DRAFT ORDERTHE LICENSING AND CONTROLLING OF LIQUOR HOUSES (BANGALORE CITY), ORDER 2010.

PREAMBLE:

The places of Public Entertainment have been defined in Sub Section 15 of Section 2 of The Karnataka

Police Act, 1963 and include Liquor House, Tavern or a shop where wine, bear, spirit or arrack, toddy, Ganja or any

other kind of liquor or intoxicant or any kind of drink is supplied to the public for consumption in or near such shop.

2. Whereas, u/s 31, Sub Section W, the Commissioner of Police, Bangalore City is empowered to make,

alter or rescind orders for licensing or controlling places of public entertainment;

3. Whereas the Hon. Supreme Court and the High Court have permitted the employment of the women in

premises liquor is served.

4. Whereas, consequent to the decision of the Supreme Court and the High Court, a number of liquor

houses have employed women for service of liquor etc., in the premises licensed to serve liquor.

5. Whereas, number of instances have come to the notice of the Police wherein these women employed in

liquor houses are indulging in singing, dancing, indulging in avoidable conversation with the customers and indecentdisplay of their bodies giving scope for unruly situations in violation of the provisions of the Excise Act, Rules and the

conditions of the license issued by the Excise Department.

6. Whereas, it is considered necessary to issue an order for Licensing and Controlling all the liquor houses

in the interest of maintenance of public order, morality and to prevent the exploitation of women employed in liquor

houses to induce the customers or for any other purpose.

Hence, the following order is formulated

1. Title:a. This order may be called The Licensing and Controlling of Liquor Houses (Bangalore City), Order

2010.

b. It shall come into force from the day of its publication in the official gazette.2. Definitions:

a. In this Order, unless the context otherwise requires, Act means The Karnataka Police Act, 1963.b. Forms mean Forms appended to this order.c. Licensing Authority means the Commissioner of Police, Bangalore City.d. Licence means Licence issued under this order.e. Liquor House means any premises where any liquor including Indian Made Foreign Liquor, as defined

in Section 2 Sub Section 18 of The Karnataka Excise Act, 1965, is served including Indian liquor,

foreign liquor and beer as defined under Sub Sections 15, Sub Section 13 and Sub Section 1 of Section

2 respectively of The Karnataka Excise Act, 1965 and includes the premises licensed in Forms No.Cl-4,

6A, No..CL-7, No.CL-14, No.CL-15 and in No.CL-9 prescribed in The Karnataka excise Act and Rules,

by the competent authority of the Karnataka Excise Department.

f. The term person includes partnership firm, private or public limited company a Club, society orassociation.

3. ALL LIQUOR HOUSES TO OBTAIN LICENCES.3.1 No person shall open or keep a Liquor House in the limits of Commissionerate of Police,

Bangalore City without previously obtaining a licence from the Licensing Authority in form No.2

after applying for the same in form No.1, annexed to this order.

4. LICENCE TO RUN A LIQUOR HOUSE EMPLOYING WOMEN.

4.1 Licence for opening or running a Liquor House Employing Women will be made in form No.3annexed to this order. No liquor house employing women shall function without a licence

issued in form No.4 annexed to this order.

5. APPLICATION FOR LICENCE TO RUN A LIQUOR HOUSE.

5.1 An application to run or maintain a liquor house shall be made in Form No.1 annexed to this order along

with the following documents:

a. The trade licence issued by the local authority i.e., Bruhat Bengaluru Mahanagara Palike, TownPanchayat or Village Panchayat, as the case may be.

b. A Licence issued by the Excise Commissioner or any competent officer of the Karnataka ExciseDepartment to run a liquor house including CL-4, CL-7, CL-9, CL-14 and CL-15 forms.

c. The Khatha extract or Lease Agreement to prove that the applicant is in legal possession of thepremises where it is proposed to run a liquor house employing women, either as bar-tenderers,

suppliers of liquor or accountants or for any other purposes, in the premises of the places licensed by

the Excise department to run the liquor house.

6. LIQUOR HOUSES EMPLOYING WOMEN.

6.1 Any liquor house which intends to employ women for supply of liquor to the customers willsubmit an application in Form No.3 annexed to this order.

6.2 The number of women proposed to be employed or employed in the liquor house will not bemore than one-fourth of the number of seats available for the customers in the liquor house.

