We are pleased to present a copy of the Radar and Radio Communications Impact Assessment Report for

Skyway 126 Wind Energy project. This report summarizes the findings of M.K. Ince and Associates

Ltd.’s assessment of the potential impacts of Skyway 126 Wind Energy on Radio Communication, Radar

and Seismoacoustic Systems. The assessment methods follow the protocol laid out in the document

Technical Information and Coordination Process Between Wind Turbines and Radiocommunication and

Radar Systems (RABC/CanWEA, 2012), produced jointly by the Radio Advisory Board of Canada and

the Canadian Wind Energy Association.

The results of this assessment indicate that impacts to radio communication, radar and seismoacoustic

system from the Skyway 126 Wind Energy project are anticipated to be limited. It will be included as part

of the Renewable Energy Approval Application package to be submitted to the Ministry of the

Environment for the Skyway 126 Wind Energy project, as an appendix to the Design and Operations

Report.

1 INTRODUCTION

1.1 Project Overview

Cloudy Ridge Wind Park LP (the Proponent) proposes to build the Skyway 126 Wind Energy project, a

10 MW Class 4 Wind Energy Generation Facility, on privately-owned agricultural lands within the

Municipality of Grey Highlands near the town of Badjeros. It will consist of five (5) REpower MM92

wind turbines of 2 MW each, located in five (5) proposed locations. The REpower MM92 has a sound

power level of 103.2 dB(A). The turbines are three bladed horizontal axis wind turbine generators that

will be mounted on 100 m hubs and have blade diameters of 92.5 m, for a maximum total height of

146.25 m above grade. Figure 1-2 depicts all radar and radio communication systems within the project

area. The project turbines will be bounded to the north by South Line C, to the east by Grey Road 9, to the

South by Grey Road 9, and to the west by Road 57A. In addition, project cabling will be constructed

along South Line C, Road 63, and 4th Concession B Road. A Power Purchase Agreement (PPA) has been

acquired for the project under Ontario’s Feed-In Tariff (FIT) Program.

1.2 Regulatory and Reporting Requirements

The Green Energy and Green Economy Act, passed in the Province of Ontario in 2009, mandates a

Renewable Energy Approval (REA) process under the Environmental Protection Act, Ontario Regulation

359/09 for specified classes of renewable energy projects. The Skyway 126 Wind Energy project is

subject to this process, which will evaluate the project’s environmental impacts and propose measures to

mitigate or avoid them.

This report summarizes the findings of M.K. Ince and Associates Ltd.’s assessment of the potential

impacts of the Skyway 126 Wind Energy project on Radio Communication, Radar and Seismoacoustic

Systems. The assessment methods follow the protocol laid out in the document Technical Information

and Coordination Process Between Wind Turbines and Radiocommunication and Radar Systems

(RABC/CanWEA, 2012), produced jointly by the Radio Advisory Board of Canada and the Canadian

Wind Energy Association.

The RABC/CanWEA document outlines the procedure for determining consultation zones with respect to

Radio Communication, Radar and Seismoacoustic Systems based on the characteristics of each system. In

the event of an overlap between the project area and the consultation zone of a communication system,

consultation with the system operator is recommended.

2 RADIO COMMUNICATION, RADAR AND SEISMOACOUSTIC

SYSTEMS IN THE STUDY AREA

2.1 Radio Communication Systems

The Spectrum group of Industry Canada manages the use of the electromagnetic spectrum in Canada.

Their database was searched on November 26, 2012 for all stations within 60 km of the project site. The

analysis of the search results is discussed in Section 4.2. Radio communication systems surrounding the

project area are depicted in Figure 1-2, with further details on the system included in Appendix A.

2.2 Environment Canada Weather Radar

The nearest Environment Canada weather radar station is WKR, located in King City, ON. This station is

approximately 65 km from the nearest turbine in the Skyway 126 Wind Energy project. The WKR station

is located well outside the 50 km consultation zone specified in the RABC/CanWEA document.

