ESTATE PLANNING*Glenn J. Witecki, Esq. • $5 ($8 NR) • March 12 & 19 • 6-7:30 pm • O’Rourke Middle School Room 109

March 12: Estate Planning Basics. Gain an understanding of the various estate planning documents, including Powers of Attorney (gifting and non-gifting), Wills (what they do and who can challenge them), Trusts (Revocable and Irrevocable), Beneficiary Designations, and Living Wills & Health Care Proxies. Learn how each of these documents/directives can help you and your loved ones so your assets go to your intended beneficiaries, and that your health care decisions follow your wishes even if you can no longer make them yourself. Learn how trusts can minimize the chance that your directives will be challenged and why a Power of Attorney is often more important to your estate plan than your will. Also, gain an understanding of the Surrogate’s Court Probate process, such as when it’s required and when it’s not.

March 19: Beyond the Basics—Asset Protection. Learn about various forms of asset protection, including how it pertains to long-term care, in general, and Medicaid nursing home care in particular. Many of us have heard of the five-year look-back period pertaining to Medicaid funding, but do you fully understand this rule? And do you know the difference between the five-year look-back period and a penalty period? Do you know that even with no prior planning, an individual or couple with significant assets can protect the majority of those assets and that some transfers do not cause a penalty period? Do you know that the purchase of some annuities can disqualify you from receiving Nursing Home Medicaid for an extended period of time? Find the answers to these crucial questions and others by attending this session. Among other things, this session will build upon the first session (see above) by exploring the uses of trusts in preventing will challenges and offering enhanced flexibility to your estate plan.