6.3 The applicant will also submit a proto-type of the uniform prescribed for the womenemployees.

6.4 The owner /manager of the liquor house is free to devise any decent uniform for womenemployed in the liquor house.

6.5 The proto-type of the uniform proposed to be issued to the women employees orwomen employees proposed to be employed should be approved by the Licensing Authority

and every women employee working in the liquor house shall wear the same approved uniform

invariably during the duty hours.6.6 The application for licence to run a liquor house shall be accompanied by particulars of each

women employee in form No.5 along with passport size photograph of the women employee.

6.7 Whenever any women employee leaves/resigns the employment in the particular liquor house,the same should be intimated to the licensing authority. Similarly, whenever new woman

employee is to be employed by the liquor house, the particulars in form No.5 should be

furnished to the licensing authority at least 10 days prior to the date of her joining the

employment and acknowledgement should be obtained from the office of the Licensing

Authority.

7. THE LIQUOR HOUSE OWNER SHOULD PROVIDE FOR PARKING OF THE VEHICLES OF THECUSTOMERS.

7.1 The liquor house owner should provide space for parking of the vehicles of the customerseither at his own premises or there should be public premises available for parking of the

vehicles of the customers who visit the liquor house. The area available for parking should be

reasonably adequate.

7.2 The owner/management of the Liquor House should abide by the relevant provisions of theLabour Act, regarding Provident Fund, Health Care, minimum wages, etc., for all the

employees of the liquor house, as may be applicable, from time to time.

8. MEANS OF ENTRANCE, ETC.,

8.1 The means of entrance and exit to and from the liquor house should be convenient, easy,sufficient and satisfactory.

8.2 The applicant should be suitable for issue of a licence to run a liquor house.8.3 The locality where such a liquor house is to be opened or run should be fit to house the liquor

house.

9. TIMINGS.9.1 The liquor house shall be open from 10.00 A.M. to 11.30 P.M. On special occasions, if the liquor

house owner intends to keep the liquor house open beyond the permitted hours, he should obtain special permission

from the Licensing Authority remitting the necessary fees. Licensing Authority will grant special permission after

satisfying itself regarding the genuine need for the same.

10. LICENCE TO BE DISPLAYED:

10.1 Every person keeping a liquor house under a licence from the Licensing Authority shall, unless

specially exempted in writing by the Licensing Authority, fix or cause to be fixed in some conspicuous outside the

premises on a wooden board of suitable size on which shall be painted conspicuously in Kannada the name of the

keeper of the place and words indicating that he or she is licensed to keep the particular liquor house, working hours

of the liquor house and licence No. and date.

11. LIQUOR HOUSES TO BE KEPT CLEAN.

11.1 Every person keeping a liquor house shall keep the entire premises in a clean and sanitarycondition and in good repair. All appliances, including furniture used in the premises shall also

be kept clean.

11.2 It shall be the duty of the licensee to inform the Licensing Authority immediately of any case ofinfectious disease occurring at the liquor house at any time.

11.3 During an epidemic, every person keeping a liquor house shall comply with all instructions andrestrictions as may be issued to him from time to time by the Licensing Authority in respect of

any measures considered necessary by him to prevent the spread of disease.

12. EVERY LIQUOR HOUSE SHOULD HAVE A FIRST AID BOX.

12.1 There shall in every place of public entertainment be provided and maintained so as to bereadily available a first aid-box or cupboard. Such box or cupboard shall be kept in charge of

a responsible person who shall be readily available on the premises.

12.2 The contents of the first aid-box or cupboard shall be checked by the Health Officers who areauthorized to inspect the premises and examine the keeper of the place and the employees

working therein.

12.3 The appliances, medicines and other material kept in the first-aid-kit box or cupboard shall bechanged after one year or according to the directions of the officers authorized local authority

from time to time.

13. LICENCES GRANTED UNDER THIS ORDER CANNOT BE TRANSFERRED:

13.1 A licence granted under this order for keeping a liquor house shall not be transferrable. Thelicensee cannot assign his business to any other person or enter into an agreement with

another person involving his giving up the conduct or control over the business without prior

approval of the licensing authority shall be taken;

13.2 In the case of death of the licensee, his heir or legal representative may make an applicationwithin one month from the date of death to the Licensing Authority, to have the benefit of the

licence for the unexpired portion of the term of the licence and the Licensing Authority may

decide the application having regard to the provisions of this clause.

