Using nozzles of differentsizes

If nozzles of different sizes areused in a sprayer, the first rat-ing determined derives fromthe assumption that nozzles ofthe same size are fitted.

The number of nozzles of thenext smallest size is taken intoaccount according to the totalnumber of nozzles.

In order to obtain the specifiedliquid output (setpoint), thepressure must be increased inaccordance with the formulabeside.

ExampleAt a sprayer speed of 6.5 km/h, 600 l/ha should beapplied. The working width is2.0 m. The total nozzle outputis then:

If 10 nozzles of the same sizeare used, the flow rate ofeach nozzle is 13.0 : 10 = 1.3 l/min.‘nozzle/pressure as perTable see above:

Atomization

The atomization processbreaks liquids down intodroplets. Most of the nozzles used in agriculturerely on hydraulic atomiza-tion resulting from fluidpressure in combinationwith the orifice effect of thenozzle tip. Those two fac-tors accelerate the flow velocity of the medium tobe atomized. This convertspotential energy into kineticenergy (= speed). The release of tension experi-enced by the liquid as itemerges from the nozzletip produces an initially flatlamella of liquid that soonloses its stability and be-comes wavy. That givesrise to strings of liquid thatdisintegrate into droplets ofvarious size.

Specification of Lechlernozzles

The performance data ofLechler agricultural spraynozzles are stated in ac-cordance with internationalstandards and include thefollowing information:n type of nozzlen spray angle n nozzle size

Lechler nozzles are ISOcolour-coded, with eachdifferent colour correspon-ding to a defined flow rate.The latter is also reflectedin the nozzle size, e.g., -05 stands for a flow rate of0.5 US gallons per minute— at 40 PSI, or 1.89 l/minat 2.81 bar, or 1.94 l/min at3.0 bar (colour: brown).The material indicator forcolour-coded nozzles is either “S” for stainless steelor “C” for ceramic.

CoverageThe theoretical coverage ofa given nozzle is chieflydetermined by the sprayangle and the spray height,i.e., the distance betweenthe nozzle and the targetsurface. Depending on theheight of the nozzle and itssize, the spray angle andaccuracy of distributioncan depend to a certainextent on the spray pres-sure. Hence, the recom-mended spray pressure at the nozzle tip and theminimum spray height fora specific nozzle spacingare two prerequisites forthe uniform distribution ofliquid within the spray pattern.

The following laws ofphysical regularity applyin principle(data in table based onwater):

n Spray media with vis-cosities higher than thatof water have narrowerspray angles.

n Spray media with lesssurface tension than thatof water have broaderspray angles.

n The density of the spraymedium has little effecton the spray angle.

Overlapping in broadcastspraying

Most broadcast sprayingwith boom sprayers is exe-cuted with flat-jet nozzles.Multiple-overlapping en-sures that the liquid is uni-formly distributed acrossthe entire working width ofthe boom. Thanks to theirlarge spray angles of 120°and 90°, high-precisionnozzles by Lechler are particularly well-suited tothe job.

Flat spray nozzles

With a view to avoidingmutual interference, thespray planes of flat spraynozzles have an offset of5° – 10° with respect to theboom axis. In the case ofLechler diaphragm checkvalves used in conjunctionwith Lechler’s TWISTLOC/MULTIJET bayonet caps,the offset is adjusted auto-matically.Lechler offers a specialnozzle aligner (order no.065.231.02 see page 55)for systems with threadedcaps.

Spray tip materials

Most agricultural spraynozzles are made of plastic(POM), stainless steel, ceramic and, in some cases, brass.

All these materials are resistant to known plantprotection chemicals, andall with the exception ofbrass are resistant to liquidfertilizers.

n Plastic is conspicuousfor high precision, resis-tance to wear and verygood price-performanceratios.

n Stainless steel is thematerial of choice forhigh mechanical loads.

n Ceramic nozzles are themost wear-resistant ofall and therefore re -commended for their extremely long servicelives and high area-specific performance.

Nozzle wear

n Even properly used nozzles wear down intime and eventuallyhave to be replaced.

n The rate of wear depends on such fac-tors as spray pressure,abrasiveness of thesprayed liquid, and thematerial of which thenozzle is made.

n Improper cleaning andhandling can damagethe nozzle tips andtherefore must be avoided.

n An easy way to deter-mine how badly worn anozzle tip may be is togauge its flow rate withthe aid of a calibrationcontainer, a stop watchand a pressure gaugefitted on a nozzle bodyon the spray boom. Withsuch a setup, one com-pares the flow ratethrough a used nozzlewith that of a new one of equal size.

n If the flow rate through a used nozzle is foundto exceed that of a newspray tip by more than10 %, it should be replaced.