2.3 Seismoacoustic Stations

The Natural Resources Canada seismoacoustic station closest to the site is the SADO station, located near

Sadowa, ON. This station is approximately 150 km from the Skyway 126 Wind Energy project. The

proposed wind farm is outside the recommended 50 km consultation zone for this station.

2.4 Air Traffic Control Radar and Airfields

The consultation zone around a military or civilian airport is a minimum of 10 km as outlined in the

RABC/CANWEA Guidelines and could extend up to 80 km depending on the type of Air Traffic Control

(ATC) radar present. The nearest airport for which records were found in MKI’s desktop analysis is the

Collingwood Regional Airport, approximately 30 km northeast of the project site. NAV Canada was

contacted and supplied with a turbine layout to ensure no potential for interference with the equipment or

operations at this or any other air traffic control radars. NAV Canada has indicated that no impacts are

anticipated.

2.5 Additional Consultation

RABC and CanWEA mandate correspondence with certain agencies to coordinate the assessment of

possible wind turbine effects on telecommunication and radar systems. These agencies include:

3 CONSULTATION ZONES FOR RADIOCOMMUNICATION SYSTEMS

3.1 Point to Point Systems

The RABC/CanWEA document prescribes the consultation zone for a point to point link as being a 1 km

radius around the transmission and reception sites, and a cylinder around the signal path with a diameter

defined as:

The data from the Spectrum Direct database search were used to determine how closely each signal

passes by the project area. All link stations transmitting and receiving within 60 km of the project area

centre were mapped. Consultation zones were calculated for any signal paths passing near or through the

project area.

Rogers Communication Partnership operates one point-to-point system within the consultation zone of

the proposed project and was contacted with the turbine coordinates. Discussions with Rogers

Communications initially identified potential impacts to one microwave path which have since been

addressed by shifting the proposed turbine locations outside the anticipated zone of interference. Further

information regarding the point to point systems and license holder are summarized in Figure 1-2 and

Appendix A. A summary of correspondence is included in Appendix B.

3.2 Broadcast Transmitters

As recommended by the RABC/CanWEA document, TV or radio broadcast transmitters have a

consultation zone of 2 km for FM and TV stations, and 15 km for an AM directional antenna system and

5 km for an omnidirectional AM antenna system. The proposed Skyway 126 Wind Energy project is

within the consultation zone of Bayshore Broadcasting Corporation’s proposed FM radio broadcast

station with the call sign CFDC-FM, identified in the Industry Canada’s Spectrum Direct Database.

Consultation with Bayshore Broadcasting Corporations has indicated that this station has not yet been

constructed and that due to its separation distance from the Skyway 126 Wind Energy project, no impacts

would be anticipated.

3.3 Over-the-Air Receptors

For broadcast receivers, which MKI assumes to be any residence, the consultation zone is defined as:

1. 15 km for Analog TV receivers

2. 10 km for Digital TV receivers.

There are several nearby communities within these consultation zones. Should reception problems arise

after construction of the wind farm, mitigation measures will need to be discussed with the affected

residents.

3.4 Cellular, Land Mobile, and Point to Point Systems below 890 MHz

The RABC document prescribes a 1 km radius consultation zone for cellular networks, land mobile

networks, and point to point systems below 890 MHz. No such systems exist within 1 km of the proposed

wind farm site, and therefore no consultation is required.

3.5 Satellite Ground Stations

Wind turbines may also interfere with a satellite link if located between the satellite and a ground station

receiver. The RABC/CanWEA guidelines recommend a 500 m radius consultation zone around satellite

ground stations. Beyond 500 m, the consultation zone is a cone extending up to 10 km along the

transmission path, with a width defined by the following:

There are no satellite ground stations within 10 km of any of the proposed turbines. No interference issues

are anticipated.

There could, however, be satellite TV receivers at some of the residences within 10 km of the project site.

If reception issues arise after construction of the proposed turbines, mitigation measures will have to be

discussed with affected residents on a case-by-case basis.