14. The Licensing Authority shall have discretion in refusing any licence for keeping of a liquor house, ifsuch place appears to him to be likely to cause obstruction, inconvenience, annoyance, risk, danger or

damage to residents or traffic in the vicinity where such liquor house is proposed to be located or is

located.

15. No person keeping a liquor house shall hold music dancing, dramatic, mimeties, theatrical or otherperformances for public amusement unless he has obtained a licence from the Licensing Authority

under The Controlling of places of Public Amusements (Bangalore City), Order 2002 or The Licencing

and Controlling of Places of Public Entertainment (Bangalore City) Order, 2005.

EXPLANATION: For the purposes of this rule, Music shall include the playing of gramophones,

phonographs, radios, radio gramophones, tape-recorders bands tom-tom, drums, cymbals and any other music and

does not include instrumental or vocal background music played below 2 decibels.

16. No person keeping a liquor house shall operate or cause to be operated as let or amusement machine

in such a place except with the approval of the Licensing Authority, provided that no such approval shall be required

for machines exclusively used for the sale of articles such as sweets or cigarettes or for the recording of weights.

17. If any person keeping a liquor house knowingly permits any illegal activity or soliciting for immoral

purpose leading to offence under The Immoral Traffic (Prevention) Act, 1956 the Licensing Authority shall have the

power in his discretion, at any time, to cancel the licence granted under these rules or to suspend it for such period

as he may certify and to direct such person to close the palace either permanently or for such period as he may

specify. The persons to whom such direction is issued by the Licensing Authority shall forthwith comply with such

direction.

18. The Licensing Authority shall have the power in his discretion, at any time to cancel a licence granted

under this order or to suspend it for such periodas he may specify and to direct the keeper of any liquor house toclose such place either permanently or temporarily; if the Licensing Authority is satisfied that, after such enquiry as

he deems fit that the licensee is not a suitable person for continuation, to hold the licence or in order to prevent any

obstruction, inconvenient, annoyance, risk danger or damage to the residents or traffic in the vicinity or to prevent

disturbance in such place and every person keeping a liquor house, shall comply with such direction as may be

issued by the Licensing Authority.

19. No licence granted under this order shall be cancelled or suspended until the holder of a licence has

been given a reasonable opportunity of showing cause why his licence should not be cancelled or suspended as the

case may be. Provided that no such opportunity for showing causes shall be necessary when the licence is

suspended for a temporary period pending an enquiry against the holder of the licence for contravention of any of the

clause in the order made there under or any of the conditions of the licence granted to him.

20. Any person aggrieved by an order of the Licensing Authority refusing to grant or renew a licence or

cancelling or suspending a licence under the provisions of this order, may within 30 days from the date of receipt by

him of such order, appeal to the State Government.

21. PERIOD OF LICENCE.

21.1 A licence under this order will be granted for a period of one year of part thereof.

21.2 Every application for renewal should be submitted ordinarily by 31st July of every year.

21.3 The licence fees may be paid in the form of a Crossed Account Payee Bank Draft in favour of the

Commissioner of Police, Bangalore City and the same will be credited to Government by the office of the

Commissioner of Police, Bangalore City to the budget head 0055-00-103-0-03 Other items.

21.4 Application for grant of licence and renewal, or for any other purpose under this act, should be

delivered to the Dy. Commissioner of Police, Administration, Bangalore City. He will maintain a register of all the

applications received under this order in such form as may be prescribed by the Licensing Authority. After receipt of

the application either for grant of licence or renewal of the licence, the Dy. Commissioner of Police, Administration, if

he considers necessary, will get a report from the Station House Officer of the area in which the liquor house is

situated or proposed to be situated regarding suitability of the applicant, suitability of the place to house the liquor

house and submit the application for the grant of the licence or otherwise, within a period of 15 days from the date of

receipt of the application.

22. ANNUAL FEES FOR LICENSES: The following fees shall be charged for licenses:-

22.1

Star Hotels Rates in Rs.

a) a liquor house in the premises of 5 Star Hotel 15,000.00b) a liquor house in the premises of 4 Star Hotel 12,000.00

c) a liquor house in the premises of 3 Star Hotel 10,000.00

d) Any other liquor house having more than 50 seats for thecustomers.

Delay in renewal of licence Fee of Rs. 500 per month shall be charged from thedate of expiry of licence if there is delay of twomonth in making application for renewal. If there isdelay beyond one year in making application thelicence shall be treated as cancelled.