All data shown in the tablesof this catalogue state theflow rates of new nozzles.Nozzles fitted on a sprayboom can also be checkedon a test bench (patter -nator) to determine theircondition with regard tocross distribution. Thequality of cross distributionand changes in flow ratecan be interdependent withregard to the calculatedcoefficient of variation (CV).

Nozzle maintenance

The proper, uniform appli-cation of plant protectionchemicals requires well-functioning nozzles.n Consequently, all noz-zles should be washedout with clear water aftereach use to prevent anyaccumulation of de-posits in the nozzle feedlines and in the nozzlesthemselves.

n Manual cleaning of noz-zles should be restrictedto the use of cleaningbrushes (order no.06A.D30.56.00 see page12) to avoid damagingthe exit orifice rims ofthe nozzles.

n The best way to avoidclogging is to ensurethat all strainers andscreen inserts servingthe nozzles or otherparts of the apparatusare properly selected.

n The flow-rate tables fornozzles of different typesand sizes include refer-ences to recommendednozzle strainers.

n The strainer setup onthe plant protectionequipment should havedecreasing mesh widths(i.e., increasing meshnumber) from the fillingscreen to the nozzlestrainer.

Regular inspection of sprayer and nozzles

Problems andconsequences

Modern plant protectionmanagement, i.e., a form ofpractice that is both thriftyand conservational, is decisively dependent onthe accurate application of plant protectants. That,however, can only be guaranteed, if the sprayeris inspected at regular intervals. Practiced handshave long known that undetected equipment defects have negative impacts on farm profits.Overdosing and under -dosing cause lower yieldsand can damage crops tothe point of total loss. Falsedosing also increasescosts and emburdens theenvironment.

Some countries of Europehave laws that call forobligatory testing ofsprayers, and other coun-tries will soon be adoptingsuch laws. In Germany, forexample, all sprayers haveto be checked at three-yearintervals by an officiallycertified test station.

Heavy duty

Boom sprayers used forspraying more than 2000 ha a year are subjectto accordingly heavy wear& tear and therefore shouldbe inspected at least oncea year to enable timely detection and rectificationof concealed defects, thusensuring that the imple-ment retains a high level ofoperational reliability.

Cross distribution andcoefficient of variation

The inspection of equip-ment includes an examina-tion of in-service nozzlesvia computer-aided as-sessment of their cross dis-tribution on a patternator(spray scanner) and calcu-lation of the coefficient ofvariation. JKI-approvednozzles in as-new conditionachieve coefficients of vari-ation (CV) amounting to lessthan 7 % for defined sprayheights on standardizedlaboratory spray boomsand patternators. The per-missible limit for sprayersand their nozzles in every-day use is 10 %.

Integrated plant protectionis a term used to describethe application of physical,biological and chemicalprocesses with allowancefor economical damagethresholds. In that connec-tion, ecologically viabletechniques are becomingincreasingly important, with the loss-reducingapplication of plant pro -tectants enjoying a specialplace value.

JKI, ENTAM and CEN

Compliance with ISO, CEN,JKI and ENTAM standardsregarding flow-rate toler-ance and uniformity of dis-tribution is instrumental tothe optimal, selective useof plant protectants. Theflow rates of new agricultu-ral spray nozzles must re-main within +/- 5 % of thetable values.

The maximum allowablecoefficient of cross-distribu-tional variation within thestated pressure range andcorresponding sprayheights is 7 %.

These requirements derivein good part from the de-pendable quality of Lechlernozzles.

Drift

In the field of plant protec-tion, the agent-ladendroplets that do not landon the target surface butare instead carried off bythe wind or thermal cur-rents are referred to asdrift.Such errant additions tosurrounding areas candamage adjacent crops,contaminate nearby waters,endanger man and ani-mals, emburden othercrops and adulterate thedosage applied to the tar-get crop.

Drift is caused by a numberof equipment-specific andmeteorological factors, e.g.:n droplet sizen sprayer velocityn spray heightn wind velocityn relative temperaturen ambient humidity