3.6 VHF OmniRange Beacons

VHF OmniRange (VOR) is a type of short-range air navigation beacon. The RABC/CanWEA document

prescribes a consultation zone of 15 km around these facilities. No VOR beacons exist within 15 km of

the Skyway 126 Wind Energy project.

4.1 Mandatory Consultations

The Department of National Defense (DND), Royal Canadian Mounted Police (RCMP), Environmental

Canada, Canadian Coast Guard and various public safety agencies were contacted and supplied with a

turbine layout. The results of these consultations are summarized in Table 4-1 below and included in

Appendix B.

5 CONCLUSIONS & RECOMMENDATIONS

Industry Canada’s Spectrum database was searched for radiocommunication systems near the Project

Location. Rogers Communications Partnership and Bayshore Broadcasting Corporation both operate

infrastructure within the consultation zones recommended by RABC/CanWEA and have been contacted

and informed of the proposed turbine locations to discuss potential impacts to communications resulting

from the Skyway 126 Wind Energy project. Rogers Communications initially identified potential

interference with its network, however, through consultation, the proposed layout has been altered to

mitigate any impacts. Bayshore Broadcasting has indicated that no impacts are anticipated.

Various public agencies were also consulted as mandated by RABC and CanWEA. No negative impacts

have been identified by these agencies to date; however, several responses are still pending as of June 14,

2013, at the time of this assessment. Appendix B includes a summary of the parties contacted for

consultation, with their contact information and any responses received with regards to the Skyway 126

Wind Energy .

The results of this assessment indicate that impacts to radio communication, radar and seismoacoustic

system from the Skyway 126 Wind Energy project are anticipated to be limited.

5.1 Recommendations

Based on the results of this study, the following recommendations were made:

Complaints of degraded quality related to direct-to-home satellite receivers, television and FM

radio receivers within 15 km of the wind farm should be monitored and if need be mitigated post-

construction by movement of receiver dish or other means agreed upon by the proponent and

impacted party.

Continue ongoing consultation with public and private agencies.

Sorry for the late reply on your request but at this time Bayshore Broadcasting has not commenced a broadcasting

operation at this location the tower site is only proposed. But as the the wind farm is over 1000 meters from this site

I see no impact to the operation of a transmitter site at this location. We operation a site in Bruce county with a wind

farm that is the same as the proposed site with no effect on our operation.

We have completed the detailed analysis of your proposed site, Skyway 126 Wind Farm, located near Badjeros, Ont

(WTA-2056). The results of our detailed analysis have shown that there is likely to be minimal interference with DND

radar and flight operations.

Therefore, as a result of these findings we have no objections with your project as submitted (attached).

When confirmed, we would ask that you advise this office of the construction date for subject project in order to advise

our flying operations at CFB Borden.

If however, the layout were to change/move, please re-submit that proposal for another assessment using the

assigned WTA number listed above. The concurrence for this site is valid for 24 months from date of this email. If the

project should be cancelled or delayed during this timeframe please advise this office accordingly.

It should be noted that our office looks at each submission on a case by case basis and as such, concurrence on this

submission in no way constitutes a concurrence for similar projects in the same area, nor does it indicate that similar

concurrence might be offered in another region.

Finally, the concurrence offered in this email extends only to the subject projects and current proponent. Should the

project or any part of it be altered, or be sold to another developer, this office must be notified and we reserve the right

to reassess the project.

as I mentioned to you earlier this week, on Dec. 5, 2012 at 12:37 p.m. I received a call from Rod Miskey from the

400th Squadrant of Borden near Feversham. His email address is [email protected]

MKI (Karla Klein) sent a request for feedback with a topographical map and a land use proposal on April 5, 2012.

Miskey reports that he is responsible for the helicopter operations out of the facility nearby to the project. Helicopter

fly-ins or approaches often happen at night with night vision goggles or under cloud cover. He also noted that

helicopters fly low -- approximately 50 feet over the tree tops.

he noted that often turbines are equipped with red LED lights, however, the issue with thos is that they are not visible

at night via night vision goggles

He requested that 1.) the turbine is equipped with at least one incandescent light; 2.) He mentioned that sometime

turbine manufacturers equip the turbines with three lights; could one of the three sockets be an infrared light?

