1 The Plainview ISD Board of Trustees met in their regular meeting on April 19, 2018, at the Education Complex Board Room, 2411 Yonkers, Plainview, TX 79072. Call to Order The meeting was called to order by Board President Bryan Wood at 6:01 p.m. Quorum Determination Trustees in attendance were Brandon Brownlee, Sylvia De La Garza, Cheryl Dickerson, Robert Rivera, Adam Soto, Ron Warren, and Bryan Wood. Invocation and Pledge of Allegiance to the Flags Invocation was offered by Ron Warren. Robert Rivera led the pledge to the flags of the United States of America and the State of Texas. Citizen Comments Lionel Garcia congratulated the Board on hiring the first Hispanic superintendent. He expressed concern that the search firm may have taken critical choices away from the Board in not disclosing information. He feels that Dr. Sanchez is not who the community needs and that the Board should demand a refund from the Search firm. Judy Weatherford asked the Board to think about their decision to hire Dr. Sanchez. We already have some controversy. He may be qualified but he is bringing baggage to our school system. The Plainview ISD Board of Trustees met in their regular meeting on April 19, 2018, at the Education Complex Board Room, 2411 Yonkers, Plainview, TX 79072.

Call to Order

The meeting was called to order by Board President Bryan Wood at 6:01 p.m.

Quorum Determination

Trustees in attendance were Brandon Brownlee, Sylvia De La Garza, Cheryl Dickerson, Robert Rivera, Adam Soto, Ron Warren, and Bryan Wood.

Invocation and Pledge of Allegiance to the Flags

Invocation was offered by Ron Warren. Robert Rivera led the pledge to the flags of the United States of America and the State of Texas.

Citizen Comments

Lionel Garcia congratulated the Board on hiring the first Hispanic superintendent. He expressed concern that the search firm may have taken critical choices away from the Board in not disclosing information. He feels that Dr. Sanchez is not who the community needs and that the Board should demand a refund from the Search firm. 1. Approval to certify the unopposed candidates for Position 2: Sofia Rivera and

Position 5: JoAnn Rey and Order of Cancellation of the Election for Board of Trustees

Position 2 and Position 5. Greg Brown, Acting Superintendent, stated that in order to cancel an election for a precinct, the Board must receive a Certification of Unopposed Candidates and then approve an Order of Cancellation. The Order of Cancellation will be posted at the polling place on the Election Day. By canceling the election, this will indicate that there are no opposed trustee positions and no propositions to be considered for this precinct.

ACTION Motion to certify the unopposed candidates for Position 2: Sofia Rivera and Position 5: JoAnn Rey and Order of Cancellation of the Election for Board of Trustees Position 2 and Position 5 was made by Ron Warren, seconded by Robert Rivera, and unanimously carried 7-0.

2. Approval to certify Board Members Certified Training Credits Greg Brown explained that TASB recommends to report the Board Training Credits in December Board Meeting and again in the month before a Trustee Election. By law they must be read at the meeting to inform the public.

ACTION Motion to certify the Board members training credits was made by Brandon Brownlee, seconded by Robert Rivera, and unanimously carried 7-0.

3. Approval of selection of District Auditor for the 2017-2018 Audit. Doris Chapa, Interim Executive Director for Business & Financial Services, presented a recommendation to engage Eide Bailly CPA & Business Advisors for the 2017-2018 school year audit. Fees are not to exceed $37,000 of the 2018 – 2019 budget.

ACTION Motion to approve Eide Bailly as the district auditor for the 2018-2019 school year audit was made by Sylvia De La Garza, seconded by Brandon Brownlee, and unanimously carried 7-0.

4. Approval to extend the Food Service Contract for the 2018-2019 school year with

Aramark Education Services, Inc.

Dr. Ricardo Garcia, Executive Director for Ancillary Services, requested the Board approve an extension on the Food Service Contract with Aramark Education Services, Inc. School districts can enter into a five-year Food Service Contract with the provision that such contracts allow for four one-year renewals. This is the first extension renewal for Plainview ISD and Aramark Education Services, Inc. under the current contract. Aramark Director Sandra Ramirez answered questions from the Board.

ACTION Motion to approve extending the Food Service Contract for 2018-2019 school year with Aramark Education Services, Inc. was made by Robert Rivera, seconded by Adam Soto, and unanimously carried 7-0.

5. Approval to renew the contract for Student Athletic Accident Insurance for the 2018-

2019 school year with Texas Kids First

Dr. Ricardo Garcia requested Board approval to renew the contract for Student Athletic Accident Insurance for the 2018-2019 school year with Texas Kids First. This student athletic accident insurance covers all UIL activities, cheerleaders, student managers, student trainers, school sponsored and school supervised off season conditioning, UIL Sanctioned activities, ROTC, FFA, FHA, Vocational Studies, student council and powerlifting. This must be renewed by July 31, 2018. Administration recommends the Lone Star Plan at a premium rate of $54,625. The premium is the same as last year. We would also offer catastrophic coverage for all students at a premium of $2,375, also the same as last year. The total cost for insurance with Texas Kids First is $57,000.