Technical know-how andknowledge of the deter-mining factors enablegood control of drift. Good,modern practice thereforeincludes:

n such drift-reducing measures as verycoarse-droplet applica-tion through ID3/IDK/IDKN/IDKT nozzles

n allowance for the direc-tion and velocity of thewind, for example metering in the field withPocketwind III / IV, see page 55

n limitation of plant protec-tion measures viaID3 and IDK/IDKN/IDKT-nozzles to windvelo cities of 5 m/s orless, AD nozzles to 4 m/s or less, and LU nozzles to 3 m/s or less

n interruption of plant protection measures atambient temperaturesabove 25 °C and relative humidity levelsbelow 30 %, for examplemetering in the field withPocket-wind III / IV, seepage 55

n sprayer speed in accor-dance to national agri-cultural practice

Environmental-compatibility criteria for agricultural spray nozzles

Drift- and Loss-reducingtechniques

Provisions governing theapplication of plant protec-tants, e.g., distance-to-water restrictions andhedge rows, have beenadopted for the protectionof non-target organisms.Depending on the toxicityof the plant protectant,such drift- and loss-reduc-ing equipment as injectornozzles can significantlyreduce the required dis-tances to water bodies andhedge rows for field cropsand space crops (e.g. or-chards, vineyards and treenurseries). In Austria, Belgium, England, FinlandFrance, Germany, theNetherlands and Sweden,Lechler nozzles are officially approved as drift reducingdevices.

The distance requirementsare functions of nozzletechnology, type of waterbody, bank flora andprocess-technological requirements. Analyses ofLechler ID3/ID/IDN/IDK/IDKN/ IDKT/IS/IDKS/E/ADnozzles and their driftstability in comparison withthat of conventional flatspray nozzles in differentcountries, e.g., Austria,Belgium, England, Finland,France, Germany, theNetherlands and Swedenenabled their accre di tationin the drift -re duction class-es 99%, 95%, 90%, 75%,66%, 50% and 25%. Fortreating field cropsalong bodiesof water,

ID3/ID/IDN/IDK/IDKN/IDKT/PRE air-injector nozzles areused to enable shorterwater-to-crop distancesrespectively hedge rows incompliance with pertinentregulations merely byreducing the speed of themotor and, hence, thesprayer speed and spraypressure. It is neither necessary toreadjust the sprayer nor toalter the sprayed-liquiddose rate, and the remain-der of the field can betreated at the optimal pressure recommended forID3/ID/IDN/IDK/ IDKN/IDKT/PRE nozzles.

Even more in Austria, Ger-many, Finland and SwedenLechler ES even flat spraynozzles have received the90 % proven drift reductionfor banding in row crops. For air assisted sprayersLechler ID 90, IDK 90, AD 90and for banding IS 80 air-injector off center nozzlesare approved in Austria,Belgium, Germany, theNetherlands and Sweden.

In Austria, Belgium, England,Finland, France, Germany,the Netherlands and Swe-den air-injector off center nozzles IS 80 respectively

IDKS 80 are recommendedalong field peripheries andhedge rows at the end ofthe boom for sharp demar-cation in combination withID3/ID/IDN respectivelyIDK/IDKN/IDKT nozzles.

Analog to field crops perti-nent regulations have to befollowed up for air assistedsprayers by use of ID 90,IDK 90 or AD 90 nozzlessuch as reducing air vol-ume or making air flow in-effective directed to watercourse or hedge rows for adefined number of rowsand if necessary to applydefined pressure settings.

The flexibilization of dis-tance-to-water requirementsand hegde rows allow theuse of drift-reducing tech-nology in fields, vineyardsand orchards. Thus hasyielded useful-propertygains in water’s-edge andhedge row areas, higherefficiency in the use ofsuch areas, and new regu-lations governing the useof plant protectants inthose same areas.

Coverage and biological-efficiency criteria for agricultural spray nozzles

For the applied plant pro-tectant to achieve a highlevel of biological efficien-cy, it has to cover the targets well. The use ofLechler high-precision nozzles characterized byexact dosing and uniformdistribution achieves thatgoal.

Rate of water application

Heed the recommenda-tions of the chemical companies regarding theproper rates of water application.

The lower the water appli-cation rate, the smaller thenozzles must be, andsmaller nozzles tend togenerate more drift.

Nozzles that emit coarsedroplets, e.g., ID-/IDN-/IDK-/IDKN-/IDKT-nozzles, avoiddrift. On the other hand,contact agents do not cov-er as well when sprayedout of air-injector nozzleswith low pressure.

Coverage

The percentage share oftarget surface that is cov-ered with the active agentis chiefly dependent on anumber of technical,chemical and biotic factors.If the recommended appli-cation rates are adhered to,coverage should amountto at least 10 % to 15 %.Contact agents require uniform coverage, while(semi-)systemic agentsmust instead reach the partof the plant where the up-ward distribution processtends to begin.

The user’s options for increasing the degree oftarget-surface coverageare limited:

n By technical means: - either the spray pres-sure can be raised or anozzle producing finerdroplets can be used toimprove atomization.