STATEMENT OF REASONS FOR ISSUING THE LICENSING AND CONTROLLING OF LIQUORHOUSES (BANGALORE CITY), 2010.

At present, the bars, restaurants and other liquor houses are running as per the timings fixed by the Excise

Department. But, according to The Karnataka Police Act, the responsibility for licensing and controlling the places ofpublic entertainment vests with the Home Department. This power has to be exercised by the District Magistrates in

the Districts and the Commissioners of Police in cities with the prior approval of the Home Department. The

responsibility for maintenance of law and order, prevention of and detection of crime is also that of the Home

Department. As such, particularly in city areas, it is necessary for the Home Department to exercise control over the

places of public entertainment in general and particularly the liquor house.

2. Until recently, the Excise Department was part of the Home Department and as such the HomeSecretary used to look after the Excise Department also at the Secretariat Level. The Dy. Commissioner who is also

the District Magistrate was also the Dy. Commissioner, Excise and was in charge of the licensing of the liquor

houses. Now, the Excise Department has created a post of Dy. Commissioner of Excise in each district and the role

of the Dy. Commissioner and District Magistrate in the affairs of the Excise Department has become minimal.

Similarly, at the State level, the Excise Department was treated as Revenue Department and as such has been

transferred from the Home Department to Finance Department. Now the Finance Commissioner is looking after the

administration of the Excise Department at the Secretariat Level. However, there is no dilution in the responsibility of

the Home Department in the maintenance of the law and order, prevention of and detection of crime. As such, now

the time has come to assume control of the places of public entertainment atleast in metropolitan cities by the Home

Department through the Commissioner of Police of the city.

3. The Supreme Court and High Court of Karnataka in Writ Petition No. 9345 of 2008 (Excise) have

removed the bar on employment of women in liquor houses for serving of liquor, etc., vide their decision.

Consequent to these decisions by the Supreme Court and High Court, about 60 bars in Bangalore City have

employed women. After the employment of women, following mal-practices have come to the notice of the Police:

a. Many of the women employed who are put on job in the liquor houses are brought to Bangalorefrom places far away in North India on the pretext that they are brought for Event Management or

some other functions and pushed to employment in bars.

b. The women employed by the bars and restaurants are being changed very frequently by the barowners.

c. The number of women employed in a bar in many cases, exceeds the number of seats available tothe customers, thereby indicating the motive of the bar owners in employing the women. It is

reliably learnt that these women employees in the bars and restaurants are not given any salary.

They are made to indulge in conversation with the customers and collect tips and out of the total

amount of tips collected by them, about 50% of the tips is given to the women employees and the

remaining 50% is taken by the bar owners, which is against all canons governing employment.

d. Keeping in view the opportunities, these women are made to sing and dance according to thewhims and fancies of the customers in total disregard of the duties for which they are employed.

According to video pictures that are published in electronic media, many of these women do not

wear decent dresses which they should do in public places like places of public entertainment.

e. It is also learnt reliably that these bars and restaurants are being made use as contact points forthe women employed in the bars and the persons interested in the friendship of these bar women.

4. In respect of the above mentioned mal-practices and violations which have crept in, a number of cases

have been booked by the Bangalore City Police during the period of last one year. The particulars of these cases are

enclosed to this statement as Annexure A.

5. In this regard, reports were sent to the Excise Commissioner for cancellation or suspension of the

licences of these bars and restaurants for violation of the licence conditions, but so far no effective action has beentaken by the Excise Department, though a period of more than 6 months have elapsed since these reports were sent

by the concerned Dy. Commissioners of Police and a DO reminder was issued to the Excise Commissioner vide our

DO letter No.BC/CP(PS)1/2009 dated 26th November, 2009.

6. Already in the Metropolitan cities of New Delhi, Kolkota and Mumbai, the system of liquor houses

obtaining the licence from the concerned Commissioner of Police is in practice. The present order is framed on the

model of the order in force in Mumbai. A copy of the Mumbai City Order which is in force is enclosed for ready

reference. It may be noted that the relevant provisions of The Karnataka Police Act are completely identical with the

relevant provisions of the Mumbai Police Act.

7. Therefore, in the interest of the maintenance of public order, morality and prevention of exploitation of

women, it is proposed to issue this order applicable to the Bangalore City.
