THE CONTRACTOR AGREES TO INDEMNIFY AND HOLD HARMLESS THE OWNER, ARCHITECT AND PROJECT MANAGER, AND THEI R AGENTS AND EMPLOYEES, FROM AND AGAINST ALL CLAI M, DAMAGES, LOSSES AND EXPENSES, INCLUDI NG REASONABLE ATTORNEYS' FEES, ARISI NG OUT OF PERFORMANCE OF THE WORK, WHICH ARE (1) FOR BODILY INJURY, I LLNESS, OR DEATH, OR FOR PROPERTY DAMAGE, INCLUDI NG LOSS OF USE, AND (2) CAUSED I N WHOLE OR IN PART BY THE CONTRACTOR'S NEGLIGENT ACT OR OMI SSION, OR THAT OF A SUBCONTRACTOR, OR THAT OF ANYONE EMPLOYED BY THEM OR FOR WHOSE ACTS THE CONTRACTOR OR SUBCONTRACTOR MAY BE LIABLE.
THIS AGREEMENT TO INDEMNIFY AND HOLD HARMLESS IS NOT APPLI CABLE TO LIABILI TY OF THE ARCHITECT AND PROJECT MANAGER, OR THAT OF THE ARCHITECT'S OR PROJECT MANAGER AGENTS OR EMPLOYEES, ARISING OUT OF THE PREPARATION OR APPROVAL OF REPORTS, OPI NIONS, SURVEYS, MAPS, DRAWINGS, DESIGN, OR SPECIFI CATIONS.
OWNERSHIP AND USE OF DOCUMENTS:
DRAWINGS AND SPECIFICATIONS, AS INSTRUMENTS OF PROFESSIONAL SERVICE, ARE AND SHALL REMAIN THE PROPERTY OF THE ARCHITECT.