- the formation of a sec-ond spray level by usingLechler IDKT nozzle orTwinSprayCap in orderto angle nozzles in direction of travel to thefront and to the rear.

n By chemical means: the surface tension canbe reduced, somewhatsmaller droplets generated, secondaryatomization enhanced,and/or a lower viscosityemployed.

n By biotic means: the na-ture of the target surface(coat of wax or hair,phyllotaxy/leaf arrange-ment), i.e., the hairier theleaf and the wider theangle of impingement,the better the coverage.

As a rule, the leaf area index (LAI) increases in thecourse of the vegetationperiod. For grain plants, itcan reach levels between70,000 and 125,000 m2/ha.The water application rateshould be adjusted tomatch the LAI of the targetsurface to ensure ade-quate, uniform applicationof the active agent.Multi-year experiments involving water applicationrates of 200 l/ha and morehave confirmed the specialsuitability of coarse-dropletID-/IDN-/IDK-/IDKN-/IDKTnozzles for achieving ade-quate, uniform active-sub-stance coverage in com-parison with conventionalflat jet nozzles producingfiner droplets. In particular,it was shown that drift reduction has the absoluteeffect of concentratingmore active substance onthe target surface.

Coarse-droplet applicationalso scores better in termsof covering hard-to-reachtarget surfaces. The theo-retical coverage probabilityfor agents applied to, say,very small weeds withID 120-03 nozzles sprea -ding 260 l/ha at 5.0 bar, aforward speed of 7.0 km/hand a Volume Median Diameter (VMD) of 455 µmis very high at 52 dropsper square centimeter.

In a given plant population,the achieved degree ofcoverage is determined bythe penetrativity of thedroplets. That, in turn, is afunction of:

1. droplet size: The pene-trativity decreases in in-verse proportion to thefineness of the droplets.Horizontal surfaces arecovered better than ver-tical surfaces (stalk).

2. velocity of impingement:Penetrativity improveswith increasing velocityof droplet impingement.Higher pressures in-crease the velocity ofimpingement.

3. forward speed: The penetrativity of coarsedroplets e.g. from ID-/IDN-/IDK-/IDKN-/IDKT-nozzles is only margi-naly effected by the forward speed.

Nozzle selection via droplet size characteristic

Nozzles of a particular typeand size can be selectedfrom characteristic curveswith allowance for the desired forward speed according to the followingcriteria:n application rate (l/ha)n desired atomizationcharacteristic for theproduct employed andcrop concerned

The atomizing characteris-tics of Lechler nozzlesbuild on their droplet sizedata and their classificationaccording to categoriesdefined by BCPC (BritishCrop Protection Council).Lechler’s droplet-sizeanalyses are conductedaccording internationallystandardized methods using modern PhaseDoppler Anemometer(PDA). This approach yieldsa complete, type-specificdescription of each nozzle’spressure-dependent atomi -zation characteristic in

terms of droplet size anddroplet velocity. The noz-zles are assigned to different droplet-size cate-gories (very fine, fine,medium, coarse, verycoarse, extremely coarse)formulated on the basis ofreference nozzles. This way, different types of nozzles are easier tocompare for different spraypressures.

The droplet size categoriesand their respective key areas of application breakdown as follows:n extremely/very coarse e.g. ID3 and IDK, IDKN,IDKT, PRE nozzles forliquid fertilizers and plantprotection chemicals foruse as drift- and loss-re-ducing techniques

For a given pressure, eachdifferent nozzle producesdroplets of a different size.The droplet size spectrumreflects the frequency dis-

tribution of the individualdroplet size fractions. Themost important parameterin this respect is the Volume Median Diameter(VMD), which means that50 % each of the sprayedvolume (l/min or l/ha) consists of droplets that arelarger or smaller, respec-tively, than the stated sizeof droplet. Another factor,the 10 % VD (Volume Di-ameter; Dv0.1) serves as ameasure of the fine-dropletfraction and, hence, pro-vides information on thedrift potential of the nozzlein question.Each increase in spraypressure at the nozzle reduces both the VMD andthe 10 % VD. The largerthe spray tip size, the largerthe VMD and the 10 % VD.Droplet-size data sheets forLechler nozzles are avail-able on request.

§ 1 Scope of Terms and Conditions, Exclusion ofConflicting Terms and Conditions

1. Our General Terms and Conditions for sale anddelivery shall apply to all our offers, deliveries andperformances.

2. The following Terms and Conditions shall only applyto entrepreneurs according to Section 14 German CivilCode, legal entities under public law or an asset underpublic law (hereinafter referred to as the "Customer").Such Terms and Conditions shall also apply to all ourfuture offers, deliveries and performances relating to theCustomer without requiring any further reference oragreement.

3. As a general rule, our General Terms and Conditionsapply exclusively. Any contradicting, conflicting oradditional general terms and conditions used by theCustomer are expressly excluded and rejected.