We requested information about construction timelines. I indicated to him that while the precise timelines are

unknown, notifications will be placed in the local newspaper when the REA documents are ready, which will include

more information at that time.

We have completed the initial analysis of the proposed wind farm under the project name Skyway 126 near

Badjeros, Ont. We have assigned a DND case number of WTA-2056, please include this number in any future

requests related to this site.

Our analysis has shown that the proposal falls within one (or more) of the DND consultation zones as outlined on our

website [ http://www.airforce.forces.gc.ca/8w-8e/units-unites/page-eng.asp?id=692 ] and in the RABC/CanWEA

document Technical Information and Coordination Process Between Wind Turbines and Radio Communication and

Radar Systems. As such this proposal will require a further more detailed analysis to determine any possible

effects/impact to the sites in question. The typical turn around time for a detailed analysis is from 2-6 weeks

depending upon the size and complexity of the site in question.

Thank you for your patience on this matter and for considering DND radar and airport facilities in your project

development process.

If you have any questions feel free to contact me otherwise, I will be in touch with you within a few weeks time with

our results.

update of the Skyway 126 wind farm layout.

Our preliminary assessment of the updated information provided to us via email on August 14, 2012 indicates that

any potential interference that may be created by the Skyway 126 Wind Farm in Grey County will not be severe.

Although we would prefer our radar view to be interference free, this is not always reasonable. As a consequence,

we do not have strong objections to the current proposal.

If your plans are modified in any manner (e.g. number of turbines, height, placement or materials) this analysis would

no longer be valid. An updated analysis must be conducted.

impact assessment on the Ontario Government Public safety radio network and provide an impact statement. Please

be advised that this radio network is utilized exclusively for the following provincial ministries: OPP, MOHLTC, MTO,

MNR MOE, CISO, MOR, MCYS and MCS.

Please contact directly any regional/local Public safety radio systems managers (eg fire, police, local operations, etc)

within the vicinity of this proposed wind farm to conduct similar impact assessments to their networks.

coordinates of several turbines have been altered and I have attached the new turbine locations to this message for your assessment. We

are in the process of finalizing this project and do not anticipate any further revisions to the Skyway 126 layout at this point.

The proponent, Cloudy Ridge Wind Park LP, is planning to engage in a renewable energy project in respect of which the issuance of a Renewable Energy Approval (REA) is required. The proposal to engage in the project and the project itself is subject to the provisions of the Environmental Protection Act (Act) Part V.0.1 and Ontario Regulation 359/09 (Regulation). This notice must be distributed in accordance with section 15 of the Regulation prior to an application being submitted and assessed for completeness by the Ontario Ministry of the Environment. On Wednesday, April 24th, 2013, a public meeting will be held related to the Skyway 126 Wind Energy project:

Project Description: Pursuant to the Act and Regulation, the facility, in respect of which this project is to be engaged in, is considered to be a Class 4 Wind Energy Generation Facility. If approved, this facility would have a total maximum name plate capacity of 10 MW. The project location is described in the map below. The distribution of this Notice of Draft Site Plan (Notice) is subject to the provisions of the Environmental Protection Act (Act) Part V.0.1 and Ontario Regulation 359/09 (Regulation). This Notice is being distributed in accordance with sections 54 and 54.1 of the Regulation prior to an application being submitted and assessed for completeness by the Ministry of the Environment. For the purposes of the 550 meter setback prohibition (subsection 54(1) in O. capacity of up to 10 MW, along with associated access roads and cabling, is to be located within the

Municipality of Grey Highlands, near the community of Badjeros, Ontario.

As per Ontario Regulation 359/09 (consolidated version, November 2, 2012), s. 54.1, a Notice of Draft

Site Plan is enclosed to clarify the locations of turbines and other project infrastructure for Skyway 126

Wind Energy. This notice is also available on the project website (www.zeroemissionpeople.com), along

with a copy of the Draft Site Plan and associated appendices.

