTRATION: For the purposes of this resolution, the Risk Manager isdesignated as the Director of Occupational Safety and Health to perform duties and toexercisepowers assignedso as to plan, develop, and administer said plan. The Directorshall develop a plan of operation for the program and said plan shall becomea part ofthis resolution when it satisfies all applicable sections of the TennesseeOccupationalSafety and Health Act of 1972 and Part IV of the TennesseeOccupational Safety andHealth Plan.

FUNDING THE PROGRAIVI: Sufficient funds for administering and staffing theprogram pursuant to this resolution shall be made available as authorized by the CountyCommission.

SEVERABILITY: That if any section,sub-section,sentence,clause,phrase, or portion ofthis resolution is for any reason held invalid or unconstitutional by any court ofcompetent jurisdiction, such portion shall be deemedseparate, distinct, and independentprovision, and suchholding shall not affect thevalidity of the remaining portions hereof.

RESOLUTION To Amend The 2012—2013General PurposeSchool Budget By $50,000.00ToAllow For The Transfer Of Funds To The Education Capital Projects Fund That Are NeededToComplete The Energy Efficient School Initiative (EESI) Project

WHEREAS, the SullivanCountyDepartmentof EducationBoard,in acontinuingeffort to improvethe operational efficiency of our schools, approved by vote to perform a system wide EESI renovationproject; and

WHEREAS, the cost of this renovationwas projectedto be $5,345,000and was funded with a stateEESI low interest loan, EESI grant,andTVA incentivefunds; and

WHEREAS, this project is nearing completion and it has been determined that np to $50,000 infunding is needed to cover the final renovation costs; and

WHEREAS, this has created the need for a one-time appropriation that can be funded from theUnassigned Fund Balance Account in the General PurposeSchoolFund; and

WHEREAS, the Sullivan County Board of Education andTennesseeDepartmentof Educationhaveapproved the use of these fundsfor this purpose.