§ 2 Conclusion of Contract, Scope of the Delivery,Prohibition of Assignment

1. Our offers are subject to change and are non-binding.In order to become binding, any orders or agree mentsrequire our written order confirmation or our delivery ofthe goods. The same shall apply to any amendments,changes or side agreements.

2. All information about our products, in particular pic-tures, sizes, performance criteria and any other technicaldata included in our offers and brochures shall beregarded as approximate average values. Tolerances inquantity, weight, number of pieces and dimensionscustomary in this line of business are expressly reserved.

3. Our written order confirmation or, in the event of lackof such order confirmation, our offer shall be relevantdetermining the scope of delivery and/or the service tobe rendered.

4. Any agreement, side agreement, warranty or modifi -cation to the contract must be reduced to writing in orderto be binding. The foregoing shall also apply to a waiverof such written form requirement.

5. Any documents such as drawings, pictures, descrip -tions and specifications of weight and dimensions whichform the basis of our offer shall only become an integralpart of the contract if they are expressly made a part ofthe offer. We reserve the right to make modifications tothe extent such modifications are not essential and thesubject of the contract is not unreasonably impaired forthe Customer.

6. The Customer shall not be entitled to assign or totransfer any claims or rights resulting from the businessrelationship with us without our prior consent. The sameapplies to any of the Customer's claims against us whichhave directly arisen by operation of law.

§ 3 Prices, Payments, Set Off and Rights ofRetention

1. Our prices are net-prices and shall be on an ExWorks Metzingen basis. VAT at the rate applicable at atime (even if not separately shown), costs for packaging,freight, assembly, postal charges, insurance costs,customs duties, any costs for bank or payment transac -tions as well as any other additional costs will have to bepaid in addition.

2. Our invoices are immediately due for payment. Forpayments made within 14 days after the invoice date, wegrant a 3 % cash discount. The timeliness of the pay -ments is determined by the date the amount is creditedto the point of payment indicated by us. Where theCustomer is in delay with any payment, the invoice shallbe immediately due for payment without any discounts.

3. In the event of payments outstanding from theCustomer - also in relation to other contractual relation -ships between the Customer and us – we are entitled tomake any further deliveries dependant on the completesettlement of such outstanding payments.

4. Where our Customer is in delay with payments,payment conditions are not met, insolvency proceedingswith regard to the assets of our Customer are filed for orany other circumstances become known or apparentthat give cause to reasonable doubts with respect to theCustomer's creditworthiness, including such facts thatexisted at the time of the conclusion of the contractbeyond our best knowledge, we shall be entitled to stopany delivery and to demand advance payment or theprovision of securities acceptable for us with respect toany outstanding deliveries. If such securities should notbe granted after an adequate grace period, we shall beentitled to withdraw from the contract. Our furtherstatutory rights shall remain unaffected. The Customershall be liable for all damages arising from the resultingnon-performance of the contract.

5. In the event of substantial increases of materialprices, salaries or energy costs between the time of theconclusion of the contract and the delivery date, we areentitled to unilaterally raise the prices reasonably(Section 315 German Civil Code), if and to the extent theperiod of time between the time of the conclusion of thecontract and the delivery date is longer than 4 months.

6. With respect to orders under framework agreements,delivery on demand or call orders that have not beenplaced yet, we reserve the right to adjust the prices in theevent substantial changes in material prices shouldoccur during the term of such framework agreements ordelivery on demand/call orders. Such adjustments requirea notice period of 4 weeks and can only be made if ourcosts (in particular caused by increases of materialprices, salaries or energy costs) should increase morethan 5 percentage points in the aggregate. If the resultingincrease in price should exceed 10 percentage points,the Customer is entitled to rescind the contract.

7. Without requiring a prior reminder, we shall beentitled to demand interest payable from the due date atan annual rate of at least 5 percentage points above thebase interest rate.

8. The Customer may only offset receivables due to uswith counter claims or claim a retention right, if suchcounter claims are undisputed or have been establishedby a court of law in an unappealable manner. Notices ofdefect furnished by the Customer shall neither affect theCustomer's payment obligations nor the date a paymentfalls due. The Customer hereby waives any right torefuse performance as well as any retention right. Such waiver shall not apply if we, our representatives orour vicarious agents have committed a fundamental

breach of contract or the Customer's counterclaimswhich form the basis for the right to refuse performanceor the retention right, are undisputed or have beenestablished by a court of law in an unappealablemanner.

9. 30 days after the receipt of the invoice the Customershall be deemed in delay unless circumstances exist(e.g. reminder or terms of payment determinable bycalendar) that cause the Customer to be deemed indelay earlier. When the Customer is in delay with pay-ment, our receivables shall bear and the Customer shallpay interest at a rate of annually 8 percentage pointsabove the base interest rate.