In the interest of aviation safety, it is incumbent on NAV CANADA to maintain up-to-date aeronautical publications and issue NOTAM as required. To assist us in that end, we ask that you notify us at least 10 business days prior to the start of construction and upon completion. These notification requirements can be satisfactorily met by returning completed, signed copies of the attached forms by e-mail at [email protected] or fax at 613-248-4094. In the event that you should decide not to proceed with this project or if the structure is dismantled, please advise us accordingly so that we may formally close the file. If you have any questions, contact the Land Use Department by telephone at 1-866-577-0247 or e-mail at [email protected]. NAV CANADA's land use evaluation is valid for a period of 12 months. Further to our correspondence in August, the turbine layout of the proposed Skyway 126 Wind Farm has been changed to mitigate anyimpacts to Rogers Communications. Turbine 4 has been shifted approximately 50 m east, the revised turbine coordinates are attached tothis message.

Please advise of any remaining issues or concerns regarding anticipated impacts to Rogers communications resulting from the proposedSkyway 126 project.

We are performing our analysis using Industry Canada's Spectrum Direct Database and the nearest stations that we have found have callsigns XJV217and XJV210. The identifiers C0121 Shelburne and C0104 Collingwood do not appear to show up in our search, and wewould like to ensure that our data is consistent with yours.

The results of our analysis show that there will be indeed an impact of the proposed turbine T4 on Rogers’ exis-ng microwave path. As shown

in the a6achment, the distance between T4 and centerline of microwave beam is only 44.5m (not included poten-al inaccuracy). The turbine

blade diameter is 92.5m and it will definitely cut the Fresnel zone of microwave beam. According to the CANWEA guideline, minimum required

distance between turbine and centerline of the beam in this case should be 92m.

Please relocate the posi-on of the turbine T4 to meet this requirement. We hope that you can s-ll meet your project objec-ves.

The distance between wind turbine T4 and C0121 Shelburne – C0104 Collingwood hop is only 44.5m, as in a6ached file.

T4 wind turbine has the blade diameter equal with 92.5m. In this case, wind turbine blade cut the Fresnel Ellipsoid more than 50% (my

es-ma-on is 60%).

Minimum distance according with CANWEA guideline formula is: Lc/2=92m.

The proponent, Cloudy Ridge Wind Park LP, is planning to engage in a renewable energy project in respect of which the issuance of a Renewable Energy Approval (REA) is required. The proposal to engage in the project and the project itself is subject to the provisions of the Environmental Protection Act (Act) Part V.0.1 and Ontario Regulation 359/09 (Regulation). This notice must be distributed in accordance with section 15 of the Regulation prior to an application being submitted and assessed for completeness by the Ontario Ministry of the Environment. On Wednesday, April 24th, 2013, a public meeting will be held related to the Skyway 126 Wind Energy project:

Project Description: Pursuant to the Act and Regulation, the facility, in respect of which this project is to be engaged in, is considered to be a Class 4 Wind Energy Generation Facility. If approved, this facility would have a total maximum name plate capacity of 10 MW. The project location is described in the map below. The distribution of this Notice of Draft Site Plan (Notice) is subject to the provisions of the Environmental Protection Act (Act) Part V.0.1 and Ontario Regulation 359/09 (Regulation). The proponent, Cloudy Ridge Wind Park LP, submits this Notice of Draft Site Plan, Draft Site Plan, and

associated appendices under the Renewable Energy Approval (REA) process for Skyway 126 Wind

Energy. The project, which will consist of up to five (5) wind turbines with a total maximum name plate

capacity of up to 10 MW, along with associated access roads and cabling, is to be located within the

Municipality of Grey Highlands, near the community of Badjeros, Ontario.

As per Ontario Regulation 359/09 (consolidated version, November 2, 2012), s. 54.1, a Notice of Draft

Site Plan is enclosed to clarify the locations of turbines and other project infrastructure for Skyway 126

Wind Energy. This notice is also available on the project website (www.zeroemissionpeople.com), along

with a copy of the Draft Site Plan and associated appendices.