ACTION Motion to approve renew the contract for Student Athletic Accident Insurance for the 2018-2019 school year with Texas Kids First was made by Robert Rivera, seconded by Ron Warren, and unanimously carried 7-0.

6. Approval to renew the contract for Property/ Casualty, General Liability, Fleet, and

Educators Legal Liability Insurance for 2018-2019 school year with the Texas

Association of School Boards (TASB). Dr. Ricardo Garcia requested that coverage be renewed with TASB under our inter-local agreement for the sum of $245,660 for the 2018 - 2019 premium year. This is an increase of $47,280. The increase is due to PISD having over $5.9 million in claims as well as catastrophic events throughout the State of Texas.

ACTION Motion to renew for 2018 - 2019 the Property/Casualty, General Liability, Fleet and Educator Legal Liability insurance with TASB was made by Brandon Brownlee, seconded by Sylvia De La Garza, and unanimously carried 7-0.

7. Approval to renew the Student Transportation Contract for the 2018-2019 School Year

with First Student Transportation Services

Dr. Ricardo Garcia requested Board approval for a one-year extension to the transportation contract with First Student Transportation Services. School districts are allowed to enter into a five-year Student Transportation Contract with the provision that such contracts allow for four one year renewals. This is the final extension renewal for Plainview ISD and First Student Transportation Services under the current contract. Lorrie Coats and Tony Vitorine with First Student Transportation Service answered questions form the Board.

ACTION Motion to approve the contract renewal with First Student Transportation Services for the 2018-2019 School Year was made by Robert Rivera, seconded by Ron Warren, and unanimously carried 7-0.

8. Approval under Texas Tax Code Section 34.05 (i) for Sale of Property and release in

the City of Plainview as listed below.

Doris Chapa explained that Hale County has received offers of purchase for land that was “stuck off” the tax rolls. All taxing entities agreed to the sale of the attached properties. Proceeds (a total of $3,652.01) will be divided among the taxing entities based on values stated. The HCAD will list the land on the tax rolls and the new owner will be responsible for taxes assessed beginning with the date of ownership. Properties revenue include: Parcel {R74597} for $3,652.01

ACTION Motion to approve the sale of property and release in the City of Plainview as listed was made by Brandon Brownlee, seconded by Robert Rivera, and unanimously carried 7-0.

9. Approval of DB (LOCAL) Superintendent Requirements and Restrictions – (This item was skipped and then voted on following the second closed session).

Business Items - Consensus Agenda

ACTION Motion to approve the following items on the consensus agenda was made by Ron warren, seconded by Robert Rivera, and unanimously carried 7-0.

1. Approval of the minutes of the Special Called Meeting on March 19, 2018; the regular Board

meeting on March 22, 2018; Special Called Meeting on March 23, 2018; Special Called Meetings on March 24, 2018; April 3, 2018; April 4, 2018; and April 11, 2018.

2. Approval of purchase of volleyball supplies using Fiscal 2018-2019 Budget.

The athletic department annually purchases supplies and equipment using next year’s (fiscal 2018-2019) budget. Items are ordered and delivered in the summer for the next school year’s use. Budget provisions approved for volleyball supplies are $6,980.90.

3. Approval to purchase campus supplies in the amount of $60,351.87 using Fiscal 2018-2019 budget.

1. Consideration of the recommendation to renew Professional Contracts for the 2018 - 2019 school year.

B. Deliberation and Consultation with attorney regarding potential or contemplated litigation or matters involving attorney client privilege pursuant to Texas Government Code 551.071

Open Session

Trustees returned to Open Session at 7:13 p.m.

ACTION Brandon Brownlee made a motion that the Board accept the recommendation to renew the professional contract of Doug Warren for the 2018-2019 school year. Motion was seconded by Robert Rivera. The motion carried 6-0 with Ron Warren abstaining.

ACTION Cheryl Dickerson made a motion that, excluding Doug warren from this motion, the Board accept the recommendation to renew Professional contracts for the 2018-2019 school year as discussed in closed session. Motion was seconded by Robert Rivera, and carried unanimously, 7-0.

Policy DB (LOCAL) requires the Superintendent to establish and maintain a legal residence within the District’s geographical boundaries.

ACTION Motion to approve DB (LOCAL) policy was made by Ron Warren, seconded by Sylvia De La Garza, and unanimously carried 7-0.

Statement from the Board of Trustees

Brandon Brownlee read the following statement from the Board of Trustees: “The Board is excited to welcome Dr. Sanchez as Superintendent of Schools for Plainview ISD. The Board vetted the allegations on the internet prior to any interview of candidates. The seven-member Board started with a list of 25 candidates and from that list chose six to be interviewed. The School Board candidates were part of this process. The Board at no time was coached on which candidates were chosen. When the field was narrowed to the final two candidates, we again vetted Dr. Sanchez’s references. References were from the education field, board members, and community leaders in Odessa and in Tucson. After that final vetting, Dr. Sanchez was chosen as the Lone Finalist. We encourage the citizens and educators of Plainview to support Dr. Sanchez and his family. “