10. The minimum net order value is a 100,-, in the eventof custom-made products a 250,-.

11. Cheques and drafts will only be accepted after pre -vious agreement and only on account of performance.Interest and costs shall be borne by the Customer.

§ 4 Delivery Time, Partial Deliveries, Deviations inQuantity

1. If a term of delivery is agreed, such term shall beginwith the date of our order confirmation, however, notbefore complete delivery of the documents to be pro -vided by the Customer and/or receipt of any advancepayments that may have been agreed upon. If we shouldbe unable to make a delivery due to reasons caused bythe Customer, a term of delivery shall be deemedcomplied with if the item to be delivered has left ourpremises or has been notified to the Customer as readyfor dispatch before such term of delivery has expired.

2. A term of delivery shall be extended appropriately inthe event of Force Majeure or any unforeseen obstaclessuch as unrest, strike, lock-out, fire, confiscation, embargo,statutory or official constraints of energy consumption orincorrect and/or not timely self-supply, if and to theextent such obstacles have not been culpably caused byus and - despite reasonable care - we were unable toavert such obstacles and such obstacles have influenceon our ability to timely fulfil our obligations under thecon tract. If due to such circumstances the extension ofthe term of delivery should exceed a reasonable time,and after a reasonable grace period defined by theCustomer has expired unsuccessfully, the Customershall be entitled to withdraw from the entire contract or, ifthe Customer is interested in partial performance of thecontract, withdraw from such part of the contract that isyet unfulfilled. If we have already performed in part, theCustomer may only withdraw from the entire contract ifthe Customer can evidence that he has no interest inpartial performance.

3. If we should be in delay of delivery and after areasonable grace period defined by the Customer hasexpired unsuccessfully, the Customer shall be entitled towithdraw from the entire contract or, if the Customer isinterested in partial performance of the contract,withdraw from such part of the contract that is yetunfulfilled. If we have already performed in part, theCustomer may only withdraw from the entire contract ifthe Customer can evidence that he has no interest inpartial performance. Further claims of any kind, inparticular claims for damages including consequentialdamages, shall be excluded. § 9 remains unaffectedhereby.

4. We are entitled to deliver before the expiry of thedelivery date and to deliver in partial deliveries, providedthat any conflicting interests of the Customer are notaffected in an unacceptable manner.

5. In the event of custom-made products, the orderednumber of items cannot always be adhered to becauseof considerations concerning production and the alignedrisk of deficient products. We reserve the right to minorexcess deliveries and short deliveries which shall lead toa proportionate reduction or increase of our remu nera -tion; these deliveries do not represent a defect in termsof the German Civil Code.

§ 5 Passing of Risk, Delivery, Packaging

1. Unless agreed upon otherwise, our deliveries arecarried out on an Ex Works basis.

2. The risk including the risk of seizure passes in allevents, even if the delivery is free of transportationcharges, to the Customer no later than when the deliveryitem is handed over to the person in charge of thetransport. This shall also apply when we ourselves are incharge of the transport or if we engage a third party withthe transport even if we have assumed the duty totransport or to deliver on our own costs. If the delivery isdelayed due to reasons caused by the Customer, the riskalready passes to the Customer on the day we haveinformed the Customer that the delivery item is ready fordispatch.

§ 6 Retention of Title

1. We retain the title to the goods delivered until com -plete fulfilment of all claims resulting from the businessconnection with the Customer including claims resultingfrom cheques and drafts and any claims for recourseresulting from payments of cheques and drafts acceptedonly on account of performance. If payment is agreedupon with the Customer on the basis of cheque-draft-procedure, the retention of title shall last until the dangerof recourse resulting from the drafts issued by us hasceased to exist.

2. Any reprocessing or change of the delivered goodsby the Customer will be done for us without creating anyobligations for us. If the delivered item is connected,mixed, mingled or processed with other items not bel -onging to us, we acquire joint ownership of the newgoods. The share of the joint ownership corresponds tothe relation of the invoice value of the delivered item tothe value of the new product. The Customer is authorizedto connect, mix, mingle or process the delivered item inthe regular course of business, provided that the afore -mentioned security interests are preserved.

3. The Customer is only entitled to sell the delivereditems and the items coming into existence from themaccording to subsection 2 above (hereinafter collectivelyreferred to as "goods subject to retention of title") in theordinary course of business provided that the extendedretention of title (assignment of claims according tosubsection 4) is ensured. Any other acts of disposal, inparticular pledge, lease, rent or transfers by way ofsecurity shall not be permitted.

4. The Customer hereby assigns to us all claims

including any future claims resulting from the resale orother use of the goods subject to retention of title. Wehereby accept this assignment. If the good subject toretention of title is jointly owned by us, such assignmentshall only relate to the amount of the claim which corres -ponds to the proportionate value of our joint ownership.

5. The Customer is only authorized dispose, process,connect, mix or mingle the good subject to retention oftitle and to collect the assigned claims in the ordinarycourse of business and only revocably. Any revocationmay only occur if the Customer has not correctly fulfilledhis duties, in particular his payment duties, if he is insol -vent or heavily indebted or the opening of an insolvencyproceeding has been applied for. In such an event, theCustomer shall notify the debtor of the assignment uponour request, furthermore we are entitled to disclose theextended retention of title to the Customer's client. If thepermission to collect has been revoked, the Customershall inform us about the name and address of hisCustomer.

6. The Customer's authorization to dispose of, to pro -cess, to connect, to mix or to mingle the good subject toretention of title and to collect the assigned claims shallterminate without express revocation in the event ofinsolvency, cessation of payments, a filing for insolvencyconcerning the Customer's assets by the Customer or athird party or in the event of establishment of over-indebt edness.

7. In the event of subsection 5 and 6, we are entitled torequest the return of the good subject to retention of titleafter reminder and fruitless expiry of an appropriateadditional respite. The Customer is obliged to releasesuch goods. The Customer shall immediately disclose tous the name of the assigned claim's debtor. We are alsoauthorized to disclose the extended retention of title tothe Customer's client.

8. If the realisable value of the securities allowed ac cor -ding to the above-stated regulations exceeds our claimsmore than 20 %, we will at our discretion release oursecurities upon the Customer's request.

9. The Customer shall immediately inform us in writingabout any future or past third parties' access to thegoods subject to retention of title or the assigned claimsby handing us out all documents necessary for anintervention. Any intervention costs, including costs oflitigation, shall be borne in the relationship between usand the Customer by the Customer.

§ 7 Warranty

1. We are to be held responsible for material defectsand defects of title according to the following provisions.

2. Certain characteristics shall only be considered aswarranted if expressly confirmed in writing. A guaranteeshall only be deemed issued if expressly denominatedas "guaranteed" in writing.

3. The Customer shall immediately give notice in writ -ing of any kind of obvious material defects, deviations inquantity and false deliveries, at the latest within one weekafter delivery, in any case before connection, mixture,processing or installation.

4. The Customer shall immediately give notice in writ -ing of any hidden material defects, at the latest within 7 days after their discovery.

5. The Customer shall give us the opportunity to jointlyassess the notified complaints and to be present at anywithdrawal for material examination.

6. Unless provided otherwise, all claims for defects aresubject to a limitation period of 12 months after thepassing of risk. There shall be no reduction of the limi -tation if the delivered item is used for a building ac cord -ing to its intended use and has caused the building'sdefectiveness, as well as for claims according to Section478 German Civil Code (right of recourse); instead, thestatutory provisions on limitation periods shall apply.

7. Unless provided otherwise in this § 7, our warrantyfor defects of quality and for defects of title shall belimited to supplementary performance. Within the scopeof our supplementary performance obligation, we areentitled, at our discretion, either to remedy the defect(subsequent improvement) or to the delivery of faultlessmaterial (replacement). If our supplementary perfor manceis delayed beyond a commensurate period of time or ifthe supplementary performance is unsuccessful despiterepeated efforts, the Customer is entitled to demand areduction of the purchase price or to withdraw from thecontract. A withdrawal from the contract is excluded if thedefect is irrelevant. Furthermore, in the event of faultlesspartial deliveries, the Customer may only withdraw fromthe entire contract if he can evidence that he has nointerest in the partial performance. Further claims, inparticular claims for reimbursement of expenses and fordamages, are excluded unless provided otherwise in thefollowing § 9. Replaced parts shall be returned to usupon our request.

8. The Customer shall return the defective good to usfor subsequent improvement or replacement, unless areshipment is not possible because of the kind ofdelivery. We shall bear the costs for transportation due tosupplementary performance, however only from theplace where the good has been delivered to accordingto the terms of contract and limited by the amount of thepurchase price. We shall take title to the replaceddelivery items or parts thereof or, as the case may be,they remain our property.

9. The Customer has to give us the necessary time andopportunity for supplementary performance. Only in theevent of urgent cases of risk to the plant safety, theprotection against unreasonably high damages or delaywith the removal of defects, the Customer shall beentitled to cure the defect by himself or by a third partyafter prior notice and to demand from us restitution of thenecessary costs.

10. Claims for recourse according to Sections 478, 479German Civil Code are excluded, unless the claim by theconsumer was legitimate and only within the limits ofstatutory regulations except for gestures of goodwillwhich were not coordinated with us. Such claims requirethe observation of own duties of the person entitled torecourse, in particular the observation of the requirementto make a complaint in respect of a defect immediatelyon receipt of goods.

11. The processing or installation of delivered items isalways deemed to be a waiver of the notice of defects to

the extent the defect was obvious.

12. In the event of legitimate notices of defects,payments by the Customer may only be withheld in anadequate proportion to the material defects occurred. Inthe event of an unjustified notice of defects, we areentitled to demand from the Customer reimbursement ofthe expenses resulting therefrom.

13. Claims based on defects shall be excluded in theevent of minor deviations from the agreed or usualcharacteristics or utility.

14. The recognition of a material defect always requiresthe written form.

15. There shall be no warranty obligation if the intendeduse of the delivery item by the Customer deviates fromthe common use, unless agreed upon in writing.

§ 8 Withdrawal, Impossibility of Performance

1. Irrespective of other provisions in these GeneralTerms and Conditions, the Customer may withdraw fromthe contract in writing, if and to the extent theperformance of the contract has become entirelyimpossible before the passing of the risk. In the event ofpartial impossibility of performance, the Customer mayonly withdraw from the contract if he can evidence thathe has no interest in the partial delivery or partialperformance – otherwise, the Customer may demand acommensurate reduction of the purchase price. Furtherclaims of the Customer are excluded unless providedotherwise in the following § 9. Furthermore, the Customermay only withdraw from the contract if the breach of dutyis substantial.

2. In the event that no party is responsible for theimpossibility of performance, we are entitled to demanda part of the purchase price in proportion to the part ofthe contract already performed.

§ 9 Liability

1. Our liability for damages, out of which legal reasonswhatsoever, is limited to

a) our acts of intent or gross negligence including actsof our leading employees and vicarious agents

b) culpable injury of life, body, health

c) culpable material breach of contract

d) if we have intentionally misrepresented the defect bysilence or if we have guaranteed the absence of defects

e) to the extent we are liable for personal and materialdamages with respect to privately used items under theGerman Product Liability Act.

2. Further claims for damages are excluded.

3. In the event of a culpable material breach ofcontract, our liability is limited to losses reasonablyforeseeable and typical for this kind of contract. Theforeseeable loss typical for this kind of contract shallgenerally be the amount of the contract value of theparticular performance.

4. If the risk of loss foreseeable and typical for this kindof contract according to § 9 subsection (3) above iscovered by a liability insurance, our liability including theliability of our legal representatives and vicarious agentsis limited to the insurance payments. To the extent theinsurer is not liable to pay, we shall pay compensationlimited by the amount of the insurance sum.

§ 10 Intellectual Property Rights, Tools

1. We reserve all title and rights including copyrightsand other intellectual property rights in applicationrecommendations, drafts, drawings and otherdocuments. These documents may not be passed tothird parties without our consent and they have to bereturned to us upon request.

2. If we have delivered products according to drawings,samples or other documents supplied by the Customer,the Customer warrants that these documents are free ofany third party rights. If any third party rights areinfringed, the Customer shall immediately defend us,hold us harmless and indemnify us against all loss,damages, costs and expenses awarded against orincurred by us. The Customer shall reimburse us allexpenses including attorney's fees incurred due to suchclaims.

3. Tools, necessary for the production of the deliveryitem and manufactured by us, remain our property, evenif we are charging the Customer for the costs on a pro-rata basis.

§ 11 Assembly

With respect to assembly, the standard terms ofassembly of the "Verein Deutscher Maschinenanstaltene.V.", Frankfurt, Germany, shall apply.

§ 12 Place of Performance, Place of Jurisdiction,Applicable Law

1. For all claims arising out of the business relationship,the place of performance shall be 72555 Metzingen,Germany.

2. The exclusive place of jurisdiction for all claimsresulting from the business relationship including claimsfrom cheques and drafts shall be with the court locallycompetent for our principal place of business. We arealso authorized, however, to sue our Customer at hisgeneral place of jurisdiction.

3. These General Terms and Conditions shallexclusively be governed by German law excluding therules of the United Nations Convention on Contracts forthe International Sale of Goods (CISG) and internationalprivate law.

4. Should one or another provision of these GeneralTerms and Conditions be or become fully or partlyinvalid, the validity of the remaining provisions shallremain unaffected hereby. The parties shall undertake toreplace such provision by a valid provision the businesspurpose of which is as close as possible to that othercancelled provision.

5. Any changes of these General Terms andConditions require the written form. This applies mutatismutandis to a waiver of the written form.
